MINUTES OF THE GOVERNING BODY OF THE CITY OF DIBOLL, TEXAS REGULAR SESSION MEETING ON TUESDAY, MAY 14, 2024, AT 5:15 P.M., IN THE DIBOLL CITY HALL CHAMBERS. COUNCIL PRESENT Mayor Trey Wilkerson, Mayor Pro Tem Daniel Lopez, Councilmembers Jana Coulter, Luis Maldonado, Nora Munoz and Ruben Terrazas COUNCIL ABSENT Councilmember Ray Williams, Jr. STAFF PRESENT City Manager Jason A. Arnold, City Secretary Rosa Olvera, Finance Director Sam Durham, ChiefofPolice Michael Skillern and Public Works Director Joshua Richard Call to Order: Mayor Trey Wilkerson called the meeting to order at 5:15p.m. Mayor Trey Wilkerson gave the invocation, then led the Pledge of Allegiance which was recited by those in attendance. C CITIZENS PRESENTATION: (Limited to 3 minutes) This item provides the opportunity.to,a address the City Council on any matter whether or not itisp posted ont the agenda. However, in accordance with the Texas Open Meetings Act, Section 551.041, the Council cannot discuss, deliberate, or take any action on matters not listed on the agenda. At this time, the Council will receive citizen comments, and if necessary, may refer the matter to City staff for research, resolution, or referral to Council on a future agenda. Public Participation: NONE Item #1: CONSENT AGENDA: All matters listed under Consent Agenda are considered to be routine by the City Council and will be enacted by one motion. There will not be separate discussion. If discussion is desired, that item will be removed from the consent agenda and will be considered separately. Consider approval oft the following reports: a. Minutes from April 9, 2024, Regular Session Meeting b. Financial Statement for April 2024 12-Month Attendance Record for April 2024 d. Investment Report for Quarter ending March 2024 All in Favor, none opposed, motion carries. Daniel Lopez made a motion to approve and Luis Maldonado second. Item #2: Oath of office administered by Justice of the Peace Precinct 4, the honorable Rodney Cheshire, to swear-in unopposed Council Members. JPI Rodney Cheshire administered the Oath ofOfficea and sworn in Council: Mayor, Trey Wilkerson; Councilmember District 2, Luis Maldonado; Councilmember District 4, Daniel Lopez. Page 1of5 Item #3: Consideration and possible action to nominate and vote for a Mayor Pro Tem. Daniel Lopez was nominated by Jana Coulter. No other nominations. Jana Coulter made a motion to approve Daniel Lopez for Mayor Pro Tem and Luis Maldonado second. All inl Favor, none opposed, motion carries. Item #4: Mayor Trey Wilkerson to present the Oath and Statement of Officer to newly hired Police Officer. Chief of Police Michael Skillern introduced Officer Ham and Mayor Trey Wilkerson administered the Oath ofOffice. Item #5: Recognition of Police Officer Feliciano (Felix) Estrada for his 20 years ofs service. Chief of Police Michael Skillern and Assistant Chief of Police Jacob Hopper presented Officer Estrada with a Years of Service Recognition Award with the Diboll Police Department and the City ofDiboll. Item #6: Presentation ofLife Saving Award by Police Chief. Dispatcher Brian Tomez, Sergeant Isaias Rodriguez and Officer Sterling Linebaugh were each presented with a Life Saving Award by Chiefof Police Michael Skillern. The citizen they rendered aid to was present and also gave thanks to the group. Item #7: Consideration and possible action to approve Ordinance 2024-05-001 that formally announces the pursuit of "Recognized" status from the Texas Police Chiefs Association's Law Enforcement Best Business Practices Recognition Program and meeting the minimal requirements to dos SO. ChiefofPolice Michael Skillern gave a briefoverview to Council. Daniel Lopez made a motion to approve and Nora Munoz second. All inl Favor, none opposed, motion carries. Item #8: Diboll Booster Club to present the 2024 Diboll Day Queen Candidates. President of the Diboll Booster Club, Rodney Cheshire gave a 2024 Diboll Day event brief and presented the Diboll Day Queen Candidates: Hannah Jones, Hailey Lovelady, Kyna Rios and Ariel Webb Item #9: Consideration and possible action to approve bid results for the 2024 Street Overlay Project. Danny Hays with KSA gave an overview oft the bid results to Council and Jason Arnold gave his recommendation to award bid to Lakey, Inc. ofLufkin, Texas. Daniel Lopez made a motion to approve and Luis Maldonado second. All in Favor, none opposed, motion carries. Item #10: Consideration and possible action to approve the TLL Temple Library Endowment Page 2of5 expenditure in the amount of $35,000 for flood damage repairs. Finance Committee recommended approval at May 14, 2024 Finance Committee Meeting. Council reviewed the letter from TLL Temple Library detailing the request. Jana Coulter made a motion to approve and Nora Munoz second. All in Favor, none opposed, motion carries. Item #11: Consideration and possible action to approve the Special Event Permit Application Policy. Luis Maldonado made a motion to approve and Ruben Terrazas second. All in Favor, none opposed, motion carries. Item #12: Consideration and possible action to approve the Citizen Award and Recognition Program. Luis Maldonado made a motion to approve and Daniel Lopez second. All in Favor, none opposed, motion carries. Item #13: Consideration and possible action to approve Ordinance 2024-05-002 for the second (2nd) amendment to the 2023-2024 Operating Budget. Nora Munoz made a motion to approve and Luis Maldonado second. All in Favor, none opposed, motion carries. Item #14: PUBLIC HEARING regarding proposed Zoning Change at 1410N N Hendrick Ave, Diboll, Texas from ("B2") Business District to ("SF2") Mixed Residential District as recommended by the Public Participation: Tami Jones, Realtor representing the seller oft this property spoke briefly Planning and Zoning Commission. regarding the requested change. OPEN: 5:52p.m. CLOSED: 5:53p.m. Item #15: Consideration and possible action to approve Ordinance 2024-05-003, Zoning Change at 1410 N Hendrick Ave, Diboll, Texas. Daniel Lopez made ai motion to approve and Luis Maldonado second. All in Favor, none opposed, motion carries. Item #16: PUBLIC HEARING regarding proposed voluntary annexation of the following one (I) Property in Angelina County, Property ID 39951, Owner- GALLTER INVESMENTS LLC Public Participation: NONE OPEN: 5:54p.m. CLOSED: 5:54p.m annexation, Property ID 39951. Item #20: The Diboll City Council willconvene intoa closed Executive Session, in accordance with Open Meetings Act, Chapter 551, Texas Government Code 551.074, for the purpose of Council will reconvene into open session following closed door session and possibly take action discussing appointment for Councilmember Districtl. on matters discussed in Executive Session.
