In Re: Resolution 25-43, Greensville County Board of Supervisors Supporting Operation Green Light of Veterans Mr. Gary Cifers, Assistant County Administrator, presented Resolution 25-43 for the Board's consideration. RESOLUTION 25-43 SUPPORTING OPERATION GREEN LIGHT FOR VETERANS WHEREAS, the residents of Greensville County have great respect, admiration, and the utmost gratitude for all the men and women who have selflessly served our country and this community in the Armed Forces; and WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in maintaining the freedoms and way ofl life enjoyed by our citizens; and WHEREAS, Greensville County seeks to honor individuals who have made countless sacrifices for freedom by placing themselves in harm's way for the good of all; and WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars, religious groups, civil service, and by functioning as County Veterans Service Officers in 29 states to help fellow former service members access more than $52 billion in federal health, disability and compensation benefits each year; and WHEREAS, approximately 200,000 service members transition to civilian communities annually; and WHEREAS, an estimated 20 percent increase of service members will transition to civilian life in the near future; and WHEREAS, studies indicate that 44-72 percent of service members experience high levels of stress during transition from military to civilian life; and WHEREAS, active military service members transitioning from military service are at a high risk for suicide during their first year after military service; and 4 WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize Operation Green Light for Veterans; and WHEREAS, Greensville County appreciates the sacrifices of our United States military personnel and believes specific recognition should be granted; THEREFORE, BE IT RESOLVED, with designation as a Green Light for Veterans of Greensville County hereby declares from November 4, 2024, through Veterans Day, November 11th 2024, a time to salute and honor the service and sacrifices of our men and women in uniform transitioning from active service; and THEREFORE, BE IT FURTHER RESOLVED, that in observance of Operation Green Light, Greensville County encourages its citizens in patriotic tradition to recognize the importance ofhonoring all those who made immeasurable sacrifices to preserve freedom by displaying green lights in a window of their place of business or residence from November 4th through November 11th, 2024. All the veterans present were asked to come forward to be recognized by the Greensville County Board of Supervisors. In Re: Public Hearing Chair Brown recommended the Board of Supervisors convene in Public Hearing. Protocol for speaking during Public Hearing: The Greensville County Board of Supervisors had developed a protocol to ensure that Board meetings and Public Hearings were productive and efficient, and that proper decorum was maintained. The Board of Supervisors wanted to emphasize that this protocol was intended to make the Board meetings and/or public hearings as productive as possible. The protocol is as follows: 1. Each speaker will be given three minutes to address the Board ofSupervisors. The time limit will be strictly enforced. 2. Each speaker will be advised when two minutes have elapsed. 3. Each speaker will be advised when three minutes have elapsed. 4. After all comments have been made by speakers at the public hearing, the applicant will be afforded three minutes to respond to comments made during the public hearing. 5. Each speaker will be permitted to address the Board ofs Supervisors only once, i.e., the three-minute opportunity to speak cannot be transferred from one speaker to another. 5 6. Speakers should face the Board ofSupervisors and address their comments to the Board of Supervisors, and not to others who are present at the meeting. Speakers should not turn to face and address members of the audience. 7. The Board of Supervisors is conducting the citizens' comments period and/or public hearing to receive comments from interested parties. Public Hearing: SP-7-2024 Otter Haven RV Resort Supervisor Astrop moved, seconded by Supervisor Conwell, to convene in Public Hearing: SP-7-2024 Otter Haven RV Resort as recommended by Chair Brown. A roll call vote was taken as follows: Supervisor Astrop, aye; Supervisor Cain, aye; Supervisor Conwell, aye; and Chair Brown, aye. Mr. Lin Pope, Director of Planning, presented SP-7-2024 Otter Haven RV Resort for the Board's s consideration. Mr. John Franklin, Co-Founder of Otter Haven RV Resort, presented a PowerPoint presentation on the project. This is a family-owned and operated business by Mr. Franklin, as well as his partners Mrs. Melinda Franklin, Mr. Tony Christopher and Mrs. Tricia Christopher, all residents of Greensville County. The request is for a special use permit to establish a RV Resort to consist of 83 oversized lots, 10 cabin sites, a clubhouse with swimming pool, retail store, restaurant, dog park, recreational room, playground, ball courts and nature trail. The resort will be operated 7 days per week, 24 hours per day, with management on site the entire time. The subject property consists of32.10 acres and is Zoned A-1. This location will provide 25 full-time jobs, and an opportunity for employment for youth during the summer. months. The construction of this project will be in three phases: Phase I (years 1-3) = Construction of Maintenance Building, Site Offices, Check Building, RV Lots 1-27, Clubhouse w/Pool; Provisional Store, Laundry Facility, Dog Park, Dog Wash Kiosks, Nature Trail, Landscape screening; Refuse Disposal Site Phase II (years 2-5) Construction of Recreation Building, RV Lots 28-66, Playground/Ball Courts, Propane Filing Station; Bathhouse 6 Phase III (years 3-6)- Construction of Restaurant, RV Lots 67-83, 10 Cabin Sites, Golf Cart Storage Building Supervisor Conwell asked about the timeline for this project and if the Resort would be open before Phase III is completed. Mr. Franklin stated that Phase I construction will be completed within three years and the Resort will be operational. Supervisor Conwell asked about permanent parking at the Resort. Mr. Franklin stated that there will not be permanent parking for guests. However, there will be permanent parking for the maintenance staff. Supervisor Conwell asked if there was a timeframe for guests to park their RVs. Mr. Franklin stated that because the Resort is seasonal, the maximum length of stay will be 3 months. Permanent structures such as decks will not be allowed. Construction workers may be granted an exception for large construction projects. Supervisor Conwell expressed his concerns regarding the RV Resort turning into a mobile home park, the six-year timeframe to complete the construction ofthe Resort, and how the County will monitor the completion of each phase of the project. Mr. Pope advised that one of the conditions as stated in the Planning Commission's Report is that the applicant must submit final site plans and obtain site plan approvals. The site plans will be reviewed by the Greensville County Building and Planning Departments, the Greensville County Water and Sewer Authority and the Virginia Department of Transportation. Further, County staff will conduct required in-person inspections of all phases. Supervisor Conwell asked how would the County monitor the permanent stays at the RV Resort. Mr. Pope advised that a condition can be added for the owners to provide a monthly or bi- monthly list of RVs at Otter Haven Resort to the Planning Department with the length of stay. Supervisor Cain asked how many staff will be at the location full-time. Mr. Franklin stated that the State requires the Resort to have a person on staff 24 hours per day during and after business hours. There will be at least four staff members present each day for the duration of construction. Supervisor Astrop asked what would a citizens see as they drive past the RV Resort. Mr. Franklin stated that citizens would see a row of evergreen trees and a large beautiful entrance. Supervisor Conwell asked what will be the timeframe for planting the trees. Mr. Franklin stated that there is a 6 feet height requirement for planting ofthe evergreen trees. The following spoke during the Public Hearing: Mr. Clint Slate, 103 Beech Tree Lane, Emporia, Virginia, expressed his support ofthe Otter Haven RV Resort Project. 7 Return to Regular Session: Chair Brown recommended the Board of Supervisors return to Regular Session. Supervisor Astrop moved, seconded by Supervisor Conwell, to return to Regular Session. Action Resulting from Public Hearing: Supervisor Astrop moved, seconded by Supervisor Cain, to approve SP-7-2024-Otter Haven RV Resort with an additional condition to be added for the owners to provide a monthly or bi-monthly list ofRVs at Otter Haven Resort to the Planning Department with the length of stay. Public Hearing: SP-8-2024 Automotive and Truck Repair Facility Supervisor Astrop moved, seconded by Supervisor Conwell, to convene in Public Hearing: SP-8-2024 Automotive and Truck Repair Facility as recommended by Chair Brown. A roll call vote was taken as follows: Supervisor Astrop, aye; Supervisor Cain, aye; Supervisor Conwell, aye; and Chair Brown, aye. Mr. Lin Pope presented SP8-2024 Automotive and Truck Repair Facility for the Board's consideration. The Applicant wishes to construct an automotive and truck repair facility within an existing accessory structure located at 1977 Purdy Road, Emporia, Virginia. Mr. David Smith, Jr, Applicant was present ifthere were any questions. Supervisor Astrop asked ift there would be additional vehicles located outside of the repair facility. Mr. Smith stated, "No." There was no one signed up to speak during the Public Hearing. Return to Regular Session: Chair Brown recommended the Board of Supervisors return to Regular Session. In Re: Items with Appointments = CSX Liberty Road Railroad Crossing Mr. Randy Marcus, CSX Director of State Relations for the regions of Virginia, West Virginia and Washington D.C., stated that local and state governmental representatives recently asked CSX to consider ways to improve access and limit stopped trains at the Liberty Road highway- rail grade crossing while the necessary alternative road access solution is advanced. In response to the request to provide safer access to Liberty Road, CSX will implement the following: CSX Operations has advised their dispatchers and crews to not stop trains on the crossing and hold stopped trains south ofLiberty Road when possible. CSX expects this operational change to mitigate the frequency and duration of stopped trains blocking Liberty Road as it is implemented in the coming