CITY OF ELKHART THESITYOF CITY COUNCIL ELKHART REGULAR MEETING MINUTES Monday, October 07, 2019 6:00 pm Elkhart Holy Temple CALL TO ORDER With a quorum present, the Special Session Meeting of the City of Elkhart City Council was called to order by Mayor Jennifer McCoy at 6:00 p.m. in the Elkhart Holy Temple, 113 West Parker Street, Elkhart, Texas 75839. Present: Mayor Jennifer McCoy, Mayor Pro Tem Raymond Dunlap, Councilmember Lucia Butler, Councilmember Chuck Conner, Councilmember James Warren, City Administrator Judith Cantrell, City Secretary Ami Ashworth. Councilmember Daryl! Faulk arriving at 6:40 pm. Also Present: Eric Clark, PW Director, Lance Vincent of Ritcheson, Lauffer & Vincent, P.C., Ricky Garren of TML, Tab Bell of Perdue Brandon Fielder Collins & Mott, LLP. REGULAR ACTION ITEMS A. CALL TO ORDER, PRAYER, AND PLEDGE OF ALLEGIANCE Pledge of allegiance was followed by the invocation given by Mayor Pro Tem Raymond Dunlap. B. PUBLIC COMMENT None C. CITY ADMINISTRATOR REPORT 1. City Finances City Administrator updated Council on City finances, including several utility billing account errors that have been found since implementing new trash vendor. Several homes were receiving services but had not paid, some in years. Those have been corrected and will continue to be corrected as we find them. Other accounts were found to have been charged the wrong amounts, some more and some less than they should have been paying. Those have aiso been corrected. Council was provided with an updated bank balance sheet. 2. Update on ersonne/Adminstration Matters Michael Wall is testing for his "D" water license next week, and all new hires are doing well. Update on Security Measures at the Water and Wastewater Facilities Security cameras are now in place at all facilities and will be monitored regularly. D. PUBLIC WORKS DIRECTOR REPORT 1. Update on Completed projects 2. Update on Scheduled projects 3. Update on future projects Public Works Director updated Council on security measures at facilities, as well as staffing progress. Comments mirrored City Administrator's report. Tremendous progress being made at wastewater plant. E. CLOSED SESSION Mayor McCoy announced Council would convene into closed session at 6:19 p.m. 1. Pursuant to Section 551.071(A) of the Texas Government Code, to consult with legal counsel to receive legal advice on Cause No. DCCV19-1202-349, Carla Sheridan VS. City of Elkhart in the 349th Judicial District Court of Anderson County, Texas. 2. Pursuant to Section 551.072 of the Texas Government Code, to discuss high bids received for resale property as follows: a. Tract 13 and 14, Blk 952-2, 0.188 acres, W. Parker Street, Elkhart, Texas b. Tract 26 and 27, Blk 953, and Tract 1, Blk 952-4, 0.86 Acres, N. Bridges Street, Elkhart, Texas F. RECONVENE IN REGULAR! SESSION 1. Pursuant to Section 551.072 of the Texas Government Code, to discuss high bids received for resale property as follows: a. Tract 13 and 14, Blk 952-2, 0.188 acres, W. Parker Street, Elkhart, Texas b. Bridges Street, Elkhart, Texas Motion was made by Councilmember Butler, seconded by Councilmember Conner, to reject all bids received for Tract 13 and 14, Blk 952-2, 0.188 acres, W. Parker Street, Elkhart, Texas 2 CITY OF ELKHART : 9 CITY COUNCIL REGULAR MEETING MINUTES EERHART Monday, October 07, 2019 6:00 pm Elkhart Holy Temple and Tract 26 and 27, Blk 953, and Tract 1, Blk 952-4, 0.86 Acres, N. Bridges Street, Elkhart, Texas. Upon vote, the Motion carried unanimously with a vote of 5-0. 2. Discuss and take action, if any, on various community projects, including City Park and "Welcome to Elkhart" sign. Motion was made by Councilmember Butler, seconded by Councilmember Conner, to approve flowerbeds at the "Welcome to Elkhart" sign. Upon vote, the Motion carried unanimously with a vote of 5-0. 3. Discuss and take action, if any, on proposals received for TCEQ-mandated repairs to the Wastewater Treatment Plant. Motion was made by Councilmember Conner, seconded by Councilmember Butler, to allow Public Works Director to proceed with hiring of vendor if no other bids are received by Friday, October 11, 2019 at 4:30 p.m. Upon vote, the Motion carried unanimously with a vote of 5- 0. 4. Discuss and take action, if any, on budgets for pump station and water line improvements to be funded by bond proceeds. Motion was made by Councilmember Butler, seconded by Councilmember Conner, to approve plans on lines less the addition of the 8-inch line repairs. Councilmember Butler then rescinded the motion. Councilmember Butler made a second motion, seconded by Councilmember Conner, to approve original plans of the pump station and waterline improvements, and allow Mayor to make decision on stabilization of the water tower. Upon vote, the Motion carried unanimously with a vote of 5-0. G. MINUTES 1. Approval of minutes of September 9, 2019 Special City Council Meeting 2. Approval of minutes of September 16, 2019 Special City Council Meeting 3. Approval of minutes of September 23, 2019 Regular City Council Meeting Motion was made by Councilmember Butler, seconded by Councilmember Conner, to approve minutes from the September 9, 2019 Special Council Meeting and the September 23, 2019 Regular Meeting.
