We moved our monthly meeting from the third week of this month to next Tuesday, November 12th. The purpose of the meeting will be to set up our agenda for that meeting. We'11 hear from our department heads, we'11 hear from our engineer, solicitor, chief of police. We'1l go down the table, hear from our mayor, council members, solicitor, borough manager. There's a public sign-in sheet. If anyone from the public would like to address us we'17 give you a few minutes at the end. RUSSELL RINALDI: So you won't go back to see him until two weeks from now? MR. SOKOLOWSKI: End of the month. MR. RUSSELL RINALDI: And the property next door got the same letter? MR. SOKOLOWSKI: Yes. MR. RUSSEL RINALDI: Any response or contact from them? MR. SOKOLOWSKI: No. MR. HOOVER: Wait for the correct time to go back. Next step. MR. RUSSELL RINALDI: I agree with Councilman Butler. I don't like that either. Let's follow the code and ordinance and two weeks or 17 days, whatever the time frame is, let's get back to both properties and take action that we should. I know I called Jimmy. I think I left you a message about when they're starting over on Edgewood Drive. Mike, I sent that to you as well and Joe. I sent them the text message I got from American on their updated schedule. MR. HOOVER: Maybe we can notify them tomorrow like the first time. MR. SOKOLOWSKI: I did last time. MS. BARTOLETTI: So I contacted them and let them know, but I didn't contacted any neighbors. MR. HOOVER: But letters to the neighbors to let them know. MR. Is the paving company doing the work in front of Miles Street Park this year? MR. LOPATKA: Yeah. They're starting that towards the end of the week. MR. RUSSELL RINALDI: I know they did the alleyway. MR. LOPATKA: The alleyway they paved today, then they're supposed to be starting First Street towards the end of the week. I sent a map to their surveyor. He was taking some stuff out. That will be done. I think schedule-wise they"11 be over doing base repairs over on Howard Wednesday and Thursday. MR. LOPATKA: Their schedule. I don't know. MR. HOOVER: Put them on notice I think the paving's terrible. I'm still waiting for my street and Nicholas Street to be sealed, still waiting for the basketball hoops to be put back. I told you all about this last week. MR. LOPATKA: I let them know about it. MR. HOOVER: The one in front of Nimitz' house, that catch basin, down about two inches in front of his driveway. Every time he pulls in his driveway he has to go slow because he bottoms out on his driveway. They should have raised that. It's just a lot of things. 108 Bubernak. John's is 106. No tarring's done on any of the streets. MR. LOPATKA: I'11 let them know all that. MR. He has a list of where they did or didn't. I think that's a good idea. MR. LOPATKA: I - think I mentioned that to Joe. Make a list and we'11 walk it. Fix whatever needs to be fixed. MR. MS. BARTOLETTI: I was just going to mention, since you were there, I was there, Joe was there. We went to the one the next day. So I'd like to have a meeting and have Bill involved as well. Maybe you, Dave, myself, Joe and Bill Stull. There are questions I think everyone has to have them put on : MR. KOMENSKY: I asked them to send us a report from last year. Did you get it? MS. BARTOLETTI: Looks like December 4th is the day they're looking to have the bids back in. MR. LOPATKA: Yes. MR. LETTIERI: We're getting there. MR. LOPATKA: Also, Pagnotti Park, that first base to extend the electricity and extend the water. That's out to bid tomorrow. MR. RUSSELL RINALDI: For the easement. MR. LOPATKA: To run a line from Villa over and then to run the electric from the stand up to the building. Then also replacing the backstop as part of that phase. Then in February or March we'11 bid the field work. MR. RUSSELL RINALDI: We don't have any time to get that done now. MR. LOPATKA: No, because we're sodding it. RUSSELL RINALDI: So it will still be ready to play in the springtime on that field? MR. LOPATKA: A17 we're going to do is extend the utilities and change the backstop. They can play on the field the way it is this year, then after the season is over. MR. RUSSELL RINALDI: And the electricity and water will already be there. MR. LOPATKA: It will be there. MR. RUSSELL RINALDI: Anyone else for Dave? Thank you, Dave. Chief Dubernas, good evening. Anything for the work session tonight or the agenda? CHIEF DUBERNAS: Just for the agenda, the parking on Franklin and Bennett Street, I'm shot sure. Is it going to go the whole length of Franklin or just from Spring Street to Austin Street on that side? MR. RUSSELL RINALDI: I'm going to ask you this, and I'11 take a ride up there after the meeting, how far does