BZA CASES Mr. Gray shared with the Commission Case No. 6531,arequest: for variance oft the distance requirement of the detached accessory dwelling unit at 2154 Emhoff Drive, Westminster. The Planning staff has no additional comments for this proposed variance. Ms. Fillat shared with the Commission Case No. 6533, a request for a conditional use for al Daycare Center /1 Nursery School at 2710 Hampstead New Mexico Road, Hampstead, Four Season Facility. The lot is 18.9 acres and is in the County's Agricultural Zone. The Planning staff finds this request for conditional use consistent with the Carroll County Master Plan, Amended in 2019. With the provisions oft the Code at the time, the Commission approved the plan as presented. Section one of Devlin Square was then recorded on December Within this subdivision, Parcels 'B' and 'C' were to hosts stormwater management facilities for the subdivision and were deeded to the Carroll County Commissioners. The facilities were constructed and were in use until 2021. In 2021, the storm water associated with the two facilities was rerouted to the existing Willow Pond along Sunshine Way, rendering the two facilities unnecessary. The two facilities were then decommissioned; the fencing was removed, and the facilities were filled in. On December 14, 2023, The County Commissioners helda public hearing on the possible transfer oft the Parcels to the Arc ofCarroll County, resulting in Staff and the developer are requesting approval of the proposed modification to the Preliminary Plan of Devlin Square changing the designation oft the parcel to buildable lots, allowing residential construction on each lot. Following the Planning and Zoning Commision'sapproval, an amended preliminary plan will be reviewed, and the associated record plat will be processed 19, 1980, in Plat Book 23, Page 92 (plat attached). Also present were Don Rowe, Executive Director with Carroll County Arc and Michelle Mr. Kane asked ift the lots are zoned Agricultural with a lot size ofa quarter acre. Mr. Becraft explained the zoning for the area is R-10,000, one parcel is around 12,000 square feet and the Mr. Kane asked if both parcels must go through Chapters 155 and 156: review. Mr. Becraft explained following this special report they will go through the amended plat process, which is Mr. Kane asked ift these houses will be permanent residences or offices. Mr. Rowe explained these two homes will be handicapped accessible for three individuals, per home, with disabilities. Beverly Polites, citizen, said she is concerned about the amount of traffic and parking along the Mr. Rowe explained the staff would have two vehicles and the residence would have a vehicle. There will be no garage, just a parking pad. The driveways would be off Snowfall Way. Mr. Kane asked whether, as this project goes through the review stages, they would review this intersection. BREAK Madam Chair reconvened the Planning and Zoning Commission meeting at 10:20 am. 2023 WATER AND SEWER MASTER PLAN- Andrew Gray recapped the presentation that was before the Commission on November 6, 2024. Mr. Gray concluded by stating he will go before the Board of County Commissioners to request ap public hearing and request the Board of County Commissioners adopt the Fall Amendment to the 2023 Water and Sewer Master Plan. Discussion: Mr. Kane stated the Commission is currently working on the 2024 Master Plan. He asked whether, when the 2024 Master Plan is completed, everything rolls overi into the new Master Plan. Ms. Daly explained every amendment that comes before the Commission isj judged oni the current active Master Plan. Once the new Master Plan is adopted, it will roll in the amended Water and Sewer Master Plan that is current at the time. Public Comment: There were none. He questioned whether the Commission should increase the amount of building permits, even though the developers do not reach the existing limits. Ms. Matyas explained the request is to look at the number ofb building permits allowed according to today's growth rate and determine if Mr. Heyn explained the County's.code currently has al limit of25 building permits per year per project. There are projects coming in that would affect these building permit limitations. The question is whether to keep the limit at 25 building permits per year or increase this amount. Alternatively, builders could request a waiver ofthe limit, or those limits could be removed from the code entirely. All other ordinances affecting the approval process would remain in place. Mr. Robertson asked ift the 25-building permit limit is related to concurrency management.
