MOUNTAIN VIEW TOWN COUNCIL REGULAR MEETING THE BERKELEY CHURCH 5200 W 43RD AVE, MOUNTAIN VIEW, CO 80212 December 16, 2024 1. Call to Order Mayor Mitcham called the meeting to order at 6:30 p.m. in Town Hall, 4176 Benton Street, Mountain View, Colorado. 2. Executive Session: Mayor Pro Tem Bailey made a motion for Council to enter into an executive session for the purposes of determining positions relative to matters that may be subject to negotiations; developing strategy for negotiations; and instructing negotiators under C.R.S. S 24-6-402(4)(b) regarding a development proposal in Town. It was seconded. Council entered into executive session at 6:36 p.m. and returned to the regular meeting Motion passed unanimously by roll call vote. at 7:02 p.m. 3. Roll Call Present: Mayor Emilie Mitcham, Council Member Leal Algiene, Mayor Pro Tem Kathleen Bailey, Council Member Laura Dennis, Council Member Brittany Loecher, Council Member Brent Metz, and Council Member Nancy Unger. Proclamation: National Radon Action Month in Mountain View, Colorado Mayor Mitcham explained that Mountain View is participating in this national effort. 6. Resolution No. 2024-12-16K- Al Resolution oft the Town of Mountain View Amending Mayor Pro Tem Bailey moved to approve Resolution No. 2024-12-16A. Itwas Mayor Mitcham introduced the Resolution, explaining that the goal was to provide the Town Attorney with Council's perspectives in order to draft updated, more specific rules relating to public commenter's requirements to disclose personal information in written Mayor Pro Tem Bailey moved to table Resolution No. 2024-12-16A. Town resident Dodie Dosh asked why the senior and pay-in-full discounts were Town resident Ryan Debner offered ideas such as email confirmation receipts for written comments, splitting the workshop and regular meetings, as well as drafting 9. Resolution No. 2024-12-16G - A Resolution Re-Appointing John Beltrone as the Mayor Pro Tem Bailey moved to adopt Resolution No. 2024-12-16G. Itv was minutes for workshop meetings. Interim Town Clerk for the Town of Mountain View, Colorado seconded. Administrator Beltrone explained an issue with the hiring process for the Clerk, citing one applicant's conflict of interest with the Mayor and asking a Council Member to volunteer to serve on the hiring committee alongside Mayor Pro Tem Bailey. Council Member Algiene volunteered. Administrator Beltrone encouraged Council to keep him as Interim Town Clerk in the meantime. The resolution was adopted by roll call vote unanimously. 10. Ordinance No. 2024-12-16A - First Reading - An Ordinance Amending Section 18.13.020 of the Town of Mountain View Municipal Code Regarding International Mayor Pro Tem Bailey moved to adopt Ordinance 2024-12-16A. It was seconded. Town Attorney Flanagan explained that this ordinance parallels changes at the last meeting and extends the construction standards to the residential code as well. 11. Resolution No. 2024-12-16H - Al Resolution of the Town of Mountain View, Mayor Pro Tem Bailey moved to adopt Resolution 2024-12-16H. It was seconded. Administrator Beltrone explained that staff have worked on compiling current fees into one document in order to review fees and be able to update them efficiently. This Residential Code Construction Standards The ordinance was adopted by roll call vote unanimously. Colorado Re-instating Town Adopted Fees Resolution is not changing fees and only restating them. The resolution was adopted by roll call vote unanimously. 12. Break - Mayor Mitcham called for a break at 7:41 p.m. and reconvened the meeting 13. Resolution No. 2024-12-161 = A Resolution of the Town of Mountain View, Mayor Pro Tem Bailey moved to adopt Resolution 2024-12-161. It was seconded. Administrator Beltrone mentioned the letter and draft bill in the packet and explained that this resolution will simplify utility billing and make it fair for everyone. Typical single- family homes will see similar bills, but some properties will increase, commercial properties having the largest increases. Also noted were the additional fees per extra trash cart, and the removal of the senior and pay-in-advance discounts. Discounts were disposed of to take burden and complexity off of staff, and the grant program was created in order to take its place for those who demonstrate financial need. After Council discussion, the resolution was adopted unanimously by roll call vote. 13. Resolution No. 2024-12-16J - A Resolution of the Town of Mountain View, at 7:51 p.m. Colorado Amending Wastewater and Trash Service Fees Colorado Creating a Needs-Based Grant Program Mayor Pro Tem Bailey moved to adopt Resolution 2024-12-16J. Itwas seconded. Mayor Mitcham introduced the resolution as administratively very similar to the sidewalk grant program and stated that the amounts awarded were up to Council. Council discussion included dissatisfaction with the $100 grant amount as well as questions regarding statistics and outreach. Administrator Beltrone reiterated that the goal for the enterprise fund was to break even and that the