* cson Coy Madison, Virginia 22727 Madison County Joint Planning Commission and Board of Supervisors Meeting Minutes January gth, 2025 The Madison County Joint Planning Commission and Board of Supervisors meeting was held in the Madison County Administrative Auditorium at 414 N Main Sti in the Town of Madison, Virginia it was called to order by Chairman Carpenter at 7:00 PM. Chairman Carpenter determined there was a quorum and the first order of business was to adopt the agenda and approve the minutes from the December 18th, 2024 Planning Commission Workshop meeting. As a quorum was established the following members were present; Chairman Stephen Carpenter, Vice-Chairman Pete Elliott, Commissioners: Michael Snider, Jim Smith, James Graves IlI, Zach Whitman and Nathan Cowan. Also, present were Hannon Wright; County Attorney, Jonathon Weakley; County Administrator, Allen Nicholls; Zoning Administrator, Deputy Clerk; Kimberly Turner;Janet Henshaw Secretary for the Planning Commission and Brian Gordon: Deputy County Administrator. For the Bos Chairman Clay Jackson, Vice-Chairman Carty Yowell. Supervisors: Jud Buchannan, Dustin Dawson, and James Jewett were also present. Vice-Chairman Pete Elliott moved to approve the agenda, and Commissioner Nathan Cowan seconded. This motion was carried by all members saying "Aye". This motion was carried by all members stating "Aye". 1) Public Hearings: A) (Case No. RZ-10-30-24-03) Criglersville Elementary School LLC- Conditional Rezoning. Mr. Felix Schapiro is requesting to rezone parcel 21-61 from A-1 to B-1 with conditions. If approved, Mr. Schapiro intends to renovate the Criglersville Elementary School building. Zoning Administrator Allen Nicholls started off the meeting by stating that essentially everything is the same as presented, no changes, there is, however, a great deal of public feedback. Comments that were presented prior to publishing the packet are in the packet. The rest that was received after publishing were printed and are alongside the packet. Most concerns are about the outdoor amplified music. Applicant Felix Shapiro addressed the Board, Planning Commission and the public, he stated that..there is nothing else to truly be said. There is a diversity of opinions, Madison as a whole is supportive of the project. There's complicated social dynamics in a small town. The matter before you is rezoning to B1. am an open book and pleased to answer any questions you may have. Regardless of the outcome, my commitment to being a good neighbor is steadfast. Criglersville is beautiful. By day my job is to develop economic studies. Desire to minimize the scale, come to appreciate why and crucial to protect the quietude of the community. hope to come to a consensus that it works with everyone. Willing to take on a personal commitment to take away the Bradford pears. Allen Nicholls commented.condlitions are voluntary proffered, need to come by him on his own. Vice-Chairman Pete Elliott questioned..any thing that hasn't been proffered we can't ask? Felix Shapiro commented.fiwanted to tweak wording, can I do that during this meeting? County Attorney Hannon Wright replied..if an amendment to a proffer would change, we would have to have a new hearing, can be changed tonight if it isn't a material change. Felix Shapiro commented..weeklay noise currently is to cease at 930 PM, would like to make a shift to one hour after sundown. Reiterate that would not do anything outside of the bounds, would dictate by good sense. Nothing unsightly or unbecoming. Pete Elliott questioned.would you entertain the idea of changing the 11 PM to 10 PM on the weekend? Felix Shapiro replied..my preference is not to do SO as a business manager to dictate how a client spends their wedding, event or recreational time. We will have a well-fitted indoor space, not a lot more to trim in this business model. Commissioner Mike Snider commented..all outdoor amplified music shall cease Sunday through Wednesday one hour after sundown and Thursday through Saturday at 11 PM. County Administrator. Jonathon Weakley questioned..do we have an online presence. Neighbor Samantha Guerry commented..in preparation of the meeting she reviewed the ordinance and the code. You must recognize the ordinance; this application does not comply with the ordinance. Neighbor Jennifer Smith commented.seconds Ms. Guerry. The rezone is not fitting and should be denied. Neighbor Peter Maillet commented.. would like to make two points..1s point being public insinuation is split, the local community that is close to the school are all against this rezoning. 