The purpose of our meeting is to go through a few housekeeping motions. We'17 hear from our department heads, we'1l hear from our engineer and our assistant fire chief and our chief of police. We'11 go down the table, we'11 hear from our borough manager, solicitor, mayor and council members. We have a public sign-in sheet with the chief. If anyone from the public would like to address us we'1l give you a few moments at the end of the meeting. With that said, we're going to move into our first housekeeping motion. SOKOLOWSKI: I talked to Schuback. He paid to get rid of this. Clean it up. It ran over sO he couldn't handle it. But he was paid from the owner to get rid of that. This is last year. MR. BUTLER: He told me two days ago that Matt Brown said he would do it for 500 bucks. MR. HOOVER: Pay him. MR. SOKOLOWSKI: I see Matt Brown every day. He never said anything to me. MR. The guy's saying he already paid to have it removed and they weren't removed. MR. BUTLER: I know he took the car out of there. The car is gone. MR. HOOVER: How many were there originally? MR. SOKOLOWSKI: There were four campers and two cars. The two cars are gone and the campers Schuback took. He said couldn't take the other ones because they would fall apart. MR. HOOVER: Mike's going to say he took the 500 to get rid of the two cars. CHIEF DUBERNAS: I know he took one camper. It was going down the road sideways. MR. MR. RUSSELL RINALDI: I'11 call Mike Schuback tomorrow. MS. BARTOLETTI: Could you talk to him, find out? MR. SOKOLOWSKI: Yes. I 3 helped him make the deal. MR. RUSSELL RINALDI: Why don't you call Mike Schuback tomorrow and Matty Brown and get the story together sO we can get the answer. MR. BUTLER: The other two houses on Grace Street, can we go anywhere with that? This lady called me again. I'm getting sick of it already. She has two abandoned houses there, they're not liveable. There's no way you're going to fix up either one of those houses. There's got to be a way for us to take these. Pittston does it all the time and there's never a problem. They take the house, knock it down and that's it. I don't know what they're doing or how they're doing it. I'11 call Lombardo and ask him. RINALDI: Because they're a city they have a redevelopment authority. They have a statute that they can go in and do that. Boroughs don't have it. MR. SOKOLOWSKI: Scranton has it, too. MR. KOMENSKY: So there's no water in that house. If I remember from what you said there's a hole in the roof and water's coming in? MR. BUTLER: The water company went down and left the thing on the door saying they shut the water off for excess usage and the bill was $848. So that tells me a pipe broke inside. MR. KOMENSKY: You said there was a hole in the roof. MR. BUTLER: Hole in the floor on the porch. But neither one of those houses is liveable. You think the one down Ripple Street is bad? You have to see these two. There's nobody going to live in these houses. Ray Street, right before the hose company. Down in the hole. KOMENSKY: Mike, can we get some pictures to Bill, try to work on it, see what we can do? Because Beaver has been complaining about this. MR. RUSSELL RINALDI: Why couldn't we take the same steps we took to condemn the other house? MR. SOKOLOWSKI: Sure. MR. BUTLER: The one house, it's Scott Carey's house. You walk up on the back porch the garbage is piled up probably taller than me. Six foot on either side of the doorway. MR. RUSSELL RINALDI: Let's take the steps to get it condemned if they are, indeed, condemnable. Then once we get them condemned we'11 figure out a way to get finances to knock them down. There's grants. At least let's get them condemned first. MR. SOKOLOWSKI: He hasn't lived there probably for five years. MR. Why would you move your girlfriend into your old house? Doesn't make any sense. I think he was feeding her a line of baloney sO she wouldn't complain. She said there's rats and mice, whatever. Possums, skunks. You name it, they're in there. MR. STULL: Under our new property management code why can't these owners be fined? MR. RUSSELL RINALDI: Well, I would think that they should be fined first. If property isn't able to be reconstructed and livable, then we should condemn it. MR. STULL: Fine them until they fix the property up. MR. BUTLER: The Pennsylvania law thing says "a property is considered abandoned after 12 months if the owner has not marketed the building in the last 60 days or made efforts in good faith to sell it." MR. RUSSELL RINALDI: My question, 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Bill, according to what Assistant Fire Chief Stull is saying Mike has the authority ATTY. RINALDI: He's got the book. MR. RUSSELL RINALDI: Mike has the authority to fine them up until the point where they're either going to fix it up or knock it down. ATTY. RINALDI: Should be. Unsafe structures, abatement, yes. Section 108. MR. BUTLER: There's no way you can fix it up. MR. RUSSELL RINALDI: Tell them they're going to get a fine according to the code and they'11 either fix it up or keep getting fined until they knock it down. MR. STULL: That should be the same thing with that building on DeSimone that burned. MR. BUTLER: I - don't know how somebody can live in half of the building while the other half is burned. MR. SOKOLOWSKI: Nobody lives there. MS. BARTOLETTI: It's a lawsuit. There was a problem with the people when the building burned. SOKOLOWSKI: We