that gully go to where they're saying when they park 13 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 their doors are getting stuck or they're falling out of their car? CHIEF DUBERNAS: So on Franklin Street it's right around the church starting up the hill, on the right shoulder. MR. RUSSELL RINALDI: Where the road starts to really : CHIEF DUBERNAS: Then on Bennett Street it's really bad from the old Zygmont's market up to the top of the hill where it would turn up to Pittston Avenue, the right shoulder. It's pitched that way. MR. RUSSELL RINALDI: If the rest of council is okay with it I'm okay with you go up there and look how far we should do it. If everyone's okay with that. I would say you're the best one to go pick that out. If you have to go with it even a little more to where the road is flat and safe and easy for them to access and enter their cars and exit, I'17 be good be with whatever decision you make and if the rest of council is okay with it. I know he was cited for a couple parking tickets he never paid. That's at the magistrate. Waiting to find out when. MR. RUSSELL RINALDI: So no cars were ever removed as of today? CHIEF DUBERNAS: No. Parking tickets. He never paid the parking tickets sO citations were issued. MR. RUSSELL RINALDI: Mike, any progress? Did you have him clean up the property? MR. SOKOLOWSKI: No, he's never contacted me. MR. RUSSELL RINALDI: Didn't respond to you as well? MR. SOKOLOWSKI: No. MR. Anything for the meeting tonight or the agenda coming up? MR. STULL: Couple things. I finally got a hold of PennDOT on our signage out there in front of the firehouse. So they need a traffic study done. It has to come from a request of the borough, I guess. MR. RUSSELL RINALDI: Do they want us to do the traffic study or they're going to do it and we just have to request it? MR. STULL: A17 it says is they need a request from the borough to do a traffic study. MR. RUSSELL RINALDI: So we can just have the borough office call them or send an e-mail :- MR. STULL: From him. MR. I can give you the secretary, but good luck getting them. CHIEF DUBERNAS: I have his e-mail. MR. RUSSELL RINALDI: Let me ask Marylynn, do you want to try and get a hold of them or would you go like Jason to try and get a hold of them? CHIEF DUBERNAS: Dave, when we did Oak Street that was a state roadway. MR. LOPATKA: But we actually did the traffic study. MS. BARTOLETTI: From a different company. It wasn't a PennDOT traffic study. MR. LOPATKA: So we had a consultant do that. I would just send him an e-mail requesting a traffic study. MR. STULL: Chief, can we have that done from Mine Street down to Wyalusing? CHIEF DUBERNAS: That's not a problem. South Keyser and Milwaukee. MR. STULL: Once we get that done we can go into Picarello. He's the one for the signage and everything like that. Where it's supposed to be placed and help us with the design on that. So that's where we are 17 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 at on that. The second thing I have is we had an incident up on Sonny Drive Tuesday, October 22nd. We had a brush fire up on top of the hill up there. It was caused from an open burner that got out of control, some guy. But with that we had to use the hydrant on Sonny Drive, and that's the one last year myself and Chief Dubernas went up there. The guy put a fence in front of the fire hydrant. So we told him to move it, and pretty much he said I'11 take care of it and hasn't taken care of it. So we literally took the saw and just cut it in half. Since then he put the fence back up, sO underneath the 2018 international fire code, section 507, fire protection and water supply, section 507.5 and .4, obstruction, unobstructed access to a fire hydrant shall be maintained at all times. The fire department shall not be deterred or hindered from gaining immediate access to fire protection equipment or fire hydrants." So I'm asking you can we cite him with code enforcement? 18 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 ATTY. RINALDI: That would be up to Mike. He would issue the citation under that section. MR. SOKOLOWSKI: Let me know. We'11 do it. MR. RUSSELL RINALDI: Bill, again, it wasn't blocked, then it was blocked. He cut it down and now it's blocked again. MR. STULL: So originally when they put the hydrant up there : because we requested one because there wasn't any. MR. RUSSELL RINALDI: There wasn't any on the hill at all. MR. STULL: So they put it up there, and sometime he put a fence up on the corner of his property, right in front of the hydrant. We asked him to take it down : MR. RUSSELL RINALDI: Is it a full size fence or just around the fire hydrant? MR. STULL: No, it sticks out : the fire