2nd point is...we are a quiet farming community, listen to our voices and deny the request. Neighbor Angela Quinn commented..have not been contacted regarding the plans of the property, sleeps with the windows open, commutes to Richmond, would like the music played to not be past 9 PM. 1 consider this a neighborhood. It is a beautiful venue inside which would be more appropriate for the amplified music. Neighbor Marty McGetrik commented... am directly behind the Criglersville School, I am supportive of him to repurpose if it doesn't interfere with the quietude of the area. Criglersville was once a Mercantile village and over the years evolved to a small neighborhood community. The Cemetery is closer to the venue, it is important to have a quiet area when you are visiting a loved one there. Neighbor Renee Belfour commented.resperctiuly ask to deny the application as it is. Commissioner Nathan Cowan commented.the impact on the community will be relatively minimal. Won't be sO heavily used, don't think it is as bad as we can picture. Recommend to the Bos for approval with changes in proffers. Hannon Wright questioned..Mr. Shapiro are you offering the change? Felix Shapiro replied..yes! Under my own free will. Pete Elliott questioned.Hannon, do you have an opinion that this application is legal? Hannon Wright replied..yes! Pete Elliott seconded the motion. Commissioner Jim Smith commented..need to separate the application from the applicant. Should have been B1 zoning all along, noise is going in, children went to school there. B1 with proffers, puts property back on the tax roll. Chairman Steve Carpenter commented. -goes along with goal two in the Comprehensive Plan, this is specifically talked about. Arterial road near the community, not a nuisance factor. Aye: Jim Smith, Steve Carpenter, Nathan Cowan, Zach Whitman, Mike Snider and Pete Ellliott. Opposed: James Graves II There were no other or public comments. B) (Case No. 2024-S0A-12-18-01) Amendment to BLA Ordinance. The definition of a Boundary Line Adjustment (BLA) is proposed to be modified to alter the platting requirements. This amendment is proposed to protect the public from undue costs associated with BLAS. Allen Nicholls commented.the language is the same as the workshop. No proposed changes currently. Steve Carpenter commented..this change is appropriate. Pete Elliott motion to recommend to the BoS for approval. Mike Snider seconded. Aye: James Graves III, Jim Smith, Steve Carpenter, Nathan Cowan, Zach Whitman, Mike Snider and Pete Elliott. None opposed. There were no other or public comments. Other Items from the Planning Commission, Staff, or Public -Disclosure of Real Estate Holdings -Planning Commission Members are required to file the Disclosure of Real Estate Holders per S 2.23115 (G). C) (Case No. RZ-10-30-24-01) Hege, Josh - Recovery of By-Right Uses (First Workshop). Mr. Josh Hege is seeking to recover the by-right B-1 (business) uses of his property located on Seminole Trail, Tax Map number 32-102. An application for rezoning D) (Case No RZ-04-23-4) was previously approved by the Board of Supervisors in March of 2023 with conditions. As a result, the applicant lost the right to some B-1 uses by proffer. The applicant's business needs have changed, and he is seeking the restoration of all the B-1 by- right uses. E) (Case No. RZ -10-30-24-02) Virginia Lawnscapes = Proposed Rezoning (Second Workshop) Michael and Rachel Williams have applied to rezone parcel 55-351 from A-1 (Agriculture) to B-1 (Business). The rezoning application comes because of a Notice of Violation issued by the Zoning Administrator on June 11, 2024. The applicants use the subject parcel to garage landscaping equipment. The subject improvements are accessory use to the applicants' service business, which is allowable in B-1 zoning, but not A-1 zoning. F) (Case No. SU-12-01) Hoffner, Amanda = Quietude Dog Boarding (Second Workshop) Ms. Amanda Hoffner has applied for a Special Use Permit to operate a Dog-Boarding Kennel on her property located at 227 Jacks Shop Rd and further identified as Madison County Tax Map parcel 62-9L. The subject parcel is 30.268 acres and is zoned A-1. The applicant has proposed modifying existing buildings to meet the needs of her business. Currently, no new buildings are proposed. G) (Case No. 2024-ZOA-12-18-02) Adoption of Personal Campground definition (Second Workshop) The adoption of a definition for a personal campground is being proposed to allow for by-right recreation on private property but regulate the use of recreational vehicles (RVs) and tents to prevent their use as permanent residences. Samantha Guerry commented..the application not legally written the way it is written; nuisance noise is not allowed. There were no other or public comments. There being no other business, Commissioner Nathan Cowan made a motion to adjourn, and Commissioner Zach Whitman seconded. This motion was carried by all members saying "Aye".
