ORDINANCE NO. AN ORDINANCE OF THE CITY OF ALTURAS AMENDING THE MUNICIPAL CODE BY ADDING TO CHAPTER 5, ARTICLE VIII - RENTAL HOUSING INSPECTION PROGRAM Article VIII. - Rental Housing Inspection Program. Sec. 5-84. - Finding and Purpose. The public interest demands that all rental housing properties comply with the minimum standards regarding the health and safety of the public. The most effective way to seek universal compliance with the minimum standards is through routine periodic inspections of all rental housing properties. Accordingly, it is the intent ofthe Alturas city council to enact the provisions ofthis chapter as the basis for establishing a rental housing inspection program aimed at securing city-wide compliance of rental housing properties with minimum standards. City-wide compliance will prevent blight and ensure that all persons who live in rental housing units are provided decent, safe and sanitary housing. Sec. 5-85. - Definitions. For purposes of this chapter, the following words and phrases shall have the meanings set forth below: "Director" means the employee ofthe city authorized by the Public Works Director to supervise the rental housing inspection division, or his or her designee. "Inspector" means any employee ofthe city authorized by the Public Works Director to conduct inspections in accordance with the provisions ofthis chapter. "Owner" means the owner oft record. "Rental housing property" means a parcel of real property, as shown on the latest equalized tax assessment role as maintained by the assessor ofthe county ofModoc, upon which ai rental housing unit is maintained. "Rental housing unit" means a single unit of residence for a single housekeeping unit of one or more persons that is being rented, or is intended to be rented. Examples ofhousing units covered by this chapter include apartment units, condominiums, duplexes and single-family houses. Rental housing unit" also includes other types of residential units that provide for sleeping accommodations but toileting or cooking facilities are shared by occupants of more than one unit, such as residential or single room occupancy hotels. This does not include units used for transient lodging such as dormitories, group homes, rooming or board houses, hotels, motels, and bed and breakfast inns. Page 1 of 4 Sec. 5-86. - Rental Housing Registration Required. No person shall own or operate rental housing property without first registering that property with the city. Sec. 5-87. - Registration and registration fee. Each owner of Rental Housing property not exempted by this chapter shall register each rental housing unit with the city by submitting a rental application, made available by the city, and paying the accompanying annual rental housing inspection program fee. The rental registration fee and reinspection fees shall be established from time to time by a resolution adopted by the City Council. Sec. 5-88. - Local contact representative. All owners of rental housing properties shall designate a local contact representative with full authority to act on behalf of the owner for all purposes under this chapter, including the acceptance of service of all notices from the city. A local contact representative must establish and maintain a local telephone number and a residence or business address within 35 miles of the Alturas City Hall. The owner of the rental housing property may act as the local contact representative. Sec. 5-89. - Inspections of rental housing units. A. Unless otherwise exempt under this chapter, all rental housing units are subject to periodic inspections to determine whether any substandard conditions exist, and to determine whether the conditions comply with applicable provisions ofthis code. B. The owner or local contact representative, or their designee, shall be present at the rental housing property at the time of the inspection. The time of the inspection shall be the time indicated in the notice issued pursuant to section 5-90 or the time that the inspection was properly re-scheduled in accordance with section 5-91. C. Ifai rental housing unit or its premises fails to pass an inspection, the director will provide the property owner with written notice of any deficiencies noted during the inspection and/or re-inspection oft the dwelling unit or its premises. D. A rental housing unit shall be subject to re-inspections as frequently as necessary to ensure that all deficiencies are corrected. Sec. 5-90. - Notice. The city shall serve written notice of the date and time of any inspection to be conducted pursuant to this chapter, by mailing such notice within a reasonable time before the date ofthe inspection. Notice shall be mailed to the owner and the local contact representative at their last known address. In the case of multiple owners of the same property, notice to any one of the property owners is sufficient notice. Page 2 of 4 Sec. 5-91. - Rescheduling an inspection. An inspection may be rescheduled once by the owner or local contact representative by giving notice to the rental housing inspection division within a reasonable time prior to the inspection date. Rescheduling an inspection more than once may result in the imposition ofa re-scheduling fee. Sec. 5-92. - Tenant rights and entry. A. Before the commencement ofa any tenancy of a rental housing unit, the owner shall provide the tenant(s) with information concerning the tenants' rights and responsibilities. The information shall be provided in a form or forms provided by the city. B. It shall be the responsibility of the owner and the local contact representative to obtain the consent of the occupants to inspect the subject rental housing units or otherwise obtain legal access to the units pursuant to the terms oft the applicable lease or rental agreement. Sec. 5-93. - Inspection results. Upon completion of an inspection conducted pursuant to this chapter by the city, the inspector shall provide the owner or local contact representative with a copy of the written results of the inspection. Sec. 5-94. - Noncompliance. A. Ifa any substandard condition or violation exists, the director or designee may provide the owner with a written notice and order to correct that describes the substandard condition or violation. The notice will provide a reasonable period of time for correction, depending on the severity ofthe condition, from 24 hours to 60 days from the date of the notice. B. Ifthe owner fails to correct the identified violation in the allotted time, the city may require an additional periodic inspection of1 the property in accordance with this chapter, to ensure continued compliance. A compliance check fee shall be imposed for the additional periodic inspection required pursuant to this subsection. Sec. 5-95. - Self-certification program. A. Ar rental housing property shall be placed in the self-certification program if after the last inspection conducted pursuant to this chapter, the inspector determines that no violations exist on the property, and the property owner has demonstrated to the Director's satisfaction that the property will continue to be maintained in compliance with this chapter. B. A rental housing property may be removed from the self-certification program ifa notice and order relating to the rental housing property is issued, or the rental housing property is repeatedly in violation ofthis code or other applicable law. C. Owners of the rental housing properties that are in the self-certification program, or their designees, shall certify each and every rental housing unit on the property at least once every calendar year and upon each change in tenancy. An owner must inspect each rental housing unit for compliance with the requirements ofthe self-certification form provided by the city and immediately make repairs to the rental housing unit in compliance with this chapter. E. After the form is completed, the owner must provide a copy of the completed form to the occupants of the rental housing unit. F. The property's local contact representative and/or owner shall retain all completed self-certification forms for at least three (3) years from the date the inspection was made and produce all completed self-certification forms to any inspector upon request. G. Properties in the self-certification program may be inspected by the city on a random basis, but not more often than once a year. Sec. 5-96. - Fee Exemption for Self-Certification. All rental housing properties that are in the self-certification program and do not require inspection shall be exempt from the unit inspection fee established by resolution. Sec. 5-97. - Transfer of ownership. When ownership of a rental housing unit changes, the seller shall notify the director of the change of ownership no later than sixty (60) days after the sale. Ifthe director is not notified, the existing rental housing property will not remain in the self-certification program, and will be subject to the program fees and inspection. Sec. 5-98. - Penalties. Any person who violates the provisions of this chapter shall be guilty of a misdemeanor pursuant to Chapter 1 Sec. 1-7 of this code, and shall be subject to penalties approved by resolution of the City Council. In addition, the city may also treat violations of this chapter as an infraction and seek injunctive relief.