weeks. In addition to the 30 daily trains moving over the crossing, sometimes slowly, operational conditions, track and infrastructure maintenance or other unforeseen circumstances may cause Liberty Road to be blocked. An alternative access point is a necessary solution to guarantee access in all situations. Several weeks prior to the work, a CSX contractor will notify road authorities, local governments, public safety agencies, school districts and other entities ofthe planned dates and crossings to be closed. This allows for coordination with local agencies on public notifications, alternative traffic routing, and identifying and mitigating impacts of unique situations, including where alternate access is not available. To improve coordination and communication with local authorities and the community moving forward, CSX will work to provide more than the typical 3-4 week notice when system maintenance activities will require closure ofl Liberty Road. IfLiberty Road is blocked in an emergency situation, citizens should contact the CSX Public Safety Coordination Center (PSCC) whose number is clearly posted on the crossing gates on each side ofthe crossing. The PSCCis CSX's equivalent of911 emergency call center, which can connect with CSX employees on the ground and local first responders to address the situation. Mr. Marcus stressed the importance of the safety of the communities where CSX operates and appreciates the stakeholders' collaborative approach to addressing the situation and bringing this situation to their attention. Dr. Charlette T. Woolridge, County Administrator, thanked Mr. Marcus for CSX's efforts to address the Liberty Road concerns. Supervisor Astrop asked if half ofthe road could be closed during maintenance instead of the entire road. Mr. Marcus stated that during maintenance, the road will need to be closed. However, if access is needed due to an emergency, CSX will provide an alternate access by placing rocks at the location, In Re: Verizon Broadband Mr. Brian Henshaw, Verizon Local Manager of Network Operations, shared a PowerPoint presentation on the Verizon Broadband project. Verizon was awarded $2,956,774.80 in Virginia Telecommunication Initiative Funds (VATI) to provide broadband service to 1,347 underserved addresses in Greensville County. The original anticipated completion date for this project was April 3, 2025. However, the project is ahead of schedule and may be completed this calendar year. Supervisor Astrop asked how citizens will be notified when broadband services are available. Mr. Henshaw stated that citizens may visit the Verizon website to check the status in their area. Also, once the work is completed citizens will receive information in the mail. In Re: Road Matters Report There was no representative present from Virginia Department ofTransportation (VDOT). The following report was submitted for review. Completed Work for September, 2024 Crews addressed 21 customer service work orders and 45 scheduled work orders. Crews continued shoulder-pulling operations on several routes in preparation and started ditching for 2025 paving. Crews performed asphalt patching on multiple routes and installed new cross pipes. Crews performed ditching operations on Brick Yard Road. Crews performed spot litter removal and animal removal county-wide. Crews prepped snow equipment for the 2024 and 2025 winter season. Crews replaced cross pipes on Gaston Road. 10 Scheduled Work for October, 2024 Area Headquarters crews will continue to address shoulder and ditch operations on the proposed pavement routes for 2025. Area Headquarters will address several Cross pipes on Pine Log Road. Area Headquarters will continue to address customer service work orders as received. Area Headquarters will continue to address dead animals and spot litter removal county-wide. VDOT continues to address several concerns brought to us by the Greensville County Board ofSupervisors. In Re: Emporia/Grensvlle Recreation Association (EGRA) Update Mrs. Chelsea Thorpe, EmporiaOreensville Recreation Association (EGRA) President, provided an update on the status ofEGRA and thanked the Board ofSupervisors fort their continued support. Mrs. Thorpe stated that EGRA will plan to attend the Board of Supervisors meetings quarterly and provide updates regarding their programs throughout the fiscal year. Mrs. Thorpe provided the following updates: Soccer and football seasons have concluded with an 80% participation rate across all age groups. The Soccer Program was commissioned by Andy Jones. There was a total of31 participants in the Soccer Pee Wee League, 3 - 4 years old; 125 participants in the 5 - 18 years old. The Varsity EGRA Football Team was named playoff runner up and the James River Regular Season Champions. The football program was commissioned by Ashley Brown. The softball team had a total of20 participates. This sport was commissioned by Rebecca Moss. Gabrielle Powell will commission the Basketball Program this year. She is working to secure gym space for practices with the schools and the YMCA. EGRA has recently hired Jerry Wright as the new groundskeeper. Mr. Eugene Porter, 407 Halifax Street, Emporia, Virginia, with Strong Temple/Hear Me Out Mentoring, thanked the Board of Supervisors for supporting and providing funds towards the purchase of a boxing ring for the boxing event recently held in Emporia, Virginia. The USA Armature Boxing League commended Mr. Porter on the location and how well the event was organized in Emporia. Mr. Lin Pope, presented Resolution 25-42, Monarch Public Utility Line and Public Utility Yard Appeal for the Board' S consideration. Mr. Rob Propes, Senior Development Manager, Urbin Grid, presented a PowerPoint presentation regarding the Monarch project. Urbin Grid is seeking 2232 approval for a utility line and public utility yard to interconnect to Dominion Energy's existing transmission network. The proposed infrastructure is similar to what already exists throughout the County including within the area where the utility yard is proposed to be constructed. Supervisor Conwell asked who would own the switching station. Mr. Propes stated that there are two substations at the location, Dominion Energy will own the switching station and adjacent to it, the substation is owned by Urbin Grid. Supervisor Conwell expressed his concern that the proposed substation would allow future solar projects to connect to the trânsmission line. Supervisor Conwell asked Mr. Propes to schedule a meeting with Dominion Energy to provide a deed restriction, or some other document, to prevent any future solar projects to connect to the substation. Supervisor Conwell moved, seconded by Chair Brown, to defer action on Resolution 25- 42, Monarch Public Utility Line and Public Utility Yard Appeal until after Urbin Grid meets with Dominion Energy. In Re: Proposed Ordinance: Congregations Obstructing Streets or Sidewalks Mr. Pope presented the Proposed Ordinance: Congregations Obstructing Streets or Sidewalks, for the Board's consideration. Sheriff William T. Jarratt has requested that the Board of Supervisors consider adopting an ordinance which would prevent persons from obstructing passage across streets or sidewalks in the County. The ordinance would read as follows: Congregations Obstructing Streets or Sidewalks. It shall be unlaful for any, persons to congregate in such a manner as to block, hinder, impede or obstruct the free and ninterrupted, passage ofvehicular o1 pedestrian traffic on the streets 07 sidewalks in the County. Any person who violates the provisions of this section shall be guilly ofa Class 4 misdemeanor. A Class 4 misdemeanor is punishable by a fine of up to $250 and the punishment does not enable imposition of any jail time. A Class 1 misdemeanor is punishable by a fine of up to $2,500 and jail time of up to 12 months. If the Board wishes to adopt the proposed ordinance, the Board is required to conduct a public hearing and determine whether it favors an ordinance which provides for a Class 1 or Class 4 misdemeanor. Supervisor Conwell asked for a recommendation from Sheriff Jarratt. Sheriff Jarratt recommends a Class 1 misdemeanor. 14 Supervisor Astrop asked how the ordinance will affect our farmers who are operating a tractor on the road. ZONING ORDINANCE The subject property is Zoned A-1: Agricultural. A communications tower is a use that is allowed within the A-1: Agricultural District with the issuance of a Special Use Permit by the Greensville County Board of Supervisors. The Agricultural District covers the largest portion of the County which is presently occupied by farms, forests, conservation areas and other types ofrural uses. Itis designed to protect these existing conditions and to encourage only that future development which promotes the preservation of the rural qualities ofthe County. In addition, selected business and industrial uses may be permitted in the district but only when the governing body finds that such development not only enables the rural characteristics of the County to be maintained but is in harmony with the economic development objectives of the County. Article 19 of the Zoning Ordinance was established to provide general guidelines for the citing of telecommunication towers and antennas. The goals ofthis article are to: (i) encourage the location of towers in nonresidential areas and minimize the total number of towers and tower sites throughout the community; (ii) encourage utilization of publicly held lands; (iii) encourage strongly the joint use of new and existing tower sites; (iv) encourage users of towers and antennas to locate them, to the extent possible, in areas where the adversei impact on the community is minimal; (v) encourage users oft towers and antennas to configure them in a way that minimizes the adverse visual impact oft the towers and antennas; and (vi) provide adequate sites fort the provision oftelecommunication services with minimal negative impact on the resources ofthe county. This article: is intended to comply with all federal regulations. COMPREHENSIVE PLAN The Comprehensive Plan recognizes the importance of cellular communications and broadband for emergency services and economic development. In addition, the Comprehensive Plan's Implementation Strategy Section suggests that the County support the siting oftowers and antennas, through code updates as necessary, to improve cellular service and coverage throughout the County. The availability of reliable cellular communication towers is a measure of a community's infrastructure capability. Improved communications, like water and wastewaterimpovements may have a favorable bearing on economic development efforts. STAFF ANLYSIS AND COMMENTS The proposed Telecommunications