IN THE COMMISSIONERS COURT OF FALLS COUNTY THE STATE OF TEXAS TO ALL INTERESTED PARTIES COUNTY OF FALLS COMMISSIONER'S COURT MINUTES FOR JUNE 24, 2024 I. Proof fofp posting of notice in accordance with the provisions of Title 5, Chapter 551. Government Code (Vernon's Texas Codes Ann. 1994)as amended. known as the Texas Open Mcctings Act. Judge Elliott asked for proof of posting and the same was affirmed by Elizabeth Perez, County Clerk, on the north and south door and the bulletin board. 2. Public comments. No comments. 3. Elected official reports. Commissioner Willberg stated he talked to the Milam County Commissioner's and they stated that there were going to be another 41 to 5 solar farms coming to Milam County will be connected to Falls County roads. Commissioner Willberg would like to make sure we get a road use agreement with them. Commissioner Willberg also stated that there are going to be some pipelines that are coming through. Judge Elliott stated that the Deer Creck bridge on Hwy 77 is closed due to repairs, which makes for more traffic. Judge Elliott said pcople are cutting through the gas station at the Y. Commissioner Wuebker stated that they could use some more detour signs. 4, Discussion and/or action concerning American Rescue Plan. Jeff. Jackson, Road and Bridge Administrator, stated that the bridge on CR 211 will be finished next week. The bridge on CR 402 will be starting on the 1"of July and then after that, they will have the bridges on CR 150 and 464. Georgie Patterson, County Auditor, stated that she transferred the $150,000 for the donation to the Falls on the Brazos Park. Georgie also stated that the deadline that was decided on for the Non-profits is June 30 and that is a Sunday. We do not come back to commissioner's court until the gt, ,so Georgie will work with all the remaining non-profits until that Friday, On July g, Georgie will provide a list of all the non-profits that have not spent their money. 5. Discussion and/or action concerning acceptance of the Falls County Annual Financial Report for the fiscal year ending September 30. 2023. Georgie Petterson, County Auditor, stated Mr. Hall said everything was great with the County's Annual Financial Report and that he did not need to be present for the meeting. Commissioner Albright made a motion to accept the Falls County Annual Financial Report for the fiscal year ending September 30, 2023. Commissioner Willberg seconded; motion carried. 6. Discussion and/or action concerning Ordinance Appointing Kayci Nehring to calculate the effective taxu rate for Falls County and Lateral Road tax year 2024. Commissioner Willberg made a motion to appoint Kayci Nehring, Tax A/C, to calculate the effective tax rate for Falls County and Lateral Road tax year 2024. Commissioner Wuebker scconded; motion carried. 7. Discussion and/or action conceming Interlocal Agreement for Assessment and Collection of Taxes. Commissioner Wuebker made a motion. to approve the Interlocal Agreement for Assessment and Collection of Taxes with Westphalia ISD, City of Marlin, ESD #1, City of Rosebud, and the City of Lott. Commissioner Albright seconded; motion carried. 8. Discussion and/or action concerning approval of] RAPPS PGY4 IGT (indigent health care) payment in the amount of $26.946.11. Commissioner Wuebker made a motion to approve the payment of $26,946.11 for the RAPPS PGY4 (indigent health care). Commissioner Willberg seconded; motion carried. 9. Discussion and/or action concerning Children's Advocacy Center Memorandum ofU Understanding. Commissioner Wuebker made a motion to approve the Children's Advocacy Center Memorandum of Understanding and the Children's Advocacy Center MDT Working Protocols/Guidelines. Commissioner Willberg seconded; motion carried. 10. Discussion and/or action concerning payout of compensatory time for one (I) road & bridge employee. Commissioner Albright made a motion to payout compensatory time for onc (1) road & bridge employce. Commissioner Willberg seconded; motion carried. 11. Discussion and or action concerning finding all three ofthe first three exceptions under TLGC $262.024 DISCRETIONARY EXEMPTIONS. to authorize the purchase of a skid steer and all necessary attachments soas to be able to clear the county roads and county lands of fallen trees and branches which are impeding use of those roads without the need to advertise for bids. Falls County must meet the following criteria to purchase a skid steer and all necessary attachments without the need to advertise for bids. (1) an item that must be purchased in a case of public calamity ifit is necessary to make the purchase promptly to relieve the necessity ofthe citizens or to preserve the property of the county; (2) an item necessary to preserve or protect the public health or safety of the residents ofthe county; (3) an item. necessary because of unforeseen damage to public property Commissioner Willberg made a motion that Falls County has met the above criteria. Commissioner Wuebker seconded; motion carried. Commissioner Wuebker made a motion to approve the purchase ofthe skid steer and all necessary attachments from RDO Equipment. Commissioner Willberg seconded; motion carried. Commissioner Wuebker made a motion to allow Georgie Patterson, County Auditor, to cut the check to RDO upon receiving the invoice and not wait until commisioner'scourt: Commissioner Albright seconded; motion carried. 12. Discussion concerning comp time policy. Discussion only. 13. Review and discussion of Road and Bridge precinct work reports. including Administrator' 's progress report. Jeff. Jackson, Road and Bridge Administrator, gave a report for the Road and Bridge Department. 14. Discussion and/or action concerning the approving ofpayment oft bills. including reimbursements late charges, the transfer of cash or funds from any line item or departments to another, book transfers and any budget amendments: including but not limited to discussion and action concerning department or non-departmental items with line items that go past their budgeted amounts. Commissioner Albright made a motion to approve the payment of all bills, budget amendments, and payroll. Commissioner Willberg seconded; motion carried. 15. Approval ofminutes of prior meetings of Commissioner's Court. Commissioner Wuebker made a motion to approve the minutes of the prior meeting. Commissioner Albright seconded; motion carried. 16.
