Whitlow, County Administratph Well Planned Growth BACKGROUND: Franklin County has an Emergency Operations Plan (EOP) that was last adopted by the Board of Supervisors in 2022, and has recently been the subject of review. The current EOP stipulates that the Board of Supervisors shall declare by resolution an emergency to exist whenever the threat or the actual occurrence of a disaster is or threatens to be of sufficient severity and magnitude to require significant expenditure and coordinated response to prevent or alleviate damage, loss, hardship, or suffering. A local emergency may be declared by the Director of Public Safety/County Administrator with the consent of the local governing board. If the governing body cannot convene due to the disaster or other exigent circumstances, the director/administrator shall declare the existence of an emergency, subject to the confirmation by the governing Board of Supervisors within 45 days of the declaration or the next regularly scheduled Board of Supervisors meeting, whichever occurs first. Any declaration of a local emergency will be reported to the Virginia Emergency Operations Center. DISCUSSION: On February 13, 2025, a declaration of a local emergency was enacted by the County Administrator, with the concurrence of the Director of Public Safety, to assist county agencies in responding to the effects of a winter storm that brought snow, heavy ice, freezing rain and high winds resulting in numerous downed trees and powerlines, road obstructions and widespread power outages across the County. County staff, including, but not limited to, Public Safety, and volunteers worked tirelessly with Emergency Management, the Department of Forestry, VDOT and other local agencies to assist with remediation. Code of Virginia Section 44-146.21, and the County's adopted EOP, requires that following a declaration of a state of emergency, the local Board of Supervisors must affirm the actions taken. RECOMMENDATION: County staff respectfully recommend that the Board of Supervisors affirm the State of Emergency Declaration declared on February 13, 2025, ending on March 18, 2025. One of those necessary life-saving services is cardiac care. To provide this service EMS providers utilize cardiac monitors and ventilators to assist with patient care. Each ambulance in the system is equipped with a cardiac monitor to aid in life-saving diagnosis and care of the patient. The majority of the current monitors are older and have exceeded their useful life and period of support. These monitors are critical to the care provided by the emergency responders. Having reliable means to diagnose and treat patients in need of cardiac care is an essential piece of technology that supports public safety. DISCUSSION: Currently we have seven (7) Stryker Lifepak cardiac monitors that are beyond their service life with three (3) more reaching the end of their service life within a year. Keep in mind that Public Safety operates seven (7) frontline ambulances and two (2) supervisor ALS intercept vehicles, this means that all the front-line ambulances and supervisor monitors are beyond the service life and are no longer supported for maintenance repairs. The two major companies that provide cardiac monitors for EMS, ZOLL and Stryker, have redesigned their monitors and are completely different from anything in the past. Franklin County Fire and EMS contacted both companies in order to have current ALS providers utilize the new monitors on a trial basis to understand the differences of the new products being provided. At the end of the trial period, it was discovered that It would be very difficult for our providers to utilize multiple different systems to provide proper patient care. Furthermore, the disposable supplies, batteries and charging systems are different regardless of manufacturer, meaning that supply renewal and stocking will pose a challenge without changing over. all the frontline monitors at one time. At the end of the trial period, with extensive use and feedback from the ALS providers, the decision to move forward with ZOLL medical was overwhelmingly positive. The monitors will allow for a more advanced care for the critical patient increasing survivability as it is the only monitor that provides real-time feedback during cardiac arrests so providers can quickly adjust to substandard care. In addition, the purchase of the ZOLL monitors would also provide supervisors with the ability to playback patient trends and educate our providers to ensure improvements in patient care through post care reviews and training. With the purchase and implementation of two (2) portable Z Vent Portable ventilators, treatment of patients with COPD, CHF and many other illness's would be far advanced from our standard practice. These ventilators would give providers the ability to provide crucial critical care for positive patient outcomes. Whitlow, County Administrator Well Planned Growth BACKGROUND: Health insurance benefits are renewed on an annual basis based on claims experience of the prior year. During this renewal period, the new premium rates are proposed from the insurance carrier. The County's insurance consultant, Pierce Group Benefits, negotiates on the County's behalf to get the best rate possible. Typically, a request for proposals (RFP) is issued at least every 5 years for State and County procurement guidelines. It has been 5 years since health benefits