Parking 100.1 Purpose The purpose of this article is to regulate parking and promote traffic safety in the Town of Boonsboro. 100.2 Definitions Abandoned Vehicle Any vehicle without current, valid license tags from any state, left on any public roadway, alley, parking lot or on private property without the property owner's permission. Commercial Vehicle - A vehicle with a gross vehicle weight (GVW), gross vehicle weight rating (GVWR), or a gross combination weight rating (GCWR) of 10,001 pounds or more, and other vehicles as defined in Federal Motor Carrier Safety Administration 49 CFR, 350.105. Delivery Vehicle - Any vehicle used to deliver goods and merchandise including cars, vans and trucks. Disabled Vehicle - Any vehicle that will not operate due to some. form of mechanical malfunction requiring the vehicle to be left, until same can be repaired and/or towed to a mechanic for repairs, on any public roadway, alley, parking lot or on private property without the property owner's S permission. Fire Lane - Any path designated for access by emergency; vehicles Handicap or Handicap Parking - Any space designated for the use of a vehicle displaying the proper handicap tags / placard as defined by Maryland law, Inoperative Vehicle Any vehicle that is dismantled or used for parts, or retained for future use for parts, regardless of whether the vehicle is licensed or otherwise, on any public roadway, alley, parking lot or on private property. Mayor and Council - The Mayor and. Council of the Town of Boonsboro Motor Home - A motor, vehicle designed and constructed primarily, to provide living quarters for recreational, camping or travel use. No Parking Zone - A vehicle is prohibited from parking in the defined area Park - To halt a vehicle, whether or not occupied, other than temporarily. Person - Any individual, firm, association, joint venture, partnership, estate, trust, corporation, group, state officer, or unit of federal, state, county, or municipal government, and all other associations and combinations, whether public or private. Parking Space - A parking space within the jurisdictional boundaries of the Town. Stand - To halt a vehicle whether or not iti is occupied, other than temporarily, when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or a traffic control device; or for the purpose of and while actually engaged in receiving or discharging passengers. State - The State of Maryland Stop - Where used in a mandatory sense, means the complete cessation from movement; and where used in a prohibitory sense, to halt even momentarily a vehicle, whether or not it is occupied, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or a traffic control devise. Street = Any public street, avenue, roadway, boulevard, highway, alley, cul-de-sac or other public place located in the Town and established for the operation of vehicles. Town - Boonsboro Maryland, a political subdivision of the State of Maryland. Traffic Lane / Any path designated for vehicle movement. Trailer - Any vehicle that is not self-propelled, designed to store, carry, haul or hold items or property. To include travel/camping trailers. Unregistered Vehicle - Any vehicle that does not have valid license/registration plate(s), from any state, permanently attached and visible. Expired Vehicle - A vehicle which the registration is expired, suspended, refused, revoked and/or canceled. Unsatisfied Summons or Citation Parking citations or summonses issued and unpaid pursuant to the parking ordinances and/or regulations of the Town of Boonsboro. Vehicle - Any two, three, four wheel, or more vehicle designed for the purpose of carrying/hauling any passenger(s), cargo or equipment that is equipped initially with a motor of any type. Wrecked Vehicle Any vehicle that has severe body damage or frame component damage that requires the vehicle to be towed, regardless of whether the vehicle is licensed, left on any public roadway, alley, parking lot or on private property. 4 100.3 Parking restrictions in general. A. It shall be unlawful for any Abandoned, Unregistered, Expired, vehicle or trailer to be parked on any street, or part thereof, in the Town of Boonsboro. B. It shall be unlawful for any' Wrecked, Disabled or noperative vehicle to be parked on any street, or part thereof, in the Town of Boonsboro for more than 72 hours. C. It shall be unlawful for any vehicle, displaying illegal or altered tags, to be parked on any street, or part thereof, in the Town of Boonsboro. D. It shall be unlawful for Vehicle, Trailer, or Motor Home to be stored on. any street, or part thereof, in the Town of Boonsboro. E. Parking on a one-way, / two-way roadway and distance from the curb. 1. A vehicle that is stopped, standing or parked on a two-way roadway shall be stopped or parked parallel to the right-hand curb or edge oft the roadway, with its right-hand wheels within 12 inches of that curb or edge of the roadway. 2. A vehicle that is stopped, standing ors parked on a one-way, roadway, where not prohibited, shall be stopped or parked parallel to the curb or edge of the roadway, in the direction of authorized traffic movement, with: a. Its right-hand wheels within 12 inches of the right-hand curb. or edge ofthe roadway; or b. Its left-hand wheels within 12 inches of the left-hand curb or edge. of the roadway. F. It shall be unlawful for any vehicle to Stop, Stand or Park in violation of any No Parking sign or any other official sign prohibiting stopping, standing or parking in the Town of Boonsboro. G. It shall be unlawful for any vehicle to park in any spot not designated as a parking space in the Town of Boonsboro. H. It shall be unlawful to Stop, Stand or: Park in front of a public driveway. A person may not stop, stand, or park a vehicle in front of a public or: private driveway or within five feet of the driveway. I. A person may not stop, stand or: park a vehicle on a sidewalk or obstruct a sidewalk. J. A person may not stop, stand or park a vehicle in a crosswalk or obstruct a crosswalk. K. A person may not stop, stand or park a. vehicle in or within 15' of an intersection. L. A person may not park for more than two (2) hours where prohibited by an official sign. M. A person may not stop, stand or, park within 15' of a fire hydrant. N. A person may not stop, stand or park a vehicle in any area designated, for safety purposes, a fire lane, whether on a public highway or private property. O. A person may not stop, stand or park a vehicle on the roadway side of any other vehicle that is stopped or parked at the edge or curb of a roadway. (Double Parking) P. A person may not stop, stand or park a vehicle alongside any curb painted red within the Town of Boonsboro. Q. A person may not park a vehicle on a private drive or private property without the consent of the owner or agent of the property. R. A person may not stop, stand or park a vehicle in violation of any posted official sign. S. A person may not stop, stand, park in, or obstruct, an alley. T. A person may not stop, stand or park in a parking space designated as a handicap parking spot without the proper tags, placard or permit and the person to whom the tags, placard and permit are issued is in the vehicle. U. A person may not stop, stand or park a vehicle in such a manner as to obstruct and hinder the safe passage and flow of vehicular traffic. V. No vehicle shall be serviced or repaired on any street, or any part thereof, except in case of emergency, and then only SO as not to block or obstruct any street or sidewalk. W. No vehicle used for or designated for commercial use is to be parked. in a. residential area except while immediately conducting business in the residential area. 100.4 Paying of Fines A. All parking related fines will be paid at the Boonsboro Police Department. B. All fines must be paid within ten (10) days of issuance. C. Any fine not paid within ten (10) days, the fine will be doubled. D. Any fine not paid within sixty (60) days will be forwarded to and flagged by the Maryland Motor Vehicle Administration (MVA) for registration suspension,
