MINUTES PURCELLVILLE TOWN COUNCIL SPECIAL MEETING TUESDAY,DECEMBER 10, 2024, 5:001 PM HERITAGE CONFERENCE ROOM COUNCIL MEMBERS PRESENT: Mayor Stanley Milan, Vice Mayor Erin Rayner, Council members Kevin Wright, Christopher Bertaut, Caleb Stought, Carol Luke, Mary Jane Williams STAFFI PRESENT: Assistant Town Manager Diana Hays, Town Clerk Kimberly Bandy CALL TO ORDER: Mayor Milan called the meeting to order at 5:01 PM. The Pledge of Allegiance followed. Mayor shared this meeting was to: interview candidates for a committee, commission, or board. DISCUSSION Council member Bertaut asked if Town Council could legally vote on a position that is not currently vacant and if the Town Attorney had been consulted. Mayor Milan and Vice Mayor Rayner stated that the Town Attorney agreed Council could move forward with the process that has been followed for many years. Council member Bertaut requested the Town Attorney attend Mayor Milan made a statement that he would recuse himself from the interview process of the other applicants and in his absence Vice Mayor Rayner would run the meeting on his behalf. Council member Williams made the motion as authorized by the Code of Virginia Section 2.2- 3711(A)(1), Town Council will convene in a closed meeting to interview, discuss and consider prospective candidates for appointment to the public body. Specifically, Town Council will interview each candidate scheduled and upon completion oft the interviews, continue to discuss the candidates for an appointment on a committee, commission, and board. The following are at the end oft the interviews toj provide his opinion. After Mr. Cafferky had a discussion with Council: regarding Council member Bertaut's previous question, he proceeded to the regular meeting in which was scheduled to start at 6:00PM. Council was aware oft the lateness oft the next meeting and continued. Motion to certify the closed session: In accordance with Section $2.2-3712 of the Code of Virginia, Council member Wright made the motion that Town Council certify to the best of each member's knowledge, (i) only public business matters lawfully exempted from open meeting requirements under Virginia Freedom of Information Act; and (ii) only such public business matters as were identified in the motion by which the closed meeting was convened were heard, discussed or considered in the meeting by (Carried: 6-0-1 Abstain, Rayner: Aye, Bertaut: Aye, Stought: Aye, Luke: Aye, Williams: the public body. Aye; Wright: Aye, Milan: Abstain) ACTIONI ITEMS a. Appointments of Applicants to a Committee, Commission, or Board Council member Williams made the motion to appoint Stanley J. Milan Sr. to fill a vacancy on the Planning Commission created by the October 22, 2024 Town Council decision to replace the Council liaison role with a new voting member. This appointment will bring the Commission's membership to seven voting members, effective January 1,2025, and will expire on September (Carried: 4-2-1 Abstain, Rayner: Aye, Bertaut: Nay, Stought: Aye, Luke: Nay, Williams: Aye; Council member Williams made the motion to appoint. Jonathan Arburg to a vacancy on the Economic Development Advisory Board commencing immediately through September 30, 2026 toc complete an existing vacant 2-year term or until another appointment has been made. (Carried: 6-0-1 Abstain, Rayner: Aye, Bertaut: Aye, Stought: Aye, Luke: Aye, Williams: Council member Williams made the motion to appoint Yvette Jaçobs to a vacancy on the Purcellville Arts Council commencing immediately through September 30, 20261 to complete an existing vacant 2-year term or until another appointment has been made. (Carried: 6-0-1 Abstain, Rayner: Aye, Bertaut: Aye, Stought: Aye, Luke: Aye, Williams: Council member Williams made the motion to appoint Yvette Jacobs to a vacancy on thel Board ofZoning Appeals commencing immediately through September 30, 2028 to complete an existing vacant 5-year term or until another appointment has been made.
