We hosted the Port and Vessel Security Course through the Rural Domestic Preparedness Consortium (RDPC) Lt. Luker completed the FBI- LEEDA Supervisor Leadership Course. AC Jones attended the TCOLE Conference in McAllen, which is a requirement to maintain our TCOLE Training Contract. Our TCOLE Training Provider Contract was approved to be extended for another 5 years. Ofc. Thomas attended several courses on the path to gaining his Intermediate TCOLE License. Ofc. Moreno and Cpl. Camack attended training and became certified as ALERRT Level 1 Instructors. Ofc. Brown, Ofc. Thomas, and Ofc. Alvarado because of certified Intoxilyzer Operators. TCO Flowers instructed the TCIC TLETS Full Access, Less than Full Access, and Mobile Operator Course. We hosted a class called "Don't let the Grinch Steal Christmas, which focused on teaching responders how to look for and respond to financial crimes and scams against the elderly. 5 Officers attended a Hostage Negotiation Update Course through LLRMI. Emergency Management We hosted the All-Hazards Communications Technician Course (COM-T) in October at the Aransas Pass Civic Center. Staff attended a meeting with the Railroad Commission of Texas hosted by the Chamber of Commerce. Staff attended several Coastal Bend Emergency Management Association Meetings and are preparing to assist with the upcoming Hurricane Conference that will be in May. Testing was done on the Fire Department All Call Notification System. Staff attended the Homeland Security Advisory Committee Meeting, and information was sent requesting that AC Jones be appointed as a member of that Committee. Staff attended the Port Security Working Group Meeting. EM staff responded to a major 5-vehicle crash on Hwy 35 with a hazmat element. A STAR Request was submitted for and filled out for assistance from the state for Traffic Control. APFD was able to manage the Hazmat incident without any additional resources needed. A STAR request was submitted and filled for additional Naloxone (AKA Narkan) for our officers to keep on hand. EM Staff responded to a piece of bulkhead that collapsed by Erickson & Jensen Seafood Company in Conn Brown Harbor. 600 CLEVELAND BOULEVARD - ARANSAS PASS, TEXAS 78336 I 361.758.5224 police.aptx.soy Harbor Safety and Enforcement 113 extra patrols/business checks, 3 Marine Incident Responses, 1 boat crash, 3 environmental responses, and 14 other Calls for Service. Marine Units respond to a vehicle that drives into the water. The subject was trapped in the vehicle and was rescued by bystanders. Marine units set up a perimeter until the vehicle could be removed. GLO was contacted and responded. The major electrical project at Redfish Marina Docks A and B was awarded to "Lectrics," and that project has been completed. Lloyd's Plumbing was hired for emergency work on a fish cleaning station on T-Pier, and that work has since been completed. Additional work is still needed on the other fish cleaning stations, but HSEO has been coordinating with the leadership class, which is taking this as their upcoming project. HSEO worked to obtain quotes for major repair work to the fishing pier and finger docks at Conn brown harbor. That project has been awarded to Coastal Piers and Docks. Work should start in early January and take about 2 weeks to complete. Park Mobile was selected as a vendor for the parking meter-style system for boats docking at the City Docks. That project has been completed and is in operation. 31 large no-wake signs were purchased for the harbor. One is up, and the others should be mounted soon. Marine units responded to a report of a sinking sailboat near Pelican Island. This response was an emergency response request from the USCG. One subject was rescued from the sinking boat, and arrangements were made with a private recovery company for the salvage of the vessel. Detective Allen was promoted to Detective Sgt. Sgt. Allen: Issued a warrant for Mail Theft Misdemeanor "A", He recovered stolen property on two separate cases and issued a warrant for Theft Class "B". Responded to the scene of an unattended death. Det. Sgt. Kent was promoted to Captain. Captain Kent: Issued two class "B" warrants for Hit and Run offenses, a Class B warrant for Criminal Trespass, a warrant for theft class "B", a warrant for Assault Causing Bodily Injury, Class "A" and a warrant for Forgery, Elderly Victim a Felony 3 offense. The forgery warrant was cleared by arrest and submitted to the District Attorney's Office. Investigators reviewed and suspended 8 cases due to lack of evidence or victim cooperation. Narco/Street Crimes: Det. Valdez continues to round up wanted persons from his operation, as well as pursuing new cases: Located a known drug user who had a felony narcotics warrant on N. Commercial Street. Located suspect who had a Man/Del warrant from our narcotics roundup from this year Located suspect who had a Man/Del warrant from our agency on N McCampbell, he is also an RSO with our agency. The residence was found in the early stages of possible demolition, Tito and 401 have been made aware and are assisting. Traffic Stop leading to narcotics arrest for 11 grams of meth and two firearms seized. The driver was charged with possession and unlawful carry. I also spoke with his PO and he will soon be issued a felony warrant for his arrest for MTR-UUMV. Search Warrant for a known drug user who also had a caution against LE. The subject was wanted for a felony possession charge out of Aransas County. Not located* Called out in reference to a shooting. Located bullets and a controlled substance from the suspects vehicle. Also completed a GSR on the suspect and obtained a DNA search warrant for the suspect to link him to the weapon used during the shooting. Submitted 11 cases to the DA's office for San Pat and Aransas County. December 2024: Capt. Kent: Investigated two cases of Assault CBI and issued two warrants for arrest. Both of those cases were cleared by arrest and submitted to the prosecutors office. Investigated an