Tower is critical to Verizon Wireless' goal ofproviding state of the art capacity forits voice and data services in Greensville County, including wireless broadband, along Allen Road (SR 610) near its intersection with Wyatts Mill Road (SR 608) and to businesses and residents in the surrounding area west of Sussex Drive and Blue Star Highway (SR 301), including the Greensville Correctional Center, the Jarratt Water Treatment Plant and Boar's Head plant. There are no other towers or tall structures in the area on which Verizon Wireless is not currently co-located. Because there are no other existing towers or tall structures in the area on which Verizon Wireless could locate its antennas, Verizon Wireless is seeking this special use permit in order to construct and operate the subject Telecommunications Tower. The proposed Telecommunications Tower is designed to accommodate up to five (5) users, including Verizon Wireless. The tower is designed to collapse within the lease area in case of structural failure. Asi indicated in the structural letter from Robert E. Beacom, P.E., S.E., dated May 15, 2024, included with this Application as Exhibit E ("Structural Letter"), the Telecommunications Tower will be designed to collapse within a fifty (50) foot radius at ground level, which. is within the 80-foot X 80-foot lease area, The antenna and/or tower has been designed SO as not to interfere with the county's public safety communications system. Submitted with this application as Exhibit H is a Radio Frequency Interference Analysis Report prepared by EBI Consulting dated September, 2024 ("Intermod Report"). As the Intermod Report indicates, the Applicant's proposed antennas will not cause interference with existing elecommunications devices and will not have a negative impact on the performance ofthe existing radio systems utilized by the County. The applicant'sa application meets the intended requirements ofthe Greensville County Zoning Ordinance. After initial construction, the establishment of a telecommunication tower will not produce any dust, fumes or vibrations that would be nuisances to surrounding properties. Being that the tower is less than 200' in height, the tower will not be marked or lit. Some noise may occur as a result ofwind. The operation ofat telecommunication tower is continuous, but passive. Occasional servicing of ground-based equipment will be necessary which will generate minor vehicular traffic. These adjustments will bej performed by few employees making occasional and irregular visits to the site. Should co-location occur, the activity surrounding the tower will be increased. The degree of activity generated by co-location would be less than any single-family residence even if the tower was put to maximum use. Fiber is the foundation of the broadband solution, but cellular and other wireless technology are important as well. Some rural areas have strict regulations on telecommunication towers that limit the ability to provide service. Zoning regulations should be reviewed and updated, as appropriate, to balance this important community need. Ast technology evolves and new options, such as small cell wireless and neighborhood internet service providers, become available, Greensville County is committed to using innovative solutions to meet the changing needs of the community. Continued partnerships, incentives, and support for additional internet access and cellular service will bolster Greensville's economy and quality of life. Cellco Partnership (d/b/a Verizon Wireless) Special Use Permit Application Telecommunications Tower Site Name: Gypsum Perkins Lane Jarratt, VA 23867 Tax Map Parcel #: 12-46 ("Property") Alton Owen, Jr. ("Owner") Project Narrative Cellco Partnership d/b/a Verizon Wireless (hereinafter "Verizon Wireless" or "Applicant") seeks a special use permit from the Greensville County Board of Supervisors pursuant to Article 19, Section 19-4 ofthe Greensville County Zoning Ordinance for the purpose ofconstructing and operating a 195-foot self-support monopole telecommunications tower with a 4-foot lightning rod, together with related wireless antennas and equipment (collectively, Telecommunications Tower") on an approximately 6,400 square foot portion of the referenced 44.99-acre parcel, which was recently rezoned Agricultural (A-1). A copy of the Applicant's completed Special Use Permit Application Form ("Application"): is included as ExhibitA. The proposed Telecommunications Tower is critical to Verizon Wireless' goal of providing state of the art capacity for its voice and data services in Greensville County, including wireless broadband, along Allen Road (SR 610) near its intersection with Wyatts Mill Road (SR 608) and to businesses and residents in the surrounding area west of Blue Star Highway (SR 301), including the Greensville Correctional Center and Boar's Head plant. As indicated on the aerial network map included with this Project Narrative as Exhibit B ("Network Map"), antennas operating on the proposed Telecommunications Tower, which is depicted with a yellow pin and labeled "Proposed Tower (Gypsum)", will connect with the following sites identified with red pins on the Network Map: (1) antennas on a telecommunications tower labeled "ATC - VZW Collo" approximately 1.68 miles to the northeast; and (2) antennas on a telecommunications tower labeled "ATC - VZW Collo" approximately 2.95 miles to the southeast, Like the networks of other wireless carriers, Verizon Wireless' network of antenna sites is largely based on the use ofe existing towers and tall structures built by Verizon Wireless and other wireless carriers and tower companies. Before determining that a new telecommunications tower was necessary to satisfy its coverage objectives, the Applicant first searched the area around the yellow pin labeled, "Proposed Tower (Gypsum)" on the Network Map, for existing towers and/or tall structures on which it could co-locate its antennas. Verizon Wireless is already operating antennas on the closest telecommunications tower to the northeast and is already operating antennas on one of the two (2) telecommunications towers to the southeast, There are no other towers or tall structures in the area on which Verizon Wireless is not currently co-located. Because there are no other existing towers or tall structures in the search area on which Verizon Wireless could locate its antennas, Verizon Wireless is seeking this special use permit in order to construct and operate a Telecommunications Tower consisting of a galvanized steel self-support monopole tower with related antennas and equipment. Wireless Façility Description As depicted on the zoning drawings ("Zoning Drawings" ) included with this Project Narrative as Exhibit C, prepared by John A. Daughtrey, III, PE, Network Building & Consulting, LLC ("NB&C"), and stamped on September 3, 2024, Verizon Wireless proposes to construct and operate a 195-foot self-support monopole telecommunications tower with a 4-foot lightning rod for a total height of 199-feet above ground level. The proposed Telecommunications Tower will be located within a 50-foot X 50-foot fenced compound within a 6,400 square foot leased area near the center of the Property approximately 1,243 feet 1 off of Allen Road (SR 610). The Telecommunications Tower will be accessed from Allen Road (SR 610) through an existing gravel access drive known as Perkins Lane. The Telecommunications Tower will be screened from view from Allen Road (SR 610) by an existing buffer of mature trees and vegetation and will not be marked or lit. The Telecommunications Tower will operate continuously, twenty-four (24) hours a day, seven (7) days a week, but will be unmanned and will be visited infrequently by a technician for regular service or during service outages. Once construction is complete, the Telecommunications Tower will not generate any noise, vibrations, dust or fumes. Finally, no signage will be posted except as required by the County or the Federal Communications Commission. Compliance with the Greensville County Zoning Ordinance 19-4 - General guidelines and requirements 19-4-1 - Where permitted? Towers, as defined herein, are permitted upon approval by the Board of Supervisors of a special use permit in Agricultural (A-1), General Commercial Business (B-2), and Industrial (M-1) zoning districts subject to the provisions of this section. Towers, as defined herein, are not permitted in any other zoning district. The subject parcel is zoned Agricultural (A-1) and a tower is permitted with a special use permit. 19-4-2 - Principal or accessory use. For purposes of determining compliance with the underlying zoning district's area requirements, antennas and towers may be considered either principal or accessory uses. An existing use or an existing structure on the same lot shall not preclude the installation of antennas or towers on such lot, unless otherwise contained herein. For purposes of determining whether the installation of a tower or antenna complies with district regulations, the dimensions oft the entire lot shall control, even though the antennas or towers shall be located on a leased area within such lots. Towers that are constructed, and antennas that are installed, in accordance with the provisions of this ordinance, shall not be deemed to constitute the expansion of a nonconforming use or structure. There is currently a storage building located on the Property; however, the Property is otherwise undeveloped. 19-4-3 - Inventory ofe existing sites. Each applicant for an antenna and or tower shall provide to the Greensville County Planning Director an inventory ofi its existing facilities that are either within the locality or within five miles of the border thereof, including specificinformation about the location, height, and existing use and available capacity of each tower. The Greensville County Planning Director may share such information with other applicants applying under this ordinance or other organizations seeking to locate antennas within the. jurisdiction ofthe locality; provided, however, that the Greensville County Planning Director shall not, by sharing such information, in any way represent or warrant that such sites are available or suitable. Pursuant to Virginia Code $ 15.2-2316.4:2(A), a locality may not require an applicant to provide proprietary, confidential or other business information, including propagation maps, to justify the need for a new wireless telecommunications tower; however, as indicated above, there are no exiting towers or structures within the search area that could satisfy Verizon Wireless' coverage objectives. 