Others Present: Greg Baker-Town Attorney Susan Wood-Town Attorney Judy Steele - Secretary Chairman Fryatt called the meeting to order at 7:15 and asked for a moment of Chairman Fryatt welcomed Chris Fleming to the Planning Commission. Hei is replacing Andy Rose on the planning commission. Agenda Item: Approval of the. Agenda Chairman Fryatt asked for any additions to the agenda and hearing no additions a motion was made by Harry Childress and a second by Norma Patton to approve the agenda. Motion passed unanimously. Agenda Item: Approval of Minutes of April 11, 2024 Motion was made by Harry Childréss and a second by Christopher Fleming to approve the minutes as presented. Motion passed unanimously. Agenda Item - Review of zoning ordinance for changes Susan Wood said that a question had come up about tiny homes and things will always be coming up. Greg Baker said that annually you can review and add amendments. He said that tiny homes are defined as four hundred (400) square feet Minutes - Planning Commission Meeting September 23, 2024 Page 2 or less which he confirmed with the building inspector, Chris Rakes. A question to be answered is ifsomeone wants to put in a tiny homei in Clintwood and ifyou allow them to do sO, then in what district will they be allowed. T.J. Fryatt said he thought they needed to be on aj permanent foundation. Tiny homes are: not built in accordance with the Uniform State Building Code or HUD standards which oversees building mobile homes. Tiny homes are built on ai new: standard which is called the Industrial Regulations. Harry Childress asked if there is a restriction on the height of a tiny home and Greg said there is a restriction on height which is in the code. Judy said the question she had been asked was about putting a tiny home in a mobile home park. Greg said you might include tiny homes must be on a permanent foundation, and connected to a separate meter for water, sewer, and electricity. Susan said she had been asked ifsomething could be included about people living in their vehicles, as well as travel trailers, and recreational vehicles. She said that she and Greg had discussed this, and this issue is not a land use issue, that it is something that would have to be done in a separate ordinance. Discussion was held concerning water and sewer hookups for campers. Greg said he did not see a problem with itifit was on their property and is their camper. You might get into a problem ifyou allow other people to start putting their stuffo on someone else's property to live in it. Susan said in the definitions, it specifically says what is a home and campers are not a listed use. She said she has also been asked ifcampers or recreational vehicles need to be parked a certain distance from the property line, street, or roadway. Greg Baker had to leave the meeting. Susan said that T.J.had suggested on the camper it be ten (10): feet from the property line and twenty-five (25) feet from a street or roadway and must be registered in Dickenson County.
