Belton City Council Meeting January 14, 2025 = 5:30 P.M. The Belton City Council met in regular session in the Wright Room of the Harris Community Center. Members present included Mayor David K. Leigh, Mayor Pro Tem John R. Holmes, Sr., Councilmembers Wayne Carpenter, Craig Pearson, Stephanie O'Banion, Daniel Bucher and Dave Covington. Staff present included Sam Listi, Matt Bates, John Messer, Mike Rodgers, Amy Casey, Chris Brown, Larry Berg, Daniel Aguirre, Jon Fontenot, Bob van Til, Paul Romer, Scott Hodde, Judy Garrett, Cynthia Hernandez, Kim Kroll, Scott Hodde, James Grant and Joe Dyer. The Pledge of Allegiance to the U.S. Flag was led by Councilmember Wayne Carpenter. The Pledge of Allegiance to the Texas Flag was led by Director of Library Services Kim Kroll. The Invocation was given by Mayor David K. Leigh. 1. Call to order. Mayor Leigh called the meeting to order at 5:33 p.m. 2. Public Comments. (Audio 2:15) There were no public comments. 3. Recognition of the Central Texas Council of Governments and its partnership with the City of Belton. (Audio 2:29) City Manager Sam Listi recognized Central Texas Council of Governments Executive Director Jim Reed and summarized the partnership between the two organizations involving payoff of the $390,000 loan balance authorized by Council in 2023 for purchase of the property at 2180 N. Main Street. Consent Agenda Items 4-11 under this section are considered to be routine by the City Council and may be enacted by one motion. If discussion is desired by the Council, any item may be removed from the Consent Agenda prior to voting, at the request of any Councilmember, and it will be considered separately: (Audio 7:24) 4. Consider an ordinance amending Chapter 15, Article II, Division 2, Section 15-2 of the Code of Ordinances, expanding the Parks Board from 5 members to 7 members. Consider an ordinance prescribing the classifications for police officer and firefighter positions and the number of positions in each classification. 10.Consider awarding contracts for mowing services. 11.Consider authorizing an extension to the BEDC Development Agreement with BCS Leasing, LLC and Texcrete Redi Mix through December 31, 2025. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Covington, the Consent Agenda less Item #10, including the following captioned ordinances and resolution, were unanimously approved upon a vote of 7-0. ORDINANCE NO. 2025-01 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, AMENDING CHAPTER 15, ARTICLE II, DIVISION 2 OF THE CODE OF ORDINANCES REGARDING THE NUMBER OF MEMBERS SERVING ON THE PARKS BOARD OF DIRECTORS; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN OPEN MEETINGS CLAUSE. RESOLUTION NO. 2025-01-R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BELTON, TEXAS, FINDING THAT THERE ARE 27,136 RESIDENTS WITHIN THE CORPORATE LIMITS OF THE CITY OF BELTON AND PROVIDING AN OPEN MEETING CLAUSE. ORDINANCE NO. 2025-02 AN ORDINANCE PRESCRIBING THE CLASSIFICATIONS FOR FIREFIGHTER POSITIONS AND THE MAXIMUM NUMBER OF POSITIONS IN EACH CLASSIFICATION. Item #10: Mayor Pro Tem Holmes commented on the mowing contracts that he would prefer to keep the contracts local whenever we are able to do SO. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Carpenter, the mowing contracts were awarded upon a vote of 7-0. Planning and Zoning 12.Z-24-32 - Hold a public hearing and consider a zoning change from Retail to Retail with a Specific Use Permit for a Package (Liquor) Store (R w/SUP for Belton City Council Meeting January 14, 2025 - Page 3 Package Store) on approximately 0.548 acres located at 2502 FM 439, for the Nomads Convenience Store. (Audio 12:07) Senior Planner Tina Moore presented this item. Public Hearing: The applicant's representative, Noel Garcia, spoke in favor of the rezoning. No one else spoke for or against the item. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Bucher, the following captioned ordinance was unanimously approved upon a vote of 7-0 with the following conditions: Future development must conform to all applicable standards of the Retail and SUP Districts. The applicant must stripe the parking lot within 90-day following the approval of the amended zoning ordinance. A final subdivision plat meeting the requirements of the adopted Subdivision Ordinance is required for future construction. Civil site plan and building plans in compliance with adopted standards are required for future improvements. ORDINANCE NO. 2025-03 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM RETAIL to RETAIL WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 0.548 ACRES LOCATED AT 2502 LAKE ROAD. 13.Z-24-33 - Hold a public hearing and consider a zoning change from Planned Development-11 to Planned Development-11 with a Specific Use Permit for a Package (Liquor) Store (PD-11 w/SUP for Package Store) located at 160 W. Belton City Council Meeting January 14, 2025 - Page 4 ORDINANCE NO. 2025-04 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM PLANNED DEVELOPMENT-11 to PLANNDED DEVELOPMENT-11 WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 2.4 ACRES LOCATED AT 160 W. LOOP 121, SUITE 100. 14.Z-24-34 = Hold a public hearing and consider a zoning change from Retail to Retail with a Specific Use Permit for a Package (Liquor) Store (R w/SUP for Package Store) on approximately 0.66 acres located at 608 E. Upon a motion by Mayor Pro Tem Holmes, and a second by Councilmember Carpenter, the following captioned ordinance was approved upon a vote of 6-1 (Councilmember Pearson dissented) with the following conditions: The development must conform to all applicable standards of the Retail Zoning Districts. Future improvements shall conform to applicable City ordinances. A wall separating Suite A and Suite B is required to allow for separate entrances. Mayor Pro Tem Holmes requested that Staff review the conditions for drive-thru liquor stores and also suggested a larger notification area for package store zoning. ORDINANCE NO. 2025-05 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BELTON BY CHANGING THE DESCRIBED DISTRICT FROM RETAIL TO RETAIL WITH A SPECIFIC USE PERMIT FOR A PACKAGE STORE ON APPROXIMATELY 0.655 ACRES LOCATED AT 608 E. CENTRAL AVENUE. Miscellaneous 15. Consider amendments to the Downtown Façade Improvement Grant (FIG) Program. (Audio 38:10) Director of Planning Bob van Til presented this item. A motion was made by Councimember Bucher to approve the financial amendments including: Belton City Council Meeting January 14, 2025 - Page 5 Up to $25,000 for the primary façade; Up to $10,000 for the secondary facades, up to two facades; Maximum of $45,000 per project; and Private match: 50%. He did not include the expanded geography or types of ineligible businesses. Councilmember O'Banion seconded the motion which was unanimously approved upon a vote of 7-0. 16. Hold a public hearing and consider adopting an ordinance amending the Belton Zoning Ordinance related to the proposed Imagine Belton Standards.