alleged Aggravated Assault with a Deadly Weapon, the complainant later dropped charges. Investigated an alleged criminal mischief, the complainant later dropped charges. Sgt. Allen: Investigated a Theft of Service, State Jail felony, issued a warrant that resulted in an arrest. Investigated a Theft of Property, Class B, warrant was issued. Continues investigating a burglary of a local business. I later located the female and arrested her. Trial in Aransas County from previous search warrant, obtained a 15 year sentence on the drug charge and 10 year sentence on the prohibited weapon charge. Plea Deal accepted for a previous search warrant, obtained a 14 year sentence for a Man/Del charge. Submitted 1 case to the San Pat DA's Office and 1 case to the AC DA's Office Issued 20 felony warrants stemming from operation "Silent Night. This operation was made public on the 19th of December. Assisting DEA with a new CI I obtained-will be working mainly in CC and Rockport for this collaboration with DEA task Force and Rockport Investigators. Large amounts of money, meth, and crack are expected. Pending seizure on a corvette from a resident in AP from operation Silent Night. SP Sgt J Hinds will be primary on this. Expecting an ATF case to be accepted and the person sentenced by the end of the month from a case generated by patrol officers that I assisted with 2400019071. The arrestee was just released this year from prison for an aggravated robbery charge. I contacted the US Marshals for two individuals from our city that have aggravated offenses, one for Aggravated Robbery and Aggravated Assault and another for Aggravated Robbery and several Man/Del charges. The Marshals are actively looking for them after providing them information on their possible whereabouts. Capt. Officers Rios and Sosa attended Taser New User course held in Aransas Pass, TX. This course serves as the training and certification necessary to carry and properly use the Taser device as an additional tool in the event a less than lethal use of force situation is presented in the field. Notable Events Ofc. Rivera was promoted to School Resourse Officer. She is scheduled to begin this assignment in January. Several officers, both on and off duty, attended the annual National Night Out event held at the Aransas Pass Little League field and park. Ofc. Rivera received a recognition from a Detective from within the department, citing her exceptional report writing skills and attention to detail when gathering necessary information and evidence. Ofc. Perez was recognized by a citizen following a traffic stop. He was stopped by her for a equipment violation. He cited her professionalism during the stop and complimented the Police Department as a reflection of her performance. Several officers, both on and off duty, attended several Halloween events held within the city such as the city's Halloween Festival at the Civic Center, the annual Character Walk held at Faulk Elementary, as well as the annual Trunk or Treat. Training Officer Thomas attended Crisis Intervention Training held in Georgetown, TX. This is a 40-hour course that teaches law enforcement how to respond to people experiencing a mental health crisis Officer Moreno and Corporal Camack attended the Level One ALERRT Instructor course in Center, TX and Houston, TX. This course provides officers with the skills necessary to instruct the ALERRT Active Shooter Response curriculum, a scenario-based training that prepares officers and other first responders to safely and effectively handle active-shooter and other violent threats. Officers Brown, Thomas, and Alvarado attended Intoxilyzer Operator School. This course instructs officers on the proper procedures for operating and obtaining accurate breath samples using the Intoxilyzer 9000 instrument following an arrest for DWI and other eligble offenses. Notable Events Officers participated in attending the annual Thanksgiving Meal held at the Civic Center. Officers attended an event held at the Aransas Pass Moose Lodge where members presented the department with stuffed animals to give to children during stressful encounters. Leadership Aransas Pass class members rode with several Patrol Officers as part of their requirements to complete the curriculum. Officers were led on a vehicle pursuit which ended with one suspect in custody for Evading Arrest in A Vehicle, Possession of a Controlled Substance and a warrant for a Parole Violation. The financial information included with this memorandum is on a cash basis; they are Non-GAAP" statements prepared directly from the City's accounting system. No monthly adjustments or accruals are included on these interim statements; those types of adjusting entries are posted at the end of the fiscal year. The City's General Fund includes year-to-date financial information and operating revenues for the Water/Sewer Fund, Harbor Fund, Aquatic Center, Civic Center, and Hotel/Motel Fund. FY 2024-2025 Investment Report Date: January 13, 2025 The City of Aransas Pass adopted its investment policy that complies with Texas Government Code Sections 2256, Texas Public Funds Investment Act," and 2257, "Texas Public Funds Collateral Act," on February 19, 2024. This report is being presented per Section 2256.023, "Internal Management Reports". ACTIVITIES FOR QUARTER This narrative and Exhibit A, which are attached, provide details on the City's quarterly investing activities. The schedule provides the economic earnings of funds invested. During the quarter, all City operating funds were held in six investment categories: (a) 14.35% was invested in Prosperity Bank checking accounts, (b) 54.06% in TexPool, a government investment pool created on behalf of Texas entities consistent with the Public Funds Investment Act and rated AAAm by Standard and Poor's, and (c) 31.59% in Texas Class, a local government investment pool rated AAAm. All investment categories comply with the City's investment policy. Overal!: For the quarter, an average of $9.135 million