PRESENTATION Anti-Smoking Jenny Ramos Gagne' and Putnam County SWAT Students. Jenny Ramos introduced the youth. The youth ofPutnam County presented an anti-smoking campaign to keep smoking out of playgrounds, parks, to protect the children from smoke. The students have asked for smoking and vaping to be taken out of the parks. Doris Carol has asked if an ordinance can be put into place in the town. Jenny Ramos explained that currently in Putnam County there is no ordinances against smoking in parks. Councilman Swanson motioned to move. forward to draft a model ordinance and Councilwoman Linkswiler 2"d the motion. Bill Carol explained that he has been dealing with cancer for over ten years now and the spoke ofthe complications ofdealing with treatment. And has asked for the Councilmembers to set the example. Town Attorney explained the enforcement will be as struggle, but the ordinance is the first step. 2 3 Motion passes unanimously. Jenny Ramos spoke about the grants that can pay., for signage. Jenny Ramos spoke ofthe differentlevels ofenforcement; some strictly use signage and some use fines. Strategic placement is key. Town Attorney would like to see what others have done; he asked if trespassing is an option. River2 Sea Loop- Larry Flaman Larry Flaman presented his ideas for the River2Sea Loop. He explained his maps that were provided, and how the route stops at 17. He proposed the route be Sisco Rd to East Main St. then connect into Crescent City. Larry is requesting the Town Council reconfirm that he stays representing the Blue Ways and Trails committee. That he wants the Town Council to commit someone to the Committee to advocate for the Town. Councilwoman Linkswiler asked about the 4 lane HWY Mary Garcia stated the trail would be built in conjunction with the River2Sea Loop. Town. Attorney spoke about the presentation, it needs to be agenda item. It needs to be noticed. Larry is asking that the item be put on the agenda to have someone be on the committee. No questions. Beautification Report 3 Beautification Representative June Ulrich reviewed the details ofbreakfast. The flower beds will be revamped in March. Dunns Creek Events coming up in March, the Mural project is moving along. The mural will be painted in March or early April. Opcoming projects a senior computer class starting March 1, computer training for seniors. The first class will be on email and computer safety. This is a free event for the community led by Chase France. Upcoming events this Sat is a community workday, March Ist will be the next breakfast along with.the.first Computer Class. April 5th breakfast and computer class. Friday and SatApril 11,12 is the Dunns Creek Event, and April 19 Easter Egg Hunt. Mayor asked about the Spring Clean, if a dumpster was brought into the park. The motion passes unanimously. 121 & 123 A Street Donation Property Public Works Superintendent explained the need for the donation of the properties to allow future drainage issues ifthe town accepts the property. 4 - Attorney Don Holmes explained the concerns with the donation ofproperty on A street. 123. A Street. He has spoken with the property owner to ask for any documents to help with the acceptance ofthe property. Mr. Holmes explained that $2,500 up to $3,000a piece. There are issues with marketable title. The issues with the two parcels are different. The issue is the past owners conveyed the property to the Town and in the deed, it contained the condition that it was to be used by a street. The other piece of property is owned by three different people. A quite title suit would need to be completed for both parcels. Publication, Title Work, the attorney. fees are associated cost. Quite Title Suits for Each Property would be needed. A discussion ofi issues and other items were had about multiple items with Town projects. Councilwoman Linkswiler motioned to accept the donated property of 121 A Street and 123 A Street and to allow Holmes and Young to move forward with the Quite' Title Suits not to exceed $6,000. Attest: Andrea Almeida, Town Clerk, CMC Anthony Cuevas, Mayor 8 ORDINANCE NO. 2025-01 AN ORDINANCE OF THE TOWN OF POMONA PARK, FLORIDA, AMENDING ARTICLE II, CHAPTER 34 OF THE CODE OF ORDINANCES ADDING A NEW SECTION 34-9 PROHIBITING SMOKING OR VAPING, IN MUNICIPAL PARKS OR MUNICIPALLY CONTROLLED BEACHIES AND BEACH PARKS; PROVIDING SEVERABILITY, REPEAL, CODIFICATION AND AN EFFECTIVE DATE WHEREAS, Chapter 386.209, Florida Statutes, provides that the regulation of smoking is preempted to the State of Florida; and WHEREAS, the youth in communities