January 16, 2025 Re: Notification ofWater Service Line Material Dear Water Customer: Your water service line has been classified as an Unknown Lead Status. The Town of Pittsville has completed its initial Lead Service Line Inventory, as mandated by the EPA's Lead and Copper Rule Revisions, and the State of Maryland. This inventory required the identification of the water service line material for the entirety of each service line, from the water main int the road to each residence/building. Each service line has split ownership; the Town owns and maintains the water service line up to and including the water meter, typically installed near the property line. Sincerely, Anastasia Kessler Wonderful Willards PTA President RESOLUTION #: 2025-01 WHAT: Resolution # 2025-01 is a "Resolution of the President and Commissioners of the Town of Pittsville To Establish An Increase in the Town's Water Usage Rates by 10% Each Year For Al Period Of Five Years As Required By the Maryland Department of the Environment/MDE" WHY: Several years ago, the Town of Pittsville's Water Treatment Plant/WTP experienced several equipment/mechanical issues with the operation of the WTP. Though those problems did not cause any health defining issues, the Town Commissioners with the guiding advice of the Town's Engineering firm, Davis Bowen & Friedel addressed the problems correcting several with the Town's own local funds to the amount of $400,000. However, after further examination and review of the entire WTP infrastructure by the Town Engineer and MDE, the Town Commissioners decided to pursue a complete "upgrade" to the WTP which began in 2019. This has finally culminated in a well designed, thorough project that addresses many of the concerns that were exhibited back in 2019. The Town applied to MDE for grant funding and received approval fori the following: 1) MDE GRANT: $968,000.00 2) MDE LOAN FORGIVENESS: $459,308.00 (which will become a grant over 10 years time) Also, the Town Manager and Town Engineer worked together to apply for and the Town was approved fora COMMUNITY DEVELOPMENT BLOCK GRANT/CDBG from the Maryland Department of Community Development/Housing (DHCD) int the amount of $800,000 which is the very maximum aj jurisdiction is All of the above funding sources received will cover the entire expense of the project entitled" PITTSVILLE WTP PHASE IV UPGRADE which totals $2,719,016.00 In a "nutshell" the Town has received 85% of the cost of the project in grants or loan forgiveness eliminating a tremendous financial burden on However, there is still needed to obtain the remaining $459,308.00 that will be provided by MDE, BUT In order for the Town to be approved for the "low" interest loan of $459,308.00 MDE is requiring the Town Commissioners adopt RESOLUTION #2025-01 that will establish an increase int the Town's water usage rates to have the financial resources to pay back the loan. This was a very long, time consuming discussion between the Town Commission President, Town Manager, and Town Treasurer to try to convince the "powers that be" at MDE that the Town DID NOT NEED to increase water usage rates because we were able to pay on the loan without doing so! Unfortunately, after a very spirited defense of our case, MDE informed the Town that IF the water usage rates were NOT increased, then the Town would NOT receive approval for the loan NOR receive the loan forgiveness offer made earlier. 3) MDE LOAN: $459,308.00 (a very low interest loan) eligible to receive. the Pittsville water usage consumer! here is where RESOLUTION #2025-01 is required! REASON FOR FINAL DECISION The Town Manager and Town Treasurer advised the Town Commission President and thus, the Town Commissioners, that though the Town was in a good position to pay on the loan, the additional $459,308 that would need to be absorbed from town funds was just a' "bridge too far"! Thus, the "reason" and "need" to adopt RESOLUTION #2025-01. WHEN RESOLUTION #2025-01 is scheduled for consideration of adoption at the next Town Meeting to be held onl Monday, January 27, 2025 commencing at 7:00 pm in Town Hall. Though it will be effective the date of passage, the increase approved will not be effective until. July 1, 2025, ANDI be reflected in the utility billing beginning October 1, 2025! WHATI IF THE RESOLUTION #2025-01 is NOT approved? IFRESOLUTION #2025-01 is not approved, then MDE will not grant the Town the additional $918,616 needed for the project, forcing the Town Commissioners to look for another source of funding to cover the "lost" revenue which will end up being another loan with an interest rate very much higher than the one being offered by MDE. In order to pay on this loan, it will still require an increase in rates way more than being proposed in RESOLUTION: #2025-01 TOWN OF PITTSVILLE RESOLUTION #2025-01 A RESOLUTION OF THE PRESIDENT AND COMMISSIONERS OF THE TOWN OF PITTSVILLE TO ESTABLISH AN INCREASE IN THE TOWN'S WATER USAGE RATE BY 10% EACH YEAR FOR A PERIOD OF FIVE YEARS AS REQUIRED BY THE MARYLAND DEPARTMENT OF THE WHEREAS, the Town of Pittsville has embarked on a major capital improvement project to fully upgrade and replace antiquated equipment within its Water Treatment Plant/WTP in a project WHEREAS, the Maryland Department of the Environment/MDE has been fully involved in assisting the Town with administrative and financial assistance in providing much needed guidance on the construction steps necessary and required to bring this much needed project WHEREAS, the Town Commissioners of Pittsville are committed to ensuring that their citizen constituent/consumers are provided the best quality of water the WTP can produce, and WHEREAS, the "Pittsville WTP Phase IV Upgrade" project will cost $2,719,016.00 to complete of which the Town has secured 85% in grant funding for the project with only 15% of the remaining cost to be funded by a loan from the Maryland Department of the WHEREAS, in order to receive approval of the loan, the Maryland Department of the Environment/MDE is requiring the Town to increase its water usage rates by 10% each year for WHEREAS, the Town Commissioners and' Town Administration have for several months been in negotiation with the Maryland Department of the Environment/MDE concerning the NOW, THEREFORE, BE IT HEREBY RESOLVED that effective July 1, 2025 and beginning with the utility billing of October 1, 2025 the water usage rates for the Town of Pittsville will be SECTION I. Water Usage rates to increase by 10% each year for a period term over five (5) years SECTION II.