2 19-4-4 Design and lighting. The requirements set forth in this section shall govern the location of all towers and the installation of all antennas governed by this ordinançe. (a) Towers shall either maintain a galvanized steel finish or, subject to any applicable standards of the FAA, be painted a neutral color, SO as to reduce visual obtrusiveness. Dish antennas will be of a neutral, no reflective color with no logos. The proposed tower will have a galvanized steel finish and will not be marked or lit. (b) At a facility site, the design of the buildings and related structures shall, to the extent possible, use materials; colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and surrounding structures. The. Applicant will utilize neutral colored equipment cabinets and will require any co-locators operating on the tower to utilize materials, colors and textures that will blend with natural surroundings. (c) Ifan antenna is installed on a structure other than a tower, the antenna and supporting electrical and mechanical equipment must be of a neutral color that is identical to, or closely compatible with, the color of the supporting structure sO as to make the antenna and related equipment as visually unobtrusive as possible. This provision is not applicable. (d) Towers shall not be artificially lighted, unless required by the FAA or other applicable authority. Iflighting is required, Greensville County may review the available lighting alternatives and shall approve the design that would cause the least disturbance to the surrounding views. As a minimum, all tower lighting shall be shielded as to minimize visibility from the ground. In addition, all antennas and towers shall utilize red beacon type safety lighting, if such lighting is required by any regulation of the U.S. government. Strobe lighting or similar lighting mechanisms shall not be permitted unless specifically required by regulations ofthe U.S. government. As indicated in the TOWAIR Determination, included as Exhibit D ("TOWAIR Determination"), the proposed Telecommunications Tower does not require notice to the FAA and is not required to be marked or lit. (e) No advertising ofany type may be placed on the tower or accompanying facility, or any associated support buildings or structures. There will be no signs installed on the Teleommunications Tower or accompanying facility other than the signage required by the Federal Communications Commission ("FCC") or the County. (f) To permit collocation, the tower shall be designed and constructed to permit extensions to a maximum height of 250 feet. As depicted on Sheet C-2 of the Zoning Drawings, the proposed Telecommunications Tower will be 195-feet tall with a 4-foot lightning rod for an overall height of 199-feet and it will be designed to accommodate up to five (5) users, including Verizon Wireless. 3 (g) Towers shall be designed to collapse within the lease area in case ofstructural failure. As indicated in the structural letter from Robert E. Beacom, P.E., S.E., dated May 15, 2024, included with this Application as, Exhibit E ("Structural Letter"), the Telecommunications Tower will be designed to collapse within a fifty (50) foot radius at ground level, which is within the 80-foot x 80-foot lease area. (h) Accessory facilities or buildings associated with the communication tower or antennas shall not include offices, vehicle storage or outside storage. Acknowledged. 19-4-5 - Federal requirements. All towers must meet or exceed current standards and regulations oft the FAA, the FCC, and any other agency oft the federal government with the authority to regulate towers and antennas. If such standards or regulations are changed, then the owners ofthe antemlas and towers shall bring such antennas or towers into compliance with such revised standards as required. A copy of any FAA, FCC, and other governmental agency approval must be on file before zoning permit approval for the tower or antenna. The proposed Telecommunications Tower will meet or exceed current applicable minimum standards and regulations of the FAA, the FCC, and any other agency of the federal government with the authority and jurisdiction to regulate towers. 19-5 Building codes To ensure the structural integrity of towers, the owner of a tower shall verify in writing that it is maintained in compliance with standards contained in applicable federal, state and local building codes and regulations. Ifsuch standards or regulations are changed, then the owners of the antennas and towers shall bring such antennas or towers into compliance with such revised standards as required. A copy of any FAA, FCC, and other governmental agency approval must be on file before zoning permit approval for the tower or antenna. The proposed Telecommunications Tower will meet or exceed current minimum standards and regulations of all applicable federal, state, and local building codes and regulations. 19-6 Information required. Each applicant requesting a special use permit under this ordinançe shall submit a scaled plan and a scaled elevation view and other supporting drawings, calculations, and other documentation, signed and sealed by appropriate licensed professionals, showing the location and dimensions of all improvements, including information concerning topography, radio: frequency coverage, tower height requirements, setbacks, drives, parking, fencing, landscaping, and adjacent uses. The zoning administrator may require other information to be necessary to assess compliance with this ordinance. Additionally, applicant shall provide actual photographs ofthe site that include a simulated photographic image ofthe proposed tower. 4 The photograph with the simulated image shall include the foreground, the midground, and the background ofthe site. Included as Exhibit C are Zoning Drawings meeting the requirements of Section 19-6. Also included as, Exhibit F are the pictorial representations ("Balloon Test Photos and Photographic Simulations") of the "before and after" views of a balloon floated at the location and height of the proposed Telecommunications Tower taken from a variety of vantage points, together with a map of the locations at which all of the photographs were taken. As the Balloon Test Photos and Photographic Simulations indicate, the design of the Telecommunications Tower and its location on this large parcel buffered by mature trees and vegetation mitigates the potential impact of the Telecommunications Tower in such a way as to cause the least adverse visual effect possible on the environment and its character, and on the residences in the area. 19-6-1 - An engineering report, certifying that the proposed tower is compatible for collocation with the minimum of three users including the primary user; but excluding use under 19-14, must be submitted by the applicant. As depicted on Sheet C-2 of the Zoning Drawings, there is adequate height and space on the proposed Telecommunications Tower for at least five (5) users, including Verizon Wireless. Complete tower design drawings and a full structural report will be submitted with the building permit application. 19-6-2 - The applicant shall provide copies ofits collocation policy. Included with this application as Exhibit G is a copy of the. Applicant's Collocation Policy, which sets for the requirements and existing process in place to allow shared use of the proposed tower by other telecommunications providers. 19-6-3 - The applicant shall provide copies of propagation maps demonstrating that antennas and sites for possible collocutor antennas are no higher in elevation than necessary. Pursuant to Virginia Code $ 15.2-2316.4:2(A), a locality may: not require an applicant to provide proprietary, confidential or other business information, including propagation maps, to justify the need for a new wireless telecommunications tower; however, as indicated above, there are no existing towers or tall structures on which Verizon Wireless could operate its antennas to meet its coverage objectives. 19-6-4 - The antenna and/or tower shall be designed and installed SO as not to interfere with the county's public safety communications system. The applicant shall perform an engineering study to determine the possibility of radio frequency interference with the county system. This study shall accompany the conditional use permit application. Submitted with this application as Exhibit H is a Radio Frequency Interference Analysis Report prepared by EBI Consulting dated September 2024 ("Intermod Report"). As the Intermod Report indicates, the. Applicant's proposed antennas will not cause interference with existing telecommunications devices and will not have a negative impact on the performance of the existing radio systems utilized by the County, 19-6-5. - The tower or antenna owner shall be responsible for correcting any frequency problems, which affect the Greensville County Public Safety Communications System, caused by the use. Such corrections shall be made immediately upon notification by the Greensville County Planning Director. 5 The tower or antenna owner agrees to correct any frequency problems which affect the Greensville County Public Safety Communications System upon written notification by the Greensville County Administrator. 