was available to invest, and $85,304 was earned, a 3.72% return on investment compared to the benchmark (average 3-month U.S. Treasury Bill) of 4.50%. Bank Checking Accounts: The City earns traditional interest paid in cash on checking account balances. The total amount of traditional interest paid to the City was $920. The total yield for this portion of the portfolio was 0.28%. The bank must secure ("collateralize") all City funds over $250,000 by pledging certain of its assets for the City and have such held by an independent third-party custodian, the Federal Reserve Bank. The custodian sends evidence of this to the City monthly. Article mI. The Council Sec. 1. Number, selection and term. The legislative governing body of the City shall consist of a mayor and four (4) councilpersons and shall be known as the "Council of the City of Aransas Pass.' 99 The members of the Council shall be the only elective officers ofthe City and shall be elected from the City at large, but the Councilpersons shall hold offices designated as Place 1, Place 2, Place 3 and Place 4. Candidates for election to positions on the Council shall file by designated offices. The positions of Mayor, Place 1 and Place 3 shall be elected during odd-numbered years and the positions of Place 2 and Place 4 shall be elected during even-numbered years. The members of the Council shall serve for a term of two (2) years from the date of their election and those elected shall serve until their successors have been duly qualified. Each council member and the mayor shall be eligible for a maximum of three full consecutive terms. Ifa council member or the mayor serves three consecutive full terms, they arei ineligible to run for city council or mayor ofthe City of Aransas Pass for twovears. This paragraphl being adopted by the voters on May 3. 2025, any portion of a term of office served by a council member or the mayor prior to May 4, 2024 shall be counted as the first term under the term limits contained in this paragraph. Any partial term served by any member of council or the mayor as a result of an appointment to fill a vacancy shall not count toward the term limits in this paragraph. All elections are to be held in the manner provided in Article IV of this charter. PROPOSITION Shall the City Charter be amended to clarify the selection process for a member to serve as Mayor Pro-Tempore. The member of council SO elected shall serve: as Mayor Pro-Tempore until the next regular City election and thereafter until the subsequent Mayor Pro- Tempore is elected, but may not serve consecutive terms. In the absence or disability of both the Mayor and the Mayor Pro-Tempore. the most senior council member present shall serve as the presiding officer ofa council meeting. PROPOSITION Shall the City Charter be amended to require the City to post video recordings on its website of all City meetings subject to the Open Meetings Act. All meetings ofthe Council shall be public except when otherwise directed by the Council. Minutes ofall proceedings shall be kept, to which any person may have access at all reasonable times and which shall constitute one of the archives of the City. The vote upon the passage of all ordinances and resolutions shall be taken by the "ayes" and "nays" and entered upon the minutes, and every ordinance or resolution, upon its final passage, shall be recorded in a book kept for that purpose, and shall be authenticated by the signature of the presiding officer and the person performing the duties ofCity Secretary PROPOSITION Shall the City Charter be amended to provide that ordinances requiring publication must also be published on the City's website. Except as otherwise provided by the charter, it shall not be necessary to the validity of any ordinance that it be read or considered at more than one Council meeting. All ordinances, unless otherwise provided by this charter or by the terms of such ordinance, shall take effect immediately upon passage. The City Secretary shall give notice oft the passage ofe every ordinance imposing aj penalty, fine or forfeiture for a violation ofthe provisions thereof, by causing the caption or title, including the penalty, ofany such ordinance to be published once in the official newspaper of the City of Aransas Pass and every such ordinance shall not take effect until after the date of its publication. He/she shall note on every ordinance, the caption of which is hereby required to be published and on the record thereof, the fact that same has been published as required by the charter, and the date of such publication, which shall be prima facie evidence of the legal publication and promulgation of such ordinance; provided, that the provisions ofthis section shall not apply to the correction, amendment, revision and codification of the ordinances of the City for publication book or pamphlet form. Except as otherwise provided by Article XI of the charter, it shall not be necessary to the validity of any ordinance that it shall be read more than one time or considered at more than one session ofthe City Council. Every ordinance shall be authenticated by the signature of the Mayor and City Secretary and shall be systematically recorded timdeve-a-erdnanee-beek-in a manner approved by the Council. It shall only be necessary to record the caption or title of ordinances in the minutes or journal of Council Meetings. All ordinances requiring publication hereunder. and all other documents required by law to be published in the official newspaper of the City, shall also be published on the City's website, or on another publicly accessible website with copy in the City Secretary's office for codes not available on an online platform. PROPOSITION Shall the City Charter be amended to provide reorganizing existing provisions to create a single article containing provisions related to administrative offices and departments ofthe City. Article VI. The City-Manager Administration Sec. 5. Administrative departments. The Council of the City