NEW BUSINESS: a) Discussion to make recommendation to City Council to amend the City of Fellsmere Land Development Code, Section 18-33 Fee Schedules. Community Development Director (CDD) Robert Loring explained the reason for recommendation is that historically, what happened with the building division is that we intake building permits and we are completely reliant upon the contractor or the inner builder to submit the value of projects in front ofi them. And alli too often, what we are now seeing, and what we have seen, is that they completely undervalue the actual price. In Thatisr notareal number. The real number is $400,000. What happens is the building division is losing money because they are not taking the actual value of construction. What we are bringing to you this evening is an amendment to the code to allow for the ICC, which is thel International Code Council, toi implement the actual price of constructioning different regions of the country to be used as the tool to establish the actual cost of construction. Kevin Klepac, our Building Official is here, in case you have any questions for him. Kevin Klepac, Building Official stood at podium for questions, Chairman Akers asked him Kevin Klepac, Building Official stated, basically everything Bob has told you is basically 100% true right now.I am currently already using this SO within my rules and regulations of the building official, lam allowed to. What is going to doi is currently, we just had al building permit submitted today, 2500 square foot home, he said he is going to build it for $90,000 itisr not going to be done, not in today's age. Maybe 30 years ago this might have been but what Idoi is I use this evaluation, I give them what the real evaluation is, and I give them a choice, either they go with that evaluation, or they show me proof that they're going to build that home for whatever set value they sent me. No one can ever do it, because they always try to undercutit, because they want toi try tol lower the permit fees. What we are asking you all to approve of and push forward is that we use this as our standard to set the rules and regulations for evaluating, for permit fees. It is happening almost on every single newhome, what my biggest fear is, when these big developments come, they can churn them out really quick, and they're going to undercut them and undervalue them extremely well because they're buying in bulk for all their supplies, even if they are buying in bulk and they are building it cheaper, does not mean that their permit fee should be a lot cheaper just because they're doing that. We'rej just using this right here fact, we just saw one this week, new house, $300,000 to state his name and tittle for the record. as ai tool toj just keep everyone on the exact same page. Chairman Akers asked for clarification, if recommendation will increase the fees or Kevin Klepac, Building Official explained the tool works, it goes off the square footage the type of building, and thati is what gives US the value per square foot. The typical home isa 5b, r3, residential home that we're building. They're coming in at $167.37 per square foot whatever theyt tell US they are building a 2500: square foot home that will give US the actual cost. What al lot of people do not understandi is they tryt toj justs say, all my building materials are going to cost me $150,000 well, they do not include what labor is. Even if they are an owner builder, you still must include what your labor costs are going to be to get your permit fees, andi that is where therei is al lot of misconception: stuff like that, this willj just allow US to just make everything equal. This is our set fees, and it keeps everyone on the same playing field. The building fee schedule gets updated twice a year, usually at the first of the year, and towards about three quarters of the way through the year. This is your City Attorney John Rhodeback stated clarification on how they are planning on keeping this data up to date on an ongoing basis, I am not trying to be pedantic about it. Let US say somebody submits a permit application, and as you are in the process of doing it, the Kevin Klepac, Building Official stated we go off whatever the permit was submitted for the date, if they submit it, and then the month later, this changes. We are not going to go off whenever they submitted the permit, we are going to go off time ofi issuance. But,Imean, lam shorting through permits quickly, between me, Dulce, and Bob, we are gettingpermits Alternative Commissioner Dominic Foti asked for clarification, this is not an option we are Kevin Klepac, Building Official stated I am aiready currently using it right now. Right now, you have submitted a permit to me to build a new home. I use this right here against whatever you are telling me. The way this worksisi if you: say itis going to cost you: $550,000, this comes up with. $500,000lam using my value. Because of that, it gives US more money fori the city. And iti is probably a truer estimate. This isj just a baseline of what the average is across the nation. It is probably a little bit low, because Florida has high building costs compared to a lot of other states. We are always going to keep updating it and keep Alternative