CITY OF ELKHART THECITYOF CITY COUNCIL ELKHART SPECIAL MEETING MINUTES Monday, September 23, 2019 6:00 pm Elkhart Holy Temple CALL TO ORDER With a quorum present, the Special Session Meeting of the City of Elkhart City Council was called to order by Mayor Jennifer McCoy at 6:01 p.m. in the Elkhart Holy Temple, 113 West Parker Street, Elkhart, Texas 75839. Present: Mayor Jennifer McCoy, Mayor Pro Tem Raymond Dunlap, Councilmember Lucia Butler, Councilmember Chuck Conner, Councilmember Daryli Faulk, Councilmember James Warren, City Administrator. Judith Cantrell, City Secretary Ami Ashworth. Also Present: Eric Clark, PW Director, as well as Jeff Gail and Josh Pannell. SPECIAL ACTION ITEMS A. CALL TO ORDER, PRAYER, AND PLEDGE OF ALLEGIANCE Pledge of allegiance was followed by the invocation given by Mayor Pro Tem Dunlap. B. SPECIAL ACTION ITEMS 1. Discuss and take action, if any, on adopting Ordinance No. 0-09232019-1, approving the 2019- 2020 Fiscal Year Budget for the City of Elkhart. Motion was made by Councilmember Butler, seconded by Councilmember Conner, to adopt Ordinance No. 0-09232019-1, approving the 2019-2020 Fiscal Year Budget for the City of Elkhart. Vote: Mayor Pro Tem Dunlap Aye Councilmember Butler Aye Councilmember Warren Aye Councilmember Faulk Aye Councilmember Conner Aye Action: Upon vote, the Motion carried unanimously with a vote of 5 "ayes" and 0 "nays." 2. Discuss and take action, if any, on ratification of the property tax increase reflected in the budget as the Fiscal Year 2019-2020 budget will require raising more tax revenue than in the previous year (whether from a tax increase or an increase in taxable value). Discuss and take action, ifa any, on adopting Ordinance No. 0-09232019-2, setting and adopting a tax rate of $0.296680/S100 for the City of Elkhart for the 2019-2020 tax year. Motion was made by Councilmember Conner, seconded by Councilmember Butler, to adopt Ordinance No. 0-09232019-2, setting and adopting a tax rate of $0.296680/S100 for the City of Elkhart for the 2019-2020 tax year. Discuss and take action, if any, on TCEQ wastewater inspection of September 17, 2019. City Administrator Judith Cantrell presented Council with an e-mail from Environmental Investigator Patrick Conner, Field Operations Division of the Region 5 Tyler Texas office of TCEQ, with his findings from his September 17, 2019, site visit. Mr. Conner notated that all violations notated during his September visit mirrored violations from his previous visits to the plant. Mr. Conner noted that the plant had not been properly maintained for a period of no less than six (6) months, and that was a very conservative estimate. He also noted that PW Director Clark would need to order equipment enabling him to successfully operate the plant, including DO and pH meters, as well as a microscope. That equipment would need to be purchased no later than November 1, 2019, and the remaining issues were to be addressed no later than February 2020. Mr. Conner noted that the state of the plant could cost the City no less than $75,000 in fines, in addition to the cost of repairs. Mr. Conner is very pleased with the direction current Administration is taking the City, and he feels hopeful fori the City's future. Motion was made by Councilmember Conner, seconded by Councilmember Butler to take no action. Upon vote, the Motion carried unanimously with a vote of 5-0. C. CLOSED SESSION Council will convene into Closed Session pursuant to Section 551.074 of the Texas Government Code, as well as Section 2.15 of the City of Elkhart Administrative Guidelines/Employee Handbook, to interview applicants, if any, for available positions within the Public Works Department. RECONVENE IN SPECIAL SESSION Mayor McCoy reconvened into Special Session at 8:18 pm. (a) Discuss and take action, if any, on applicants interviewed in Executive Session. (b) Motion was made by Councilmember Butler, seconded by Councilmember Conner, to hire Eric Clark as the Public Works Director, with a salary of $65,000/year, and with all benefits afforded to full-time staff. Upon vote, the Motion carried unanimously with a vote of 5-0. (c) Motion was made by Councilmember Butler, seconded by Councilmember Faulk, to give Michael Wall a pay raise in the amount of $1.00/hour. Upon vote, the Motion carried unanimously with a vote of5-0. (d) Motion was made by Councilmember Butler, seconded by Councilmember Conner, to hire Joshua Pannell as a Public Works Field Technician at a rate of pay of $10.00/hour, and with all benefits afforded to full-time staff. This offer is to be contingent upon the passing of the required drug screen and physical. Upon vote, the Motion carried unanimously with a vote of 5-0. (e) Motion was made by Councilmember Faulk, seconded by Councilmember Conner, to hire Jeff Gail as a Public Works Field Technician at a rate of pay of $10.00/hour, and with all benefits afforded to full-time staff.