of Aransas Pass may abolish or consolidate such offices and departments as it may deem to be to the best interest oft the City,and may divide the administration of any such department as it may deem advisable: create new departments and may discontinue any offices or departments ati its discretion, except as to the office of City Manager, Municipal CourtJudge, and other offices and departments created by this Charter. Sec. 6. City Secretary. The Council shall appoint a City Secretary. The Council shall have the right to appoint the City Secretary and. in such appointment, shall give consideration to the recommendations of the City Manager, but shall not be bound thereby, and shall have the absolute right to appoint wl hatsoever the Council may deem advisable to the position of City Secretary. The City Secretary shall give notices of Council Meetings. shall keep the minutes ofi its proceedings. shall authenticate by his/her signature and record in full. in a book kept and indexed for the purpose. all ordinances and resolutions. and shall perform such other duties as the City Manager shall assign to him/her, and those elsewhere provided forin this charter, or by ordinance. Sec. 7. Municipal court. (a) There shall be established and maintained a court designated as a "Municipal Court" for the trial of misdemeanor offenses. with all such powers and duties as are now. or hereafter may be. permitted by the laws of the State of Texas concerning Municipal Courts. (b) The Judge of said court shall be a qualified voter and resident of the City. shall be appointed by the City Council, shall hold his/her office at the pleasure of the City Council, shall receive such salary as may be fixed by ordinance of the City Council, and shall meet all qualifications or requirements as may be mandated by the laws of the State of Texas. (d), The clerk of said court and his/her deputies shall have the power to administer oaths and affidavits. make certificates. affix the seal ofs said court. and do and perform any and all acts permitted and required of clerks ofc courts in the State of Texas inj issuing processes and conducting the business of said court. (e) In the event the Judge is absent, disabled, or unable to perform, his/her duties for any cause, or his/her position becomes vacant by reason of death, removal or resignation, the Mayor or Mayor Pro Tempore shall act as Judge of said court, or the Council may appoint an Alternate Judge of said court who shall serve until the Judge of said court returns to his/her duties or a successor is appointed. Any such person as may be appointed as an Alternate Judge shall meet all qualifications for the position as one set forth herein and as mandated by state law. Sec.8. City Attorney. The City Council shall appoint a competent and duly licensed attorney who shall be its City Attorney. He/she shall receive for his/hers services such compensation as may be fixed by the Council and shall hold his/her office at the will oft the City Council and until his/her successor is appointed. He/she shall be the legal adviser of. and attorney and counsel for, the City and all officers and departments thereof. The City Attornev shall represent the City in all litigation, but at the Council's discretion may or may not participatei in litigation. Special attornevs may be emploved under contract and for any purpose, at such fees and for such length of time as the Council may prescribe. Sec. 9. Official bonds ofCity) Manager, City Secretary and Financial Officer. The City Manager, the City Secretarv, and the Financial Officer shall, before entering upon the duties of their offices, enter into a good sufficient fidelity bond in a sum to be determined by the City Council, payable to the City of Aransas Pass and conditioned for the faithful discharge of the duties of such respective officers and for the faithful accounting for all monies. credits and things ofy value coming into the hands of such respective officers: and such bonds shall be signed as surety by some surety company authorized to do business under the laws of this state, and the premium of such bonds shall be paid by the City of Aransas Pass: and such bonds must be acceptable to said City Council. Such employees shall maintain such bonds for the duration of their employment. Sec. 10. Official bond for other officers and employees. The council of the City of Aransas Pass shall have the right to require fidelity bonds from other appointive officers and emplovees of the city, in such amounts as said council may from time to time fix by ordinance or resolution. and conditioned for the faithful discharge of the duties of his/her office and accounting for all monies, credits and things of value coming into the hands of such officers and employees: and all such bonds shall be signed as surety by some surety company authorized to do business under the laws of this state, and the premiums accruing thereon shall be paid by the City of Aransas Pass. Sec. 11. Audit and examination ofthe City books and accounts. The Council shall cause a continuous audit to be made of the books and accounts of each and every department of the City. Such audit shall be made by certified public accountants who shall be selected by the Council and the books of the City shall be audited at least annually, and a complete audit shall be made at the close of each fiscal year, and it shall include a recapitulation of all audits made during the course of each fiscal year, and all audit reports shall be filed with the Council and shall be available for publication or public inspection. Such public accountants sO selected shall have no financial or personal interest in the fiscal affairs of the City, and shall not maintain or keep any of the City's accounts or records. PROPOSITION Shall the City Charter be amended to reduce the number of signatures required on a recall petition to remove any member of council from office. Article V. Initiative, Referendum and Recall Sec. 13. Recall petitions. The citizens