These changes codify the requirement for a 7.5' setback for single family detached in the townhome district. It also cleans up previous language and exceptions that were temporarily in effect post hurricane Michael which have since expired. It also specifies the points from which measurements must be taken. NOW THERFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MEXICO BEACH THAT: SECTION 1. APPROVAL AND ADOPTION OF AMENDMENT Sections 2.02.02D, 2.02.07, 3.00.04, and 6.01.00 of the City's Land Development Code are amended as set forth on Exhibit "A" attached hereto and made a part hereof. SECTION 2. REPEAL All codes, ordinances or resolutions or parts of codes, ordinances or resolutions or portions thereof of the City in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. SECTION 3. SEVERABILITY If any section, subsection, sentence, clause, phrase or other portion of this Ordinance, or any particular application thereof shall be held invalid or unconstitutional by any court, administrative agency, or other body with appropriate jurisdiction, the remaining sections, subsections, sentences, clauses, or phrases and their application shall not be affected thereby. SECTION 4. SCRIVENER'S ERRORS. The City Attorney may correct any scrivener's errors found in this Ordinance by filing a corrected copy of the Ordinance with the Clerk. A scrivener's error may not include an amendment that changes the context or meaning of the Ordinance. SECTION 5. ORDINANCE TO BE LIBERALLY CONSTRUED. This ordinance shall be liberally construed in order to effectively carry out the purposes hereof which are deemed not to adversely affect public health, safety, or welfare. SECTION 6. CODIFICATION. The provisions of this Ordinance shall become and be made part of the Land Development Code of the City. The sections of this Ordinance may be renumbered or re-lettered to accomplish such intention, and the word "ordinance" may be changed to "section, II "article, or other appropriate word. SECTION 7. EFFECTIVE DATE. This Ordinance shall take effect immediately upon passage. We would like to transfer that excess $13434.26 to Public Works to augment the $25k budgeted for their truck, bringing the available funds to roughly $38k for their new truck. The lone bid was over our expected budget. We need to decline the bid which will then allow the Administrator to work directly with contractors to change the project scope in order to bring it within budget. Action Requested: The City Council should decline the bid. ISSUE OVERVIEW Background Information & Issue Summary: We've previously spent around $250k to purchase three bypass pumps with the ultimate goal of erecting raised platforms and installing them at the three locations listed. This is being funded by the Hazard Mitigation Grant Program (HMGP). The lone bid came in around $500k which is over the estimated $300k budget we have for the project. Once the bid is declined, the Administrator can begin discussions with local contractors, including the bidder, to find ways to share the work between the contractor and the City in an effort to bring the total cost down to the budgeted amount.
