Present: Jesse Nelson, Mayor Judy Vandergrift, Mayor Pro' Tem Sam Peebles, Commissioner Pat Perno, Commissioner Jamie Warrick, Commissioner Vickie Gainer, City Manager Sergeant at Arms Amy Myers, City Legal Counsel Item #1. Call to order. Mayor Nelson called the meeting to order at 9:02 A.M. Item #2. Invocation and the Pledge of Allegiance. The invocation was given by Pastor Mascado from the United with Christ Church, followed by the Mr. Scray - regarding aj previous meeting, he believes the HR Director committed a sunshine violation while communicating regarding the Jan 2024 query about an MLK festival payment. He requests they pull the item from this consent agenda SO it can be discussed appropriately. It concerns him that department heads have appropriate training to avoid breaking the sunshine law, sO the commission is Mr. Sharp - Arc oft the Bay - Thanked everyone for their attendance oftheir facility's groundbreaking and the city staff for their part int the rebuild, especially Ms. Amanda who was always helpful. He went on and spoke about providing a tax return service in conjunction with AARP, at no charge, they will Mr. Walker - 1106 Michigan Ave - Embarking on a new year and a new era. There is a lot to look forward to as commissioners. Spoke about his understanding of districting. He has only seen 1.5 commissioners representing this city. He hopes they look at the Charter, Comprehensive Plan, and the Mrs. Beshearse - 811 Louisiana Ave Wanted to speak about the Planning Board meeting from Tuesday. The neighbors were respectful and calm. The bottom line ist they do not want the development The Mayor mentioned Mr. Scray's comment about the agenda item on the consent agenda and asked the attorney to clarify. Ms. Myers said that although there may be a perception of sunshine law violation, she is not convinced it was. They have the opportunity to address it now. Because it is a ratification of a decision already made it makes it appropriate to go on the consent agenda, however, because it is being questioned then yes it may be appropriate to bring it out oft the consent agenda at The Mayor addressed the perception from one speaker not seeing all the commissioners serving the The Mayor thanked Ms. Beshearse for speaking and giving her opinion on the planning board issue. Page 2 The Mayor advised hel had met with the city manager a few times to discuss some concerns, and she is following up with some ofthose on! his behalf. The city manager will put that information together to present to each of the commission separately and then aj public workshop will be held. Thereafter we had a briefcall with the city manager regarding the sewer plant and a study to link in with the county. He had met with a member who wants to create a transition house in the community and discussed some ideas on that housing program. He also met with new businesses about some incentives for The city manager and he had attended the grand opening of a local business in Panama City and met The Mayor advised he had phone consultation with our legislative consultant ahead of the appropriations session in March SO that we are prepared. This led to a discussion with her and Rep. Griffiths who gave ai favorable response to our requests and is hoping to get us some matching funds. He had also mentioned a few additional items for new grants, a pumper truck, and sports fields. Working to get as much money as we can to lift that burden from our taxpayers. Last year he was one ofthe advocates for the. Air B&B and sO we. had a good discussion with him about that, and he said we could create our own ordinance here in the city as long as the guidelines are not more strenuous than what the state provides for. The Mayor will follow up with the City manager and staff about putting an ordinance in place that is appropriate for our citizens. He thanked all the commissioners who were Followed up with HR Director and regarding the City manager evaluation. Some are still working on Was happy to be part oft the celebration naming the Chamber after Former Mayor Walter T. Kelley. Commissioner Peebles - Reminded all that he has a coffee meetup on Jan. 25th at Sola. Enjoyed attending the naming ceremony for Mayor Walter T. Kelley. Spoken to many people to determine some ideas going forward, e.g. adding ai non-binding question to the ballot. Ifa anyone has any other ideas to please let him know. He has been trying to get the word out about businesses and events sol he can help spread it. Hel has also been researching what other cities have been doing regarding accessory: structures. Thanks to Ms. Beshearse for the update from the Planning Commission. Regarding what Mr. Scray spoke about -1 this happened about a year ago, and thought we were just answering an email andi ifthat was not the right thing, he can assure everyone there was: nothing malicious going on. This idea came from Jessica from the Estuary Program originally and he wanted to give complete credit and validity to the Estuary program. He wants to add their newsletter to his report and will hand it to IT to ensure that happens. His heart goes out to those affected by the wildfires in Commissioner Warrick Was able to attend the Legislative Delegates meeting. Attended the Arc of the Bay opening and he learned the land was donated by the LHI Methodist Church. The ARC has a special place in his heart as they helped one of his daughters. Enjoyed the chamber naming ceremony for Mayor Walter T. Kelley. Former Mayor Kelley had told Commissioner Warrick to keep fighting the tough things. Arc of the Bay in Lynn Haven to provide skills to our young adults and kids with learning disabilities, and their new building was named after Mr. Finch for all he does for that program. Mr. Kelly is a good example ofs sharing your gifts and talents with a city you love. Regarding the statement about 1.5 commissioners serving the city, she takes offence to that. When she makes decisions, she tries to be open-minded and think about what the 20,000 people will benefit from. Second to the Motion: Commissioner Peebles Ms. Arlene - Over the years she has held both salaried and hourly positions. As an hourly worker she could pick up extra hours if she wanted to. In a salaried position she made intelligent decisions about managing her time, and if she decided to work, she would take time off at another time to balance it off. When she accepted herj job it was as a salaried position. How much is her hourly wage, and will it be time and a half? Are other salaried employees in the city going to get paid overtime? The