CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Jennifer McCoy called the meeting to order at 6:00 p.m. Present: Mayor Jennifer McCoy, Councimembers Lucia Butler, Randy McCoy, Tanya Conner, Mayor Pro Tem James Warren, Interim City Secretary Sunshine Alcorta and Code Enforcement Tambara Farrell, Public Works Director Eric Clark, citizens William Ellis, Diane Parker, and Beverly Warren. Absent: Councilmember Tammy Baughman. The Pledge of Allegiance was followed by the invocation given by Mayor Pro Tem James Warren. B. PUBLIC COMMENTS None C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: 1. Request by Diane Parker concerning the ditches. Recess called by the Mayor; council, and citizens walked to Ms. Parker's property to view ditches. Councilmember Randy McCoy made a motion, seconded by Councilmember Tanya Conner, to clean city culverts from Hortman to Watkins. Vote: 3-1. 2. Industrial Rates. Mayor Pro Tem James Warren made a motion, seconded by Councilmember Randy McCoy, to accept the industrial rates as follows: Industrial rates- $55.00 Base water rate, $0.55 per 100 gallons. $77.00 base sewer rate, $0.84 per 100 gallons, and $3000.00 Industrial Surcharge. Vote: 4-0 unanimously. 3. Update on Code Enforcement violation at property 206 W. Parker St. regarding the cleanup of hazardous structure and approve lien that will be placed on the property. Councilmember Tanya Conner made a motion, seconded by Mayor Pro Tem James Warren, to approve the 206 W. Parker St. Elkhart, TX 75839 lien. Vote 4-0, unanimously. D. PUBLIC WORKS REPORT. Public Works Director Eric Clark reported on the following: 1. Beginning road repairs and cleaning ditches on Bridges and Parker St. 2. Update on Jones Road lift station prices. 3. Continuing to mow and do road patches. E. MUNICIPAL COURT Code Enforcement Tambara Farrell reported on the following: 1. Update on open and closed code enforcement cases. F. MAYOR REPORT Mayor McCoy reported on the following: 1. Mulch was taken care of at the park. 2. Pear trees are producing. EMERGENCY MANAGEMENT REPORTS Emergency management Coordinator Randy McCoy reported on the following: 1. 18-wheeler rollover at the light. 2. The Fire Hydrant needs to be replaced at the corner of Hwy 19 and E. Parker Street. H. CLOSED SESSION Council will convene into Closed Session pursuant to Section 551.074 of the Texas Government Code regarding personnel matters as follows at 7:09 p.m.: 1. Discuss and take action if any, of employment, evaluation, reassignment, duties, discipline or dismissal of. A. Justin Benton I. RECONVENE INTO REGULAR SESSIONS 1. Council reconvened into Regular Session at 7:24 p.m. Discussed and take action on items discussed in Closed Session. A. Mayor Pro Tem James Warren made a motion, seconded by Councilmember Randy McCoy, to rehire Justin Benton pending attorney approval, and six months' probation. Vote 4-0 unanimously. J. COUNCIL COMMENTS None K. APPROVAL OF MINUTES Mayor Pro Tem James Warren made a motion, seconded by Councilmember Tanya Conner, to approve minutes from June 3, 2024. Vote 4-0 unanimously. L.