were last procured, sO County staff worked with Pierce Group to issue an RFP for the County's health insurance benefits. Two responses to the RFP were received from Anthem and Sentara. By going through the RFP process, the intent is to realize some savings from a typical annual renewal. DISCUSSION: During the last year, the County has had another significant year of claims experience. Anthem, the County's current provider, proposed a 15% increase in premiums, and they were the lowest respondent. Sentara proposed a 16% increase in premiums. As a reminder, the County incurred premium increases of 24.9% and 7.6% for fiscal year 2024 and 2025, respectively. The County was able to absorb both the employer and employee increases to the premiums in both of those fiscal years. However, due to budget constraints, that will not be possible for FY 2026 under the current proposal. In the proposed FY 2026 budget, funding was included to share the increase with employees by the County picking up 75% of the premium increase and passing along 25% of the increase to the employee. This still results in some sizeable premium increases for the County and employees. As such, staff requested the Pierce Group to explore and examine any alternatives that may be available outside the realm of the recently submitted proposals. The Pierce Group met with staff on Wednesday, March 12th and shared a possible option for the County to consider. The Commonwealth of Virginia operates a state-run pooled insurance program among various localities and state agencies, better known as: The Local Choice (TLC). The Pierce Group reached out for a TLC quote consideration, but the quote was not received in time to consider before the FY. 2026 proposed budget. Fortunately however, Pierce has now obtained a quote from TLC where our consultants are analyzing both the plan services, as well as costs. TLC is a cost-sharing pooled program managed by the State Department of Human Resource Management where localities may choose to participate. Much to staff's pleasant surprise, TLC has offered a reduction of -4.8% as opposed to a 15% increase that the County obtained through the Anthem proposal. TLC functions similar to any insurance program where providers are procured through a competitive process. Currently, Anthem is the TLC coverage provider offering similar coverage and plan services as the County's existing plan. Staff, along with Mr. Gray Hooker, Senior Vice President with Pierce Group Benefits, will review with the Board the health insurance RFP results along with the quote recently received from TLC. There are benefits and challenges to each option. For example, TLC rates also include dental and vision benefits. The Pierce Group and staff will look to review all proposals, answer any questions, and seek to obtain feedback in awarding the insurance contract to Anthem as submitted and/or consider the most recent proposal opportunity from The Local Choice (TLC) option. RECOMMENDATION: Staff respectfully requests the Board of Supervisors consider both insurance options and select the benefit options for fiscal year 2026. The other structure addressed on the property is a detached garage but is not anticipated to be used as short-term rental. The property is located on a secondary state-maintained road and has a flat, level driveway that would provide ample parking. The water supply is a well and the sewer supply is a septic system. The closest residence is approximately two hundred and two (202') feet from the proposed short- term rental located at 105 Smith Road. Patricia Brown and John Balfour stated in their letter of application that they plan to rent the two (2) bedrooms in the basement level of the home. Ms. Brown and Mr. Balfour will live on the main level of the home. The application was advertised, site posted, and notifications sent to all adjacent property owners. The Development Review Team (DRT) reviewed the application at its January meeting. AEP, VDH, VDOT and other agencies had no comments or concerns due to the nature of the application. Prior to the Planning Commission public hearing, staff received two (2) phone calls from an adjoining property owner inquiring about the application. COMMISSION'S RECOMMENDATION At the end of the staff presentation, and applicant comments, there was a period for citizen comment. Mr. Charles Poindexter, property owner, spoke on behalf of several citizens who own property within the area stating he owns a farm nearby on Crafts Lane and stated his objection to the application for the special use permit. He indicated that this area is harmonious, and a short- term rental would violate the low density of single-family homes. He stated that the detached garage has two floors as well as the home and could easily have three (3) short-term rentals which could cause an issue with the septic if there is an apartment in the detached garage. He stated concerns regarding noise, trash, etc. and that there are seven (7) active farms along this road that do not want trash in their fields. He indicated there are hilltops and places on Smith Road that do not have visibility; with farm tractors, this could pose a problem with drivers passing. He stated that, if approved, this short-term rental would end up with Airbnb under property management. He also stated COWS escaping out into the road and getting hit by someone that is short-term renting and what recourse the owner ofthe