19-7 - Factors considered in granting special use permits for new towers The applicant shall obtain a special use permit from the Greensville County Board of Supervisors before erecting towers or antennas covered by this article. The Greensville County Board ofSupervisors shall consider the following factors in determining whether to issue a special use permit: (a) Height of the proposed tower; The proposed Telecommunications Tower will consist of a 195-foot monopole with a 4-foot lightning rod. (b) Proximity oft the tower to residential structures and residential district boundaries; As depicted on the Zoning Drawings, the proposed lelecommunications Tower will be 480 feet from the closest off-site residential structure. (c) Nature of the uses on adjacent and nearby properties. The surrounding area consists primarily of agriculturalforested parcels with a small residential subdivision to the northwest. (d) Surrounding topography; The area surrounding the proposed Telecommunications Tower site is mostly flat. (e) Surrounding tree coverage and foliage; The surrounding area consists mature trees and vegetation. (f) Design oft the tower, with particular reference to design characteristics that have the effect of reducing or eliminating visual obtrusiveness; The proposed Teleommunications Tower is a self-support monopole that will have a galvanized steel finish, which will blend with the sky. Moreover; it will be setback 1,243 feet from the closest public right of way, 2,182 feet from rear property line, 167-feet from western property line and 267 feet from eastern property line in a portion ofthis large parcel, which contains mature trees and vegetation buffering the Telecommunications Tower from surrounding uses. (g) Proposed ingress and egress; The Applicant will access the proposed Telecommunications Tower over the existing gravel drive known as "Perkins Lane" that provides access to Allen Road (SR 610), (h) Collocation policy; As indicated above and included with this application as Exhibit G is a copy of the. Applicant's Collocation Policy, which sets for the requirements and existing process in place to allow shared use of the proposed tower by other telecommunications providers. (I)Language of the lease agreement dealing with collocation; 6 Included as Exhibit I is a redacted copy of the Applicant's lease ("Lease") with the Owner. (J) Consistency with the comprehensive plan and the purposes to be served by zoning; The Comprehensive Plan recognizes the importance of cellular communications and broadband for emergency services and economic development. In addition, the Comprehensive Plan's Implementation Strategy Section suggests that the County support the siting of towers and antennas, through code updates as necessary, to improve cellular service and coverage throughout the County. (k)4 Availability of suitable existing towers and other structures as discussed below; and As indicated above, there are no exiting towers or structures within the search area that could satisfy Verizon Wireless' coverage objectives. (L) Proximity to commercial or private airports. The closest airport is the Emporia Greensville Regional Airport, which is approximately 8.3 miles to the north, 19-8 - Availability of suitable existing towers or other structures. No new tower shall be permitted unless the applicant demonstrates to the reasonable satisfaction oft the Greensville County Board of Supervisors that no existing tower or structure can accommodate the applicant's proposed antenna. Evidence submitted to demonstrate that no existing tower or structure can accommodate the applicant's proposed antenna may consist of any of the following: (a) No existing towers or structures are located within the geographic area required to meet applicant's engineering requirements. As indicated above, there are no exiting towers or structures within the search area that could satisfy Verizon Wireless' coverage objectives. (b) Existing towers or structures are not of sufficient height to meet applicant's engineering requirements. As indicated above, there are no exiting towers or structures within the search area that could satisfy Verizon Wireless' coverage objectives, (c) Existing towers or structures do not have sufficient structural strength to support applicant's proposed antenna and related equipment. Not applicable. 7 (d) The applicant's proposed antenna would cause electromagnetic interference with the antenna on the existing towers or structures, or' the antenna on the existing towers or structures would cause interference with the applicant's proposed antenna. Not applicable. (e) The fees, costs, or contractual provisions required by the owner in order to share an existing tower or structure or to adapt an existing tower or structure for sharing are unreasonable. Costs exceeding the cost of new tower development are presumed to be unreasonable. Not applicable. (f) The applicant demonstrates that there are other reasonable limiting factors that render existing towers and structures unsuitable. Not applicable. 19-9 - Setbacks The following setback requirements shall apply to all towers and antennas for which a special use permit is required: (a) The tower must be set back from any off-site residential structure, cemetery or public park no less than six times the height ofthe tower. Virginia Code $15.2-2316.4:2.A9) prevents localities from applying a greater setback to telecommunications towers than other types of utilities or towers. Section 19-3-1 of the County's Zoning Ordinance specifically excludes amateur radio and receive-only antennas from the regulations that apply to other teleommunications towers. Amateur radio towers that are 50-feet or less and receive-only antennas do not need to meet the requirements of $19-9(a) requiring towers to be set back six times the height of the tower from off-site residential structures and $19-9(c) and $19-9(e), which require towers to be set back 100% of the height of the tower to lease area boundaries and to existing buildings other than residential structures. Because Virginia Code $15.2-2316.4:2.A19) prevents localities from applying a greater setback to telecommumication towers than other types of tower's or utilities, the only setbacks that can be imposed on the proposed tower are the setbacks applicable to all buildings and structures in the Agricultural (A-1) zoning district. (b) Accessory facilities must satisfy the minimum zoning district setback requirements for primary structures. 8 The proposed Telecommunications Tower will be set back at least 167 feet from all property lines; therefore, exceeding the district setback requirements for primary structures. (c) Towers must be set back from the lease area boundaries no less than 100 percent of the tower height. As indicated above, Virginia Code 915.2-2316.4:2.A) prevents localities from applying a greater setback to telecommumications towers than other types of towers or utilities. Due to the fact that the County's zoning ordinance excludes certain types of towers and antennas from the setback requirements listed in subsection (c), the only setbacks that can be imposed on this Tower are the setbacks applicable to all buildings and structures in the. Agricultural (A-1) zoning district. (d) The lease area boundaries must be set back from the total parcel boundaries the minimum distances as required by the underlying zoning district for principal uses. The lease area will be set back approximately 116 feet from the closest property line; therefore, far exceeding the zoning district setback requirements for primary structures. (e) Towers must be set back from any existing building, other than residential structures, which house people for other purposes (i.e., businesses, industries, schools, churches) no less than 100 percent ofthe tower height. There are no businesses, industries, schools, churches, ete. near the tower site. (f) Residences constructed after the location of a tower must be set back a minimum ofthe 50 feet from the lease area boundaries. Acknowledged. 19-10. - Security fencing Towers and all accessory structures shall be enclosed by security fencing not less than eight feet in height and shall also be equipped with an appropriate anti-climbing device; such fence shall be designed to preclude view ofthe tower base and supporting buildings and equipment from the public right-of-way and adjacent propelties.The fence design shall be submitted to the county for approval. The compound containing the Teleommunications Tower will be enclosed with a 7-foot chain link fence topped with 1-foot of barbed wire to deter climbing. 19-11 - Noise The noise level of supporting equipment and facilities shall not exceed 65 decibels at the lease area boundaries. The sound emanating from the proposed Telecommunications Tower will not exceed 65 decibels at thel lease area boundaries. 9 19-12-I Landscaping The following requirements shall govern the landscaping surrounding towers for which a special use permit is required. (a) Where existing mature tree growth or natural landforms on the site do not exist, tower facilities shall be landscaped with a buffer of plant materials that effectively screen the view of the supporting buildings from adjacent property. The standard buffer shall consist of a landscaped strip at least four feet wide outside the perimeter of the facilities. As indicated above, the proposed Ielecommunications Tower will be surrounded by existing mature trees and vegetation. (b) Where existing mature tree growth or natural landforms on the site exist, they shall be preserved to the maximum extent possible. Existing trees and vegetation will be preserved to the maximum extent possible. 19-13- Signage The lease area shall be internally posted with one (1) "No Trespassing" sign which shall be placed on the access gate, On all other sides two (2) "No Trespassing" signs shall be posted within twenty feet ofthe lease area. All signs shall be erected to ensure visibility and permanency. Other signage may be placed at the discretion ofthe applicant to deter illegal entry or avoid entry, but no sign, excepting those signs required by federal regulation, shall be placed for any other purpose. Acknowledged. 19-14 - Local government access Owners of towers shall provide the county collocation opportunities as a community benefit to improve, radio communication for county departments, agencies, and emergency services organizations without costs. Virginia Code $15.2-2316.4:2.A(8) prevents localities from conditioning or requiring the approval of an application for a tower on the basis of the applicant's agreement to allow the localities' antennas or equipment on the tower. 19-15. - Removal of abandoned antennas and towers Any antenna or tower that is not operated for a continuous period of 24 months shall be considered abandoned and the owner of each such antenna or tower shall remove same within 90 days. Removal includes the removal ofthe tower, all tower and fence footers, underground cables and support buildings. The buildings may remain with owner's approval. Ifthere are two or more users of a single tower, then this provision shall not become effective until all users cease using the tower. Acknowledged. 10 19-15-1 - Surety for removal. Prior to the issuance of zoning and building permits for towers or antennas, the owner shall provide a performance bond with approved surety in an amount equal to the cost to demolish the tower at such time as the antennas or tower ceases to be operated as described in section. Virginia Code $15.-2316.4:2.A/4) prevents localities from imposing surety requirements, unless the locality imposes similar requirements on other permits for other types ofsimilar commercial development. Where such surety can be imposed, it shall not exceed a reasonable estimate of the direct costs of removal of the tower, 19-15-2 - The exact amount of this performance bond will be determined by the county attorney and director of planning. As indicated above, Virginia Code 15.2-2316.4:2.A(4) prevents localities from imposing surety requirements, unless the locality imposes similar requirements on other permits for other types of similar commercial development. Where such surety can be imposed, it shall not exceed a reasonable estimate of the direct costs of removal of the tower. 