grant numbers will be continuously reported to Council in order to maintain transparency and efficiency. Council discussed reducing the income threshold for eligibility as well as increasing the Council Member Loecher moved to amend Resolution 2024-12-16J to move the income eligibility threshold to 50% and the grant amount to $500. It was seconded. After Council discussion, Council Member Loecher moved to amend her prior motion to increase the income eligibility threshold to 60% and decrease the grant amount to $300. grant amount. Itwas seconded. Motion passed unanimously by roll call vote. 14. General Business Discussion Planning Consultant for Residential Development Administrator Beltrone reported that the committee decided to pursue a Request for Proposal (RFP) in order to select a planning consultant for residential development standards. Proposals will be due by the end of. January, and the selected vendor will hopefully start work in March with the goal of presenting their recommendations at the July regular meeting. Council Members Algiene and Loecher noted the importance of transparency, a neutral vendor, and a broad scope of work. Administrator Beltrone Standards Analysis noted community engagement. 15. Staff Reports A. Police Department Police Chief Nesbitt reported on the automated vehicle identification system: warnings are being sent out until January. The statistics gathered before photo radar installation reported roughly 100 cars a day over 10mph over the speed limit, and the statistics gathered by the photo radar are very similar. The high speed alert is set right now at 70 mph; since November 26th, there have been 13 high speed alerts with the highest speed being 90 mph. Chief Nesbitt noted that the warning phase will assist with the ultimate goal of safety. Additionally, a patrol car was replaced, and the police department is working to have it outfitted. The total money spent on the new car should be roughly the same amount as was paid out by CIRSA for the old, damaged car. Chief Nesbitt thanked Corporal Ranck for acquiring new fingerprint readers which help identify people without identification. The police department is still investigating a sex assault that occurred in October. Evidence was submitted to the Colorado Bureau of Investigation (CBI) and updates will be given at the next meeting. Sergeant Behrman organized a blood drive on January 6th. B. Public Works Department Public Works Coordinator David Nugent reported that Denver Water communicated that they will not be doing the lead pipe replacement in Town. Wheat Ridge Water was notified and is reaching out to Denver Water to confirm who is responsible for Mountain View's lead pipe replacement. Coordinator Nugent met with the original engineer for 4185 Ames St and confirmed the structural integrity of the foundation aside from one spot being investigated. The floor loads will also need to be updated from residential limits to commercial. The engineering plans would cost roughly $5,000. The construction fence was removed. Installing a backup generator is still being looked at to counter power-outages, which is particularly important for police matters. Vision triangle spots are still being worked on and more curb painting will be done with good weather. Sharp metal has been collected from the 4183 Ames lot and gravel will be ordered for less the $1000 to create extra parking behind Town Hall. Mayor Mitcham thanked Coordinator Nugent for his contribution to the Neighborhood Gazette newspaper. C. Town Administrator Administrator Beltrone thanked staff for their work on the automated vehicle identification system. The 2025 budget and tax levy have been adopted and submitted to the state and county. Budget corrections and fieldwork for the financial audit willl be worked on in January. Administrator Beltrone thanked Council and staff for their work on the updated utility billing. Mayor Mitcham thanked Beltrone for all his hard work. 16. Council and Committee Reports A. Mayor's Report process. B. Events Committee Mayor Mitcham spoke about the 2025 calendar and asked Council to review it and offer suggestions. She also explained the Town Administrator review Council Member Loecher thanked the Town's special Santa and everyone for coming to the holiday event, and to everyone involved in the toy drive. Mayor Mitcham thanked Council Member Loecher for her hard work volunteering to put on the community events. C. Historical Mountain View Committee Mayor Pro Tem Bailey said the report was in the packet. D. Town Hall Remodel Project Council Member Metz stated he is working with Coordinator Nugent to get budget numbers together for different options and thanked Coordinator Nugent for his hard work. Council Member Metz said he was happy to continue to assist in whatever ways he was needed for this project. Administrator Beltrone reviewed all future agenda items and asked for any updates. Mayor Mitcham thanked Administrator Beltrone for his future agenda work and asked Council to communicate future agenda updates. Council had 17.
