18 THE TOVN OF 13 MINUTES OF THE BUENA VISTA BOARD OF TRUSTEES BUENA VISTA REGULAR MEETING CO Tuesday, February 25, 2025 MINUTES OF THE MEETINGS OF THE BOARD OF TRUSTEES ARE A TRANSCRIPT OF THE GOVERNING BODY'S ACTIONS RATHER THAN A VERBATIM RECORD OF DELIBERATIONS. Work Session at 6:00 PM - Water Conservation Plan Recommendations Mayor Libby Fay, Trustees Maggie Huyck, Andrew Rice, Devin Rowe, and Cindie Swisher, Water Advisory Board members Kelly Collins, Jeff Ollinger, Tony LaGreca, and Liz Daigle were in attendance for the presentation from Al Smith with Swiftwater Solutions regarding the Water Conservation Plan recommendations. Also present were Town Administrator Brian Berger, Treasurer Phillip Puckett, Senior Policy Advisor & Project Advocate Joel Benson, Planning Director Marika Kopp, Public Works Director Shawn Williams, and Town Clerk Paula Barnett. Town resident Wendy Gordon introduced herself and shared that she is interested in joining the Waer Advisory Board. Mayor Fay shared that Trustee Chris Sturm has recused himself from the work session. Al Smith gave a brief recap of the Water Conservation Policy presentation that he presented on February 11, 2025, which included the following. Data utilized represents water demands from 2023 Treads are similar for all years Year-to-year fluctuations are mainly dependent on summer precipitation and the percent of water loss within the water system The highest usage in the town historically occurs in the summer months, mainly due to outdoor watering activities Buena Vista used three times more water during its highest usage month (usually July or August) than the average during the non-irrigating season (November through March) Water loss accounted for approximately 21.5% of total water produced in 2023. Water loss has averaged approximately 21% over the last 10 years. Smith reviewed a graph reflecting the monthly use of water, current water treatment capacity, current water rights, and future water treatment capacity upon completion of the new facility. BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 1 of 14 Regular Meeting February 25, 2025 Smith stated that the treatment capacity only focuses on the water infiltration gallery and does not include Well Two, Well Three, and Well Four. Smith said the new treatment plant is scheduled to go online in May of 2025 and can treat 2.5 million gallons of water a day but will be limiting it to 2 million gallons. Smith shared that the Water Advisory Board considered and selected the Best Practices recommended in the Colorado Waterwise Best Practices Guidebook. Considerations from this meeting can and will be incorporated into the final selection of alternatives. Best Practices #1: Conservation = Orientated Rates and Tap Fees Level of Effort: Low to moderate - A tiered rate structure is currently in place, and guidance is needed on where to set rates to promote water conservation Level of Impact: High = Residential users - 80% of all taps and 60% of total water demand Relative Cost to Implement: Low Implementation Strategy: This will be determined with input from the Board of Trustees, Town Staff, and Water Advisory Board. Town Treasurer Phillip Puckett stated that the Town currently utilizes tiered rates, and the more water a resident or business uses, the higher the fee. Puckett said a study has not been done to determine if there has been a change in the demand for water since the tiered rate fee schedule has gone into effect. Trustee Swisher stated she feels it is an excellent idea but does not want people with lawns to not water, have yards die, and become patches of weeds. Trustee Rice stated that water rates should be based on what it costs to manage water and required staff time, not what the market can bear. Puckett noted that he would recommend a Rate Study be completed before adjusting the current water rates. The Board agreed to pursue a tiered rate process. Best Practices #3: System Water Loss Control Level of Effort: Moderate to High - Requires specialized leak detection equipment, invasive repairs, and Town Staff resources. Level of Impact: High -Town water loss has averaged 21% over the last 10 years. The industry standard is less than 15%. Relative Cost to Implement: Moderate to High = Costs increase dramatically if capital pipe replacement is required. Implementation Strategy: This will be determined with input from the Board of Trustees, Town Staff, and Water Advisory Board. BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 2 of 14 Regular Meeting February 25, 2025 Trustee Swisher shared that she would like to utilize several recommendations, and infrastructure needs to be maintained as the town ages. Trustee Rice stated that the pipe life expectancy is 50 to 100 years, and in the upcoming budget, he would like to evaluate if a percentage of funds can be allocated for pipe replacement. Best Practice #4 = Water Conservation Coordinator Level