Commissioner Joel Tyson- Asked when one comes in and they tell you they're going to build a home on such a lot do you give them a package with all requirements, and do you go over it. There seems to be a lot of misunderstanding as to what the rules Kevin Klepac, Building Official stated if somebody comes on up, usually, the very first person that they are generally going to talk toi is Dulce. She gets them squared away with all the paperwork that they need, lets them know everything that we need backi in return. Once they give US that packet, itusually goes to Bob to planning, he makes sure everything is good through planning. Once Bob approves it, then it comes to me, and thati is whenl go through alli the paperwork on the building side and make sure everything is good, code decrease it February. building valuation data changes. out, within a week or two, we are getting them cranked back out. going to use this permanently, correct? moving forward. and regulations are. compliant if everything's meets code. Then once I pass it, then that's when we issue the Alternative Commissioner Joel Tyson asked, who normally comes in to pay? Would it be Kevin Klepac, Building Official stated We have a lot of both, we are starting to see a lot more contractors come here, but wel have also seen al lot of upticks of owner builders, and the misconceptioni is, is the people think thatif they are an owner builder, they get to save alot of money, when honestly, they really do not, because they are taking a lot longer time frame. We are having to spend an extensive amount of time educating people throughalot of different processes. And we're helping everyone out the best we can, but itis becoming all probably within the last probably six months we have got, a few where we are having to basically walk through every single process of how to build a home. We Community Development Director (CDD) Robert Loring stated we have a perjury clause on the backside of our building permit list, Ibelieve there is a clause when they sign their name to the building permit. Touchberry stated several years ago, the City of Fellsmere passed an ordinance that allows people to operate golf carts on public roadways. The ability to do sois is founded in Florida Statute of law allows cities and counties tor regulate the use of golf carts on public roadways where the city of Fauciis unique is that we canr regulate the use of golf carts on city ownedi roadways only. We cannot authorize golf carts to be operated on county or state roads. We can, however, authorize the crossing of county and state roads to get from one city road to the next. That ordinance was adopted several years ago, Ibelieve 2019 and, in that ordinance, it contained a provision for licensed use. While Resolution No. 2025-02 by title only. a golf cart operator does have tol have a driver's license as established asi is established in Florida Statute, and referenced in the ordinance, the term license that I am referring to applies to that theyll be issued a license by the city. And SO that passed on the original ordinance, but there was no provision on how we issue that license, or even howv we make sure that golf carts are, you know, safe tol be operated on the public roadways according to Florida statute. The purpose of amending this ordinance is toi include a provision on that licensing and the language changes. You should have a track change of the ordinance in your backup documentation. The red language and the blue language are the Blue language, or thei if you have a colorized version, the blue coloring refers toj justsome type of grammatical changes, but ther red language is the mosts substantive language that was been added, and that pertains to the licensing process all that contained under paragraph H, pretty much items one through five, andIcan answer any questions about the process if you want. Thisi is one that we puti in, you know, on the shoulders of the police department to act on behalf of the city to implement the licensing and the renewal of those licenses on an annual basis. Also, of course, to inspect the golf club. Alternative Commissioner Joel Tyson asked if the City would issue a City license or if you Police Chief Keith M.Touchberry: stated the license we wouldissued. We view that as being like a decal. When you get the ordinance, you will see we will put it in. This will be renewable at the beginning of the year, and every year, January 1, it would be color coded each year. Main concern for this is someone operates a golf cart on the roadway. An officer sees it. We want to make sure that they are following the law, but we do not want to: stop them unjustly, either we do not want to wonder if theyl have beeni inspected ornot. We want to show proof. A separate provision fori ify you are approved to operate at night or not, because you have to have the proper equipment. A lot of golf carts do not come with lights and sO forth. You may only be able to operate a golf cart during the day, but if you have the golf cart equipped for nighttime use, we can approve that. We will have toi indicate that on the sticker, someone wants to do that at night. Alternative Commissioner Joel Tyson asked if this also applies to "side by side". Police Chief Keith M.
