Proofo of posting ofi notice in accordance with the provisions ofTitle 5. Chapter 551. Goyernment Code (Vernon's Texas Codes Ann. 1994) as amended. known as the Texas Open Meetings Act. Judge Elliott asked for proof of posting and the same was aflimed by Elizabeth Perez, County Clerk, on the north and south door and the 2nd floor bulletin board. 2. Public comments. No comments. 3. Elected official reports. Commissioner Wuebker stated that Nextlink was awarded the grant for internet service. She also stated that she received an email from Brooke Thompson with MRB that the completion of the Falls on the Brazos park is set for August 2025. 4. Discussion andor action concerning American Rescue Plan. Nothing at this time. 5. Public Hearing: Discussion and/or action considering adoption of Guidelines and Criteria for Tax Abatement and to consider a resolution to clect to be cligible to participate in tax abatement agreements promoting cconomic development within Falls County. Wally Burns stated that he would like Falls County to send out letters to the adjacent properties oft the property that is being developed. He said he would like to see this be put in our abatement guidelines. Mr. Dixon stated that you can add that to the abatement guidelines. Steve Sharp is going to work on getting that added and will bring it back to court as an amendment to the abatement agreement. Commissioner Green made a motion to approve the adoption of Guidelines and Criteria for Tax Abatement. Commissioner Albright seconded; motion carried. Commissioner Green made a motion to approve the resolution to be eligible to participate in tax abatement agreements promoting economic development within Falls County. Commissioner Albright seconded; motion carried. 6. Public Hearing: Discussion and/or action concerning Amendment to the existing Tax Abatement Agreement between Falls County and BT Yixon Solar. LLC. Wally and Rusty Burns state their concerns with the abatement agreement. Rusty Burns is wondering ifthis is going to be a regular 10 year agreement or a 5 year depreciation agreement. Also, is there going to be storage on the property or just solar or both. Commissioner Willberg made a motion to approve the amendment to the existing tax abatement agreement between Falls County and BT Yixon Solar, LLC. Commissioner Green seconded; motion carried. 7. Public Hearing: Discussion and/or action concerning approval OfBT Yixon Solar. LLC project Road Usc Agreement to prevent degradation of county-maintained roads. Rusty and Wally Burns stated that they have concems with trucks speeding and running people off the road. It was suggested that a law enforcement member should sit and start giving tickets. They were told to contact Sherriff. Jason Campbell. We have not received the road use agreement for BT Yixon Solar, LLC. When we receive the agreement, we will put it on the agenda at a later date. 8. Discussion and/or action conceming tax abatement application for Energiekontor US Texas SP 16 LLC. Commissioner Wuebker made a motion to accept the tax abatement appliƧation for Engergiekontor. Commissioner Green seconded; motion carried. 9. Discussion and/or action concerning adopting a resolution to designate authorized signatories (A201) for the 2023 Texas CDBGI program, grant agreement number CDV23-0043. Commissioner Wuebker made a motion to approve the adoption ofthe resolution to designate authorized signatories for the 2023 Texas CDBG program. Commissioner Albright seconded; motion carried. 10. Discussion and/or action concerning approving a resolution adopting required CDBG Civil Rights policies, (A1014)(A1013) (A1003) and (A1004) and (code of conduct). Commissioner Green made a motion to approve the resolution adopting required CDBG Civil Rights policies. Commissioner Albright seconded; motion carried. 11. Discussion and/or action concerning Proclaiming April as Fair Housing Month (A1015): This proclamation will helpt to fulfill Fair Housing activity obligations as required by the grant (A1007). Executive Session: Section 551.071 ofthe Government Code (V.C.T.A.): An executivelclosed session will be held sO that the City Council can seek and receive legal advice from its attomeys regarding pending or threatened litigation, settlement offers. claims, or other matters for which the attorneys' duties to their client under the Texas State Bar Disciplinary Rules of Professional Conduct Conflicts with the Open Meetings Act (Ch.551, Gov. Code): Falls County, Texas V Young Livestock Ranch. We went into an executive session at 9:46 a.m. and went back to regular session at 10:27 a.m. 13. Discussion and action on proposed settlement between Falls County and Young Livestock Ranch. Commissioner Green made a motion to accept the proposed settlement between Falls County and Young Livestock Ranch, with everything remaining confidential until the final agreement is done. Commissioner Albright seconded; motion carried. Commissioner Willberg abstained. 14. Discussion and/or action concerning copier contract renewal fort the Falls County Agricultural Extension Agency. Commissioner Albright made a motion to approve the copier contract for the Falls County Agricultural Extension Agency. Commissioner Green seconded; motion carried. 15. Discussion and/or action concerning approval ofUC DY 141 IGT (indigent health care) payment in the amount of $I03.203.09. Commissioner Albright made a motion to approve the payment of$103,203.09 for UC DY 14 IGT. Commissioner Wuebker seconded; motion carried. 16. Discussion and/or action concerning contracted services agreement with Falls Community Hospital and Clinic. Sheryl Pringle, County Treasurer, suggested the $114,600 for pilot payments be invested in a one-year CD. Commissioner Green made a motion to approve the purchase of two vehicles for the DA's office, giving Judge Elliott authority to sign the agreement when received. Judge Elliott stated that they are going to put the DA Office's Ford Explorer in the auction rather than spending the money to repair it. Commissioner Albright made a motion to use Waco Auction Group for the auction. Commissioner Willberg seconded; motion carried. 29. Discussion and/or action concerning purchasing file cabinets for the DA's Office. Commissioner Green made a motion to approve the purchase of file cabinets for the DA's Office.