of effort: Moderate to High - May require hiring a full-time employee Level of impact Moderate to High - No direct water savings but raises Town engagement with the community. Ensures that water conservation actions are evaluated and completed. Relative Cost to Implement: Moderate - The Town may hire a full-time employee or assign duties to existing Staff. Smith stated that the Water Advisory Board recommends the Trustees consider a Water Conservation Coordinator to ensure a successful conservation program. Kellie Collins noted that a coordinator can educate the citizens and provide resources for residents who want to change landscaping to reduce water use. Trustees Rowe and Hyuck stated they feel it would be beneficial to provide education, although they expressed concern if the enforcement of water conservation could become confrontational. Smith shared that the construction of buildings and housing developments needs to follow and be held accountable to the reviewed and approved landscaping plans. Smith stated that the landscaping plans submitted for the Buena Vista Middle and High School before construction were not followed, resulting in extremely high water use. Puckett stated that if a Water Conservation Coordinator position is created and funded, Staff would also want the employee to obtain water operator certification and perform leak detection. Town Administrator Brian Berger stated that there is currently no budget for this position, and it may be something that gets grown into to meet the needs to operate and maintain town facilities and infrastructure and assist residents. Best Practice #7 - Landscape Watering Budgets Level of Effort: Moderate to Moderately High = Each landscaped area would need to be individually evaluated and monitored. Level of Impact: Moderately High - Schools and Parks made up 10% of the Town's water demand Relative Cost to Implement: Low - If included in duties of the Water Conservation Coordinator Position. Best Practices #8 and #9 - Water Efficient Design, Rules and Regulations Level of Effort: Low to Moderate = Considers updated code and enforcement Level of Impact: Moderate to High = Provided codes and enforcement are effective at reducing outdoor watering Relative Cost to Implement: Low = If included in duties of the Water Conservation Coordinator position. Moderate - If responsibilities are passed to an outside consultant Implementation Strategy: To be determined with input from the Board of Trustees, Town Staff, and Water Advisory Board Smith stated that this practice focuses on enforcement, for example, the school and developments that may not comply with the tap application submitted when initial eveopment-constructon plans were reviewed. Tony LaGreca stated that he feels this policy is highly needed as a member of the Water Advisory Board and the Planning Zoning Commission. Jeff Ollinger stated the Water Conservation Plan could be a phased process. Ollinger suggested meeting with the 20 highest water users to discuss why the use is SO high and options to reduce water use would be a good starting point. Trustee Rice thanked Smith and members of the Water Advisory Board for their collective efforts in working on the proposed plans. Members of the Board echoed Trustee Rice's appreciation. Mr. Pilgrim's public statement is on file with the Town Clerk. Read McCulloch, Executive Director of Chaffee Housing Trust, stated that regarding the request for the Trustees to approve the Letter of Support for a Housing Development and Preservation Grant Application by the Chaffee Housing Trust for 14 permanently affordable homes at The Crossing, he would also request the Board consider that the Town waive the building permit fees on the 14 homes. McCulloch stated the grant funds are very competitive, BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 6 of 14 Regular Meeting February 25, 2025 and they are seeing counties and communities that have waived building fees being awarded the grants. Paul Andrews, Developer of The Crossing, stated he appreciates the support of the Trustees and Staff over the past couple of years but needs additional support to provide affordable housing. Andrews noted that projects will continue to struggle unless all entities work together. Andrews said that Grand and Gunnison counties received 6 million dollars in loans from the State, partly due to the counties working with the developers by waiving building permits and water tap fees. Andrews requested the Town consider waiving building permits and water tap fees for the 14 homes as an avenue to make the cost of building work for everyone. PRESENTATION - Introduction of Planning & Zoning Commission Applicant Planning & Zoning Commission applicant Jared Lane thanked the Trustees for considering him to serve on the Planning & Zoning Commission. Lane shared he has lived in Buena Vista since he was eight years old, left for six years to obtain his master's