were on the phone just the other day. MR. KOMENSKY: They were just in court, then they : MR. SOKOLOWSKI: It's for arbitration. MR. RUSSELL RINALDI: The one on Oak Street? ATTY. RINALDI: Yes. If you read through this there's violations you can order to have them tear it down. If they don't there's remedies. Look under 108, unsafe structures and equipment. MR. KOMENSKY: We didn't get a check from them. Right? MS. BARTOLETTI: No. Usually we get an escrow check from the insurance company and we hold it until the work is done. There's nothing because the insurance company says it wasn't insured. There's two buildings there. Contact the owner, notify them that if the property's not fixed up he'11 be fined. MR. SOKOLOWSKI: I just talked to him last week. MR. RUSSELL RINALDI: If he doesn't want to fix it up we're going to fine him and condemn it until he knocks it down. ATTY. RINALDI: Look at 107, 108. It tells you how to send them the notice, what you want to order them to do, do the inspection, determine what has to be done. Either tear it down, make safe. He's got sO many days to comply. MR. KOMENSKY: The one on Oak Street, too? ATTY. RINALDI: For any structure. MS. SHOTWELL: Really should be something we look into. We should look at that for all the properties that fall under that category. MR. SOKOLOWSKI: My report, that's what I sent him. LOPATKA: So with that, we had put together a set of plans that shows everything, but in discussions with Marylynn what we're going to bid actually is bringing the water and sewer to the building and redoing the backstop for now, then in March we'11 bid the field sO that they can use the field during this coming season. Then as soon as the season's over we'1l have it ready to bid to do the field and put the irrigation in. MS. BARTOLETTI: The work will be done. The grass part will be done when the season is over. If he tries to do that before the season they won't be able to use it. MR. RUSSELL RINALDI: So when will we be able to start the work besides the grass? MR. LOPATKA: Where going to put that out now. MS. BARTOLETTI: It's on the agenda tonight. MR. I know that. That part of the field after the season. MR. LOPATKA: We could put it out to bid now. We can eventually get that work done sooner than later sO when March comes. It's basically the trenches. That part can be done anytime. Also, the senior center, I dropped ten sets of plans off at the county today. Specs and drawings. So that's going out to bid within the next week or two. MR. HOOVER: What about the veterans wall? MR. LOPATKA: I have plans ready for that. I should have the specs ready for that by next week or so. Wednesday, October 30th, 10 a.m. until noon over at the fire station the 01d Forge Fire Department will be testifying before the Pa. House Democratic Policy Hearing on different fire things that are going on across the state. So at this time I would like to invite the mayor, members of council and the borough manager to come over and see what's going on with fire service throughout Pennsylvania. They'11 have broadcasting there from the state along with our local news coverage, too. So this will be an 18 member committee from the House right across the state will be there. So we'11 have one of our firefighters that are going to testify on behalf of the fire departments state wide. So I'm throwing that up to get you guys to attend. Wednesday, October 30th. It starts at 10 a.m. and should be over around noon. The second thing is, Russ, what you called me on the other day, I reached out to 26 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Jason, who gave me a contact for that PennDOT district four. I reached out to April Hannah. So she put me in contact with a Robert, and he's the layout and design guy for PennDOT. So he would come out, look at the area, the layout, where he would want those signs put for the fire department. One of my requests of them was between the signs if we can take the speed limit from 35 down to 25. She says we probably can in that area. It's horrible there anymore getting out, getting in. Cars are just speeding by. So this is something that I want to move on. I'm waiting for them to get back to me sO that we contact the company that makes the signs and see what we can come up with. MR. RUSSELL RINALDI: Did he say was there any certain signs that aren't allowed there or certain ones that are allowed? MR. STULL: No. He hasn't called me back yet. People coming especially north on Milwaukee Avenue coming around that corner they're just hauling ass. MR. BUTLER: The ones I saw light up. They're flashing. They're the only ones I think people are going to see. MR. STULL: Something that's flashing, yellow lights on it, firehouse ahead or fire station ahead. The ultimate, if we could put 25 miles an hour on it. CHIEF DUBERNAS: We had our big message boards there. MR. STULL: Hopefully by the work session we can have some kind of answer. MR. The total amount is $142,086, and we won't receive that until next year. So they're always a year behind. Keep that in mind. Other items, we did receive a $30,000 grant from LLVSA for the sewer 29 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 department. Dave and I started working on the master site plan for Pagnotti Park, and he has a nice layout of the park and we started trying to come up with changes, ideas, that type of stuff. Dave had some good information here. I think we