19-16. - Required yearly report The owner of each such antenna or tower shall submit a report to the director of planning once a year, no later than July 1. The report shall state the current user status oft the tower and shall include an inspection report from a certified engineer that the tower is structurally sound. Acknowledged. 19-17- - Required five-year plan The tower owner shall submit to the county a five-year proposed site location plan. Such plan shall be submitted with the special user permit applications and shall include the following: (a). A map showing the location of each site within Greensville County at which owner proposes to construct a communications tower within the five years subsequent to the current application; and (b). A narrative which describes the precise location of each tower shown on the aforesaid map. The foregoing maps shall be updated and any revision submitted, no later than July 1, once a year with the required yearly report (section 19-16). As indicated above, Virginia Code $ 15.2-2316.4:2(A), prohibits a locality from requiring an applicant to provide proprietary, confidential or other business information. The location ofthe Applicant's other antenna sites and plans for future sites is proprietary and confidential in nature, 19-18 - Review fees Any costs incurred by Greensville County for outside independent review of any or all oft the above required information shall be paid by the applicant within thirty (30) days of the receipt of such invoice from the county. Acknowledged. 19-19 - Violations 11 Such actions shall be in addition to all other rights and remedies available upon a violation of this article, including, although not limited to, rescission ofthe special use permit approval. Acknowledged. 19-20 - Deviations Any application which includes a deviation from the strict and literal compliance with the terms and conditions oft this article shall be made to the Greensville County Board of Supervisors as part ofthe initial application the Board of Supervisors shall have no duty to approve any such application. Ifthe Board of Supervisors approves any such application, it may require, as a condition of such approval, compliance with any terms and conditions promulgated by the board that exceeds the minimum criteria herein established or creates new criteria. Acknowledged. To the extent that the layout and design of the proposed Telecommunications Tower deviates from the terms and conditions of Article 19, the. Applicant is requesting that the approved special use permit authorize such deviations. 19-21 - Severability Should any section thereof: subsection hereof, or any portion of either be determined by a court of competent) jurisdiction to be unenforceable had not theretofore been a part hereof. The energy that is radiated above and below the assigned frequency is known as sideband noise energy and extends for several megahertz on either side of the operating frequency. This undesired noise energy can fall within the passband of a nearby receiver even if the receiver's operating frequency is several megahertz away. The transmitter noise appears as "on-channel" noise interference and cannot be filtered out at the receiver. Iti is on the receiver's operating frequency and competes with the desired signal, which in effect, degrades the operational performance. The analysis predicts each transmitter's noise signal level present at the input of each receiver. It takes into account the transmitter's noise characteristics, frequency separation, power output, transmission line losses, filters, duplexers, combiners, isolators, multi-couplers and other RF devices that are present in both systems. They are receiver produced, transmitter produced, and "other" radiated IM. Transmitter produced IM is the result of one or more transmitters impressing a signal in the non-linear final output stage circuitry of another transmitter, usualy via antenna coupling. The IM product frequency is then re-radiated from the transmitter's antenna. Receiver produced IM is the result of two or more transmitter signals mixing in a receiver RF amplifier or mixer stage when operating in a non-linear range. "Other" radiated IM is the result of transmitter signals mixing in other non-linear junctions. These junctions are usually metallic, such as rusty bolts on a tower, dissimilar metallic junctions, or other non-linear metallic junctions in the area. IM products can also be caused by non-linearity in the transmission system such as antenna, transmission line, or connectors. Communication sites with Co-located transmitters, usually have RF coupling between each transmitter and antenna system. This results in the signals of each transmitter entering the nonlinear final output (PA) circuitry of the other transmitters. When intermodulation (IM) products are created in the output circuitry and they fall within the passband of the final amplifier, the IM products are re-radiated and may interfere with receivers at the same site or at other nearby sites. Additionally, these strong transmitter signals may directly enter a receiver and drive the RF amplifier into a nonlinear operation, or if not filtered effectively by the receiver input circuitry, these signals could mix in the nonlinear circuitry of the receiver front-end or mixer, creating IM products directly in the receiver. The power level of the IM product is determined by the power level of the incoming extraneous signal from another transmitter and by a conversion loss factor. The conversion loss factor takes into account the mixing efficiency of the transmitter's final output stage. Conversion loss differs with transmitter design, adjustment, frequency separation of the source signals, and with the order of the IM product. The analysis calculates all possible IM product frequencies that could potentially interfere with receivers at the communications site based on each receiver's individual bandwidth. While there are thousands of potential IM product combinations based upon the large number of transmitters located at this facility, all potential products produced yielded values that were below the limit where any noticeable degradation to system performance would be experienced. This internal IM mixing process takes place in the receiver's RF amplifier when it operates in a nonlinear range and/or in the first mixer, which, of course, has been designed to operate as a nonlinear device. Receivers have a similar conversion loss type factor and receiver performance is commonly described in terms of conversion loss with respect to the 2A - B type products. Here, conversion loss is the ratio of a specified level of A and B to the level of the resulting IM product, when the product is viewed as an equivalent on-channel signal. Receiver conversion loss varies with input levels, AGC action, and product order. The analysis calculates all possible IM product frequencies that could potentially interfere with receivers at the communications site based on each receiver's individual bandwidth. The analysis takes into account the transmitter's harmonic characteristics, output level, transmission line losses, filters, duplexers, combiners, isolators, multi-couplers and other RF devices that are present in each system. Additionally, the analysis considers the antenna separation space loss, horizontal and vertical gain components of the antennas as well as how they are mounted on the structure. The gain components are derived from antenna pattern data published by each manufacturer. The analysis determines how much isolation is required to prevent receiver performance degradation for any harmonics that fall within a receiver's passband. The generation of spurious frequencies could be due to non-linear characteristics in a transmitter or possibly the physical placement of components and unwanted coupling. If a spurious signal falls within the passband of a nearby receiver and the signal level is ofs sufficient amplitude, it can degrade the performance of the receiver. The analysis takes into account a transmitter's spurious output specification, output levels, transmission line losses, filters, duplexers, combiners, isolators, multi-couplers and other RF devices that are present in each system. Additionally, the analysis considers the antenna separation space loss, horizontal and vertical gain components of the antennas as well as how they are mounted on the structure. The gain components are derived from antenna pattern data published by each manufacturer. Note: With the modern design of transmitters, Spurious interference results are rare. Any results in this Report Section could be from Transmitter Noise or Receiver Desense issues. Refer to report Section 5 or 6. This analysis was performed solely based upon radio configuration data provided by Verizon Wireless and a query of the FCC's active license database. In certain instances, where assumptions were required, industry standard values were utilized for variables such as transmission power levels, filter response curves, combining schemes and other configuration variables if not provided by the parties listed above. The scope of this study was limited to radio systems identified in this report exclusively. It does not take into account emissions from surrounding radio sources. As identified in the various sections of this report, the potential is present for certain forms of interference to exist. A motion was made and seconded recommending that the proposed public utility line and public utility yard (switch station) to be found not in conformance with the Greensville County Comprehensive Plan for the reasons stated in the Staff] Report. The motion carried on a 6-2 vote; therefore, it has been determined that the proposed public utility line and public utility yard (switch station) is not in accord with the Comprehensive Plan for the following reasons: 1. The proposed project is not necessary to support the provision of public utilities and the size, scale, and overall design of the proposal detracts from the agricultural use of subjects and the rural character ofthe area. The Code of Virginia does not require the Board of Supervisors to take action on an applicant's 2232 application. Although it normally does not happen, the Board of Supervisors may overrule the action of the Planning Commission with a majority vote. There is no time limit as to when the Board of Supervisors can call the application up for review or action. URBANGRID Greensville County Planning Commission September 9, 2024 Members of the Planning Commission: Monarch Solar, LLC (Applicant) is pleased to submit revised 2232 and Special Use Permit (SUP) applications for consideration by the Planning Commission and Board of