of the city shall have the power to remove any member or members of the council from office by recall, and may exercise this power by filing with the city secretary a petition signed by qualified voters ofthe city equal in number to fy twenty-five (50 25) percent ofthe total number of votes cast in the last regular city election, or ve-hundred two hundred fifty (500 250), whichever is greater. The recall petition shall be initiated, signed, verified and filed in the same manner as initiative and referendum petitions. The petition must distinctly and specifically point out the grounds upon which the recall is predicated. No petition papers shall be accepted as part to a petition unless it bears the signature of the city secretary as required in section 12 herein. PROPOSITION Shall the City Charter be amended to require all bond issues over eight million dollars to be approved by the voters. Article VIII. Borrowing for Capital Improvements Sec. 3. Bond ordinance; vote required. The city shall authorize the issuance ofbonds by a "bond ordinance" passed by the affirmative votes ofthe majority ofall members oft the council. Revenue bonds may be issued by the council under the authority of applicable provisions of law. The issuance oft tax bonds must be approved by a majority of the qualified voters voting at an election called for that purpose, provided however that approval of qualified voters shall not be necessary for the refunding of outstanding bonds. All bonds over eight (8) million dollars must be put on an election ballot to be voted on by the registered voters. PROPOSITION Shall the City Charter be amended to require the Finance Director to maintain an inventory of fixed assets and capitalized equipment, including date of purchase, location, purpose, and the name of the employee responsible. Article IX. Finance Administration Sec. 1. Director offinance; powers and duties. The finance director shall have charge of the administration oft the financial affairs of the city and to that end he/she shall have authority and shall be required to: (1) Maintain a general accounting system for the city government and each of its offices, departments and agencies; cause to be kept books for and exercise financial budgetary control over each office, department and agency; keep separate accounts for the items of appropriation contained in the city budget, each of which accounts shall show the amount oft the appropriation, the amounts paid therefrom, the unpaid obligations against it and the unencumbered balance; require reports of receipts and disbursements from each receiving and spending agency ofthe city government to be made daily or at such intervals as he/she may deem expedient; (2) Submit to the council a monthly statement of all receipts and disbursements in sufficient detail to show the exact financial condition ofthe city; (3) Prepare, as of the end of each fiscal year, a complete financial statement and report; (4) Serve as City Treasurer and shall have custody ofall public funds belonging to or under the control ofthe City or any office, department or agency of the City government, and deposit all funds coming into his/her hands in such depositories as may be designated by resolution ofthe Council, subject to the requirements of law as to surety and the payment ofinterest on deposits, but all such interest shall be the property of the City and shall be accounted for and credited to the proper account. (5) Have custody ofall investments and invested funds ofthe city government, or in possession ofsuch government in a fiduciary capacity, and have the safekeeping ofall bonds and notes oft the city and the receipt and delivery of city bonds and notes for transfer, registration or exchange. (6) Supervise and be responsible for the purchase, storage and distribution of all supplies, materials, equipment and other articles used by any office, department or agency ofthe city government. (7) Approve all proposed expenditures. Unless he/she shall certify that there is an unencumbered balance of appropriation and available funds, no appropriation shall be encumbered and no expenditure shall be made. (8) Prescribe the forms of receipts, vouchers, bills or claims to be used by all the offices, departments and agencies of the city government; (9) Audit and approve before payment all bills, invoices, payrolls and other evidences of claims, demands or charges against the city government and with the advice of the city attorney determine the regularity, legality and correctness of such claims, demands or charges; (10) Inspect and audit any accounts or records of financial transactions which may be maintained in any office, department or agency of the city government apart from or subsidiary to the accounts kept in his/her office. (11). Maintain an inventory of all fixed assets and capitalized equipment, including the date of purchase, location, purpose. and the name of the emplovee responsible. No more than 25% ofthe annual collections of hotel occupancy tax funds shall be distributed to any one entity in a single year. For the purpose of promoting the health, safety, morals or general welfare of the city, the council may by ordinance regulate the location, height, bulk and size ofbuildings and other structures, the size of yards, courts and other open spaces, the density of population and the uses ofbuildings, structures and land for trade, industry, business, residence or other purposes. Such ordinances may provide that the zoning board of adjustment may, in appropriate cases and subject to appropriate principles, standards, rules, conditions and safeguards set forth in the ordinance, make special exemptions to the terms of the zoning regulations in harmony with their general purpose and intent. Such ordinances may provide that the zoning board of adjustment may authorize variances from the strict application ofthe regulations in such situations and subject to such limitations as may be set forth in the ordinance. All of the powers granted by