hydrant sits behind the fence. It's more of a : CHIEF DUBERNAS: Decorative corner. MR. STULL: You can't get in there to put a hose on the hydrant. STULL: Then he just replaced it back up again. I don't want anybody thinking he can get away with it, why can't Ig get away with it. MR. RUSSELL RINALDI: Not a fire hydrant. Absolutely not. Especially if there's a state ordinance against it and an ordinance that we have against it. MR. STULL: The international fire code, we can cite him under that. MR. RUSSELL RINALDI: So if we send Mike out there are we going to tell him to cite him instantly or give him : how long would it take to remove it? Two minutes? MR. STULL: Couple seconds. MR. RUSSELL RINALDI: Mike, would go up? Go up with him. MR. SOKOLOWSKI: I'1T go with him. MR. RUSSELL RINALDI: Go up, read him the state code and the ordinance, say we're going to give you a chance to go out there right now and remove it. Give him a chance to remove it without fining him, but if he doesn't remove it -- if he says no, I'm leaving it, Bill, do we fine him and it still stays there or do we fine him and remove it again? ATTY. RINALDI: Whatever the section calls for. MR. HOOVER: Is the fire hydrant in the right-of-way or on his property? That's what we have to find out first. If that fire hydrant's on private property they're going to have to move it. The water company's going to have to move it closer to the road. It is a pretty good distance off the curb. If it's on private property that's still no reason to block it. If the fence is on his property it's a catch 22. MR. BUTLER: The problem is everybody thinks they own right to the street. That's not the fact. You have a five foot buffer zone from the street to where your property actually starts. You can't go right to the road. MR. LOPATKA: A17 depends which is 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 the rignt-OT-way. If it's a 50 foot right-of-way it's measured from the center line. MR. HOOVER: I C can't believe the water company would have put it on his property. MR. STULL: Pride Mobility has hydrants in their property but you can't block them. MR. KOMENSKY: Does it look like it's in the sidewalk? MS. SHOTWELL: There is no sidewalk. MR. RUSSELL RINALDI: Go up with Mike and we'17 take it from there. MR. STULL: Last thing I have, last Wednesday, October 30th, members of our fire department testified before the Pa. House Democratic Policy hearing. It was on the volunteer fire departments in the state of Pennsylvania. So they actually did an awesome job. I'd like to thank Russ Rinaldi for being there and council for being there. Idid post it on our Facebook page for the fire department, if anybody got a chance to look at it. I'm not sure how it works. I did send an e-mail out to the fire commissioner's office. There is a couple municipalities in the state of Pennsylvania that does this. I want to see how it's run, how they started it and everything like that sO I can get a little bit more information on it. So we're working on that avenue now. MR. RUSSELL RINALDI: It was a great meeting. It was good to see all the representatives come up to the town, but it was good to see them engage with the fire department, our members, but also, like you said, there was EMS there from other towns, fire departments from other towns. MR. STULL: Actually Jimmy Williams and Bob Aulisio were the first fire chiefs here in the borough. They asked them to come down to Harrisburg to testify. MR. Mike goes up there and catches him let me know. MR. HOOVER: I'm going to get the drones up the during the week. He's doing something up behind that house. She calls me every day. ATTY. RINALDI: I had pictures taken for the hearing. I have pictures of the piles, but the only activity when we went up there two guys were spray painting and sandblasting. MR. HOOVER: She's trying to get some of the neighbors just to come. ATTY. RINALDI: If it's something they see with their eyes and who's doing it that's good for us. MS. SHOTWELL: And hear it. MR. RUSSELL RINALDI: Will they take video footage in court? ATTY. RINALDI: Yeah, if they took it and can identify it. I don't know what's going on in back of the Gilchrist property. RUSSELL RINALDI: So what are they doing there, running a trucking business? MR. SOKOLOWSKI: A garage, yeah. They service their trucks. MR. RUSSELL RINALDI: Are they permitted for it? MR. SOKOLOWSKI: I have no idea. I don't know how long they're there. It's been there a long time. I don't know : MR. RUSSELL RINALDI: Did you get a hold of any of them? MR. Jay, council knows why you're here. i informed council you guys were coming in tonight. Obviously, we don't have a final decision, but we discussed