PLANNING & ZONING COMMISSION MEETING MINUTES OF AUGUST: 22,2024 STATE OF TEXAS COUNTY OF TARRANT CITY OF BEDFORD S S S The Planning and Zoning Commission of the City of Bedford, Texas meti in Regular Session at 6:00 p.m. in the Council Chamber of City Hall, 2000 Forest Ridge Drive, Bedford, Texas on the 22nd day of August 2024: CALL TO ORDER & ROLL CALL Director of Development Wes Morrison advised the Commissioners that Chairman Emery would not be in attendance and that due to there not being a vice-chair, the commission's by-law's stated staff would open the meeting. Mr. Morrison asked the Commissioners if they would nominate someone to fill in as Chair for the meeting. The Commissioners appointed Commissioner Gallenstein to fill in for the meeting. Acting Chair Gallenstein called the meeting to order at 6:00 p.m. and conducted a roll call. The following persons were present: Members: Roger Gallenstein Danielle Stellrecht Kate Barlow Steve Otto JR Smith Chairman Emery and Commissioner Jacobsen were not in attendance. Aquorum of the Commission was present. PLEDGE OF ALLEGIANCE The Pledge of Allegiance to the flag of the United States of America was given. PLANNING & ZONING COMMISSION MEETING MINUTES OF AUGUST22, 2024 APPROVAL OF MINUTES 1. Consider approval of the following Planning and Zoning Commission meeting minutes for the July 25, 2024 meeting. With no discussion or revisions, a motion was made. Motion: Commissioner Stellrecht made a motion to approve the meeting minutes as presented, seconded by Commissioner Barlow. Motion approved unanimously by a vote of 5-0-0 PUBLIC HEARINGS 2. Conduct a public hearing and consider making a recommendation to City Council regarding a rezoning of the property described as Chimney Creek Addition Block 1 Lot 1R from Planned Unit Development to Planned Unit DevelopmenuSpectric Use Permit - Massage Salon and the property is generally located on the north side of Bedford Road, to the south of Airport Freeway, commonly known as 1105 Bedford Road. (SUP-24-9). Acting Chair Gallenstein introduced the Specific Use Permit and recognized City Planner Enrique Alvarez to speak on the matter. Mr. Alvarez discussed and presented background information on the item. Acting Chair Gallenstein recognized the applicant, Teressa Hughes, 837 San Marcos Ln. Bedford, TX to speak on the business. Ms. Hughes stated her business provides unique services and focuses on injuries and other physical therapy treatments to help with rehabilitation. Ms. Hughes stated she has been in business within the city for approximately 13 years and looks forward to continuing her business in Bedford. Acting Chair Gallenstein opened the public hearing at 6:09 P.M. Patrick Westbrook, 302 Somerset Cir. Bedford, TX, adjacent neighbor to the property. Mr. Westbrook stated he had concerns regarding the adjacent commercial uses, including a drive-through restaurant adjacent to his property. Mr. Westbrook stated he'd like to have privacy improvements on the nearby commercial properties to improve neighboring Becky Ferrell, 2204 Field Ln, a client of Ms. Hughes. Ms. Ferrell spoke in support of Ms. Hughes' business and the benefits they provide to the community. Ms. Ferrell stated that clients who have to come in from out of town stay in Bedford, which means they support homes. the local businesses while they are here. PLANNING & ZONING COMMISSION MEETING MINUTES OF AUGUST22, 2024 Nicole Rodieck 2745 N. Odell Ct. Grapevine, TX, client of Trees Bodyworks. Ms. Rodieck stated she visits the location for continuing treatments for years on a bi-weekly basis. Ms. Rodieck stated this business provides affordable and practical treatment options to her Leanna Mendoza, 1304 Shady Creek Dr. Euless, TX, Massage therapist at Trees Bodyworks. Ms. Mendoza spoke about the services offered at the location and the reason and her family. behind the proposed move, including a quieter location. Acting Chair Gallenstein closed the public hearing at 6:21 P.M. Commissioner JR Smith asked Director of Development, Wes Morrison, why the applicant has to go through the Specific Use Permit process. Mr. Morrison advised that SUPS are site-specific. Ms. Hughes, the applicant, advised that work behind their current location has made it difficult to maintain normal business operations. Mr. Morrison advised that staff granted a temporary certificate of occupancy for 60 days to the applicant based on their good standing with past required registrations at their current location. Mr. Morrison advised that this was also contingent on a final decision from council for the current application. With no further discussion, a motion was made. Motion: Commissioner Barlow made a motion to approve the Specific Use Permit as presented, seconded by