Call to Order and Certification of a Quorum Mayor Ram Gomez called the Aransas Pass City Council Regular Meeting to order at 6:00 p.m. With Council Members present, a quorum was established. Council Members present: Mayor Pro-Tem Carrie Scruggs, Council Members Jason Knight, Joe Dominguez, J. R. Haskins, and Mayor Gomez. Staff present: City Manager Mary Juarez, City Secretary Kandice Garrett, Finance Director Sandra Garcia, Planning Director Brenda Joyas, Public Works Director David Flores, Interim Police Chief Aaron Jones, and Fire Chief Michael Neujahr. Also present was City Attorney Epimenio Ysassi. 2. Invocation City Manager Mary Juarez delivered the invocation. 3. Pledges Mayor Gomez led the Pledge of Allegiance to the U.S.A. flag and the Texas flag. 4. Presentations and Proclamations a. Presentation on 2024 Racial Profiling Report. (Interim Police Chief) Interim Police Chief Aaron Jones presented this item noting the data is reported annually to the state and required to bring to council and that there were no issues with the report and the department met all state requirements. 5. Citizen Comments There were no public comments. 6. Staff Reports and other Discussion Items a. Beach On the Flats Mr. Nester Angel presented this item to have a beach on the flats leading to the ferry that goes to Port Aransas to attract tourists to our city. There was further discussion Regular City Council Meeting Minutes - February 3, 2025 Page 1 of 4 and a consensus by the council to look further into the possibility of the beach and perform a feasibility study. b. Draft Council Policies City Manager Mary Juarez discussed the resolution for policies and general rules and procedures of the city council and there was a consensus from the council to move forward as written with the exception of including the language that a motion to reconsider could be made at the next regular meeting as stated in the draft in Section 1.3. 7. Action Items a. Consideration of approving a Resolution ordering an election to be held in the City of Aransas Pass on May 3, 2025 for the purpose of electing a mayor and council members to places 1 and 3; submitting proposed city charter amendments to the qualified voters for their approval at said election; authorizing a Joint Agreement with San Patricio County Elections Administrator for the conduct of the election; providing for procedures for holding such election; providing for notice of election and publication; providing for establishment of early voting polling place and designating election day polling place location; providing a severability clause; and providing an effective date. (City Manager) City Secretary Kandice Garrett presented this item and stated the cost of last year's election was $22,652 and we are anticipating a joint election agreement with Aransas Pass Independent School District which would result in halving the cost with the city, but waiting to hear back on a final answer. Council Member Knight made a motion to approve Item 7.a., seconded by Mayor Pro Tem Scruggs and the motion passed with the following vote: Gomez, Scruggs, Knight, Dominguez, and Haskins voted Aye. b. Consideration of approving issuance of request for proposals for the 2025 Independence Celebration Firework Display to be held at Community Park and selecting the date of July 5, 2025. (City Manager) Community Enrichment Director Kaylynn Paxston presented this item and recommended to the council the fireworks show along with an added festival for this year's date be moved back to Community Park near the softball fields due to traffic issues involving Conn Brown Harbor. Councimember Knight asked about adequate parking and Mrs. Paxston responded that there is adequate parking. Mayor Pro Tem Scruggs made a motion to approve Item 7.b., seconded by Council Member Knight and the motion passed with the following vote: Gomez, Scruggs, Knight, Dominguez, and Haskins voted Aye. C. Consideration of approving the 2025 Facility Lease Agreement with the Aransas Pass Little League beginning on March 4, 2025 and ending March 3, 2026. (City Manager) Community Enrichment Director Kaylynn Paxston presented this item and noted that there were two changes to the agreement, which are pest control is being sponsored, and the Regular City Council Meeting Minutes - February 3, 2025 Page 2 of 4 main leaseholders will be the only ones on the contract since there are no secondary partnerships this year. Council Member Knight made a motion to approve Item 7.c., seconded by Mayor Pro Tem Scruggs and the motion passed with the following vote: Gomez, Scruggs, Knight, Dominguez, and Haskins voted Aye. d. Consideration of approving Change Order Number 001 with Associated Construction Partners to credit the contractor one hundred eighty (180) additional workdays at no cost for the Stormwater Pump Station No. 1 and No. 2 also known as Maddox Pump Station. (City Manager) Street Maintenance Superintendent Mickey Bonner presented this item and stated the reason for the change order is primarily due to some adjustments made by the city for safety and health concerns at the Maddox Pump Station and the theft of a louver system at the station that had to be reordered and the lead time on that item. There is no cost to the city for the change other than the time extension. Council Member Knight made a motion to approve Item 7.d., seconded by Mayor Pro Tem Scruggs and the motion passed with the following vote: Gomez, Scruggs, Knight, Dominguez, and Haskins voted Aye. 8. Executive Session The meeting was recessed into Executive Session at 6:23 p.m., under the provision of Section 551, Texas Government Code to discuss the authority of: a. Texas Government Code Section 551.071 - To meet with its attorney to seek legal advice on a matter in which the duty of the attorney to the city council under the Texas Disciplinary Rules of Professional Conduct of the state bar of Texas clearly conflicts with the Texas Open Meetings Act relating to: i. Conn Brown Harbor Lease - Aransas Pass Seafood Packers ii. Conn Brown Harbor Lease - Justin Chandler iii. Cause No. 22-0132, City of Aransas Pass, Texas VS. Rockport Terminals, LLC in the 36th Judicial District Court, Aransas County, Texas b. Texas Government Code Section 551.073 = to deliberate a negotiated contract for a prospective gift or donation to the state of the governmental body if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person. i. Huey Airframe at VFW Post 2932 The council reconvened the meeting at 8:21 p.m. Mayor Pro Tem Scruggs made a motion to accept the donation of a Huey Airframe from Defense Logistics Agency with the Colorado National Guard to designate as a historical item of art on property at the VFW Post 2932 located at 620 W. Wheeler, Aransas Pass, Texas as a public memorial, seconded by Council Member Knight and the motion passed with the following vote: Gomez, Scruggs, Knight, Dominguez, and Haskins voted Aye.
