IN THE COMMISSIONERS COURT OF FALLS COUNTY THE STATE OF TEXAS TO ALL INTERESTED PARTIES COUNTY OF FALLS COMMISSIONER'S COURT MINUTES FOR MAY 13, 2024 1. Proof of posting of notice in accordance with the provisions of Title 5, Chapter 551, Government Code (Vernon's Texas Codes Ann. 1994) as amended, known as the Texas Open Meetings Act, Deputy Clerk Sharon Scott noted that the agenda was posted on the north and south doors of the Courthouse, as well as the bulletin board on the second floor outside the County Clerk's office. 2. Public comments. None 3. Elected official reports. Proposition 2 was passed at the last meeting; the Resolution was signed by the commissioners today, 4. Discussion and/or action conceming American Rescue Plan. Nothing currently. 5. Discussion and/or action conceming CR 102 subdivision. Commissioner Albright moved to approve. the CR 102 subdivision (the signatures will be changed to reflect county officials, rather than Marlin City officials). Commissioner Green seconded. Motion carried. 6. Discussion conceming Disaster Declaration for Falls County. 4 The County Judge declared Falls County a disaster area on May 9,20. Following a discussion about the length of time this may be applied, there will be a Spccial Meeting due to the urgent public necessity of extending the disaster declaration. The meeting will be held at 8:30 a.m. on Wednesday, May 15, 2024 7. Discussion and/or action concerning resolution for WaterSmart grant application. The commissioners discussed that they had previously voted on a limit of $50,000 of their investment in grant applications, and that this is sort of a pre-planning application, Commissioner Green moved to approve the resolution; Commissioner Albright seconded. Motion passed unanimously, 8. Discussion and/or action concerning Unclaimed Property Capital Credits for Counties. FA Green moved to make the application for unclaimed property capital credits. Nita Wuebker seconded. The vote was unanimous. 9. Discussion and/or action concerning Tri-County S.U.D. road bore on CR 129, Commissioner Albright moved to approve the road bore on CR 129; Commissioner Wuebker seconded. Motion carried. 10. Discussion and/or action conceming approving the annual distribution of permanent school funds. There are Falls County students attending Troy, Lorena, etc., and the student count would include all the Falls County students. Commissioner Willberg moved to approve the annual distribution as indicated; Commissioner Albright seconded. Motion carried. 11. Discussion and/or action conceming canvass of city and school election. Commissioner Wuebker moved to approve the canvass of city and school elections; Commissioner Albright seconded. Motion carried. 12. Discussion concering Railroad Commission ofTexas Oil and Gas Division in Archer County. Following discussion, it is determined that a letter will be prepared to inform the owners and lessees by Falls County. For theplwsins ofwwells thut oR boadewlal, see AHRChMeNT 13. Discussion and/or action concerning SB22, (DA, Sheriff, and Constable). After discussing the "backfill" pay, Commissioner Albright moved to approve that pay for the Constable, applicable employees in the District Attorney's Office, Deputics, and Jailers who currently "Certified" . with the other jailer's 's back pay regarding SBB 22 held until further clarification from the Comptroller's Office. Commissioner Green seconded. 14, Discussion and/or action conceming confidentiality policy and agreement, There was discussion that this policy should be entered into the handbook, and would affect the County Judge's Office, the District Attorney's Office, both the District and County Clerk's Offices, the Justices of the Peace and the Auditor's Office. F.A. Green moved to add this policy to the handbook; Milton Albright seconded. Motion carried. 15. Discussion and/or action concerning the next Commissioners Court meeting, Tuesday, May 28, 2024. Commissioner Wuebker moved to move the meeting scheduled for the fourth Monday to Tuesday, May 28, because the regularly scheduled meeting is on a holiday. Commissioner Green seconded. The motion carried. 16. Review and discussion of Road and Bridge precinct work reports, including Administrator's progress report. The tires from the recent Trash Day will be taken as the department is able. They are not in the way, and they will just move them as they can, and it will not be 50 expensive at once. Two oft the department employees are currently on restricted work schedules. There is still aj position for shredder in Precinct #4, but that may be filled soon. They will be having a demonstration for a new shredder if any oft the commissioners would like to attend. We do have some roads closed. County Road 109 is going to be closed until the bridge is replaced. The state will be arranging for the bridge replacement, and it will probably sometime late next year before it is completed. County Road 110 is currently like a swamp. County Roads 452 and 442 are also currently closed, They have also not received any millings from Highway 6: yet. 17. Discussion and/or action conceming the approving of payment of bills, including reimbursements, late charges, the transfer of cash or funds from any line item or departments to another, book transfers and any budget amendments; including but not limited to discussion and action conceming department or non-departmental items with line items that go past their budgeted amounts. Milton Albright moved to approve the bills as presented. Nita Wuebker seconded. Motion carried unanimously. 18, Approval of minutes of prior meetings of Commissioner's Court. Following a brief discussion, Nita Wuebker moved to approve the minutes. Milton Albright seconded. Motion carried. 19. Adjournment. County tax records show you as the landowner of the referenced property, Pursuant to Sections 89.043 and 91.113 of the Texas Natural Resources Code, please be advised that the Railroad Commission of Texas (the "Commission") plans to conduct plugging and/or cleanup operations at the above referenced property as scheduling allows. Should access to the property be locked or otherwise inaccessible, please provide instructions to access the property If the property is subject to al lease, please provide a name and phone number for the lessee. If you require any special considerations prior to Commission access, please contact Jeff Jacobs at Jeffrey, jacobs@rrc: texas.gov or 940-723-2153 as soon as possible to discuss the requested arrangements. Commission personnel will require continued access to the property during plugging and/or clean-up operations and for the removal of salvaged material. The Commission will keep any property disturbances to a minimum. However, trees and brush may need to be removed and new roads built in order to move required equipment onto the property. After the completion of all operations, the Commission will restore the surface of the property to as close to the original condition as possible. Pursuant to Sections 89. 085 and 91.115 of the Texas Natural Resources Code, equipment and/or hydrocarbons recovered during operations may be sold for salvage. Any person with a legal or equitable ownership or security intérest in the equipment and/or hydrocarbons may file a Claim for Proceeds of Salvage. If any equipment is deemed non-salvageable, ity will be left on site. The commission may, in some circumstances bury non-salvageable equipment with landowner approval.