Commissioner JR Smith. Motion approved unanimously by a vote of 5-0-0 3. Conduct a public hearing and consider making a recommendation to City Council regarding a rezoning of the property described as Airport Freeway Center Block 1 Lot 2 from Heavy Commercial to Heavy CommercialSpec"fic Use Permit = New and Used Cars and Truck Sales and Service and the property is generally located at the intersection of Bedford Road and Tennis Drive on the northwest: side and commonly known as 223 Bedford Rd. (SUP- Acting Chair Gallenstein introduced the Specific Use Permit and recognized City Planner Mr. Alvarez discussed and presented background information on the item. Staff advised that the location is currently utilized as a car rental location, with a previously granted Specific Use Permit for such use. Mr. Alvarez advised that staff's concerns regarding the proposed use surrounded parking at the location and vehicle visibility. PLANNING & ZONING COMMISSION MEETING MINUTES OF AUGUST22, 2024 Acting Chair Gallenstein opened the public hearing at 6:29 P.M. Sam Assad, 9052 Blue Ridge Trl. Fort' Worth, TX, owner of the property. Mr. Assad stated that the property was bought as a car lot back in 2019. Mr. Assad stated that there was an issue with licensing with the previous owner, and therefore the use did not continue. Mr. Assad stated that the location is still in the same condition as it was previously when itf functioned as a car lot. Regarding parking, Mr. Assad stated that 2 spots in the front of the location would be reserved for customer parking and the other 2 spaces would be show spaces for vehicles. In addition, the gate would be open in the rear to display the other vehicles at the property. Mr. Assad stated that nothing would physically change at the location with this new use. Acting Chair Gallenstein closed the public hearing at 6:33 P.M. Commissioner JR Smith inquired from staff about previous use at the location. Mr. Morrison stated the use may have possibly been nonconforming, with the business closing and time elapsing where it lost its nonconformity. Mr. Morrison stated that this location was within a commercial focus area within the current comprehensive plan, the main issue stemmed from the functionality of the site and the displaying of cars at the Mr. Morrison advised that the car rental business was currently in use at the location by location. the same applicant proposing used car sales. Conduct a public hearing and consider making a recommendation to the City Council regarding rezoning of the property described as Nielson Addition Block 1 Lot 1 from Heavy Commercial to Heavy Commercialspecinc Use Permit - Religious Facility and the property is generally located on the north side of Bedford Road, to the east of Norwood Drive and commonly known as 111 Bedford Road. (SUP-24-8) Acting Chair Gallenstein introduced the Specific Use Permit and recognized City Planner Enrique Alvarez to speak on the matter. Mr. Alvarez discussed and presented background information on the item. Acting Chair Gallenstein opened the public hearing at 6:39 P.M. PLANNING & ZONING COMMISSION MEETING MINUTES OF AUGUST: 22, 2024 Austin Oneal, 5709 Diamond Oaks Dr. Haltom City, TX - applicant. Mr. Oneal stated that they are a fairly young church of approximately 5 years and are currently occupying a space of another church. Mr. Oneal stated that they have plans to reach Commissioner Barlow asked the applicant if they had plans for growth at the current location. Mr. Oneal stated that they currently have 25 people, and this space would certainly allow them to grow and have a greater outreach to the community. Mr. Oneal stated that this location would be a great starting point for them and their church. out and invest within the community. Acting Chair Gallenstein closed the public hearing at 6:42 P.M. With no further discussion, a motion was made. Motion: Commissioner Stellrecht made a motion to approve the Specific Use Permit, seconded by Acting Chair Gallenstein. Motion approved unanimously by a vote of 5-0-0 DISCUSSION ITEM 5. Accept nominations and elect the office of Vice Chairperson. Acting Chair Gallenstein stated that due to the absence of Chairman Emery and Commissioner Jacobsen, it may not be the most appropriate time to nominate a vice chair Mr. Morrison advised that if the commissioners wished to table the item, a motion would at the current time. be needed. With no further comment, a motion was made. Motion: Commissioner Otto made a motion to table this item for a further meeting, seconded by Acting Chair Gallenstein. Item was tabled by a vote of 5-0-0. UPDATE ON PLANNING PROJECTS Wes Morrison, Director of Development, gave updates on current and past Planning and Zoning cases. No action taken on this item.
