CITY COUNCIL MINUTES MEETING LOCATION: ALEDO COMMUNITY CENTER 104 ROBINSON COURT ALEDO, TEXAS 76008 THURSDAY,SEPTEMBER 26, 2024 6:00 P.M. CALL REGULAR MEETING TO ORDER 1. CALL TO ORDER Mayor Pro Tem Nelson Rowls called the regular meeting of the City Council to order at 6:01 pm on Thursday, September 26, 2024 at the Aledo Community Center 104 Robinson Court. Those in attendance at this meeting were Mayor Pro Tem Nelson Rowls, Councilmember Shawna Ford, Councilmember Summer Jones and Councilmember Christian Pearson. Mayor Nick Stanley was not present at this meeting having given prior notice of his absence. Staff present were City Manager Noah Simon, Finance Manager Jennifer Garrett, Director of Public Works Luis Gatica, Assistant to the City Manager Josh Blubaugh Communications and City Secretary Deana McMullen, and City Attnorney Alicia Kreh. 2. INVOCATION AND PLEDGE OF ALLEGIANCE Councilmember Summer Jones gave the Invocation. Mayor Pro Tem Nelson Rowls led the Pledge of Allegiance given by all present. 3. CITIZEN APPEARANCES: This is an opportunity for citizens to address the City Council on any agenda item not listed for public hearing or any matter not posted on the agenda. This is the citizens' only opportunity to address the City Council on agenda items not listed for public hearing. Individual citizen comments are normally limited to three (3) minutes; however, time limits can be adjusted by the presiding officer. Time is not transferable. The presiding officer may ask the citizen to hold their comment on an agenda item if the item is posted as a Public Hearing. The City Council cannot by law take any action nor have any discussion or deliberations on any presentation made at this time concerning an item not listed on the agenda. The City Council will receive the information, and ask the City Manager to review the matter, or an item may be noticed on a future agenda for deliberation or action. Please sign in before the start of the meeting and provide the paper to the City Secretary. There were no Citizen Appearances for this meeting. 4. PRESENTATIONS AND PROCLAMATIONS Mayor Pro Tem Nelson Rowls asked the Council and Audience to give outgoing City Secretary Deana McMullen a standing ovation for all ofher years of service to the City of Aledo. 5. CONSENT AGENDA: All items listed below are considered routine by the City Council and will be enacted with one motion. There will be no separate discussion of items unless a Council Member requests, in which event the item will be removed from the general order of business and considered in its normal sequence. Approval of the Consent Agenda authorizes the City Manager to implement each item in accordance with the staff recommendation. The consent Agenda was presented as follows: a. Consider approval of the City Council meeting minutes from the following meetings: i. September 5, 2024, City Council regular meeting. b. Consider approval of Resolution 2024 --196, a Resolution approving an Interlocal Agreement with the Parker County Sheriffs Office for the provision of police protection services. C. Consider approval of Resolution 2024--197, a Resolution approving a Parking Lot License Agreement between the City and M2G Ventures to provide additional parking for the ice-skating event. d. Consider approval of Resolution 2024--198, a Resolution authorizing the City of Aledo to remain in Class Action Settlements involving Tyco Fire Products LP and BASF Corporation, regarding the manufacturing of aqueous film foaming products. Motion was made by Councilmember Shawna Ford seconded by Councilmember Shane Davis to approve the Consent Agenda as presented. Motion carried 5-0 6. REPORTS AND UPDATES: Reports and Updates are prepared for informational purposes and will be accepted as presented (there will be no presentations associated with the report items). The City Council may discuss information presented in the reports, but no action will be taken on these items unless listed as an action item below or placed on a future agenda. There were no reports or updates for this meeting. 7. PUBLIC HEARINGS AND CITY COUNCIL ACTION ITEMS The following items are the regular business of the City Council. If any item requires a public hearing, it will be noted in the caption of the item. a. Discuss and consider Ordinance 2024--216, an Ordinance amending the Aledo Code of Ordinances, by adding Article IX, "Property Maintenance Standards, to Chapter 10, "Buildings and Building Regulations, 29 to provide fence maintenance standards to the Code of Ordinances. Director of Public Works addressed the Council regarding Ordinance 2024-216 that amends the Code of Ordinances by adding Property Maintenance Standards to Chapter 10 to provide fence maintenance standards to the Code of Ordinances. CITY OF ALEDO, TEXAS ORDINANCE 2024--216 AN ORDINANCE OF THE CITY OF ALEDO, TEXAS, AMENDING THE ALEDO CODE OF ORDINANCES, CHAPTER 10, BUILDINGS AND BUILDING REGULATIONS, 99 BY ADDING A NEW ARTICLE, ARTICLE IX, "PROPERTY MAINTENANCE STANDARDS," TO PROVIDE FENCE MAINTENANCE STANDARDS AND TO AUTHORIZE THE CITY'S BUILDING OFFICIAL TO ENFORCE AND ADMINISTER THIS ARTICLE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. Motion was made Councilmember Christian Pearson, seconded by Councilmember Shane Davis to approve