ison Duy Madison, Virginia 22727 Madison County Planning Commission Workshop Meeting Minutes January 15th, 7 2025 The Madison County Planning Commission Workshop meeting was held in the Madison County Administrative Auditorium at 414 N. Main Street in the Town of Madison, Virginia it was called to order by Chairman Steve Carpenter at 6:30 PM. Chairman Carpenter determined there was a quorum and the first order of business was to adopt the agenda and approve the minutes from the January gth Joint Planning Commission Meeting. As a quorum was established the following members were present, Chairman Steve Carpenter, Vice-Chairman Pete Elliott, Commissioners Nathan Cowan, Zack Whitman, Mike Snider. James Graves III and Jim Smith. Also,present were Hannon Wright; County Attorney, Jonathon Weakley, County Administrator, Secretary of the Planning Commission Janet Henshaw, Allen Nicholls; Zoning Administrator. Assistant County Administrator Brian Gordon was absent. Chairman Clay Jackson and Vice-Chairman Carty Yowell for the BoS were also present. Zoning Administrator Allen Nicholls made an announcement that everyone except Jim Smith needed to complete the mandatory disclosure that Kimberly Turner sent out. Adoption of Agenda Commissioner Nathan Cowan moved to adopt the agenda and Commissioner Zach Whitman seconded. This motion was carried by all members saying "Aye", none opposed. Public Comment New Business Nominating Committee, Election of Officers, Adoption of Bylaws Commissioner Nathan Cowan commented that the Nomination Committee met 01/10/2025 and made a motion to elect Steven Carpenter as Chairman. Commissioner Zach Whitman seconded. County Attorney Hannon Wright questioned if there were any discussions or further nominations. Hearing none. All members voting "Aye" none opposed. Nathan Cowan made to elect Pete Elliott as Vice-Chairman. Commissioner Mike Snide seconded. Hannon Wright questioned whether there were any discussions or further nominations. Hearing none. Adoption of Minutes- January 8h,2025 Commissioner Nathan Cowan moved to adopt the minutes and Commissioner Mike Snider seconded. This motion was carried by all members saying "Aye", none opposed. B. No. SU-12-01) Hoffner, Amanda - Quietude Dog Boarding (First Workshop) Ms. Amanda Hoffner has applied for a Special Use Permit to operate a Dog-Boarding Kennel on her property located at 227 Jacks Shop Rd and further identified as Madison County Tax Map parcel 62-9L. The subject parcel is 30.268 acres and is zoned A-1. The applicant has proposed modifying existing buildings to meet the needs of her business. Currently, no new buildings are proposed. Zoning Administrator Allen Nicholls stated that we received some public feedback which is included in the packet. There are questions that are reasonable to discuss. Also included in the packet is the SUP for HART for reference, which should be discussed if we would like to add additional conditions. So far conditions have been limited to 25 dogs. Commissioner Jim Smith questioned for council the definition of al kennel? In our ordinance the definition for a kennel state that it's a place designed or prepared to house, breed dogs or cats for sale or compensation. Jim Smith questioned..am Icorrect in reading that...a kennel is a place not an activity? County Attorney Hannon Wright commented..we have our own definition of a kennel in our ordinance, it's ok what the VA Code has in terms of our Zoning Ordinance. Jim Smith questioned if you are operating a kennel under our Zoning and there are no other regulations that then place it under the state since it would then be for compensation. Hannon Wright stated...I welcome the applicant to make sure she is of the understanding. Ms. Hoffner, are required to get a permit? you Applicant Amanda Hoffner replied..not that lam aware of. Hannon Wright questioned..do you get inspected by the state? Ms. Hoffner replied..no. Hannon Wright stated that he would be happy to investigate it before the next meeting. Allen Nicholls stated that he would be happy to have a conversation with our Animal Control Officer the matter to provide more feedback. Greg Cave on Commissioner Mike Snider questioned.. how stringent is VADACS with a smaller operation? Vice-Chairman Pete Elliott questioned.. who will monitor the feces and urine? Allen Nicholls replied... VDH doesn't regulate. Mr. Cave said that it's such a small operation he isn'tconcerned. Pete Elliott questioned if the property was in land use? ? Will you take the portion out of land use? Amanda Hoffner replied... yes, it is in land use, and we will take the kennel portion out. Mike Snider questioned.. will there be a noise barrier? There's more to this than what we are seeing, than what the pictures are depicting. You can take dogs to an outside area, there is a fenced in play area. Amanda Hoffner replied..dogs can go down a channel to two separate lots. Chairman Steve Carpenter commented.. describe the security fencing. Amanda Hoffner replied..iti is horse woven wire. Nathan Cowan questioned..the number of dog's isn't a concern, correct? Allen Nicholls replied..correct, spoke to Mr. Cave in office, he doesn't see an issue. Don't know where the line is drawn to when it's regulated. Nathan Cowan questioned..SUP says 25 dogs, PDRC says 12 dogs? Allen Nicholls commented..25 came up as a proposed threshold. Zach Whitman questioned..you have no animal attacks? Amanda Hoffner replied... have my owner animals and there are no issues. Zach Whitman questioned.. when you were boarding how did you dispose of the animal waste? Amanda Hoffner replied..the Animals Shelter take it to the dump; the dump allows it. Mike Snider questioned..as of now you have 6 spaces, when you have 12 dogs would you put 2 in one space? Amanda Hoffner replied..yes. Mike Snider questioned..not looking at putting another building up, just using what you have and expanding that building? What do you do as far as barking dogs? Amanda Hoffner replied..correct. We have bark collars, or1 they aren't welcome back. Steve Carpenter