degree in music, is a resident of Buena Vista, and is currently providing music lessons and writing music for movies. Lane stated that he worked construction to pay for his college tuition, allowing him to learn and understand required codes. Lane shared his parents instilled in him that if you can help your community, it is responsible to do SO. Lane said that he feels it would be an asset to have someone who works in the arts industry on the Planning & Zoning Commission. BUSINESS ITEMS Canine Officer Thor Retirement Should the Board of Trustees approve the adoption of Resolution No. 15, Series 2025, entitled, "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, RECOGNIZING THE DISTINGUISHED SERVICE OF CANINE THOR AND CONVEYING OWNERSHIP OF THOR TO OFFICER FRAZER POMFRET." Police Chief Dean Morgan reviewed that Canine Officer Thor has reached an age where he needs to retire. Thor has served with the Buena Vista Police Department for over five years, and recently, he has begun displaying some issues with his back and hips. Veterinarians examined him, and although he faces no serious medical problems, keeping him with the department as a working dog is not advisable due to his age and health issues. Thor's handler, Officer Frazer Pomfret, concurs with this decision and hopes to keep Thor as his dog as Thor leaves police service and enters retirement. MOTION NO. 03: MOVE TO ADOPT RESOLUTION NO. 15, RECOGNIZING THE DISTINGUISHED SERVICE OF CANINE OFFICER THOR AND CONVEYING OWNERSHIP TO OFFICER FRAZER POMFRET. Chief Morgan stated not at this time and that the Salida Police Department, Park County Sheriff's Department, and the Department of Corrections have trained canine officers who can be called to assist the department when needed. Chief Morgan thanked K9 Thor for his years of service, and Officer Pomfret and members of the law enforcement gave Thor his last sign-off. 2024 Buena Vista Recreation Study Overview Recreation Director Shane Basford gave the Trustees an overview of the 2024 Buena Vista Recreation Study. The studies include the Recreation Community Survey conducted by consulting firm SE Group, with remaining funds allocated for the firm to complete the Comp Plan survey, and a Trails Analysis conducted by Trailside Ltd, which analyzed the Town's current trail conditions and provided recommendations for maintenance, improvement, and expansion of the system. Basford reviewed the 2024 Recreation survey, which was administered to understand the community's perception of and priorities for the Town's parks, trails, and recreational facilities and programs. The survey also gauged the community's willingness to fund future recreation projects and what funding mechanisms community members would be comfortable dedicating to parks. The survey was open from November 18 to December 15, 2024, and received 907 responses. Key points of the survey include: Respondent Demographics Parks & Recreation Facilities Trail Network Recreational Programming Recreational Priorities & Funding Mechanisms The Trustees discussed the extremely high costs of constructing and maintaining a swimming pool and options to provide transportation to the Salida Hot Springs Aquatic Center. The Trustees also briefly discussed with Staff the Use Agreement with the Boys & Girls Club to utilize that space for programs after the site is constructed. Basford stated the Recreation Study will be posted on the Town website with the Master Plan. BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 8 of 14 Regular Meeting February: 25, 2025 Buena Vista Library Parking Waiver Should the Board of Trustees approve the adoption of Resolution No. 16, Series 2025, entitled, "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING THE PAYMENT OF CASH IN LIEU OF PARKING FOR THE BUENA VISTA PUBLIC LIBRARY." Planning Director Marika Kopp, reviewed the Town is currently reviewing a major site plan application for the proposed library expansion. The existing library is 7,531 square feet (sqft) with a proposed second-story addition of 4,479 sqft, bringing the total building to 12,001 sqft. The town parking requirement is one space for every 500 sqft of building space, and the proposed development is required to provide 25 off-street vehicle spaces. The existing library currently has six off-street parking spaces and is proposing to double that amount to 12. Due to site constraints such as the adjacent Cottonwood Creek, the parking area cannot be expanded further than proposed, leaving a 13-space parking deficit. The Unified Development Code allows for various parking alternatives when off-street parking requirements are not met, including shared parking, off-site parking, additional bicycle parking, and cash in lieu. The Library team has pursued several alternatives, including a shared parking agreement with Grace Church, securing eight overflow parking spaces. By providing four additional bicycle parking spaces