THE STATE OF TEXAS IN COMMISSIONERS COURT COUNTY OF TERRELL REGULAR SESSION COMMISSIONERS COURT MINUTES, REGULAR SESSION, FEBRUARY 10, 2025 The Terrell County Commissioners Court met on Monday, the 10th day ofFebruary 2025, at 9:00 A.M. in the commissioner's courtroom of the county courthouse in the city of Sanderson, Texas. Notices of the meeting place were posted at a site readily accessible to the general public at all times. They remained posted for at least seventy-two hours preceding the scheduled time of this meeting, in compliance with the Open Meetings Act. The Hon. Public Comments on Agenda Items - Mary Kay Rose spoke on Senior Citizen and Pantry projects. Cindy Busch spoke on CBD/Marijuana in the County. Minutes from previous meetings- Commissioner Johnson motioned to approve the minutes from the December 9, 2024, Regular Session and. January 13, 2025, Regular Session. Commissioner Chavez seconded the motion, calling for a vote; all members answered "aye," and the motion carried. Chamber of Commerce upcoming events 2025, asking for funds from the Hotel/Motel line item - Commissioner Johnson motioned to approve the funds from the Hotel/Motel Line item for $1000.00 for the Pachanga Art Walk, Cinco De Mayo and $1,500.00 for the Fourth ofJuly. Commissioner Chavez seconded the motion, calling for a vote; all members answered "aye, and the motion carried. February 1, 2025 Attention: Terrell County Commissioners Court As we embark on another year in' Terrell County, Texas, the Chamber of Commerce is committed to enhancing the visibility of Sanderson through a series of events. We kindly seek the support oft the Terrell County Hotel/Motel Tax Fund to assist int the organization of our Pachanga, Cinco De Mayo Festival, and the 4th of July Festival. These events will be accompanied by promotional materials, including posters, aimed at attracting visitors to Sanderson. The Pachanga iss scheduled for April Sth and will feature an Art Walk and dinner. On May 3rd, we willl host a street dance with a live band, complemented by vendors offering food and various goods. Our annual 4th of. July Festival will take place on July 4th and 5th, featuring two street dances, food vendors, a cornhole tournament, and continuous music throughout the day. We extend our gratitude to the Commissioners' Court for their ongoing financial support through the Hotel/Motel Tax Fund, and we eagerly anticipate our events in 2025. Resolution authorize Approval of Statewide Opioid Settlement Agreements Commissioner Johnson motioned to approve the Resolution on the Statewide Opioid Settlement Agreements. THE STATE OF TEXAS $ COUNTY OF TERRELL $ ORDER (RESOLUTION) AUTHORIZING APPROVAL OF PROPOSED TEXAS STATEWIDE OPIOID SETTLEMENT AGREEMENTS BE IT REMEMBERED, at a regular meeting of the Commissioners Court of Terrell County, Texas, held on the 10th day of February, 2025, on motion made by Adam Johnson Commissioner of Precinct 1 and seconded by Gene Chavez Commissioner of Precinct the following Order (Resolution) was adopted: WHEREAS, Terrell County obtained information indicating that certain drug companies and their corporate affiliates, parents, subsidiaries, and such other defendants as may be added to the litigation (collectively, "Defendants") have engaged in fraudulent and/or reckless marketing and/or distribution of opioids that have resulted in addictions and overdoses; and WHEREAS, these actions, conduct and misconduct have resulted in significant financial costs in the past to the County and will undoubtedly result in significant financial costs in the future; and Comm.court.: regular session 02-10-2025 Page 2 WHEREAS, the County brought or has investigated claims against The Kroger Co. ("Kroger"), and certain other defendants related to potentially released claims; and (2) other defendants in the opioid supply chain on behalf of the County in In Re: Texas Opioid Litigation, MDL No. 2018-63587, currently pending in the 152nd District Court of Harris County, Texas and/or removed pending remand; and WHEREAS, on October 30, 2024, the Kroger Defendant in the opioid litigation brought by the County, the State of Texas, through the Office of the Attorney General, and a negotiation group for Texas political subdivisions entered into an Agreement entitled Kroger Texas Statewide Opioid Settlement Agreement and Release (hereinafter collectively the "Texas Agreement"); and WHEREAS, Special Counsel and the State of Texas have recommended that the Terrell County Commissioners Court support the adoption and approval oft the Texas Agreement in its entirety; and WHEREAS, even though the payments from the settlements reflect partial compensation to Terrell County for the past damages it has suffered or the future damages it is likely to incur, given the risks oflitigation, the fact that it is to the benefit ofTexas and the County and its residents, and that it reduces 1 the risks associated with protracted litigation; NOW, THEREFORE, BE IT RESOLVED that we, the Commissioners Court of Terrell County: 1. Support the adoption and approval the Texas Agreement; 2. Authorizes the County to execute the Texas Release for the Texas Subdivision Participation Form and Release; and 3. Finds as follows: a. There is a substantial need for repayment of past opioid-related expenditures and payment to help abate current and future opioid-related harms in and about Terrell County, Texas; and b. The County Commissioners Court supports in its entirety the Texas Agreement. The County Commissioners Court understands that the purpose of each Settlement is to effectuate resolution ofthe Opioid Litigation against the Kroger Defendants. We also understand that an additional purpose is to ensure the effective means of distributing any potential settlement funds obtained under settlements in Texas and under the jurisdiction ofTexas Courts in a manner and means that would promote an effective and meaningful use ofthe funds in abating the opioid epidemic in this County and throughout Texas. The County is hereby authorized to approve and accept the Texas Agreement as set forth herein. TEXAS ASSOCIATION of COUNTIES a DIR Cybersecurity Course Enrollment Form for Counties Texas Government Code S 2054.5191 requires all county employees, elected officials, and appointed officials who have access to a local government computer system or database and use a computer to perform at least 25 percent of their duties to complete an annual cybersecurity training that has been certified by the Texas Department of Information Resources (DIR). In response to the cybersecurity training mandate and in furtherance of our continued commitment to our county family, TAC is offering a cybersecurity course that has been certified by DIR: and fulfills the requirements of the law. This course is available to counties for an annual fee of$ $5 per enrolled user. Please note that TAC will not be responsible for monitoring, enforcing, or reporting course completion this will be performed entirely within your county.
