CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Jennifer McCoy called the meeting to order at 6:01 p.m. Present: Mayor Jennifer McCoy, Councilmember Lucia Butler, Councilmember Tammy Baughman, Councilmember Randy McCoy, Mayor Pro Tem Chuck Conner, Public Works Director Eric Clark, Billing Clark Sunshine Alcorta and Citizens Connie Davis, Carl Hallmark, Heath bridges, Vernon Jogie, Zack White, Bernice Waggoner, Rhonda Weaver, Chad Steely. Absent: Councilmember James Warren. Pledge of allegiance was followed by the invocation given my Councilmember Randy McCoy. B. PUBLIC COMMENTS No Public comments. C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: 1. EYAA Lease agreement for year 2022-2023. Councilmember Lucia Butler made a motion, seconded by Mayor Pro Tem Chuck Conner, to table until November 7, 2022, meeting with finalized Contract. All in favor, motion carried. 2. Approving the 2022-2023 Contract with Elkhart Fire Department. Councilmember Randy McCoy made a motion, seconded by Mayor Pro Tem Chuck Conner, to table the Fire Department Contract until November 7, 2022. All in favor, the motion carried. 3. Mr. Fred Robertson, requested to discuss the removal of the trailer on his property. Councilmember Randy McCoy made a motion, seconded by Mayor Pro Tem Chuck Conner, to take no action. All in favor, motion carried. 4. Ordinance No 09022019-1 Amended RV Parks. All aspects including and/or deletion of outdated verbiage advised by City Attorney. AN ORDINANCE OF THE ELKHART CITY COUNCIL OF ELKHART, TEXAS, AMENDING THE RECREATIONAL VEHICLE (RV) ORDIANCE 0-09092019-1, REGULATNG THE ESTABLISHMENT AND OPERATION OF RECREATIONAL VEHICLE PARKS (RV PARKS) AND INDIVIDUAL RECREATIONAL VEHICLES LOCATED WITHIN THE CITY OF ELKHART, PROVIDING FOR A SERABILITY CLAUSE; PROVIDING FOR A SAVING CLAUSE; PROVIDING FOR A PENALTY CLAUSE REPEALING ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING FOR AN ENGROSSMENT CLAUSE, PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER, AND PROVIDING AN EFFECTIVE DATE. PENALTY: Any person(s) violating the ordinance shall be subject to fine not to exceed Five Hundred Dollars ($500.00) for each provision violated, and each day that there is failure to comply with the terms of any provision of this ordinance is declared to be a separate offense. For violation of the provisions of the ordinance that govern fire safety, zoning, or public health sanitation, including dumping or refuse, the fine may not exceed Two Thousand Dollars ($2,000) per day, per violation. The code official shall be the authority of the jurisdiction responsible for the issuance of citations and any actions deemed necessary for the enforcement of this ordinance. EFFECTIVE DATE: This ordinance shall be in full force and effect from and after the date of its passage and publication as required by law, and it is SO ordained. Councilmember Randy McCoy made a motion, seconded by Councilmember Lucia Butler to adopted Ordinance 09022029-1 Amended RV Parks. All in favor, motion carried. 5. Adopting Sex Offender Ordinance No. 10032022-01. Councilmember Lucia Butler made a motion, seconded by Councilmember Randy McCoy to adopt Sex Offenders Ordinance No. 10032022-01. All in favor, motion carried. 6. Adopting a noise ordinance, No. 10032022-02. Mayor Pro Tem Chuck Conner made a motion, seconded by Councilmember Tammy Baughman to adopt Noise Ordinance 10023022-02. All in favor, motion carried. 7. Proclaiming October for Breast Cancer Awareness Month. Councilmember Lucia Butler made a motion, seconded by Mayor Pro Tem Chuck Conner, to Proclaim October as Breast Cancer Awareness Month. All in favor, motion carried. D. PUBLIC WORKS REPORT. Public Works Director Eric Clark reported there were some issues with some of the new electric meters. Confirmed with distributor, it was a software issue. All meters were reprogramed. Ground is still dry SO leaks will continue to be a possibility. Reminder that part of the repair process is calling in locates that may take up to 3 hours. E. MUNCIPAL COURT None. F. MAYOR REPORT Mayor McCoy reported that on October 4, 2022, is National Night Out from 6:00 p.m. to 8:00 p.m., free burgers and hotdogs. October 12 is Fire Prevention Day. October 15, KEB clean up the streets. Anderson County is under a Burn Ban. October 31, from 5:00 to 7:00 p.m. is Trunk or Treat behind City Hall. Mayor McCoy will be reaching out to citizens to explain about the electric meters. Will be calling a special meeting with 2 weeks regarding the adjustments to be made. G. EMERGENCY MANAGEMENT REPORTS Emergency management Randy McCoy reported that he has been to a lot of fires due to the dry conditions. He will be having another drill meeting in El Dorado and inviting all First Responders. H. COUNCIL COMMENTS Councilmember Lucia Butler commented and discussed with EYAA about their dumpster. I. APPROVAL OF MINUTES Councilmember Tammy Baughman made a motion, seconded by Mayor Pro Tem Chuck Conner to approve minutes from September 6, 2022. All in favor, motion carried.