can make some good progress with some of the problems there and we'11 try to get some grant money from DCNR. BARTOLETTI: It's 132,086, and of that $116,511 stays with the borough and $25,575 goes to Lackawanna County for administration. wanted to remind again about the November dates. The work session is changed to November 4th and the public meeting is changed to November 12th. It's on our website as well. We had a finance meeting on October 8th to start going over some of the budget 30 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 concerns, and I'm hoping to have the budget ready for tentative passing on November 12th, at our meeting, and then there will be a formal passage on December 17th. MR. HOOVER: At the finance meeting we discussed the recycling. We have to make some hard decisions with recycling. To date our recycling number is $64,980. So roughly $6,000 a month for recycling. MS. BARTOLETTI: I was going to say that report, part of the concerns in the budget are the recycling expense, the yard waste hauling expense, the garbage contract, and we are all trying to work on options within the office and also within the finance committee. Idid talk to Dave about something else that we're trying to work on. Since it is very expensive to haul away the yard waste we're trying to come up with something on one of the borough's properties that we can possibly turn into our own little composting type of facility. Because just to take the little trailers that they dump into, just to take one of those to Dupont is $300 every time they go. So that might be a place that we can really improve and not having to take it to Dupont. It's not that far, but if we're ale to do something in 01d Forge our trucks will be able to be filled up and just go and dump rather than having to take these trucks, bring them back to the DPW garage, dump those into a big container and then have someone come and take that container and take it to where it needs to go. So it's a big process to get rid of branches and grass and stuff like that. MR. RUSSELL RINALDI: Bill, any of our Project 70 land, could it be used for something like that? If not, the lower part that's Project 70, the upper part where we were going to expand the parking lot. It goes pretty far up toward Ransom. There might be a spot up there as well. MR. RUSSELL RINALDI: That is a good idea. MR. BUTLER: Some towns use paper bags. MS. BARTOLETTI: If they do the paper bag just disintegrates. But the problem isn't the collection, the problem is getting rid of it. Once our guys pick it up, where it goes from there. MR. We're talking about potentially going all the way up towards the top of that and leave a wooded buffer between the park and where that would be. MS. BARTOLETTI: If that's doable. MR. KOMENSKY: We're going to need pretty close to $100,000, is what we figured the other day, regardless. MS. BARTOLETTI: I spoke to Alliance/Waste Management today. They happened to come in to deliver one of their quarterly checks. In talking with them, they're working on recycling, too, and putting a new facility in Penn Argyll. So they're looking for local customers to be able to do the recycling and collect here and take it there. Ij just want to point out, in case people don't realize, we used to do all of our recycling with Northeast Cartage and we used to sell it. This is back a few years ago when it had value. Then as the value started to lower Northeast Cartage sold their business to -- Ib believe it was County Waste, who then turned into DFL, who now turned into Casella. So it keeps changing. Every time it changes the prices go higher and higher and it gets a little more difficult. So this is something that's important, and obviously we see it's important because of the finances, but also to have a company that's more easy to work with and someone you know who you're talking to. JP Mascaro, we'17 be going into our fifth year of the contract. Bill and I have been talking about that. I asked him to put together : start working on putting together the letter sO we can probably extend or contract for that fifth year. The sewer on Grace Street is leaking down onto our property and it's going on for about five years. The water's coming down the hill. Mike did go down there and looked at it and said it had gotten fixed, but it's still leaking down onto the property. It's running under : it used to go down the house on 611 Grace Street and it's running underneath their pool down there and their property. Then there's where they built -- it used to be called Melmore Street. The name of it is Lenape Lane. I heard that they 36 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 want to put an alley in back there. Now, there's a restriction that's back there behind the homes off Cherokee Drive. It's for the fire engines only. It's in case of emergency. That's the only way that that's supposed to be used in that area. Behind where Gryczko used to live, I heard they want to extend the alley through there but it's up on the top. That's the only reason they want access to that. It's only for fire engines and that's it. Okay? Then there's where they built that new house on Grace Street. Okay? If I hadn't mentioned anything : they never went in there and surveyed it. They got a surveyor, went in there and they surveyed it and now he poured concrete. Now there's a situation : we've been paying the taxes on it for all