Chapter 211 ofthe Texas Government Code, together with existing amendments and all amendments as hereinafter may be made relating to zoning in cities are hereby adopted and made a part of this charter,provided that any notice required by Chapter 211 of the Texas Government Code to be provided to owners of property located within 200 feet of any zoning change shall also be provided to owners of property located within 500 feet of the zoning change. It shall be the duty of the Commission to: (a) Inquire into the operation of the City Government under the Charter provisions and determine whether any such provision requires revision and to this end, public hearings may be held and the Commission shall have the power to compel the attendance of any officer or employee oft the City and to require the submission of any of the City records which it may consider necessary to the conduct of such hearings; (b) Make any recommendations it considers desirable to ensure compliance with the provisions of this Charter by the several departments of the City; (c) Propose amendments to this Charter to improve its effective application to current conditions; (d) Report its findings and present its proposed amendments, if any, to the Council. INTRODUCTION It is the policy of the City of Aransas Pass that the administration of its funds and the investment of those funds shall be handled as its highest public trust. Investments shall be made in a manner which will provide the maximum security of principal while meeting the daily cash flow needs of the City and conforming to the Public Funds Investment Act (the " Act") Texas Government Code Chapter 2256. It is the intent of the City to be in complete compliance with local law and the Act. The receipt of a market rate of return will be secondary to the requirements for safety and liquidity. The earnings from investment will be used in a manner that best serves the interests of the City. The purpose of this Policy is to set specific investment policy and strategy guidelines. Direct specific investment parameters for the investment of public funds in Texas are found in the Act. The Public Funds Collateral Act, Chapter 2257, Texas Government Code, specifies collateral requirements for all public Texas funds deposits. II. SCOPE This investment policy applies to all financial assets of the City and any new funds created unless specifically exempted by the City Council and this Policy. III. OBJECTIVES It ist the policy ofthe City that alli funds shall be managed and invested with four primary objectives, listed in order of their priority: safety, liquidity, diversification and yield. Investments are to be chosen in a manner which promotes diversity. To match anticipated cash flow requirements the maximum weighted average maturity (WAM) of the overall portfolio may not exceed 6 months. Safety The primary objective of the investment activity is the preservation of capital. Each investment transaction shall be conducted in a manner to avoid capital losses, whether from security defaults, safekeeping, or erosion of market value. Investments in high credit quality securities and decisions based on anticipated cash needs are primary factors in providing safety. Liquidity The investment portfolio shall be structured to meet all expected obligations in a timely manner. This shall be achieved by matching investment maturities with forecasted cash flow liabilities and maintaining additional liquidity for unexpected liabilities. Diversification The portfolio shall be diversified by institution, market sector and maturity as much as possible. 1 Yield The benchmark for the commingled portfolio shall be the comparable period of 6 months U.S. Treasury Bill, designated for its comparability to the expected average cash flow pattern and the Policy maximum weighted average maturity (WAM) limit of 6months. The investment program shall seek to augment returns above this threshold consistent with risk limitations identified and the City's prudent investment strategy. Cash management is the process of managing funds in order to insure maximum cash availability and reasonable yield on short-term investments. The City shall strive for a cash management program which includes timely collection of accounts receivable, vendor payments in accordance with invoice terms, and prudent investment of assets. IV. INVESTMENT STRATEGY The City maintains one commingled portfolio for investment purposes which incorporates the specific uses and the unique characteristics of the funds in the portfolio. The investment strategy has as its primary objective assurance that anticipated liabilities are matched and adequate investment liquidity provided. The City shall pursue conservative portfolio management strategy. This may be accomplished by creating a laddered maturity structure with some extension for yield enhancement. The maximum maturity of any security will be 24 months and the maximum dollar weighted average maturity of 6 months or less will be calculatedusing the stated final maturity date of each security. The investment strategy for debt service funds shall have as its primary objective the timely payment of debt service obligations. Successive debt service dates will be fully funded before any investment extensions are made. V. DELEGATION OFI RESPONSIBILITY No unauthorized person may engage in an investment transaction and all transactions shall be executed as provided under the terms of this Policy and its supporting procedures. Investment Officer(s) The City Manager and Director of Finance will be designated as Investment Officers, by governing body resolution, responsible for investment decisions and activities. The Investment Officer(s) are responsible for creating and maintaining the portfolio in accordance with this Policy, providing timely quarterly reporting to the Council, and establishing supporting procedures. The City may further contract with an SEC registered investment adviser for non-discretionary management of the portfolio. All investment officers shall attend at least ten (10) hours of training approved by the City Council within twelve months of designation as investment officer and shall attend eight (8) hours of training every two successive fiscal years. Investment Officers shall refrain from personal and business activity that could conflict with proper execution of the investment program or which could impair their ability to make impartial investment decisions. An Investment Officer who has a personal business relationship within two levels of blood or marriage with an organization seeking to sell an investment to the City shall file a statement disclosing that relationship to the City Council and the Texas Ethics Commission. 