(b) Exceptions to this section include: (1)P Property where outdoor storage is authorized by the zoning ordinance or action; (2).Cut wood which is neatly stacked in lengths not to exceed three feet fort the personal use ofthe owner or occupant and which is stored in a side or rear yard; (3) Rubbish, garbage, trash or other similar items plaçed outside for collection by an authorized wastel hauler not more than 241 hours prior to the designated collection date for that property." SECTION2. That Section 31-127, Chapter31 ofCodeofOrdmances ofWalnut Grove, Georgia bel hereby deleted ini its entirety and replaced with the following: "Sec.31-127.Junk Vehicles. (a) Junk vehicle means any vehicle, automobile, truck, van, trailer of any kind or type, or contrivance or part thereof which is wrecked, dismantled, partially dismantled, stripped, ----- or kept parked, stored or maintainedon any premises or publierghntd'waywtnour a currentlicense plate and/or decal displayed on the vehicle. (b). Junk vehicles shall not be kept, permitted, parked, stored or maintained on any premises or public right-of-way. (c) Exceptions to this section include: (1) Junk vehicles, which are kept within ai fully enclosed building onj property in residential zoning districts, provided the owner or occupant of thej property is in thej process ofreconditioning the junk vehicle for personal use; (2) Junk vehicles which are kept on property in zoning districts authorized by the zoning resolution for repairing, reconditioning or remodeling junk vehicles, and provided that such junk vehicles are not stored fort the purpose ofs salvage ofparts but are in the continual process of repair, reconditioning or remodeling; 1 (3). Junk vehicles which are kept on propertyi in zoning districts as authorized by thez zoning resolution for aj junk or salvage yard." SECTION3. That Section 31-136, Chapter31 ofCodeofOrdimances ofWalnut Grove, Georgia bel hereby deleted ini its entirety and replaced with the following: "Sec. 31-136.- Grass, weeds and uncultivated vegetation. (a) Premises and exterior property shall be maintained free from grass, weeds, or uncultivated vegetation in excess of 12i inches in height. (b) Exceptions to this section include: (1) Any parcel zoned AG (agriculture district) that is greater than three acres in size. (2). Any parcel within a single-family residential zoning classification that is greater than three acres in size. (c) Property owners abutting a right-of-way shall not allow yard trimmings to accumulate on a public street or sidewalk. (d) The unpaved areas off front yards shall be maintained with grass, ground cover or other type of landscaping to such an extent that the soil is not subject to erosion." SECTION4. That Section 31-143, GhyejiefCaraf0atiaune of Walnut Grove, Georgia bel hereby added with the following: "Sec.31-1438.- Grass, weeds and uncultivated vegetation. (a) A certain document, three copies ofwhich are oni file in the office ofthe City Clerk of the City of Walnut Grove, being marked and designated as thel International Property Maintenance Code, 2012 edition, and the Georgia State Amendments thereto as revised January 1, 2015, as published by the International Code Council, be andi is hereby adopted as the Property Maintenance Codeofthe Cityof Walnut Grove,int the StateofGeorgia: forregulating and goveming the conditions andi maintenance ofall property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential toensure thatstructures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing and collection of fees structures as herein provided; providing for the issuance of permits therefore; and each and all of the: regulations, provisions, penalties, conditions and terms of said property maintenance code on file in the office of the City of Walnut Grove are hereby referred to, adopted, and made aj part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in this Section. (b) The following sections are: hereby revised: Section 101.1. Insert: City of Walnut Grove Section 103.5. Insert: Fee Schedules of the City of Walnut Grove Section 111. Insert: Appeals shall go to the Municipal Court oft the City of Walnut Grove Section 111.2. Delete this Section ini its entirety Section 111.7. Clarification: The Court referenced is the Municipal Court of the City of Walnut Grove" SECTION5. Pursuant to the Section 3.14 of the City Charter, authority is hereby delegated to the City Clerk to cause this Ordinance to be numbered and codified in the City Code of Walnut Grove, Georgia, in such a way as toj place this Ordinance in the Codei in an organized and orderly sequence toi maximize the organization oft the Code. The City Clerk is authorized to designate to the City Attorey or to such other Mayor and Council approved contractors to assist in the effort to codifythis provision provided the decision ofthe City Clerk is final as tot the placement ofthis Ordinance within the Comprehensive Land Development Plan of Walnut Grove, Georgia. The goal oft this authorization is to codify and number this Ordinance in the Plan in such a way as to be clear and orderly. SECTION6. GEORGIA TOAMEND CHAPTER30F THE CODE OF ORDINANCES(ADMINISIRATION)OF WALNUT GROVE, GEORGIA TO CREATE THE POSITION OF CITY ADMINISTRATOR; TO PROVIDE FOR SEVERABIITY; TO REPEAL CONFLICTING ORDINANCES; TO PROVIDE AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. and Council thereof; and WHEREAS, the goveming authority of the City of Walnut Grove, Georgia is the Mayor WHEREAS, the governing authority ofthe City of Walnut, Georgia desires to amend its WHEREAS, thel health, safety, and welfare ofthe citizens of Walnut Grove, Georgia, will NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of SECTION: 1. That Section 3, Article V of Code of Ordinances of Walnut Grove, Georgia be code of ordinances to create the position of city administrator; and be positively impacted by the adoption of this Ordinance. Walnut Grove, Georgia, and it is hereby ordained by authority of same, as follows: hereby added to create the: following: ARTICLE V.-C CITY ADMINISTRATOR Sec. 3-501. : Selection and appointment. The mayor and council shall appoint by affirmative voteofamajority ofa a quorum ofits members a city administrator, who shall be the administrative head of the city govemment and shall be responsible fort the administration of all departments. Sec. 3-502.- Term and compensation. 