Mayor said her time is up. Commissioner Warrick apologized stating that he had made a motion to approve thinking it was: for item 12. Motion by Commissioner Warrick tol Rescind his motion. Second to the Motion: Commissioner Peebles Commissioner Warrick read from the City Manager's contract, which stated that she would be entitled to take compensatory time off. After: reaching out to other municipalities, the responses were chuckling at the question. They do not get paid overtime. The other contracts are worded similarly to ours. Yes, she works long hours, which is why shei is well compensated. What bugs him the most is that the email that was sent put the commissioners in a bad position, and he did not respond to it. Then instead oft the city apologizing for putting the commissioners in this position they decided toj place it on the consent agenda. He feels it should be on the normal agenda, and everyone be given the opportunity to discuss it. However, he also takes some responsibility fori it as he should have paid more attention to prevent it getting to this point. He formally apologized to the residents for not paying more attention. The Mayor askedifhei is asking the employees to apologize for] putting them in that position. The attorney said the wording in the contract is up for interpretation. Commissioner Warrick said that even then it should Commissioner Perno said he had confirmed face to face with Ms. Hodges that he would do whatever everyone decided. He went on to say that the City Manager has now stated that going forward she doesn't want overtime. She already got paid. Since it is ai retro payment, and it is now in the open, it has already happened. He apologized to the department heads who have worked and haven'tg got paid, have been done in the open instead of via private emails. If there is any doubt as to whether Commissioner Peebles -1 the key here is there is a learning element and now we have a way forward. The City Manager doesn't want overtime going forward, her contract is coming up for renewal soon and we can sort that out going forward then. He apologized for the confusion this has caused and now Commissioner Vandergrift - looked at this as a bonus, not SO much as overtime pay. Iti is not that she simply worked this, she organized it and was responsible for getting the individuals there to sort it out. She likes to show her staff that if she asks them to do anything then she will do it too. Ms. Richard pointed out where the residential houses were, stating that there were none immediately adjacent to that property. Ms. Richard explained that we. have to look at whether the request is aligned with land uses of the adjacent properties, and not what is currently built on those properties, and that Traditional Neighborhood does also allow for commercial Commissioner Perno = they could do it commercial because it is TND, but they want to make this one acommercial? Mr. Walker commented this will be the first small scale for 2025 and they correctly identified that this has to go to the state. He went on to explain his understanding oft the process. Discussion only pertaining to defining what constitutes an accessory structure per Commissioner Peebles has been looking at what other cities are doing. He has discovered that ifit is intended to be aj permanent accessory structure then it needs to be anchored down. Another question is how far you want it tol be set back. Also, ifp permanent, what is the maximum height, and the maximum Commissioner Vandergrift - the number one complaint she hears is that they have something in their front yard or driveway, and how they follow the city rules, but their neighbor does not. Commissioner Perno - where do we go from here? The City Manager said now that the city has the feedback, staff can now go and put together updated policy for them to review. The Mayor asked Ms. Richard what grey areas they need direction on. Ms. Richard said storage containers, huge shipping containers etc. Other cities have added a list of prohibited structures, which we can also do. Commissioner Peebles also would not like to see citizens cited for these but rather given a specific time to remove the items once they are notified oft the violation. The attorney said that fori now everything is allowed sO the Commission should give direction about what they want and what they want to prohibit. Ms. Richard - currently no accessory structures are allowed in the front ofa Commissioner Peebles - could we say the pods are an accessory structure and only allowed ini the front Commissioner Warrick - people normally use pods for temporary use, and he is okay with that. We could set limits on it for 2 weeks to a month, with approval to extend if required to keep them in the Commissioner Vandergrift - a lot of those temporary pods have been there for months and months already. Mayor then once this is passed then we start at day one with our new. language. The Mayor clarified that we are discussing storage containers for only temporary use if placed in the front yard, but we are okay with them being placed in the side or rear yard. The staff also asked for directions about whether they need to be classified as an accessory structure or not, and ifthere are certain aesthetics those structures should have. Commissioner Perno asked if there are any issues with shipping containers. Ms. Richard said it is becoming a thing. Mayor Nelson - what sizes are people asking about? Ms. Richard - the big ones that are used on ships. They are: not allowed currently. Also, most people won'tbe able to use them because accessory structures currently cannot be more than 50%1 the size oftheir house. Commissioner Peebles said that for him as long as it is no more than 50% of their home and no more than 25ft high. St. Andrew and St. Joseph Bays Estuary Program o 2025-01-08 Meet the Pine Snake-a fascinating and elusive resident of our watershed's upland habitats! This state-designated Threatened species is non-venomous and can grow up to an impressive 71 feet long. With dark blotches in shades of brown or reddish- brown and a white belly, they are masters of camouflage. Pine Snakes are fossorial, spending much of their time underground in pocket gopher burrows, using their cone- shaped head perfectly adapted for burrowing. When threatened, they put ona an impressive defensive display by inflating their bodies, hissing loudly, and vibrating their tails against leaf Iitter--sometimes even striking! As predators of pocket gophers, they play a crucial rolei in maintaining the balance of our ecosystem.