questioned.Planning on 12 but any expansion would still be within the same barn? Amanda Hoffner replied..yes. Neighbor Austin Griffin commented.nelghbors aren't against it, noise disturbance was an issue, do recall hearing the noise when going to bed at night, consider attaching conditions regarding the noise. I want to make sure it's done right. Neighbor Richard Wernig commented..our issue would be the noise, barking all day long. Changes our quality of life, devalues the property. How could the noise issue be enforced? When one starts barking, they all start barking. Mike Snider commented..the only condition we have right now is the number of dogs. Steve Carpenter replied..that is correct. We are hearing concerns about noise, security and waste removal. Hannon Wright commented..this would qualify as a boarding establishment. Provide adequate food, would have an obligation if an emergency to take them to the vet. Pete Elliott commented..one dog can cause a lot of barking. Do you have the ability to isolate one dog? Amanda Hoffner replied... can close doors/windows. Continued discussions. Mike Snider commented.Detween now and the next meeting, provide more in -depth pictures. Steve Carpenter commented..no noise ordinance and unlikely in the future, not like for a dog ordinance. Voluntary proffers for conditions on the SUP. Nathan Cowan commented..one recommendation. - always can come back its something isn't working. (Case No. RZ -10-30-24-02) Virginia Lawnscapes - Proposed Rezoning (Second Workshop) Michael and Rachel Williams have applied to rezone parcel 55-351 from A-1 (Agriculture) to B-1 (Business). The rezoning application comes because of a Notice of Violation issued by Zoning Administrator on June 11, 2024. The applicants use the subject parcel to garage landscaping equipment. The subject improvements are accessory use to the applicants' service business, which is allowable in B-1 zoning, but not A-1 zoning. Allen Nicholls commented.nothing has changed since the last workshop; this simply would bring them into compliance with our ordinance. Pete Elliott quesioned.uncondition.t rezoning? Allen Nicholls replied..yes. Nathan Cowan questioned..has this beeni in land use? Allen Nicholls replied..once rezoned it won't be in land use. Nathan Cowan commented..there are commercials spaces around. Allen Nicholls commented..this is appropriate for what they are doing. More rezoning applications will be coming for that area. Pete Elliott commented.. agree, should be B1 zone. No bathroom, what happens if someone needs to use the bathroom? Allen Nicholls replied..that is a matter for the Health Department, if becomes a place of employment, they would have to have at facility for employees. Nathan Cowan commented.at least one building has a concrete floor. Mike Snider commented..two buildings that are there are nice, looks like a business operation. It should be handled in a business way. Not just pick up and drop off, should be required to have a bathroom. Allen Nicholls commented..can get a letter from the Building Official Jamie Wilks. Zach Whitman questioned..this has an easement through to another A1 property; would that be an issue? Hannon Wright commented.would be an issue between the two property owners, not the county. Applicant Michael Williams commented.in the summer we do put a porta john on premises. We have submitted the septic; we will need to pay the fee to the Health Department. An application for rezoning (Case No RZ-04-23-4) was previously approved by the Board of Supervisors in March of 2023 with conditions. As a result, the applicant lost the right to some B-1 uses by proffer. The applicant's business needs have changed, and he is seeking the restoration of all the B-1 by-right uses. Allen Nicholls commented..this is the first workshop, should be familiar with the case that came through a few months ago. The usesi in yellow were proffered away, the green was retained. Just a change in the proffered conditions. Pete Elliott questioned..is this in land use? Applicant Josh Hege replied... never put it in land use. Continued discussions. Josh Hege commented.. would have been sufficient had my business plan succeeded. Glass bottles became 80% of our revenue, China has subsidized a certain industry and swamped the market. Priced way cheaper, that market has disappeared, the need to diversify. Dairy stainless steel is 20%, still strong, and give me freedom to carry a broader range of products. Been talking with shed companies, shipping containers are in high demand. Mike Snider questioned.. will you be paving the access? Josh Hege replied..got a foot of recycled asphalt. The site is located on the west side of Highway 29, just south of Orange Rd. The property contains a total of 3.214 acres and is zoned B-1 (Business). The project, known as. Anabaptist Healthshare Office, is proposing to construct: a new 14,091 square foot office building. Pursuant to Appendix 1 (Zoning), Article 8-1-3, office buildings are a by-right use. 43,554 square feet of earth will be disturbed during construction. Allen Nicholls commented..been working with my office for a while, still waiting on final comments from Culpeper Soil and Water, took them over a year the 40,000 square feeti is 6 square feet short of going to DEQ, they don't want to see if since it is less than an acre. Parking overflows into the adjacent lot, meets the ordinance for parking requirements that way. Mike Snider questioned.. who is the transfer station? Allen Nicholls replied..commentary from Mr. Bain's to move the easement to accommodate. Applicant Al Esh commented..the easement runs through there, just gravel, will tie in pavement to to over to their building. When we go there to start to work, we will create a parking lot at the top to stage material, the plan is to do the septic once the building is 80% finished. Allen Nicholls commented..has been advertised for Public Hearing. Criteria, more than 3 sites require a permit through the Health Department, it doesn't matter if it is for compensation or not.
