Belton City Council Meeting February 25, 2025 -= 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor David K. Leigh, Mayor Pro Tem John R. Holmes, Sr., Councilmembers Wayne Carpenter, Craig Pearson, Daniel Bucher and Dave Covington. Councilmember Stephanie O'Banion was absent. Staff present included Sam Listi, Matt Bates, John Messer, Mike Rodgers, Amy Casey, Alex Munger, Larry Berg, Daniel Aguirre, Wesley Gilbreath, Aric Henkelman, Bob van Til, Paul Romer, Judy Garrett, Christina Sparks, Scott Hodde, and several officers from the Police Department. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Dave Covington. The Pledge of Allegiance to the Texas Flag was led by CVB and Retail Coordinator Judy Garrett. The Invocation was given by Councilmember Craig Pearson. 1. Call to order. Mayor Leigh called the meeting to order at 5:32 p.m. 2. Public Comments. (Audio 1:48) There were no public comments. 3. Proclamations: A. German Exchange Students Day = February 25, 2025 (Audio 2:20) UMHB students and Staff who were part of the cultural exchange, along with the German exchange students and their Professor, were present to receive the proclamation. B. Theatre in Our Schools Month - March 2025 (Audio 7:04) Members of Belton High School's Theatre Troupe were present to receive the proclamation. Consent Agenda Items 4-9 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councimember, and it will be considered separately. (Audio 11:23) 4. Consider minutes of the February 11, 2025, City Council meeting. 5. Consider a resolution appointing election officers for the May 3, 2025, General and Special Elections. Consider a resolution authorizing the City Manager to execute an amended Municipal Maintenance Agreement with the Texas Department of Transportation. 7. P-25-01 = Consider a final plat for Wheat Warehouse Addition comprising 3.692 acres, located on Wheat Road. 8. Receive the Tax Increment Reinvestment Zone (TIRZ) Annual Report for 2024. 9. Consider designating a depository for City funds for the 3-year period from April 1, 2025, to March 31, 2028, with a provision for an extension of two additional 1-year terms and authorize the City Manager to execute all initial contracts and agreements related to this designation. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Carpenter, Consent Agenda Items 4-8, including the following captioned resolutions, were unanimously approved upon a vote of 6-0. RESOLUTION NO. 2025-08-R A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, APPOINTING ELECTION OFFICERS FOR THE CITY'S MAY 3, 2025, GENERAL AND SPECIAL ELECTIONS. RESOLUTION NO. 2025-09-R A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDED MUNICIPAL MAINTENANCE AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION. Director of Finance Mike Rodgers made a brief presentation on Item 9. Upon a motion by Councilmember Pearson, and a second by Councilmember Carpenter, Consent Agenda Item 9 was unanimously approved upon a vote of 6-0. Planning and Zoning 10.Z-25-02 = Hold a public hearing and consider a zoning change from Retail to Retail with a Specific Use Permit for a Package Store on 0.11 acres located at 2144 N. Main Street. No one else spoke for or against the item. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Bucher, the following captioned ordinance was unanimously approved upon a vote of 6-0 with the following conditions: The development must conform to all applicable standards of the Retail Zoning Districts. Future improvements shall conform to applicable City ordinances. ORDINANCE NO. 2025-14 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM RETAIL TO RETAIL WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 0.11 ACRES LOCATED AT 2144 N. MAIN STREET. 11.Z-25-03 = Hold a public and consider an appeal from AB King LLC regarding a zoning change from Commercial Highway to Commercial Highway with a Specific Use Permit for a Package Store on approximately 0.13 acres located at 824 S. Main Street. (Audio 19:35) Senior Planner Tina Moore presented this item. Public hearing: Applicant Sunil Adhikari, 3321 Charbray Drive, spoke in favor of the zoning change. Allison Finney, 820 S. Main Street, spoke against the zoning change. No one else spoke for or against the item. A 75% super majority vote of the Council is required to overturn the Planning and Zoning Commission denial of the zoning change. Upon a motion for disapproval of the appeal with prejudice by Councilmember Bucher, and a second by Councilmember Covington, the rezoning was denied upon a unanimous vote of 6-0 12.Z-25-06 = Hold a public hearing and consider a zoning change from Agricultural to Commercial-2 on approximately 6.53 acres located at 6955 W. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Carpenter, the following captioned ordinance was unanimously approved upon a vote of 6-0 with the following conditions: The development must comply with all applicable standards of the Commercial-2 (C-2) Zoning District. A final subdivision plat meeting the requirements of the adopted Subdivision Ordinance is required. Construction plans that meet all applicable standards must be submitted and approved before construction begins. ORDINANCE NO. 2025-16 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM AGRICULTURAL TO COMMERCIAL-2 ON APPROXIMATELY 6.53 ACRES LOCATED AT 6955 W. US HWY 190 AND 6749 DOGRIDGE ROAD. 13.Z-25-07 = Hold a public hearing and consider a zoning change from Agricultural to Retail with a Specific Use Permit for an office showroom on approximately 3.37 acres located at 1918 Auction Barn Road. A motion for approval of the zoning change for approximately 2 acres was made by Councilmember Covington. Councilmember Pearson seconded the motion which was unanimously approved upon a vote of 6-0 with the following conditions: The development must conform to all applicable standards of the Retail Zoning District. A final subdivision plat meeting the requirements of the adopted Subdivision Ordinance is approved. A construction plan that meets applicable standards must be submitted and approved before construction begins.