over the required bicycle parking requirement, the library has provided the maximum credit of two required vehicle spaces, leaving three remaining spaces to address. The determination has been made that the library will pay the fee for off-street parking cash in lieu of $1,200.00 per space, with a total cost of $3,600 for the three spaces requested. MOTION NO. 04: MOVE TO ADOPT RESOLUTION NO. 16, APPROVING THE PAYMENT OF CASH IN LIEU OF PARKING FOR THE BUENA VISTA PUBLIC LIBRARY. RESULTS ROLL CALL CARRIED MOVER Trustee: Hyuck SECONDER: Trustee: Sturm AYES: Huyck, Rice, Rowe, Sturm, Swisher Northern Chaffee County Library District Should the Board of Trustees approve the adoption of Ordinance No. 02, Series 2025, entitled, "AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA APPROVING AN AGREEMENT WITH THE NORTHERN CHAFFEE COUNTY LIBRARY DISTRICT TO REMOVE THE TOWN'S RIGHT TO REVERTER ON CERTAIN PROPERTY OWNED BY THE LIBRARY DISTRICT. Town Administrator Brian Berger provided the Board with the library property's history, which dates back to June 21, 1880, when the property was deeded from the Buena Vista Land BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 9 of14 Regular Meeting February 25, 2025 Company to the Town of Buena Vista. The town constructed a public library on the property around 1923. It leased it to the Buena Vista Library Association until the Northern Chaffee County Library District was created in 1974 to operate the library, and the property was then continued to be leased until 2004. At that time, the Library District initiated plans to build a new library on the property, and the Town took steps to transfer ownership of the property to the Library District. When the property was transferred to the Library District through a Quit Claim Deed, it included a reversionary clause "that all uses of the real property shall be restricted and limited to Public Library uses, operations, and activities and that should the real property be used in whole or in part, for the use other than a Public Library use, the real property shall revert to the Grantor." The Library District has initiated plans to construct an addition to the library. During the financing process, the finance team identified the reverter. The District has been advised that this provision is problematic in their financing plan. Town staff has worked with legal counsel to draft the appropriate mechanism to consider removing the reverter language. Ordinance No. 02 Series 2025 includes an Agreement to Remove the Right to Reverter in Property" approving an agreement with the Northern Chaffee County Library District to remove the Town's Right to Reverter on Certain Property owned by the Library District. Trustee Rice stated that he supports the addition to the library. However, by removing the reverter, the current Board is reversing the action taken by the Trustees in 2004 that a library remains in that location, and by eliminating the reverter, it takes away that control and places it all on zoning. Buena Vista Library Executive Director Cecilia LaFrance shared that the estimated longevity of the library, with the new addition, is 20 to 25 years. The long-term goal is for the library to be centralized in the Town of Buena Vista, and if needed in the future, an annex could be built in Centerville. MOTION NO. 05: MOVE TO ADOPT ORDINANCE NO. 02 APPROVING AN AGREEMENT WITH THE NORTHERN CHAFFEE COUNTY LIBRARY DISTRICT TO REMOVE THE TOWN'S RIGHT OF REVERTER ON RESULTS CARRIED MOVER Trustee Rice SECONDER: Trustee Swisher AYES: Huyck, Rice, Rowe, Sturm, Swisher BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 10 of 14 Regular Meeting February 25, 2025 Public Improvements Agreement Should the Board of Trustees approve the adoption of Resolution No. 17, Series 2025, entitled, "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, APPROVING THE PUBLIC IMPROVEMENT AGREEMENT WITH MARK N. DOERING FOR THE PROPERTY KNOWN AS THE BLOCK 75 AMENDMENT NO. 3 SUBDIVISION." Senior Policy Advisor & Project Advocate Joel Benson reviewed the purpose of a Public Improvement Agreement and the work that goes into the agreement to ensure improvements to the property are completed by the property owner. The fees that are collected are held by the town to use for improvements if the property owner-developer does not complete them. MOTION NO. 06: MOVE TO ADOPT RESOLUTION NO. 17 APPROVING THE PUBLIC IMPROVEMENT AGREEMENT WITH MARK N. DOERING FOR THE PROPERTY KNOWN AS THE BLOCK 75 AMENDMENT NO. 3 SUBDIVISION. RESULTS CARRIED MOVER Trustee Rice SECONDER: Trustee Rowe AYES: Huyck, Rice, Rowe, Sturm, Swisher Berger reviewed with the Trustees that in many cases not much weight has been given to the requirements of a Public Improvements Agreement in the past. In the future, individuals and developers should understand that this is a contract between the Town and the developer and that infrastructure must be completed