IN THE COMMISSIONERS COURT OF FALLS COUNTY THE STATE OF TEXAS TO ALL INTERESTED PARTIES COUNTY OF FALLS COMMISSIONER'S COURT MINUTES FOR SEPTEMBER 23, 2024 1. Proof of posting of notice in accordance with the provisions ofTitle 5. Chapter 551. Government Code (Vernon's Texas Codes Ann. 1994) as amended, known as the Texas Open Meetings Act. Judge Elliott asked for proof of posting and the same was affirmed by Elizabeth Perez, County Clerk, on the north and south door and the bulletin board. Commissioner Wuebker was not present for the meeting. 2. Public comments. Wally Bums wanted to give a tribute to. Stan Parker for all his hard work and dedication to veterans. 3. Elected official reports. Commissioner Albright stated that he wants to put CR 120C on the next agenda to get it abandoned. Commissioner Green wants to know what is going on with the suit on the Falls on the Brazos Property. Judge Elliott stated that it is still ongoing, and he is going to contact Mike Dixon and talk to him. There was a meeting scheduled this past April, but it was cancelled. 4. Discussion and/or action concerning American Rescuc Plan. Judge Elliott suggested that the uncontracted money in the amount of $2,025 from the American Rescue Plan be added to the park. Commissioner Green made a motion to add the uncontracted money to the park. Commissioner Albright seconded; motion carried. Judge Elliott stated that currently the money for the bridges is obligated, but when the contract is over there may be some money that may be sent back. Judge Elliott is going to get with Jim Hanks and see ifwe can tweak the contract for the bridges to prevent sending money back. The grant manager is going to be at Commissioner's Court on October 14, 2024. 5. Discussion and/ for action concering ESD #l's audit. Commissioner Albright made a motion to accept ESD #1's audit. Commissioner Green seconded; motion carried. 6. Discussion and/or action concerning Texas Water Development Board Amendment No.4. Commissioner Willberg made a motion to approve the Texas Water Development Board Amendment No. 4. Commissioner Green seconded; motion carried. 7, Discussion and/or action concerning approving county official's bond. Commissioner Green made a motion to approve the two county official's bonds. Commissioner Albright seconded; motion carried. 8. Discussion and/or action concerning county investments. Commissioner Albright accepted the quarterly investment report submitted by Sheryl Pringle, County Treasurer, and accepted Sheryl's suggestion to renew 3 CD's. Commissioner Green seconded; motion carried. 9. Discussion and/or action concerning internet link between the courthouse and sheriff's department/jail. Judge Elliott talked with Lynn at Engincer Austin. Lynn suggested that we buy our own frequency, which would cost us about $4,000 and replace the equipment for roughly $6,000. This would need to be renewed every 5 years. Commissioner Green made a motion to approve the purchase of frequency and new equipment. Commissioner Albright seconded; motion carried. 10. Discussion and/or action concerning changes to the Falls County Employee Handbook. Commissioner Willberg made a motion to add 2A-19 Earned Overtime During Declared Disaster Event to the Falls County Employee Handbook. Commissioner Green seconded; motion carried. 11, Discussion and/or action concerning purchase ofs safety equipment with Sheriff SB22 Grant funds: Commissioner Green made a motion to approve the purchase of safety equipment with Sheriff SB22 Grant funds. Commissioner Albright seconded; motion carried. 12. Discussion and/or action concerning distribution of unclaimed capital credits reyenue. Commissioner Green made a motion that the unclaimed capital credits revenue is to be split 5 ways between the Boys and Girls Club; Faith, Hope and Charity; Child Protective Services; Roscbud Public Library and Marlin Public Library. Commissioner Albright seconded; motion carried. 13. Discussion and/or action concerning the purchase ofHalloween candy, decoration, etc. with county funds. Commissioner Green made a motion to approve that Halloween candy, decoration, etc, cannot be purchased with county funds, Commissioner Willberg seconded; motion carried. 14. Discussion and/or action concerning approval ofpayout of county compensatory time as of September 30. 2024. Commissioner Albright made a motion to approve the payment of all compensatory time as of September 30, 2024, so starting October 1, 2024, the slate will be clean. Commissioner Green seconded; motion carried. 15. Discussion and/or action concerning establishing a county policy relating to Local Government Code 154.025. Steve Sharp, ADA, suggested that we have an executive session on Local Government Code 154.025 on October 14, 2024. 16. Discussion concerning Appraisal District resolution to nominate candidates for 2025-2026. Information only. 17. Discussion and/or action concerning Interlocal. Agreement for Assessment and Collection ofTaxes. Commissioner Willberg made a motion to accept the interlocal agreement for Rosebud-Lott ISD and Marlin ISD. Commissioner. Albright seconded; motion carried. 18. Discussion and/or action concerning purchasing jury summons. Commissioner Albright made a motion to approve the purchase ofjury summons. Commissioner Green seconded; motion carried. 19. Review and discussion of Road and Bridge precinct work reports, including Administrator'sp progress report. Jeff. Jackson, Road and Bridge Administrator, stated that they are working on FEMA cleanup in Pct. 2. He said that is a lot of debris at the jail that needs to be burned as soon as the bum ban is lifted, and permits are issued. Jeff stated that he found a 2012 Freightliner that he wants to purchase. The bridge on CR 109 has been taken off the list for the American Recue Plan because TxDOT is going to replace it. Commissioner Willberg made a motion to approve the purchase of the 2012 Freightliner. Commissioner Albright seconded; motion carried. 20. Discussion and/or action concerning the approving of payment of bills. including reimbursements. late charges. the transfer of cash or funds from any line item or departments to another, book transfers and any budget amendments: including but not limited to discussion and action concering department or non-departmental items with line items that go past their budgeted amounts. Commissioner Albright made a motion to approve. the payment of all bills, payroll and budget amendments. Commissioner Green seconded; motion carried. 21. Approval of minutes of prior meetings ofCommissioner'st Court. Commissioner Green made a motion to approve the minutes of the prior meeting. Commissioner Albright seconded; motion carried. 22.