2 City Council Responsibilities The City Council holds ultimate fiduciary responsibility for the portfolio. It will designate investment officer(s), receive and review quarterly reporting, approve and provide for investment officer training, approve broker/ dealers, and review and adopt the Investment Policy and Strategy at least annually. VI. PRUDENCE ANDCONTROLS The standard of prudence to be applied to all City investments shall be the "prudent person" rule, which states: 'Investments shall be made with judgment and care, under circumstances then prevailing, which persons of prudence, discretion and intelligence exercise in the management of their own affairs, not for speculation, but for investment, considering the probable safety of their capital as well as the probable income to be derived." In determining whether an investment officer has exercised prudence with respect to an investment decision, the determination shall be made taking into consideration the investment of all funds under the City's control, over which the officer has responsibility rather than a consideration as to the prudence of a single investment. The Investment Officer, acting in accordance with written procedures and exercising due diligence, shall be responsible but not liable for a specific security's credit risk or market price changes, provided that these deviations are reported immediately and that appropriate action is taken to control adverse developments. Internal Controls The Investment Officer is responsible for establishing and maintaining internal controls to reasonably assure that assets are protected from loss, theft, or misuse. The concept of reasonable assurance recognizes that the cost of a control should not exceed the benefits likely to be derived, and, the valuation of costs and benefits requires ongoing estimates and judgments by management. The internal controls shall address the following points at a minimum: Control of collusion, Separation of transaction authority from accounting and record keeping, Custodial safekeeping, Clear delegation of authority, Written confirmation for all transactions, and Review, maintenance and monitoring of security procedures both manual and automated. Annually the Investment Officer shall perform an internal compliance audit to assure compliance with requirements of this Policy and the Act. Annually, the City's external auditor shall review the quarterly reports. Cash Flow Forecasting Cash flow forecasting is designed to protect and sustain cash flow requirements of the City. The Investment Officer will analyze and maintain a cash flow plan to monitor and forecast cash positions for 3 investment purposes. Competitive Bidding All security transactions will be made on documented competitive bid basis to assure the City is receiving good market rates. When-issued US agency securities should be compared to other securities available in the secondary market to determine competitiveness. Monitoring Credit Ratings The Investment Officer shall monitor, on no less than a monthly basis, the credit rating on all authorized investments in the portfolio which require credit ratings based upon independent information from a nationally recognized rating agency. If any security falls below the minimum rating required by Policy, the Investment Officer shallnotify the City Council of the loss of rating, and liquidate the investment within two days. Monitoring FDIC Status for Mergers and Acquisitions The Investment Officer shall monitor, on no less than a weekly basis, the status and ownership of all banks issuing brokered CD securities owned by the City based upon information from the FDIC (fdic.gov). If any bank has been acquired or merged with another bank in which brokered CDs are owned by the City, the Investment Officer or Adviser shall immediately liquidate any brokered CD which places the City above the FDIC insurance level. VII. AUTHORIZED INVESTMENTS Assets of the City may be invested only in the following instruments as further defined by the Act. If changes are made to the Act they will not be authorized until this Policy is modified and adopted by the City Council. All investment transactions will be made on a competitivebasis. A. Obligations of the United States Government, its agencies and instrumentalities with a maximum stated maturity of 2 year excluding mortgage backed securities B. Fully insured or collateralized depository certificates of deposit from banks in Texas, with a maximum maturity of 2 year insured by the Federal Deposit Insurance Corporation, or its successor, or dlateralizedinacordancewiththsPoliy, C. AAA-rated, Texas Local Government Investment Pools which strive to maintain a $1 net asset value (NAV) as defined by the Act and authorized by resolution of the City Council. D. AAA-rated, SEC registered money market mutual funds striving to maintain a $1 net asset value. E. FDIC insured, brokered certificates of deposit securities from a bank in any US state, delivered versus payment to the City's safekeeping agent, not to exceed 12 months maturity. Before purchase, the Investment Officer must verify the FDIC status of the bank on www fdic.gov to assure that the bank is FDIC insured F. FDIC insured or collateralized interest bearing and money market accounts from any FDIC insured bank in Texas. 