before a building permit or certificate of occupancy is issued. Amendments to the Public Improvement Agreement should also be minimal going forward, as long as clear communication is provided to the developers regarding the expectations and requirements of the Town. Senior Policy Advisor and Project Advocate Joel Benson reviewed the requirements of the Public Improvement Agreement between the Town and Mark Doering for the property in Block 75 Amendment No. 3 Subdivision. Trail Bids Consideration Should the Board of Trustees approve the adoption of Resolution No. 18, Series 2025, entitled, "A RESOLUTION OF THE TOWN OF BUENA VISTA, COLORADO, APPROVING A NOTICE OF AWARD TO PAVEMENT MAINTENANCE SERVICES, INC FOR THE RAILROAD STREET PEDESTRIAN TRAIL REHABILITATION PROJECT." Public Works Director Shawn Williams reviewed with the Board the Public Works Department advertised a public bid process and held a bid opening on February 12, 2025. The Railroad Street Pedestrian Trail Rehabilitation Project received one complete bid proposal. The project includes milling and paving the asphalt trail along South Railroad Street. The bid proposal from BOARD OF TRUSTEES OF THE TOWN OF BUENA VISTA Page 11 of 14 Regular Meeting February25, 2025 Pavement Maintenance Services, Inc. includes the full scope of the project requirements for the milling and paving and the overlay for the pedestrian footbridge along the trail. Asphalt material will be ourchased by the Town for this project and is included in the project budget from the 2025 Adopted Budget. MOTION NO. 07: MOVE TO ADOPT RESOLUTION NO. 18 APPROVING A NOTICE OF AWARD TO PAVEMENT MAINTENANCE SERVICES, INC. FOR THE RAILROAD STREET PEDESTRIAN TRAIL REHABILITATION PROJECT. RESULTS ROLL CALL CARRIED MOVER Trustee: Rowe SECONDER: Trustee Sturm AYES: Huyck, Rice, Rowe, Sturm, Swisher INFORMATION ONLY Benson reviewed that after the discussion and decisions made at the Water Allocation Policy Work Session on February 11, 2025, he has several more points for the Trustees and Staff to consider before adopting a revised policy. Benson reviewed the five points on page 197 of the Board of Trustees Packet, which was emailed to the Trustees outlining his recommendations to the Board. The Trustees agreed that more time is needed to ensure that the Staff and Board are making wise decisions and that the Staff will proceed to publish the Water Allocation Policy with the proposed revised language. 2. Draft Letter of Support for a Housing Development and Preservation Grant Application by the Chaffee Housing Trust for 14 Permanently Affordable Homes at The Crossing in Buena Vista, Colorado. The Board had a lengthy conversation regarding the risks to the Town by waiving building permit fees and water tap fees. The Board agreed to amend the draft letter of support by replacing the last paragraph: To further show the Town's support of the project, the Town has provided in-kind support through drafting and presenting successful grant applications for the required public infrastructure and continues to provide grant administration services as a pass through from the funding agency to the applicant. In addition, by allowing the individual lots to be consolidated will allow the applicant to purchase a single larger water tap rather than individual taps for each unit resulting in a significant cost savings on a per unit basis. In addition, by allowing the individual lots to be consolidated will allow the applicant to purchase a single larger water tap rather than individual taps for each unit resulting in a significant cost savings on a per unit basis. MOTION NO. 08: MOVE TO APPROVE MAYOR FAY SIGN THE LETTER OF SUPPORT AS AMENDED FOR THE HOUSING DEVELOPMENT AND PRESERVATION GRANT APPLICATION BY THE CHAFFEE HOUSING TRUST FOR 14 PERMANENTLY AFFORDABLE HOMES AT THE CROSSING. Trustee Rice shared that Chaffee County Public Health has asked the Town of Buena Vista to partner with the BV Community Book Club, The Anxious Generation, on April 24, 2025, at the Community Center. A light dinner will and childcare will be provided. The Town's immediate contribution to the project will be providing the location for the event and making books available for pickup at the Town Hall. If a financial contribution is needed, that will be determined post-event. The Trustees agreed to partner in the event. Trustee Swisher stated that at the Work Session on February 11, 2025, the Darren Patterson Christian Academy students provided the Board and Staff with solid recommendations to improve the Town's safety and traffic. Trustee Swisher would like to ensure several of their recommendations are implemented. Trustee Rice echoed Trustee Swisher's comments and requested they be completed before the end of the school year. Berger stated that the Staff will work on evaluating the recommendations and is also working with the Colorado Department of Transportation on highway-related items.
