MINUTES OF THE GOVERNING BODY OF THE CITY OF DIBOLL, TEXAS REGULAR SESSION MEETING ON TUESDAY, SEPTEMBER 10, 2024, AT 5:15 P.M., IN THE DIBOLL CITY HALL CHAMBERS. COUNCIL PRESENT Mayor Trey Wilkerson, Mayor Pro Tem Daniel Lopez, Councilmembers Luis Maldonado, Nora Munoz, Ruben Terrazas and Ray Williams, Jr. COUNCIL ABSENT Councilmember Schuyler Bacon STAFF PRESENT City Manager Jason A. Arnold, City Secretary Rosa Olvera, Finance Director Sam Durham, Chief ofPolice Michael Skillern, Public Works Director Joshua Richard and Fire Chief Aaron Smith. Call to Order: Mayor Trey Wilkerson called the meeting to order at 5:15p.m. and gave the invocation, then led the Pledge of Allegiance which was recited by those in attendance. CITIZENS PRESENTATION: (Limited to 3 minutes) This item provides the opportunity to address the City Council on any matter whether or not itis posted on the agenda. Howeve,inaccordance with the Texas Open Meetings Act, Section 551.041, the Council cannot discuss, deliberate, or take any action on matters not listed on the agenda. At this time, the Council will receive citizen comments, and if necessary, may refer the matter to City staff for research, resolution, or referral to Council on a future agenda. Public Participation: Benita Sheffield Duffield addressed Council regarding accessory building ordinances. Bill Goodwin addressed Council regarding numerous Diboll related items. Christy Stephens addressed Council regarding the Lottie & Arthur Temple Civic Center. Gary Gores addressed Council regarding streets in Deer Trace and other Diboll related items. Item #1: CONSENT AGENDA: All matters listed under Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion. Ifdiscussion is desired, that item will be removed from the consent agenda and will be considered separately. Consider approval ofthe following reports: a. Minutes from August 13, 2024, Regular Session Meeting b. Minutes from September 3, 2024, Special Called Meeting C. Financial Statement for August 2024 d. 12-Month Attendance Record for August 2024 Daniel Lopez made a motion to approve and Luis Maldonado second. All in Favor, none opposed, motion carries. Item #2: Consideration and possible action to approve Ordinance 2024-09-002; establishing rates charged for water and sanitary sewer usage in the City of Diboll, Texas. Item #3: Consideration and possible action to adopt Ordinance 2024-09-003, approving and documenting a revised 2024 fee schedules, combining all categories of fees, for the City ofDiboll. Daniel Lopez made a motion to approve and Ruben Terrazas second. All in Favor, none opposed, motion carries. Item #4: PUBLIC HEARING - Second Reading of the Proposed 2024-2025 Fiscal Year Operating Budget for the City of Diboll. Public Participation: Bill Goodwin addressed Council regarding fees on budget. Item #5: Consideration and possible action to adopt Ordinance 2024-09-004, approving proposed 2024-2025 Fiscal Year Operating Budget. Ray Williams, Jr. made a motion to approve and Nora Munoz second. Record vote to approve, none opposed, motion carries. Item #6: Consideration and possible action to approve a rate increase requested by Piney Woods Sanitation, Inc. (Live Oak Environmental, LLC d/b/a Live Oak Waste, LLC). Sonny Hubbard requesting to Council for a rate increase. Daniel Lopez made a motion to approve and no second. Council raised concerns about poor performancelately.