1 The city administrator shall serve at thepleasure of thei mayor and council and shall receive such compensation and benefits as the mayor and council shall determine through an employment contract. Sec. 3-503. - Rolei in city's organizational structure. (a) The city administrator shall serve as the mayor and city council's liaison with the city's employees. The administrator shall serve as the immediate supervisor for each of the city's department heads. (b). Inl keeping witht the city's organizational structure, except forthe purpose ofinformal inquiries orl upon approval ofthe city council, thei individual members oft the city council shall deal with city officers and employees who are subject to the direction or supervision of the city administrator solely through the city administrator, and the members oft the city council shall not give orders or jobrelated direction to any such officer or employee, either publicly or privately. (Ord. (W-6-13) of5-7-13) Sec. 3-504. - Purchasing limits. (a) Allj purchases by the city administrator top pay out money in excess ofthe sum of one thousand dollars ($1,000.00) shall be approved through thel budget, or approved in writing by thei mayor and city council. (b) In case of accident, disaster, or other circumstance creating a public emergency, the city administrator may make purchases for the purpose of meeting the emergency up to ten thousand dollars ($10,000.00). (c) The city administrator shall file within two (2) business days with the mayor and council documentation showing ther necessity fori the action taken pursuant to subsection (a) or (b) above, together with an itemized account of all expenditures. Sec. 3-505.-) Powers and duties. 2 The cityadministrator shall bet the chief administrative officerofthe city, and shall ber responsible to the mayor and council for the proper administration of the city. To that end, the mayor and council delegate to andj provide for the city administrator tol have thei following powers and duties: (1) Direct and supervise the administration ofall departments and employees ofthe city, except as otherwise provided by City Charter or by state and federal law. (2) Hires employees and, when the city administrator deems it necessary for the good oft the city, suspension or removal of city employees, except as otherwise provided by personnel policies. (3) Shall have authority to approve the salaries and compensation for all city employees in accordance with the city budget and the city pay and classification plan approved by the mayor and council; (4) Has the authority to appoint or temporarily act as a department head should the position be vacated; (5) Prepare, revise and/or amend an employee personnel policy, subject to the approval of the mayor; (6) Requiring any department or employee under the city administrator's supervision to submit written reports, attend meetings and to provide other information deemed necessary; (7) Assists the mayor with preparing the budget annually and submitting it to the council for approval and be: responsible for its administration after adoption; (8) Prepare and submit toi the mayor and council at the end ofthe fiscal year a complete report on the finances and administrative activities of the city; (9) Keep the mayor and council advised ofthei financial condition and future needs ofthe city and make such recommendations. as may be deemed fiscally responsible; (10) Oversee thej purchase ofall materials, supplies, and equipment for which funds are provided in the budget pursuant to fiscal guidelines set forth by the: mayor and council; 3 (11) Shall have the authority to sign checks on behalf of the city in accordance with fiscal guidelines established by the mayor and council; (12) Attend all city council meetings, unless excused therefrom, and take part in the discussion of all: matters coming before council, when requested; (13). Assists the mayor in ensuring that all laws and ordinances are duly enforced; (14) Mayi investigate all non-criminal complaints or inquires in relation to matters concerning the administration oft the government of the city; (15) Shall have the right to request the counsel, advice or opinion oft the city attorney concerning any matter affecting the interest of the city; (16) Assist the mayor and council in developing long term goals for the city and strategies to implement these goals; (17) Advise the mayor within a reasonable amount of time any reported situation in the city that would likely attract negative public attention and/or create press inquiries; (18) Perform such other duties as may bei required by the mayor and council, not inconsistent with the City Charter, law or ordinances. Sec. 3-506.- - Removal of city administrator. (a)' The city administrator works at the pleasure oft the mayor and city council and may bei removed from office with or without cause by an affirmative vote of a majority of all its members. (b) The mayor and council shall providet the city administrator with notice of five (5) business days prior to any action for removal that does not involve cause for a criminal nature. (Ord. (W-6-13)of5-7-13) Sec. 3-507.- Acting city administrator. (a)If, on account of the temporary absence or disability of the city administrator beyond thirty (30) days, it should be necessary in the judgment of the mayor and council to designate some 4 person to serve as acting city administrator during the temporary absence or disability ofthe city administrator, the mayor and council may appoint a temporary city administrator, and fix his compensation. The mayor and council may, by resolution, appoint anyqualified person toj perform the powers, duties, and functions of the city administrator until the city administrator shall return to the city, the disability ceases, or the mayor and council appoints a new city administrator. (b) In the event of a vacancy in the position ofthe city administrator, the mayor and council may designate by resolution aj person as acting city administrator, who shall exercise all powers, duties, and functions of the city administrator until a city administrator is appointed. (C)Nor member of the city council shall be appointed city administrator during the term of office for which they are elected or for a period of one (1): year thereafter." SECTION2. Pursuant to the Section 3.14 of the City Charter, authority is hereby delegated to the City Clerk to cause this Ordinance to be numbered and codified in the City Code of Walnut Grove, Georgia, in such a way as toj place this Ordinance in the Codein an organized and orderly sequence to maximize the organization of the Code. The City Clerk is authorized to designate to the City Attomey or to such other Mayor and Council approved contractors to assist in the effort to codify this provision provided the decision ofthe City Clerk is final as to the placement ofthis Ordinance within the Comprehensive Land Development Plan of Walnut Grove, Georgia. The goal ofthis authorization is to codify and number this Ordinance in the Plan in such a way as to SECTION3.
