THE CITYOF CITY OF ELKHART ZELKHART CITY COUNCIL REGULAR MEETING MINUTES September 3, 2024 6:00 pm City Hall A. CALL TO ORDER, PLEDGE, AND INVOCATION Mayor Pro Tem James Warren called the meeting to order at 6:00 p.m. Present: Councilmembers Lucia Butler, Randy McCoy, Tanya Conner, Tammy Baughman, Mayor Pro Tem James Warren, Interim City Secretary Sunshine Alcorta and Code Enforcement Tambara Farrell, citizens William Ellis. The Pledge of Allegiance was followed by the invocation given by Mayor Pro Tem James Warren. B. PUBLIC COMMENTS None C. REGULAR AGENDA Discuss, Consider, and Possibly Take Action Regarding: 1. Request by Mr. and Mrs. Campbell concerning a leak adjustment. Councilmember Randy McCoy made a motion, seconded by Councilmember Tammy Baughman, made a motion to give a 25% adjustment off the sewer. Vote: 2 yes and 3 No. 2. Request by Ms. Moore concerning leak adjustment. Councilmember Tanya Conner made a motion, seconded by Councilmember Tammy Baughman to take no action. Vote: 4-0. 3. Municipal Ad Valorem tax rate for 2025. Councilmember Tanya Conner made a motion, seconded by Councilmember Tammy Baughman to approve Municipal Ad Valorem tax rate for 2025 at 0.2217448. Vote: 3-0 4. Budget approval for October 1, 2024-September 30, 2025. Councilmember Lucia Butler made a motion, seconded by Councilmember Tanya Conner to approve the budget for FY2024-2025. Vote: 3-0. 5. Approving the holiday schedule for 2025. Councilmember Lucia Butler made a motion, seconded by Councilmember Tanya Conner, to approve the 2025 Holiday Schedule. 6. Adopting Resolution 09022024-1, Designating the Official Newspaper for City, Fiscal year 2024-2025. Councilmember Lucia Butler made a motion, seconded by Councilmember Tanya Conner, to adopt Resolution 09022024-1, Designating the Palestine Herald Press as our city newspaper. Vote: 3-0 7. Developing criteria for utilizing outside contractors for public works projects and/or repairs. Councilmember Lucia Butler made a motion, seconded by Councilmember Tanya Conner to take no action. Vote: 3-0. 8. All aspects of credit card processing fees. Councilmember Tanya Conner made a motion, seconded by Councilmember Lucia Butler, to charge the credit card fees to cardholders charging the minimum. Vote 3-0. 9. Street repairs for 2024-2025. Councilmember Tanya Conner made a motion, seconded by Councilmember Lucia Butler to repair N. Bridges, Jones Road, and Day Road. Vote 3-0. D. PUBLIC WORKS REPORT. Brookshires is still planning on building in Elkhart, possibly breaking ground in 5 months. 2. Fire Hydrant is being contracted out due to no valves. 3. Main St Lift Station was reported to TCEQ. 4. Rainstorm lightning struck controls and WWP. 5. Motors and the Newsome well were struck by lightning and are waiting on the parts. E. MUNICIPAL COURT Code Enforcement Tambara Farrell reported the following (Report included in packet). 1. Update on open and closed code enforcement cases. F. MAYOR REPORT Mayor McCoy reported on the following: No updates G. EMERGENCY MANAGEMENT REPORTS Emergency Management Coordinator Randy McCoy reported on the following: No updates H. COUNCIL COMMENTS Questions regarding the update on Brookshires and road repairs. I. APPROVAL OF MINUTES Councilmember Tanya Conner made a motion, seconded by Councilmember Tammy Baughman, to approve minutes from August 5, 2024, and August 12, 2024. Vote 3-0 unanimously. J. ADJOURNMENT Councilmember Tammy Baughman made a motion, seconded by Councilmember Tanya Conner to adjourn the meeting at 7:47 p.m. Vote: 3-0 unanimously.
