IN THE COMMISSIONERS COURT OF FALLS COUNTY THE STATE OF TEXAS TO ALL INTERESTED PARTIES COUNTY OF FALLS COMMISSIONER'S COURT MINUTES FOR FEBRUARY 26, 2024 1. Proofofp posting of notice in accordance with the provisions of Title 5. Chapter 551. Govemment Code (Vernon's 's Texas Codes Ann. 1994) as amended. known as the Texas Open Meetings Act. Judge Elliott asked for proof of posting and the same was affirmed by Elizabeth Perez, County Clerk, on the north and south door and the bulletin board. 2. Public comments. No comments. 3. Elected official reports. No elected official reports, 4. Discussion and/or action concerning American Rescue Plan. Judge Elliott stated the bridge on CR 493 has been completed. Jeff Jackson, Road and Bridge Administrator, said that CR 347 is in the process of working on the bridge. That would put them at the halfway mark for the bridges that were on the list. Jeff stated that he needs to make sure that the funds are there to complete the other bridges on the list. 5. Discussion and/or action conceming Marlin Circle T Travel Center. Brandon Trinh, with the Marlin Circle TTravel Center, wants a IO-year tax abatement. Discussion only. 6. Discussion and/or action concerning department revenue collections. Sheryl Pringle, County Treasurer, stated that JP #2 had someone dispute their credit card transaction, therefore JP #2 needs the money to cover the refund that PayTexas issued to the customer. Sheryl also stated District Clerk had an attorney submit an e-file that was not for Falls County, therefore District Clerk needs to issue a refund to the attorney that submitted the e-file. Commissioner Wuebker made a motion to pay the two refunds out of contingency. Commissioner Albright seconded; motion carried. 7. Discussion and/or action concerning interlocal agreement with Rosebud/Lott ISD. Will move to next month' s commissioner' s court meeting. 8. Discussion and/or action concerning WW IL memorial concrete work. There were no bids submitted. Sanchez Driveways submitted an estimate to redo the concrete work for the WWII memorial. Commissioner Green made a motion to accept the bid of$10,500 with Sanchez Driveways, pending the contract, plans and bond. Commissioner Willberg seconded; motion carried. 9. Discussion and/or action conceming Interlocal Cooperation Contract (ICC) for Failure to Appear (FTA) Program. Commissioner Green made a motion to accept the Interlocal Cooperation Contract (ICC) for Failure to Appear (FTA). Commissioner. Albright seconded; motion carried. 10. Discussion and/ or action conceming Constable Pct. 4's racial profiling report. Commissioner Wuebker made a motion to accept Constable Pct. 4's racial profiling report. Commissioner Willberg seconded; motion carried. 11. Discussion and/or action çoncerning Road & Bridge uniform contract. After discussion, Judge Elliott and Steve Sharp, ADA, recommend that we go with the current uniform and sign a new contract with the same company, The new contract will be for 36 months for $200 a week company and will delete the remainder 18 months of the old contract at $400 a week. Commissioner Green made a motion to allow Judge Elliott and Steve Sharp, ADA, to finish negotiating the new contract, with approval from commissioner' s court to sign the new contract for $200 per weck for 36 months deleting the remainder of 18 months at $400 per week on the current contract. Commissioner Albright seconded; motion carried. 12. Review and discussion of Road and Bridge precinct work reports, including Administrator's progress report. Jeff. Jackson, Road and Bridge Administrator, gave a report on road and bridge. Jeff stated that he got a quote to add on a room and move the oil drums outside. The quote is $5,650. Commissioner Wuebker made a motion to approve the quote and the addition of the add on for the oil drums, and for the funds to be taken out of Road and Bridge new vehicle fund. Commissioner Albright seconded; motion carried. 13. Discussion and/or action concerning the approving ofp payment of bills. including reimbursements. late charges. the transfer ofs cash or funds from any line item or departments to another. book transfers and any budget amendments: including but not limited to discussion and action conceming department or non-departmental items with line items that go past their budgeted amounts. Commissioner Wuebker made a motion to approve the payment of all bills, budget amendments and payroll. Commissioner Albright seconded; motion carried. 14. Approval ofr minutes ofj prior meetings ofCommissioner's Court. Commissioner Wuebker made a motion to approve the minutes of the prior meeting. Commissioner Willberg seconded; motion carried. 15.
