Proof of posting of notice in accordance with the provisions of Title 5, Chapter 551, Government Code (Vernon's Texas Codes Ann, 1994) as amended, known as the Texas Open Mectings Act. Deputy County Clerk, Sharon Scott verificd that the agenda had been posted on the north and south doors of the courthouse, 2. Public comments. No comments 3. Elected official reports. Commissioner Willberg noted that the Sheriff had been at the Westphalia Picnic yesterday, and had directed traffic, and that he was most appreciative ofthe presence. Commissioner Wuebker noted that we have RC&D money available for tire removal of what we have still here from last time. County Treasurer, Sheryl Pringle, presented "Thank You" from Marlin Public Library for donation from the County. 4. Discussion and/or action concerning American Rescue Plan. Following a discussion that contracts would have to be completed by the end of 2026, and that things under contract that would not be using the monies designated could be transferred to other contracts, a Memorandum of Understanding was presented to the Commissioners. Commissioner Albright moved to use the $2,025 that had not been utilized for use in the park; Commissioner Willberg seconded. Motion carried. 5. Public Hearing: Discussion and/or action conceming records archive fee. Following a brief discussion, Milton Albright moved to increase the archive fcc $10. F.A. Green seconded. Motion carried. 6. Discussion and/or action concerning Rodeo Springs Addition plat. Following a brief discussion, Nita Wuebker moved to approve; FA Grecn scconded. Motion carricd. 7. Discussion and/or action concerning Bahia Pipeline, LLC road bore/cut for CR 452, CR 452 (2"d Cross), CR 459, CR 486, CR 481, CR 479, CR 487, CR 480, CR 489, CR 488, CR 340, CR 344, CR 343; and road use agreement. Commissioner Willberg moved to approve the road bore agreement, with a bond and a road use agreement to follow. Commissioner Wucbker seconded. Motion carried. 8. Discussion and/or action concerning loose. livestock policy and procedures. Commissioner Willberg noted to the Sheriff that he had been informed that there were repeated calls in the Durango area. He asked the Sheriff he could corroborate that information, and the Sheriff then described calls the Sheriff s Office had been receiving in that area. Commissioner Willberg requested to know what the policy for chronic livestock issues are. The Sheriff said that for cach extra hous they arc chasing loose livestock, the livestock owner is billed at $100.00 per hour. JIÉ 9. Discussion and/or action conceming Energiekontor US Texas SP 16 LLC Tax Abatement application. Following discussion that the County is in the process of updating guidelines and criteria for abatements, Commissioner Wuebker moved to accept the application, and Commissioner Green scconded. Motion carried. 10. Discussion and/or action concerning early voting sccurity. Judge Elliott expressed to Sheriff Lopez the importance of having law enforcement as security during the entirety of carly voting. The Sheriff noted that he had spoken with Nicket of the Elections Office. I1, Discussion and/or action concerning Spindlemedia LLC agreement with Tax Office. The Commissioners asked the tax attorney for Falls County regarding his experience with this company and reccived the answer that he was most satisfied in his experiences with the company. Tax assessor, Kayci Nchring explained the pricing differences and the capability differences. It was determined that this possibility had been considered when they budgeted, and placed under "contingencies". Commissioner Albright moved to sign the ne contract with Spindlemedia that would begin the end of the NetData contract. Commissioner Willberg seconded, Motion carried. 12. Discussion and/or action concerning SAVNS Maintenance Grant Contract FY 2025. Commissioner moved to approve the grant contract. Commissioner Albright seconded. Motion carried. 13, Discussion and/or action concerning Fifth Contract Renewal participating entity services agreement for statewide automated victim notification service (SAVNS)- Commissioner Wuebker moved to approve the contract renewal. Commissioner Albright seconded. Motion carried. 14. Discussion and/or action conceming application for structural repairs to dams in Cow Bayou Watershed, There is approximately $1.7 million from the state to make repairs on thrce of the five lakes in Cow Boyou. #16 has $910,000 assigned, #27 has $300,000 and #30 has $490,000. Commissioner Wucbker moved to approve the application and Commissioner Albright seconded. Motion carried. 15. Discussion and/or action concerning order to approve online education for county commissioners. Following a bricf discussion, Commissioner Albright moved to approve and Commissioner Willberg seconded. Motion carried. 16. Discussion and/or action conceming Appraisal District resolution to nominate candidates for 2025-2026, Commissioner Green moved to nominate lan Giesler and Bryleen Terry as candidates.. Commissioner Albright seconded. Motion carried. 17. Discussion and/or action concerning increase in fccs for Travis County Medical Examiner. There was a discussion about the increase in costs for autopsies, and it was noted that an increase had been budgeted. 18. Discussion and/or action concering accepting ESD #3's 2024/2025 budget. Commissioner Willberg moved to accept the budget from ESD#3. Commissioner Green seconded, Motion carried. 19. Discussion and/or action conceming 2025 county holidays. Following a brief discussion that Christmas Eve had been exchanged for the Friday 26" of December next ycar. Commissioner Allbright moved to approve. Commissioner Wuebker seconded. Motion çarried. 20. Discussion and/or action concerning 2025 resolution for Indigent Defense Grant Program. Commissioner Albright moved to approve the 2025 resolution for Indigent Defense Grant. Commissioner Green scconded. Motion carried. 21. Discussion and/or action concerning indigent cremation. Commissioner Albright approved the payment for the cremation presented upon receipt of the completed contract, Commissioner Green scçonded. Motion carried. 22. Review and discussion of Road and Bridge precinct work reports, including Administrator' S progress report. The Road and Bridge Department presented information regarding the conclusion of the contract with John Deere in January, Researching a contract with CAT would be approximately $70,000 cheaper over the five-ycar contract span than was John Deere, with the possibility of purchasing at the end of the contract for $1. This is unlike the John Decrc contracts we have had where the purchase oft the grader at the end of the contract has been costs in the vicinity of $200,000. Jeff was informed that it needs to be placed in the newspaper, and should be back on the next agenda to be addressed, 23. EXECUTIVE SESSION PURSUANT TO SECTION 551.074 OF THE GOVERNMENT CODE, THE COMMISSIONERS COURT WILL HOLD AN EXECUTIVE SESSION TO DISCUSS PERSONNEL MATTERS AND LOCAL GOVERNMENT CODE 154.025. Executive Session began at 10:22 a.m. After the executive session, the Commissioners Court may consider, in open session, any motions one or more ofi its members wish to make, regarding this item. Upon the return of the Commissioners from Executive Session, Judge Elliott announced that no action was required. 24. Discussion and/or action concerning the approving of payment of bills, including reimbursements, late charges, the transfer of cash or funds from any line item or departments to another, book transfers and any budget amendments; including but not limited to discussion and action concerning department or non-departmental items with line items that go past their budgeted amounts. Commissioner Albright moved to pay the bills. Commissioner Wuebker seconded. Motion carried. 25. Approval of minutes of prior mectings of Commissioner's Court. Following a brief discussion, Commissioner Willberg moved to approve the minutes as presented. Commissioner Green seconded. Motion carried. 26. Adjournment.