these years, but they're saying that the property is not owned by us. It's owned by the borough or whoever at the end of Grace Street. Now that house was bought by attorney Gallacher. It's put in Sean O'Neil's name. George Dunbar is the owner 37 of that house. A lot of people don't now that. Now we have somebody -- I grew up in 01d Forge. I loved 01d Forge. Now we have somebody that comes into this town and thinks he can do whatever he wants to do. It's got me very upset. He's going outside of the area where he supposed to be going outside of. I know that because we've been going through a lawsuit for nine years now and we're in over our heads almost $200,000 because he dug into our property. And this has been going on for many years now. So I don't know what they can do over there. Like I said, the access to that alley, there is no access to that alley. They can't put an alley in there because, like I said, they told my dad when they put that back there that was for emergency purposes only. That land is not supposed to be used. On the map it said Melmore Street but it's actually called Lenape Lane to our development that's down there. Ij just want everybody to know with this guy coming in, and he is the one that owed that house over there. Where somebody could come into our town and just do what he wants and it's, like, I don't know what this town is coming to, to tell you the truth. I grew up here. A1l of us grew up here. I loved 01d Forge. I really did. But it's just ridiculous what they're doing. It's all because Mr. DeNaples' money is being brought into this town. That's millions and millions of dollars. But they need to do something with that concrete over there. I have to figure out who actually owns that property. I know we've been paying taxes on it probably for 50 years now already. MR. RUSSELL RINALDI: My question is the first issues was the water is coming Down Grace? MR. HATALA: It's coming down under Grace Street and it wiped out the wall where our pool used to be, where we had the railroad tie wall. We had big concrete blocks. It cost a lot of money to do it. That water is running down into our property where our pole barn is around the back there. MR. RUSSELL RINALDI: You talked to Mike about that or Joe Lenceski? MR. HATALA: Mike, I talked to you. MR. Why don't we have Bill find out who owns that property, Joe and Mike look into the sewer, and then also we're going to find out who owns the alleyway. If we don't own it they'd have to come before us anyway and ask us for the right to open it up if they wanted to. Bill Stull talked about the speed on Keyser Avenue and Milwaukee Avenue. As a resident, I've been here just under 20 years. It's most recent trying to pull out of Franklin Street, which intersects at the firehouse, is very, very hard, as well as Keyser Avenue coming up at that stop sign trying to get onto -- Oak Street trying to get onto Keyser. I just noticed over the last six or eight months there's no obedience to speed whatever. Whatever is proposed to be the limits. I've had quite a few close calls and I've also seen other people, especially between 3 and 6 p.m. So I kind of get the feeling I know exactly what Bill's talking about. I think a lot is commuters. Not as much residents as commuters that feel like 49 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 81's backed up. Bill definitely has a valid issue there. The reason I'm here, listen, I've been here just under 20 years and I really like living in 01d Forge and I intend to stay here for a long, long time. But the reason I'm here today is because of something that happened two nights ago and it's a repeat of something that happened two years ago. 1 live on Franklin Street. You guys all probably know where that is and you're familiar with Saint Stanislaus Church. It's not only pitched up but it's pitched to the side, and then on an angle. What had happened two nights ago at 3 a.m. in the morning, there were police officers that went up and down the street and ticketed for anyone who was parked on the wrong side of the road. This happened again June of 2022. I respect the fact that there are regulations. I really do. But I will tell you again, living here all the time, that I have : my health is getting progressively worse, my mobility is getting much worse. 50 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 In fact, Mike and I have been working on me getting a handicap placard -- I have a handicap placard, but getting a handicap space in front of my home because of the issue of the pitch and just walking from the street in general. S spoke with the mayor in 2022. I will say that I help a gentleman two doors down from me. He's 75 this year. He parks his car going down the street, on the opposite side than he should, against traffic, for very specifically one reason only. It's the only way he can get out of his car. I park in front of my house for the same reason. When your car is pitched like this and then like this, to try to get out of your car, specifically if you have any type of disability, it's almost impossible. I spoke with the mayor. He was very nice about it. He explained to me that he would have a conversation and we would be able to have that privilege to be able to park in front of our home. I'm going to use one example. I 51 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 believe it was in early 2000. I don't know what Mary's last name is, but she lived at 1261 Franklin Street. She was in her 80s. She parked just like we're talking now, down the street on the nappropriate side, and she was given a ticket. At 86 she took that very seriously. She paid her ticket. She parked in the correct direction, and less than a week later, trying to get out of her car, the door came down and broke her leg. Poor Mary, I believe, did not walk after that. Now, I'm saying this because I don't know that my leg would get broken or what could possibly happen, but the truth is I know with my disability I can't get out of the street or out of the car with the car parked in the right direction on that pitch. 