4 Deliveryversus Payment All securities shall be purchased on a delivery versus payment (DVP) settlement basis. Funds shall not be released until receipt of the security by the City's approved custodian. The custodian shall provide the City with proof of ownership or claim by an original document delivered to theCity. VIII. REPORTING Quarterly Reporting The Investment Officers shall submit a signed quarterly investment report to the governing body in accordance with the Act giving detail information on each portfolio and bank position and summary information to permit an informed outside reader to evaluate the performance of the investment program. The report will include the following at a minimum: A full description of each individual security or bank/pool position held at the end of the reporting period including the amortized book and market value at the beginning and end of the period, Unrealized gains or losses (book value minus market value), Overall change in market value during the period as a measure of volatility, Weighted average yield of the portfolio and its applicable benchmarks, Earnings for the period, Allocation analysis of the total portfolio by market sector and maturity, and Statement of compliance of the investment portfolio with the Act and the Investment Policy signed by the Investment Officer(s). Market prices for the calculation of market value will be obtained from independent sources. IX. FINANCIAL COUNTER-PARTIES Depository At least every five years, a banking services depository shall be selected through a competitive request for proposal or bid process in accordance with the Texas Government Code 105. In selecting a depository, the services, cost of services, credit worthiness, earnings potential, and collateralization by the institutions shall be considered. If securities require safekeeping, the RFP/bid will request information on safekeeping services. The depository contract will provide for collateral if balances exceed the FDIC insurance balance per tax identification number. All time and demand deposits in any depository of the City shall be insured or collateralized at all times in accordance with this Policy. Other banking institutions, from which the City may purchase certificates of deposit or place interest bearing accounts, will also be designated as a depository for depository/collateral purposes. All depositories will execute a depository agreement and have the Bank's Board or Bank Loan Committee pass a resolution approving the agreement if collateral is required. 5 Security Broker/Dealers All pools, financial institutions, and broker/dealers who desire to transact business with the City must supply the following documents to the Investments Officer(s). (if brokers) Financial Industry Regulatory Authority (FINRA) certification and CRD # (if brokers) proof of Texas State Securities registration policy review certification Each pool/bank/broker must be provided a copy of the City's current Investment Policy and certify to a review of the Policy stating that the firm has controls in place to assure only Policy approved investments will be sold to the City. A list of qualified broker/dealers will be reviewed at least annually by the City Council. In order to perfect the DVP process the banking services depository, ori its brokerage subsidiary, will not be used as a broker. XI. COLLATERAL Time and Demand Deposits Pledged Collateral All bank time and demand deposits shall be collateralized above the FDIC coverage by pledged collateral. In order to anticipate market changes and provide a level of security for all funds, collateral will be maintained and monitored by the pledging depository at 102% of market value of principal and accrued interest on the deposit S. The bank shall monitor and maintain the margins on a daily basis. Collateral pledged to secure deposits shall be held by an independent financial institution outside the holding company of the depository. The collateral agreement with the depository shall be approved by resolution of the Bank Board or Bank Loan Committee. The Custodian shall provide a monthly report of collateral directly to the City. All collateral shall be subject to inspection and audit by the City or its independent auditors. Authorized Collateral Only thet following securities are authorized as collateral for time and demand deposits or repurchase agreements: A. FDIC insurance coverage. B. All safekeeping arrangements shall be approved by the Investment Officer and an agreement 6 of the terms executed in writing. The independent third party custodian shall be required to issue safekeeping receipts to the City listing each specific security, rate, description, maturity, cusip number, and other pertinent information XII. If any provision, section, subsection, sentence, clause or phrase of this ordinance, or the application of same to any person or set of circumstances, is for any reason held to be unconstitutional, void, or invalid, the validity of the remaining provisions of this Ordinance shall not be affected, and it is the intent of the City Council in adopting this Ordinance that no portion, provision, or regulation herein shall become inoperative or fail by reason of any unconstitutionality, voidness, or invalidity of any other portion, provision or regulation, and all provisions of this Ordinance are declared to be severable for that purpose. 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval by the City Council of the City of Aransas Pass. BACKGROUND AND FINDINGS: The Civic Center is asking for support to fund a Spring Break concert to draw traveling guests and revenue for the local businesses on March 13th, 2025. The proposed entertainment is the Spazmatics at a cost of $11,000.00. Staff requests the use of HOT funds for this cost. This concert has the potential to generate out of town travelers to our city through hotel bookings. STAFF RECOMENDATION: Approve the use of HOT funds for the concert at the Civic Center.
