CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Jennifer McCoy called to order at 6:06 p.m. Present: Mayor Jennifer McCoy, Councilmember Lucia Butler, Councilmember Tammy Baughman, Councilmember Randy McCoy, Interim City Secretary Jan Stuteville, Public Works Director Eric Clark, Billing Clerk Sunshine Alcorta and Jagerrion McKnight. Absent: Councilmember James Warren and Mayor Pro Tem Chuck Conner. Pledge of allegiance was followed by the invocation given by Councilmember Randy McCoy B. PUBLIC COMMENTS No Public Comments C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: 1. EYAA Lease agreement for year 2022-2023. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman to take no action. All in favor, motion carried. 2. Ordinance No. 01062020-03 Amended, Grease Traps, all aspects including and/or deletions of outdated verbiage advised by City Attorney. Councilmember Tammy Baughman made a motion, seconded by Councilmember Randy McCoy to approve Ordinance No. 01062020-03 Amended, Grease Traps. All in favor, motion carried. 3. Ordinance No. 06192022-01 Food Service Establishments, all aspects including and/or deletion of outdated verbiage advised by City Attorney. Councilmember Randy McCoy made a motion, seconded by Councilmember Tammy Baughman to approve Ordinance No. 06192022-01 Food Service Establishments. All in favor, motion carried. 4. Ordinance No. 09062022 Subdivision, all aspects including and/or deletion of outdated verbiage advised by City Attorney. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman to approve the Ordinance No. 09062022 Subdivision with all corrections. All in favor, motion carried. 5. Adopting Resolution R-09062022-1, Designating the official Newspaper for City, Fiscal year 2022-2023. Councilmember Randy McCoy made a motion, seconded by Councilmember Tammy Baughman to approve the Resolution R-09062022-1 to Designate Palestine Herald Press as the official Newspaper for Fiscal Year 2022-2023. 6. Approving the 2022-2023 Contract with Elkhart Fire Department. Councilmember Tammy Baughman made a motion, seconded by Councilmember Lucia Butler to take no action until October 3 2022. All in favor, 2 aye and 1 abstain. 7. Approving holiday Schedule for 2023. Councilmember Lucia Butler made a motion, seconded by Councilmember Randy McCoy to approve the Holiday Schedule for 2023. 8. All aspects of the Pavilion. Councilmember Lucia Butler made a motion, seconded by Councilmember Randy McCoy to charge a $50 fee to rent the Pavilion with $40 being refundable provided the facilities are clean. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman to reappoint Municipal Judge Alan Gell for term 2022-2024. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman to move Closed Session from Item H to Item D. All in favor, motion carried. D. CLOSED SESSION 6:31 p.m. Council will convene into Closed Session pursuant to Section 551.074 of the Texas Government Code regarding personnel matters as follows: 1. Discuss and take action if any, of employment, evaluation, reassignment, duties, discipline, or dismissal of. Jagerrion McKnight E. RECONVENE INTO REGULAR SESSION 6:35 p.m. Councilmember Lucia Butler made a motion, seconded by Councilmember Tammy Baughman to hire Jagerrion McKnight at starting rate of $14.00 effective as of September 6, 2022. All in favor, motion carried. F. PUBLIC WORKS REPORT Public Works Director Eric Clark reported leaks have calmed down. City did have a leak in the middle of the which night caused us to have a boil water notice, which has been rescinded as of September 6, 2022. It has been brought to our attention that some of the electric meters may be misreading, we are investigating and working to resolve the issue. G. MUNICIPAL COURT None H. MAYOR REPORT Mayor McCoy reported that in October the Circus will be in town. Tile is being installed and completed shortly. I. EMERGENCY MANAGEMENT REPORTS None J. COUNCIL COMMENTS Councilmember Lucia Butler commented ladies in office are doing a great job with the remodel. K. APPROVAL OF MINUTES Councilmember Lucia Butler made a motion, seconded by Councilmember Randy McCoy to approve minutes. August 1, 2022, Regular Agenda Minutes August 15, 2022, Workshop Minutes August 24, 2022, Public Hearing Minutes August 24, 2022, Special Meeting Minutes. All in favor, motion carried.