it. We got a quote back. You guys got the quote back for the turf, $165,000. MR. The quote for the lights : we said there was different things we were proposing. Lights at Pagnotti, and then the other option would be turfing the infield at Miles. There's obviously wiggle room as to what the turf looks like, the design. The more designs you throw on that the more expensive it is. The initial quote that we had for the lights was $185,000, but that was two and a half years ago. So I'm assuming just inflationary it's going to be more than that. MR. LETTIERI: Do we have a quote? MR. O'HERN: We do from that point in time, yes. MR. RUSSELL RINALDI: I talked to Joe before the meeting because also council had discussed before the meeting we were waiting until you came up and then we were going to ask Joe if he could go and get some quotes for the lights. So we were going to ask Joe to get us all that sO we have the number, which we figure is going to come back over 185. MR. O'HERN: From our perspective we don't know if we're pushing something that's not going to be able to happen because obviously we have the 95 that we can throw at that. It's a $100,000 grant but there's five in administrative fees. So there's 95 to utilize. The quote we have is 165. When we got that we kind of started to fish around to the school district to see if they would be open to possibly putting in some money towards that since they already put money in toward field maintenance. They put in money toward the field conditioner. Each year they buy a pallet of field conditioner. They seemed open to the possibility. I don't have a solid number, what that would actually be. That would be a discussion that you have to have. But we just wanted tos see because obviously it was more than 31 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 95. So I don't know what kind of funds are available out there that are available for a project like this. But we were looking to see if there was another revenue source. The school district seemed like it was not completely opposed to saying we don't want to do that. From their perspective that frees up all during softball season someone has to come down during the day for maintenance and be working down on the field to get it prepped. It definitely has some perks. So that is a possibility if we decide to go down that path. It's probably a better conversation for you guys to have with the school district. We could always intervene between those two. MR. RUSSELL RINALDI: So what we were thinking was get the quote for the lights, get the quote for the electricity. Isaid to Joe in the hallway but we want to ask him formally in the meeting. He said he'll get it as fast as he could. Then council can make a decision. Obviously, you don't want to lose the $95,000. MR. LETTIERI: Jay, do you remember in the quote for the lights if the power was included in that quote? Or was it just the lights? MR. DESTEFANO: Just the lights. Lights in the parking lot as well. MR. RUSSELL RINALDI: One light? MR. DESTEFANO: One light for the parking lot with one pole. MR. RUSSELL RINALDI: By the entrance? MR. DESTEFANO: Almost centered in the parking lot. MR. O'HERN: Now, with the turf, depending on what kind of Togo you want on it, what color do you want. It varies. Did you guys discuss it amongst yourselves or your board which way people would be leaning more toward which project? MR. O'HERN: We are going to have a meeting next Thursday. The problem is : and I was even discussing it with the board today. They sometimes go at the approach of do we want to vote for lights or turf, and my statement is how are we voting for either because we don't have enough money for either of those things. That would have to come from you guys to say we're interested in this. Then we would say MR. RUSSELL RINALDI: Not to put it this way but it's this way. It sounds right now that the turf is going to be cheaper. MR. O'HERN: Turf is definitely a benefit for the field usage down there. We even mentioned last time that Miles Park is really the crown jewel of the town. Kind of having something like that. Every time we go to play Midvalley, they just did the fields over. They're gorgeous. MR. RUSSELL RINALDI: Turf totally? MR. O'HERN: No. They just turfed their infield. We were coming here trying to gauge your feel. RUSSELL RINALDI: Or do a plan C, which I hope we don't. MR. O'HERN: I don't even know what plan C would be, but when they hand us $95,000, to not utilize the $95,000 : MR. RUSSELL RINALDI: I think council right now is comfortable -- if I'm not correct stop me : having Joe get the quote for the lights, for the power. We already have the quote tentatively for the turf.
