AI RESOLUTION OF THE COMMISSIONER OF BARTOW COUNTY FOR THE PURPOSE OF APPROVING Z-24-00068, A REQUEST TO AMEND THE COMPREHENSIVE LAND USE MAP AND THE OFFICIAL ZONING MAPS OF BARTOW COUNTY AT THE REGULAR MEETING OF THE COMMISSIONER OF BARTOW COUNTY HELD ONJANUARY8, 2025. WHEREAS, AUBREY CORPORATION submitted an application to amend the Comprehensive Land Use Map and Official Zoning Maps of Bartow County, the same being designated Z-24-00068; and WHEREAS, the hearings of the Planning Commission and the Commissioner were duly advertised and held as provided by said ordinance and all the prerequisites to considering the amendment have been met; and WHEREAS, the Planning Commission of Bartow County reviewed the application during its December 16, 2024 meeting and recommended approval with condition to amend the Official Zoning Maps of Bartow County to the Commissioner; and WHEREAS, the Commissioner has considered and reviewed the analysis submitted by the applicant, the reports of the various county agencies and the recommendation prepared by the Planning Commission, all of which are incorporated herein by reference; and WHEREAS, the Commissioner deems it to be in the best interest ofthe Citizens NOW THEREFORE BE IT RESOLVED, AND IT IS HEREBY RESOLVED, by virtue of the authority vested in the Commissioner by law and pursuant to the Zoning Ordinance of Bartow County, that the request of the applicant for the property located in Land Lots 113, 114, 139, and 140, 22nd District, 2nd Section, of] Bartow County that a final decision on said request be made. to allow the following: 1) Zoning Map Amendment a) Revise the boundaries of the PGDD overlay district to add a 23.10 acres +/- portion of parcel 0111-0140-005 to the PGDD overlay district and remove a 25.16 acres +/- portion of parcel 0102-0184- b) Amend the concept plan map of the PGDD overlay district to a) Rezone a 23.10 acres +/- portion of parcel 0111-0140-005 from A-1 001-3 from the PGDD overlay district. delineate the 500 acres +/- mineral extraction area. 2) Rezoning to A-1 and PGDD overlay district. 1 b) Rezone a 25.16 acres +/- portion of parcel 0102-0184-001-3 from A- a) Alter zoning condition #1 to read as follows: Mining and industrial traffic shall be accessed from U.S. Hwy 411 or Ga. Hwy 20. This shall not preclude traffic-signal controlled crossing of trucks over Stamp Creek Rd for inter-parcel access and for access to Ga. Hwy 20. Industrial access onto Stamp Creek Rd shall be allowed from the industrial area to U.S. Hwy 411. Mining traffic onto Stamp Creek Rd shall only be allowed between an access point across from 212 Stamp Creek Rd (parcel #0101-0142-001) and U.S. Hwy 411. b) Alter zoning condition #2 to read as follows: Single-family homes on minimum 7,500 sqft lots on area north of Stamp Creek Rd if sewer available. Single-family homes on minimum 5,000 sqft lots on area 1and PGDD overlay district to A-1. 3) Alteration of Zoning Conditions related to zoning case. RZ-2597-23. south of Stamp Creek Rdi ifsewer available. as set forth in Z-24-00068, and to amend the Comprehensive Land Use Map and Official Zoning Maps of Bartow County accordingly, be and hereby is APPROVED WITH CONDITION: alteration of case RZ-2597-23 condition #2 to additionally note as follows: Max 500 units between 5,000 sqft and 7,500 sqft in size.