COWS would have. Mr. Balfour, the owner, stated that they are aware of all the prior issues with noise, etc. from previous owners. He indicated that there are two (2) septic systems and two (2) wells on the property. He responded in answer to the property manager's statement stating that he and Ms. Brown would be the property managers because they occupy the home full-time. After the period of public comment, the Planning Commission then began their deliberations. Mr. Victor Evans asked the owners if they received the staff report and were aware of the conditions. Mr. Balfour stated yes; they did receive the staff report and agree to the conditions. Mr. Evans asked where they would be living in the home, Mr. Balfour stated they would be living in the home full-time. Mr. Ron Jefferson asked if there was a separate septic system for the detached garage apartment or ifit was tied to the existing septic system for the home. Franklin County Planning Commission BACKGROUND The property is located at 105 Smith Road (Route 913) and is zoned A-1, Agricultural. The property consists of approximately 5.08 acres. The parcel is identified as Parcel ID # 0460008900 in the Union Hall election district. This is the only dwelling located on the parcel and where the short-term rentals are proposed to take place. The property is located on a secondary state-maintained road and has a flat, level driveway that would provide ample parking. The water supply is a well and the sewer supply is a septic system. The closest residence is approximately two hundred and two (202') feet from the proposed short-term rental located at 105 Smith Road. According to County records, the dwelling is a one-story single-family residence constructed in 1990 and consists of three (3) bedrooms and two (2) full bathrooms and has a total living area of approximately 1,504 square feet. In 1988, the septic permit report was issued by the Virginia Department of Health for a three (3) bedroom home. The other structure addressed on the property is a detached garage but is not anticipated to be used as short-term rental. Patricia Brown and John Balfour stated in their letter of application that they plan to rent the two (2) bedrooms in the basement level of the home. Ms. Brown and Mr. Balfour will live on the main level of the home. The applicants/owners stated they would not anticipate renting short-term would cause any changes in the surrounding area. Economic Development Goals, Objectives, and Strategies (page 11-6) Objective 11.0: Promote and expand the tourism industry within Franklin County. Strategy 11.0 b: Encourage the development of infrastructure that supports tourism (.e. lodging, restaurants.) Comprehensive Plan Summary By increasing the stock of short-term rentals within the county, the Comprehensive Plan's economic strategies 11.0 and 11.0b would be met. While short-term rentals do include commerciallusiness transactions, the inherent nature of a short-term rental is typically not any more intense than that which would be expected if the single-family dwelling was occupied full-time. With this consideration, as well as those mentioned above, the Comprehensive Plan would support the short-term rental of this property, with the conditions recommended in this staff report. ZONING ORDINANCE: Special uses for the A-1 district are set forth in Section 25-179. The requested use is referenced as short-term tourist rental of dwelling. Sec. 25-638 oft the Zoning Ordinance sets forth the County's authority to issue special use permits for certain uses. In order to issue a special use permit, the Board of Supervisors must find that such use will not be a substantial detriment to adjacent properties, that the character of the zoning district will not be changed thereby, and that such use will be in harmony with the uses permitted by-right in the zoning district, and with the public health, safety, and general welfare to the community. Sec. 25-640 of the Zoning Ordinance sets forth the County's authority to impose conditions for the issuance of special use permits. The ordinance states that the Board of Supervisors "may impose upon any such permit such conditions relating to the use for which such permit is granted as it may deem necessary in the public interest. : 3 Conditions associated with a special use permit must be related to the particular land use which required the permit and must be related to some impact generated by or associated with such land use. SPEC12-24-18173 January 31.2025 Franklin County Planning Commission Sec. 25-641 of the Zoning Ordinance states that a special use permit shall expire eighteen (18) months from the date ofissuance if "no commencement of use, structure or activity has taken place. 