This Ordinance shall bel known as Ordinance 1175. amendment to the City ofLynn Haven Comprehensive Plan. SECTION2. Ordinance 1175 amendment to the City of Lynn Haven Comprehensive Plan does hereby repeal all portions oft the Lynn Haven Comprehensive Plan adopted pursuant to Ordinance 11741 that are: inconsistent or in conflict with this Ordinance 1175, and the City ofLynn Haven Comprehensive Plan is hereby amended and consists oft the following: A. Ordinance #1175 SECTION. 3. The City Commission finds that the amendment as finally adopted by this Ordinance is in compliance with the Local Government Comprehensive Planning and Land Development Regulation Act, Chapter 163, Florida Statutes. SECTION 4. Ifany provision of this Ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this Ordinance or the City ofLynn Haven's Comprehensive Plan which can be given effect without the invalid provision or application, and to this end the provisions oft this Ordinance are declared severable. SECTION5. Effective Date Pursuant to Section 163.3187(3) (c), Florida Statutes, the effective date of this land use change shall be 31 days after adoption, unless the amendment is challenged. If challenged, the effective date of this amendment shall be the date a final order is issued by the Department of Economic Opportunity or the. Administration Commission finding the amendment in compliance with Section 163.3184, Florida Statutes. No development orders, development permits or land uses dependent on this amendment may be issued before it has become effective. Ifa final order ofnoncompliance isi issued by the Administration Commission, this amendment may nevertheless be made effective by adoption of a resolution affirming its effective status, a copy of which resolution shall be sent to the Department of Economic Opportunity, Tallahassee, Florida.