Supervisors. These revisions were made in response to a concern expressed by the Planning Commission during the July 9th public hearing that the location of a new 115kV transmission line would attract new solar development into an area of the county where it is not desired. We respect Greensville County's desire to control where solar projects are to be sited in the county and have no intention of developing a solar project anywhere in the county. In support of this commitment, we are proposing the following three solutions, which we are confident will alleviate this concern: 1. We have released 4,855 acres of land in Greensville County that Applicant previously had under an option agreement with Dominion Woodland, LLC. This land was under an option agreement for several years and is no longer needed. This reduces Applicants land holdings by 98%. The Applicant is only retaining the land associated with the easement for the utility line and utility yard. 2. We have re-engineered the utility line from two parallel 115kV lines to a single 115kV line. 3. Lastly, we propose including a condition in our SUP application that restricts the use of the utility line to only transmitting power generated by the solar facility in Brunswick County. These three solutions clearly demonstrate our intention to only build a utility line and utility yard in Greensville County and prevent any future development of solar in the area. Since the July 9th Planning Commission hearing, we have met more than a dozen business owners in Emporia and Greensville County who are eager to see the proposed project come to fruition. PROPOSED USE: This application is with respect to a public utility line easement and public utility service yard (the "Project") that would improve the functionality of Dominion's existing 500 kilovolt transmission line and enable renewable energy to be injected into the electrical grid from a solar project to be located in Brunswick County. The public utility line easement will be 120 foot wide at its widest point, and approximately 4.8 miles in length. The utility line easement will include a single, 115-kilovolt power line, as shown in the preliminary site plan (Attachment B). The Project facilities are similar to the existing electrical lines and substations that exist throughout Greensville County today. The same electrical equipment, structures and operational requirements that provide electricity to the homes and businesses in the county will be used to build and maintain the Project. The Project proposed by the Applicant is pursuant to the Conditional Use Planned Development Special Use Permit (the "Utility SUP") and Code of Virginia Sec. 15.2-2232 application the URBANGRID ("Utility 2232 Application") (the Utility SUP and the Utility 2232 Application, collectively, the "Utility Applications"), each dated September 9, 2024, for the proposed Project more particularly described in the Utility Applications (the "Project"). Code of Virginia Sec. 15.2-2232 provides for the review of the "general location, character, and extent" compatibility of a private or public utility facility in accordance with the comprehensive plan of the County of Greensville, Virginia (the "County"). The Applicant respectfully requests that the County review and approve the general location, character, and extent of the Project proposed by Applicant pursuant to its Conditional Use Planned Development Special Use Permit (SUP) of even date with this application. The Project's completed County 2232 application form is included with this submittal. GENERAL COMPREHENSIVE PLAN COMPATIBILITY - LAND USE: The Greensville County Comprehensive Plan calls for a balanced model of planned business development that ensures managed economic growth to enhance the quality of life of its residents while attracting responsible new businesses, and meanwhile ensuring that development occurs in a planned manner that serves to preserve the County's rural character, abundant natural resources, and environmentally sensitive features. Comp Plan pages 1 -8. The Applicant's S Project enhances the stability of the existing Dominion transmission line by adding a new switching station to give Dominion greater control and flexibility to manage the flow of energy on the line. In addition, the Project will enable the development of a domestic source of clean energy that is needed to meet the Commonwealth's clean energy goals. The Project will utilize the existing natural buffers to help maintain the County's rural character. Comp Plan page 27. The Project will not utilize any farmland, and will not be a detriment to rural residential, or other agricultural uses in the surrounding community. From an environmental perspective, the Project will not create any negative impacts to the surrounding areas because there will be no odor, air or water pollution associated with the Project. The Project will not produce any wastewater or create additional water run-off. Wastewater mitigation measures will be employed to avoid soil erosion and maintain the quality of stormwater to protect sensitive environments identified in the Comprehensive Plan. Comp Plan page 8. The Project contributes to protecting the environment on a larger scale, because it connects clean energy to electric customers in the region and can reduce the commonwealth's overall reliance on fossil fuels. The Project is situated at the closest possible location between the solar project in Brunswick County and existing transmission utility lines. URBANGRID The connection to renewable energy and the mitigation of impacts based on location promotes rather than threatens the County's natural resources. The Project is further not detrimental because it will be designed and built in a manner that is sensitive to existing natural resources like the Nottoway River, located approximately one mile away, and avoids existing wetlands. COMPATIBILITY - SURROUNDING USES: Applicant will preserve existing trees and vegetation on the perimeter of the public utility yard to mitigate views of the switching station. In addition, the Project will only utilize approximately 88 acres, with approximately 68.5 of these acres used for the utility line easement, 5.2 acres for the easement access to the public utility yard, and approximately 15 acres for the public utility yard. The 15 acres does not include stormwater management features that will be located near the public utility yard and incorporated into the Site Plan for approval by the county. Thousands of acres surrounding the Project will continue to be managed for commercial timber. The layout of the Project is obscured by natural areas, which is consistent with the Comprehensive Plan. Comp Plan, Land Use Genera!; Comp Plan pages 27- 28. These natural areas using existing mature forest prevent the real and perceived encroachment of the use into any adjacent areas. Comp Plan pages 27 - 28. In addition, Dominion Woodlands, one of the landowners associated with the Project area, currently allows hunting on the property. The Applicant and Dominion Woodlands have met with the hunt club that utilizes the land for hunting to share the proposed Project with them and obtain their input. The hunt club will continue hunting on the land where the utility line is located and supports the Project. A letter of support from the hunt club, as well as other local businesses is included in Attachment F. COMPATIBILITY - HISTORIC RESOURCES: Applicant engaged Dutton & Associates to conduct a Phase la Cultural Resources Survey. Seven verified archaeological sites lie within a mile of the project boundary, but no such site is within view of the proposed Project. These areas will be further evaluated during a future Phase 1 field survey to be conducted in the commercially customary sequence of diligence, and any significant findings will be shared with the Virginia Department of Historic Resources, the Department of Environmental Quality, and the County. URBANGRID COMPATIBILITY - NATURAL RESOURCES: With respect to wetlands located within the Project area, the Applicant conducted a desktop wetland assessment to identify and to the extent practical will avoid any impact to wetlands. COMPATIBILITY - AGRICULTURAL AND FORESTAL LAND USES: Utility development in the A-1 district provides a balanced pattern of land use by preserving the rural character of the area with a passive, non-invasive land use. Utility use improves the viability of the rural district with additional tax revenue and connection to a complementary clean, renewable power source. The Project is a self-sustaining, self-funding operation that does not require County expenditures and resources for utilities, water, or sewer. The Project will be a clean and quiet neighbor that integrates with and respects the rural community. Applicant will minimize and mitigate disturbances to nature and neighbors wherever possible. Once constructed, the Project will be quietly maintained with no disturbance to wildlife, existing residents, or businesses. The Project will not increase traffic or contribute to periodic wear and tear on County roads, nor will the Project interfere with planting, harvesting, grazing or other rural activities in the countryside. After the Project is built, it will not generate any loud noise, dust, or odor. COMP PLAN STRATEGY- ECONOMIC DEVELOPMENT: The Project fits the County's efforts to recruit for economic development. Applicant bears all land development costs without requiring the County to extend costly infrastructure. The Project will strengthen the stability of the existing electrical grid that powers existing homes and businesses and will provide alternative energy resources without any air or water pollution. This will improve the well-being of Greensville County citizens through responsible economic development. The Project is proposed in an Opportunity Zone, which is designed to encourage long-term private investment in low-income census tracts. The project properties are all located within Census Tract 51081880101, which is a designated low-income tract as identified by the Virginia Department of Housing and Community Development. The Project will provide local and regional construction jobs. It provides significant additional tax revenue while broadening and diversifying Greensville County's tax base. The tax revenue over the 35-year life of the Project is estimated at $5.88 million. The Project is in accord with the employment goals and URBANGRID objectives of the Greensville Comprehensive Plan and Applicant's proposal to coordinate with local career training providers is discussed below. Comp Plan; Economic Development; Unemployment Strategy. The Project will employ dozens of workers during an estimated 18 - 24 month