1 The ordinance states that "commencement" shall consist of "extensive obligations or substantial expenditures in relation to the project, " including engineering, architectural design, land clearing, and/or construction. Section 25-138 and Section 5.5-72 of the Zoning Ordinance outlines requirements for operation of short-term rentals in Franklin County as follows: Sec. 25-138. - Short-term tourist rentals. The following general regulations apply to all short-term tourist rental of residential dwellings: (a) The use oft the dwelling unit for short-term rentals shall be primarily. for residential purposes related to tourism or vacationing. (b) There shall be no change in the outside appearance ofthe dwelling or premises, or other visible evidence ofthe conduct ofsuch short-term rentals. (c) There shall be no more than two (2) adults per bedroom occupying the dwelling at any one time. An adult, for the purpose ofthis regulation, is any person over the age of five (5). The number of bedrooms in dwellings relying upon septic tanks and drainfields for sewage disposal shall be determined by reference to health department permits specifying the number ofbedrooms for which the supporting system was designed. (d) All vehicles of tenants shall be parked in driveways or parking areas designed and built to be parking areas. In the case of multifamily dwellings, all vehicles must be parked in spaces specifically reservedfor the dwelling unit being rented. (e) All boats of tenants shall be parked on the lot on which the dwelling is located. ANALYSIS In accordance with Section 25-638, the proposed special use permit is evaluated to determine ifi it will be a substantial detriment to adjacent properties, change the character of the zoning district, and be in harmony with the uses permitted by-right in the zoning district, and the public health, safety, and general welfare to the community. SPIEC-12-24-18173 January 31.2025 Franklin County Planning Commission With Franklin County (including the Town of Rocky Mount and Smith Mountain Lake) being a prime vacation destination, the proposed use would expand temporary lodging options, where guests can visit and enjoy the amenities and recreation within the County. In addition to extra lodging, short-term rentals will continue to drive tourism and add economic value to the County. The single-family dwelling can be rented to a maximum of four (4) adults according to the septic permit that was issued by the Virginia Department of Health for three (3) bedrooms. The applicants/owners of the property are living above the short-term rental and proposing to rent the basement area of the home. The property has single family dwellings on each side. The majority of the properties consist of lot sizes from 5 acres or larger. The property with the proposed short-term rental and other properties located on each side are wooded in nature, which helps with screening between the properties. The properties across Smith Road are large and open mostly. The property has a flat, level driveway which would provide ample parking. The traffic generated by this short-term rental would be similar to what is generated by a single- family dwelling that is not rented. The noise of the rental should not be more than normally expected in a residential neighborhood. The applicant will be required to conform to all conditions pertaining to the special use permit, all criteria listed under Section 25-138 and Section 5.5-72. Given these requirements, staff concludes that the proposed use will not be a substantial detriment to adjacent properties, change the character of the zoning district, and will be in harmony with the purpose and intent of this chapter, and with the uses permitted by right in the A- 1 zoning district. Whitlow, County Administrator Conserve & Promote Natural Assets S MM Well Planned Growth BACKGROUND: In order to meet the additional needs for capital items for volunteer fire departments like equipment and building needs, the County established a volunteer capitai grant program initially through the allocation of year end carry over funding. In last year's budget, the Board approved an additional $50,000 for the volunteer fire capital grant program. The Board also approved an additional $30,000 to also provide a volunteer rescue grant program to aid the County's rescue agencies. DISCUSSION: The Franklin County Volunteer Fire Association President, Morris Ledbetter, presented the County with a list of projects proposed to be funded through the grant program on March 12th (see attached). The list includes capital needs from several the volunteer fire stations and includes items like turnout gear, air pack bottles, etc. The requests total $58,122.42 as follows: Boones Mill VFD: $3,367.90 Burnt Chimney VFD: $11,680.00 Callaway VFD: $9,911.09 Ferrum VFD: $9,068.99 Fork Mtn VFD: $9,737.40 Glade Hill VFD: $3,249.20 Henry VFD: $11,107.84 Per the Board's previous direction, these requests have not been reviewed by Public Safety staff. The grant proceeds were not fully expended in previous years sO the total balance in the account is now at $84,376. The remaining balance after the current requests would be $26,253.58. In the email communication, the fire association has requested any additional balance in the account be allocated for volunteer training activities however no cost details have been provided. This grant program was designed for capital needs of the volunteer agencies however the Board has given previous approval of some funds to the association to use funds for training purposes. Mr. Ledbetter is expected to be present at the March 18th meeting to answer any questions pertaining to these requests on behalf of the association. RECOMMENDATION: Staff has not reviewed these requests but respectfully requests that the Board of Supervisors approve the proposed capital expenses presented by the volunteer fire association in the amount of $58,122.42 as there is adequate funding available. For the reimbursement of these funds to be provided, proper documentation regarding the purchases will need to be provided to the County Finance Department.