Ordinance 2024-216 that amends the Aledo Code of Ordinances, by adding Article IX, "Property Maintenance Standards, to Chapter 10, "Buildings and Building Regulations, 99 to provide fence maintenance standards to the Code of Ordinances. Motion carried 5-0 b. Discuss and consider Ordinance 2024- -217, an Ordinance amending the Aledo Code of Ordinances, by adding Article III, "Stopping, Standing, and Parking, 9 to Chapter 62, "Streets, Sidewalks, and Other Public Property," to establish limitations for parking on City Streets. Director of Public Works Luis Gatica was present to address the Council in reference to amending the Aledo Code of Ordinances to establish limitations for parking on City Streets. He stated that the Unified Development Code addresses this issue however it is only for new development. The proposed ordinance would address issues regarding parking on city streets, on grass, sidewalks, etc.. throughout the City, not just new developments. ORDINANCE 2024--217 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ALEDO, TEXAS, AMENDING CHAPTER 62, "STREETS, SIDEWALKS AND OTHER PUBLIC PROPERTY" OF THE CITY OF ALEDO ZONING ORDINANCE, BY ADDING ARTICLE III, "STOPPING, STANDING, AND PARKING," TO ESTABLISH LIMITATIONS FOR PARKING ON CITY STREETS; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION: AND PROVIDING AN EFFECTIVE DATE. Motion was made by Councilmember Shane Davis, seconded by Councilmember Shawna Ford to approve the proposed ordinance establishing limitations for parking on City Streets as discussed. Motion carried 5-0 8. BOARDS/COMMISSIONS/COMMITTEES a. Discuss and consider removal of commissioners from Board/Commissions/Committees. This item will be discussed in Executive Session b. AppointmeReuppomntmen to Boards/Commissions/Committees Consider approval regarding appointments to Boards/Commissions/Committees: This item will be discussed in Executive Session C. Discuss and consider accepting the Report concerning Board and Commission meeting activity for the past year, October 1, 2023, through September 30, 2024. City Secretary Deana McMullen gave the annual report regarding Board and Commission meeting activities for the past year and stated she polled all members whose term expired in even numbered years (2024) and all were willing to serve another term for the various boards with the exception of two members on Planning & Zoning, Mr. Jeff Corby and Mr. Eric Grimm due to conflicts in schedules of meetings VS. their jobs. Motion was made by Councilmember Shane Davis, seconded by Councilmember Christian Pearson to accept the board report as it was presented. Motion carried 5-0 d. Discuss, consider, and accept the resignation of Jeff Corby, Chair, Planning and Zoning Commission. Discuss, consider, and accept the resignation of Eric Grimm, Vice Chair, Planning and Zoning Commission. Motion was made by Councilmember Shane Davis, seconded by Councilmember Shawna Ford to accept the resignation of Eric Grimm, Vice Chair, Planning & Zoning Commission. Motion carried 5-0 9. EXECUTIVE SESSION: Pursuant to the Texas Open Meetings Act, Chapter 551 ofthe Texas Government Code, the City Council may convene in executive session to deliberate regarding the following matters: Mayor Pro Tem Nelson Rowls adjourned the regular session into Executive session at 6:17 p.m. Those in attendance of the Executive session were Mayor Pro Tem Nelson Rowls, Councilmember Shane Davis, Councilmember Christian Pearson, Councilmember Shawna Ford, Councilmember Summer Jones, City Manager Noah Simon and City Attorney Alicia Kreh. To conduct a private consultation with the City Attorney on any legally posted agenda item, when the City Council seeks the advice of its attorney about pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the governmental body under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the provisions of Chapter 551, including the following items: Potential Annexation North of Dean Ranch to I-20. Dean Ranch Development Conversation. Grand Prairie V. State - S.B. 2038 lawsuit. Potential Annexation of Property at 2 Dean Drive. $ 551.074. Deliberation regarding Personnel Matters. The City Council may convene into executive session to discuss and deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee or to hear a complaint or charge against an officer or employee, including the following: Officers' removal from and/or appointment to the Parks Board, Aledo Economic Commission, Planning and Zoning Commission, Zoning Board of Adjustment, Veterans Advisory Board, and Public Safety Advisory Committee. City Secretary. 10. ADJOURN EXECUTIVE SESSION AND RECONVENE INTO OPEN SESSION Mayor Pro Tem Nelson Rowls adjourned the Executive Session at 6:55 pm and reconvened the regular session at 6:32 p.m. 11. COUNCIL RECAP/STAFF COMMENTS DIRECTION: (In compliance with the Texas Open Meetings Act, Council members may comment on routine city matters, may ask questions of staff that require only responses of factual information or statements of existing City policy, or may request that non-routine matters of public concern be placed on a future agenda. Council members may not discuss non-agenda items among themselves. In compliance with the Texas Open Meetings Act, staff members may comment on routine City operations and projects.
