CALL TO ORDER, PLEDGE, AND INVOCATION With a quorum present, the Regular Meeting of the City of Elkhart City Council was called to order by Mayor Jennifer McCoy at 6:00 p.m. at City Hall, 110 West Parker Street, Elkhart, Texas 75839. Present: Mayor Jennifer McCoy, Mayor Pro Tem Chuck Conner, Councilmember Lucia Butler, Councilmember James Warren, Public Works Director Eric Clark Absent: Councilmember Daryll Faulk, Mayor Pro Tem Raymond Dunlap Pledge of allegiance was followed by the invocation given by James Warren. B. PUBLIC COMMENTS None C. REGULAR AGENDA 1. Discuss and take action, if any, considering a resolution declaring the office of Council Place 3 vacant due to the member's failure to comply with Section 22.041(b) of the Local Government Code. Motion was made by Mayor Pro Tem Conner, seconded by Councilmember Butler to adopt resolution declaring the office of Council Place 3 vacant. Upon vote, motion carried unanimously 3-0. 2. Discuss and take action, if any, considering appointment of an officer to fill the vacancy in Council Place 3 to serve until the next regular municipal election. Mayor McCoy recommend Tammy Baughman. Motion was made by Mayor Pro Tem Conner, seconded by Councilmember Butler to accept Tammy Baughman to fill vacancy in Council Place 3 to serve until the next regular municipal election. Upon vote, motion was carried unanimously 3-0. 3. Discuss and take action, if any, on appointment of representative to the Board of Directors with the Anderson County Appraisal District for 2021-2022 term, and adoption of resolution to memorialize said appointment. Motion was made by Mayor Pro Tem Conner, seconded by Council member Warren to appoint Randy McCoy to the Board of Directors with the Anderson County Appraisal District for the 2021-2022 term. Discuss and take action, if any, on concerning the sale and acceptance of sealed bids for the dump truck and dump trailer. Motion was made by Councilmember Butler seconded by, Councilmember Warren to sale and accept bids for the dump trunk and dump trailer. Starting bid amount for the dump trailer will be $4,000.00 and the starting bid for the dump truck will be $3,500.00. Upon vote motion carried unanimously 3-0. 5. Discuss and take action, ifany, on the FY2021 Scheduled Closing for City Observed Holiday's. Motion made by Mayor Pro Tem Conner, seconded by Councilmember Butler to keep the Holiday Schedule the same. Upon vote, motion carried unanimously 3-0. D. PUBLIC WORKS REPORT Public Works Director gave update to council. Council has requested an inventory of equipment/parts for the Wastewater Treatment Plant. E. MAYORS REPORT Motion was made by Mayor Pro Tem to move item this item after item H. Mayor updated council on the Halloween Festival, and the city park. F. EMERGENCY MANAGEMENT REPORT Not present G. COUNCIL COMMENTS None H. CLOSED SESSION *Motion was made by Mayor Pro Tem Conner, seconded by Counciimember Warren to move item H after item D. Mayor McCoy convened into executive session at 6:46 p.m. City Council will convene into closed session pursuant to Section 551.074 of the Texas Government Code regarding matters of employment. Discuss the employment, evaluation, reassignment, duties, discipline, or dismissal of Public Works Supervisor, James Wiley. I. RECONVENE IN REGULAR SESSION 2 : THEÇITYOF ELKHART CITY OF ELKHART CITY COUNCIL REGULAR MEETING MINUTES December 7, 2020 6:00 pm City Hall Mayor McCoy reconvened into regular Session at 6:57 p.m. Discuss and take action, if any on matters discussed in executive session. Discuss the employment, evaluation, reassignment, duties, discipline, or dismissal of Public Works Supervisor, James Wiley. Motion was made Councilmember Butler, seconded by Councilmember Warren to approve a pay increase for James Wiley to 17.50 per hour. Upon vote, motion carried unanimously 3-0. J. APPROVAL OF MINUTES 1. Minutes of November 2, 2020 2. Minutes of November 16, 2020 Minutes for the November 16, 2020 meeting are not ready. Motion made by Mayor Pro Tem Conner, seconded by Councilmember Warren to accept the minutes of November 2, 2020. Upon vote, motion carried unanimously 3-0. K. ADJOURN Motion to adjourn was made by Mayor Pro Tem Conner, seconded by Councilmember Warren.
