STATE OF TEXAS COUNTY OF CONCHO BE IT REMEMBERED THAT THE COMMISSIONERS COURT OF CONCHO COUNTY, TEXAS, met in Regular Term on this, the 25th day of February 2025 at Paint Rock, Texas, in the District Courtroom, Second Floor, after proper notice to the public for the proper length of time, being Notice #6543, with the following members present, to-wit: David Dillard, County Judge, presiding; Trey Bradshaw, Commissioner, Precinct #1; Eric Gully, Commissioner, Precinct #2; Chad Miller, Commissioner, Precinct #3; Keith Dillard, Commissioner, Precinct #4; Amber Hall, County Clerk and Ex-Officio Clerk: of Commissioner's Court; and Jenifer Gierisch, County Treasurer; Scott Spoonts, Justice of the. Peace; Ginger Paul, County Attorney; Brent Frazier, County Sheriff; Dwaine Rayburn, Chief Deputy. Sheriff; Paul Pearson, Lieutenant Deputy Sheriff; Keith Neffendorf, Neffendorf & Blocker; and Members of the Public; See Exhibit "A"; when the following business was transacted, to-wit; Judge Dillard called the meeting to order at 10:00 a.m., gave the invocation, and led the pledges. WELCOME AND PUBLIC COMMENTS None CONSIDER BURN BAN = TAKE APPROPRIATE ACTION No action taken. Burn ban to remain in effect. CONSDFRDSCUESAPPROVE AUDIT REPORT FROM NEFFENDORF & BLOCKER BY KEITHI NEFFENDORF - TAKE APPROPRIATE ACTION Keith Neffendorf presented the Audit Report for the Year Ended September 30, 2024. Mr. Neffendorf stated that Concho County is doing very well. He did advise Mrs. Gierisch that the Debt Service Fund, when the County had an outstanding Bond, could be closed out since there are no more outstanding bonds being paid. He advised that it would just take a Court Order to eliminate the Debt Service fund and transfer it over to the General Fund. Commissioner Bradshaw made a motion to accept the Audit Report as presented by Keith Neffendorf, duly seconded by Commissioner Dillard. Motion carried unanimously. See Exhibit "B" The court took a recess at 10:27 a.m. to read through the previous meetings' minutes and accounts payable. The court went back into session at 10:30 a.m. after recess. APPROVE MINUTES FROM PREVIOUS MEETING Commissioner Dillard made a motion to approve the minutes from February 11, 2025, Commissioners Court, as presented, duly seconded by Commissioner Gully. Motion carried unanimously. CONSIDERVAPPROVE ALL ACCOUNTS PAYABLE FOR CONCHO COUNTY - TAKE APPROPRIATE, ACTION Mrs. Gierisch presented the monthly Accounts Payable Claim Register from February 12, 2025, through February 25, 2025, with a total of $55,161.37. Commissioner Gully made a motion to approve and pay all accounts due and owing by Concho County, duly seconded by Commissioner Miller. Motion carried unanimously. See Exhibit "C" REPORTS, INFORMATION, AND FUTURE AGENDA ITEMS - NO ACTION TO BE TAKEN Mrs. Gierisch presented the Clerk's Report for January 2025. See Exhibit "D" Commissioner Gully presented his Certificate of Completion for his 2024 Continuing Education hours, for the record. See Exhibit "E" Commissioner Gully stated that tomorrow, Wednesday, February 26th, from 10 am-12 pm, there is going to be a Fire Prevention education training held at the Research Center for County Commissioners, Judges, and Fire Chiefs. He is planning on attending. He said that from 2 pm-4 pm they will be having Fire Prevention education for the Public. 167 168 Commissioner Bradshaw presented a Certificate of Completion for his 2024 Continuing Education hours, for the record. See Exhibit "F" Commissioner Bradshaw also mentioned that the County should probably look into hiring another auditor. We should be changing auditors every two to three years, and we have had Neffendorf for quite at few years. Commissioner Dillard presented his Continuing Education hours of completion, for the record. See Exhibit "G" Commissioner Dillard also had Sheriff Frazier clarify some things about the Burn Ban. Sheriff Frazier stated that Immigration and Customs Enforcement and Homeland Security just entered 700,000 administrative civil warrants into the National Crime database. The Sheriff's Office cannot arrest someone solely on these administrative warrants; unless the Sheriff's Office enters into an agreement that would essentially deputize the Sheriff's Officers to be Warrant Service Officers for the Federal Government. The alternative to that is if the individual is committing an offense other than Speeding or Open Container (which are not arrestable offenses by themselves), they could go to jail for the Class C offense being committed and then HSI could pick them up from there. Judge Dillard presented a letter from Southern Power on the Cactus Flats Wind Energy, LLC = Tax Abatement Agreement Annual Certification, for the record. See Exhibit "H" Judge Dillard stated that Shawn Baxter is going to be at the March 25th Commissioners court and speak about Hazardous Mitigation Plan. Judge Dillard said that Alan Bristol with Texas Association of Counties is going to be at the next Commissioners Court and is going to take the Elected Officials to eat at Lowake. Judge Dillard said that Aaron Clements, County Attorney from Dickens County, called him yesterday and updated him on the latest Abatement talks. Mr. Clements said that he calculated what the taxes would generate at the current tax rate on the biggest solar project, for the next 10 years; which would be $9 million. Part of doing the PILOT, Mr. Clements countered with 45%, with them paying 55% of the $9 million. They countered that offer with paying $200,000 a year, which would be about 76%. Mr. Clements countered back with 50%, and paying $100,000 at the start and $200,000 at the completion of the project. The company countered back on that offer with them paying $275,000 a year, with no money upfront. Judge Dillard advised Mr. Clements to stick as close to the 50% as he can. The Commissioners said that 50% with no upfront money, or 55% with upfront money.