2017 : and I don't know. I wasn't here when you completely did the roads in the early 2000s. My understanding is when you paved Franklin Street not only did you resurface it, but you put that lean on it and also started to put the drains in the center. So if you drive up Franklin Street 52 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the highest part is the middle of the road, where the drain is. Many 2017 - MR. RUSSELL RINALDI: Those aren't drains. MS. - ONDERKO: Where does the water go, then? MR. RUSSELL RINALDI: The water goes off to the side. MS. ONDERKO: And into the houses, and that's the second issue that : MR. RUSSELL RINALDI: You have water going in your houses? MR. ONDERKO: Chris Scalese has been flooded how many times. It goes in his front and comes right out his back basement door. I have pictures of that, I have pictures by the church where there's water that is up to your knees, and basements in the house next door where there's at least 12 inches of water. In fact, the fire department had to come in and turn off the electric box because we couldn't go in. MR. HOOVER: I - believe there are catch basins in the middle of the road. They're more to release the air, Joe told 53 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 us. It's because, I guess, there's all pressure. MS. ONDERKO: I'm fortunate enough that when we bought the property we knew and we put a french drain around the property before we moved in. But the houses on that side of the street above me and below me are always getting flooded out. In fact, the fire department's bringing sandbags for us to pile up to try to redirect that water. I'm not here to repave the roads or anything like that, but I can say that everyone that's lived up in the heights we love where we live and we try to make adjustments where possible. The reason I'm here today is because d didn't get a ticket but the 75 year old man that lives two doors down got it. It seems interesting to me that the tickets and please don't take that personally, Jason. CHIEF DUBERNAS: I - don't. MS. ONDERKO: Two years ago on my security camera I saw the officer take a knee in front of his headlight at 1:00 in 54 1 2 3 the morning to write that 75 year old man, who's been there eight years, a ticket. He's now looking to buy a two by four to be able to open his door and try to crawl out onto his knee onto Franklin Street and then get himself up from his knee to go into his house. I don't think any of you want that. - know I don't. I € did not get a ticket this time, but it continues with okay, what do I do now? How do I get in and out of my car? 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 I guess what I'm trying to say is I'm appealing to the borough right now to help us out with this. I mean, there's no one looking for a problem up there, but there are a lot of elderly people and a lot of people that have a bad back or a bad leg and that's how they get in and out of their car. I've been here just short of 20 years and these are the only two times I've seen this happen. So I can only wonder why now did it happen a second time after, again, I spoke with the mayor. Like I said, I'm just pleading because my health is deteriorating. I drive : I have people that drive me down 55 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 to Baltimore to Johns Hopkins Hospital probably every six to eight weeks. I'm not looking for sympathy here, I'm just asking the borough to work with me. Specifically, the winter is coming and you've got snow, ice, you have a pitch, and it's really something that is concerning to us. It may sound like nothing to all of you but it means a lot to a lot of us that live in the heights. We're talking a quiet street up in the heights where we're just trying to have some semblance of safety. MAYOR LEGG: What is your address? MS. ONDERKO: I live in the church rectory. It's 1267. MAYOR LEGG: And the 75 year old man, what is his address? MS. ONDERKO: He's 1263, on the other side of the church. The woman I was talking about lived two doors down from the church. That's 1261. She's gone and there's a new person in there now. But again, I'm appealing to you to see what we can do. I will be speaking to several others. It is a big commitment, but I think they add so much to the community and I think it would definitely be an asset. It's getting to be budget time, sO I don't know if we can do it this year. If we can, fine. If not, I'm sure we can get grants for a car, maybe even a dog, too. I would like council to consider it. I can't tell you some of the conversations that came up in the in-service, how much better and how much safer the staff feels having our own officers in the building, building relationships with our kids every day.