throughout Florida currently play on playgrounds, athletic fields, aquatic facilities, and other recreation facilities with inconsiderate smokers around the children providing them unhealthy secondhand smoke; and WHEREAS, according to a 2020 report published by the United States Department of Health and Human Services, the Surgeon General has found that tobacco smoke is the leading cause of preventable disease, disability, and death in the United States. The Surgeon General has also previously found that tobacco smoke contains over 7,000 chemicals, including hundreds that are toxic and up to 69 that are. known to cause cancer and exposure to secondhand smoke can cause numerous health problems and has been linked to cancer and other fatal diseases; and WHEREAS, HB 105 and SB 224 were filed in the Florida Legislature for the 2022 Legislative Session, to allow local governments to protect the youth of their community by designating smoke-free zones or designated smoking areas within a municipality or county; and WHEREAS, the staff analysis published for HB 105 references various studies from United Health Foundation, America's Health Rankings, the Centers for Disease Control and Prevention ("CDC"), and others on the impact that smoking has on the health of citizens; and WHEREAS, the reports referenced in the staff analysis for HB 105 further states that secondhand smoke is generally defined as smoke from burning tobacco products or smoke that is exhaled by a tobacco smoker. Exposure to secondhand smoke can cause numerous health problems and has been causally linked to cancer and other fatal diseases. Studies suggest that secondhand smoke in crowded outdoor areas can cause concentrations of air contaminants comparable to those caused by indoor smoking; and WHEREAS, the CDC states that secondhand smoke is generally defined as smoke from burning tobacco products or smoke that is exhaled by a tobacco smoker; and WHEREAS, HB 105, as amended, passed the Florida Legislature on March 2, 2022, and was later signed into law by the Governor on June 24, 2022; and WHEREAS, HB 105 became effective law on July 1, 2022, and the Town Council of Pomona Park, Florida (the "Town Council"), has determined a public health and safety need to establish designated smoke-free zones within the municipal parks and municipal beach ofPomona Park; and WHEREAS, the Town Council of Pomona Park finds and declares that the adoption of this Ordinance is appropriate, and in the public interest of this community. The Town Council may adopt and amend as necessary, by resolution, specific designated smoking areas in each municipal park and the municipal beach park within the Town as authorized by Chapter 2022-213, Laws of Florida. Section 4: Severability and Conflict If any portion of this Ordinance is declared by a Court of competent jurisdiction to be invalid or unenforceable, such declaration shall not be deemed to affect the remaining portions of this Ordinance. All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. This caused the hydrant to pour water profusely. Prior to my arrival, city officials were able to disable the hydrant. Jennifer advised the fire hydrant will cost about $8,000.00 to replace. Jennifer advised the crash occurred at approximately 1:06pm and she was informed a tan golf cart driving on the sidewalk struck the hydrant and left the scene. Through myi investigation, I spoke to several businesses. While was not able to gain video of the crash, 1 was informed by staff of the Whistle Stop a male in a tan golf cart lives in the Edgewater Mobile Home Park nearby (1754 South Highway 17). I located a tan golf cart with some front-end damage at Lot 7.1 made contact with Robert Rumler at this unit who advised he did strike the hydrant. Robert advised he was driving home in his golf cart on the sidewalk when he observed a couple making out"' along the side of the road. Robert, advised this distracted him, at which point he crashed into the hydrant. Robert advised he was ejected from the golf cart, but did not suffer any injuries. I attempted to locate a VIN for the golf cart, but was unable due to the VIN plate being rusted beyond legibility. Robert did not alert the Sheriff's Office, nor the City of Pomona Park of the crash. Contact was made with Florida Highway Patrol who advised they did not receive any calls from Robert about the incident. Robert was given a non-criminal uniform traffic citation (AKN8KXE) for Leaving the Scene of a Crash with Property Damage Greater than $500.00. This ended my involvement with the incident.
