CITY OF ELKHART - THE CITYOF ELKHART CITY COUNCIL REGULAR MEETING MINUTES November 4, 2024 6:00 pm City Hall A. CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Jennifer McCoy called the meeting to order at 6:00 p.m. Present: Mayor Pro Tem James Warren, Councilmembers Lucia Butler, Randy McCoy, Tanya Conner, Interim City Secretary Sunshine Alcorta, Public Works Director Eric Clark, Code Enforcement Tambara Farrell and citizens Tom Ellis and Justin Benton. Absent: Councilmember Tammy Baughman. The Pledge of Allegiance was followed by the invocation given by Councilmember Randy McCoy. B. PUBLIC COMMENTS None C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: Requested by Ms. Thomas concerning Norris White's s account. Ms. Thomas did not attend. 2 Request by Mrs. Riddle concerning the water quality. Mrs. Riddle did not attend. 3 Policy for leak adjustment. Councilmember Randy McCoy made a motion, seconded by Councilmember Tanya Conner to draft a policy for adjustments. Vote: 2 yes, 2 no, Mayor yes. 4 All aspects of Eagle Railcar. Mayor Pro Tem James Warren made a motion, seconded by Councilmember Randy McCoy, to ask Attorney to send a letter to Eagle Railcar regarding the chemical discharge and invoice for the damage caused. Vote: 4-0, unanimously. D. PUBLIC WORKS REPORT Update on completed, pending, and future projects. 1. There has been an increase in leaks. A. Leak behind mill run that put Elkhart residents without water. B. 2 Pending leaks 2. Start working on Christmas lights. 3. Winterizing for the winter. E. MUNICIPAL COURT The report included in the packet Dangerous building F. MAYOR REPORT Update on city events and projects 1. The Halloween Trunk or treat went very well. Transmission went out on the ladder truck. 2. Purchasing a new truck. $45000.00 for a 1998 Model. H. CLOSED SESSION The council will convene into Closed Session at 6:38 p.m. pursuant to Section 551.074 of the Texas Government Code regarding personnel matters. 1. Discuss and take action if any, of employment, evaluation, reassignment, duties discipline, or dismissal of. A. Justin Benton I. RECONVENE INTO REGULAR SESSION The Council reconvened into Regular Session at 6:44 p.m. Discussed and took action on items discussed in the Closed Session. A. Mayor Pro Tem made a motion, seconded by Councilmember Tanya Conner to rehire Justin Benton to full- time immediately. Vote 4-0 unanimously. J. COUNCIL COMMENTS No comments K. APPROVAL OF MINUTES Mayor Pro Tem made a motion, seconded by Councilmember Randy McCoy to approve the minutes for September 3, September 16, October 7, and October 21, 2025. Vote 4-0, unanimously. L. ADJOURNMENT Councilmember Randy McCoy made a motion, seconded by Mayor Pro Tem James Warren, to adjourn the meeting at 6:16 p.m. The Vote was 3-0 unanimously.