construction period. Applicant will work closely with a general contractor or development firm to be selected to construct the Project, to identify local workers through job fairs and online employment sites. These will be good paying jobs that last many months and provide transferable skills that can be used on other utility construction projects or other industries. There will be opportunities for local sub-contractors in electrical, civil site work, and related trades. The construction of the Project will be a significant economic opportunity for area heavy equipment rental and maintenance companies, fencing, port-o-potty rentals, concrete, gravel supply, lodging and food vendors, and many others. A cross-section of these businesses have expressed their support for the project with letters of support. These letters are included in Attachment F. ALTERNATIVE SITES CONSIDERED: Given the location of Dominion's existing 500 kilovolt transmission line and the available capacity on the line to accommodate the injection of electricity from the solar project, there were no other suitable points of interconnection. The utility line easement has been designed to achieve the most direct path from the Brunswick/Greensvile County line to the point of interconnection while avoiding wetlands. PROPOSED DEVELOPMENT The Applicant proposes to construct a public utility line and public utility service yard intended to improve the functionality of Dominion's 500kV transmission line and enable the transmission of energy into the electrical grid generated from a proposed utility-scale solar facility proposed to be located in adjacent Brunswick County. The proposed utility line would be located across nine (9) parcels, with a substation and switch yard located on one ofthe parcels at the point ofinterconnection; the parcels have a total area of approximately 2,137 acres, however, the utility line easement utilizes only approximately 68.5. acres, 5.2 acres for the easement access to the utility yard, and 15 acres for the public utility yard, totaling approximately 88.7 acres. The applicant lists the parcels as 3-6, 3-13, 3-14, 3-5, 3-12, 9-39, 4-25A, 4-25, 9-51A. The project site is zoned A-1 and currently consists ofa agricultural and timber land, and wetlands. As noted, the Project is intended to support a proposed 500 MW solar facility that would include adjacent land under control by the Applicant in the northeast corner ofBrunswick County. The Applicant proposes to preserve existing trees and vegetation on the perimeter of the site to mitigate views of the switching station and collection line areas. As noted, the Utility Project will be comprised of a single 115kV line? approximately 95' in height and utilize approximately 88.7 acres, with approximately 68.5 ofthese acres used for varying width easement corridors of70 feet and 120 feet (the majority of the easement corridor is 120 feet in width). The easement corridor will be approximately 4.8 miles in length, and the Applicant has proposed a condition, which could be considered to be imposed on any granted SUP, that the use of the utility line would be restricted to only the transmission of power generated by the associated solar facility located in Brunswick County. PURPOSE OF THE REVIEW UNDER VIRGINIA CODE SECTION 15.2-2232 Virginia Code Section 15.2-2232 requires that the Planning Commission review all proposed developments that include a "public utility facility" prior to the construction or authorization of such facility. The purpose of the Planning Commission's review is to determine if the general or approximate location, character, and extent of the proposed public utility facility is substantially in accord with the Greensville County Comprehensive Plan or part thereof. The Planning Commission has set aside time at its October 8, 2024 meeting to afford citizens an opportunity to offer their comments to the Planning Commission. Ifappealed by the Applicant, the Board ofSupervisors may overrule the action ofthe Planning Commission. EXISTING CONDITIONS AND ZONING The properties where the easement path is to be located is used as a commercial timber farm, as well as for recreational hunting, and it is anticipated that the remaining land area not utilized for the project will continue to be managed for commercial timber. The application property is currently zoned A-1, agricultural zoning district. The future land use designation for the application property is Rural Residential. The Applicant conducted a Phase la Cultural Resources Survey. Seven verified archaeological sites lie within a mile ofthe project boundary, but no such siteis within view ofthe proposed Utility Project. These areas will be further evaluated during a future Phase 1 field survey to be conducted in the commercially customary sequence of diligence, and any significant findings will be shared with the Virginia Department of Historic Resources, the Department of Environmental Quality, and the County. Staff consulted the Virginia Cultural Resources Information System (V-CRIS) and confirmed that Applicant's conclusions. With respect to wetlands, the. Applicant conducted a desktop study and identified wetlands potentially impacted by the development. Based upon Staff's review of the County's GIS and the Virginia Department of Conservation and Recreation's ComserveViginiaVignia Natural Heritage Data Explorer mapping, the proposed utility line would Cross three creeks. The Applicant has indicated that they will avoid impact to wetlands to the extent practicable. Based upon further review of the ConserveViginiaVig.hia Natural Heritage Data Explorer mapping, the majority of the area of the project is considered to be "Outstanding" with respect to Ecological Core rating and "Very High" or "Outstanding" with respect Forest Conservation Value rating. ADJACENT AND SURROUNDING USES Adjacent and surrounding uses are similar to those of the subject properties, with properties being largely undeveloped or utilized for agricultural or silviculture activities. There are a few residences in the area where the utility line crosses Smokey Ordinary Road and near the parcel where the substation and switchyard are to be sited. COMPREHIENSIVE PLAN CITATIONS Below are the relevant sections of Greensville County's Comprehensive Plan. Goals and Objectives GENERAL 1) Provide adequate governmental services, including public utilities, to meet the needs of Greensville's citizens. 2) Coordinate development with the provision for public utllities and services. 3) Preserve the rural character of the County by directing and controlling growth in designated areas, 3 LAND USE GENERAL 1) Encourage new development that complements surrounding uses. 2) Concentrate development in appropriate locations by encouraging more efficient site design and incorporating proper buffers between differing uses. RESIDENTIAL 3) Prevent the encroachment of conflicting land uses on existing viable neighborhoods. COMMERCIAL/IDUSTRIAL 5) Evaluate large scale industrial economic development projects that will provide an economic benefit to the County but that may not be in designated development areas or near major transportation systems. PUBLIC FACILITIES 3) Plan accordingly for the future needs of the population. Planning Issues & Strategies AGRICULTURAL AND FORESTAL LAND ISSUES 1) There is concern to maintain the agricultural characteristics of the County not included in the Urban Services District. TRATEGIESPOLICIES a. Re-evaluate current development standards to ensure all areas that lie within the Rural Development Area, with the exception of Major Commercial Hub, maintain these agricultural and rural development qualities. Future Land Use Map The Comprehensive Plan describes Rural Residential; Conservation Area as follows: Characterized by low-density residential development such as detached single-family units on lots larger than urban or suburban lots. Certain agricultural and farming uses are typically allowed. In addition, large scale economic development projects may be allowed subject to required land use approvals as approved by the Board of Supervisors. STAFF COMMENTS AND ANALYSIS Staffhas analyzed the Comprehensive Plan elements and the proposed project appears to be consistent with, or not in conflict with, the Comprehensive Plan's applicable goals, objectives, and strategies. Subject to the project's final design and construction, and based on the information reviewed for this 4 report, staff finds that the proposed utility-scale solar facility may be substantially in accord with the Greensville County Comprehensive Plan, or parts thereof. 1. The proposed location and scale of the project appears to be in accord with some of the land use goals and objectives set forth in the Comprehensive Plan, namely that: a. The project is in an agricultural zoned district. b. The project is not competing with other major land uses in desired locations. 2. The character and extent of the proposed utility-scale solar project does appear to be substantially in accord with the Comprehensive Plan owing largely to its scale and limited impact on continued agricultural and silvicultural use of subject properties. The question before the Planning Commission with this 2232 application is: Whether the general location or approximate location, character, and extent ofthe proposed solar energy facility is substantially in accord with the Comprehensive Plan or part thereof. The Planning Commission should consider all relevant portions ofthe Comprehensive Plan in its analysis. The Planning Commission should carefully and thoroughly document its reasons for whatever conclusion it reaches. The Planning Commission has three options: a. Approve the application with written reasons for its decision. b. Deny the application with written reasons for its decision. C. Defer the application for further discussion and consideration (within the 60-day window). To ensure that we continue to meet service requirements for demand response and due to low ridership, staff is recommending to eliminate the Southside Surgical Specialties (Stop #10), located at 702 North Main Street, Emporia, Virginia. This will ensure we continue to keep service running in a timely manner as well as continue to ensure the safety of our drivers and riders. This will also assist in preparation of the route expansion to the West of Interstate 95 which is slated to begin in the future. The Department of Rails and Public Transportation requires a public hearing to be held to receive input from the public in regards to this proposed route change. The public hearing will be held on Monday, December 2, 2024, from 11:00 am to 12:00 pm. Any citizen feedback from the public hearing will be shared with the Board.
