We're going to go through a series of housekeeping motions, we're going to go through our department heads. We're going to have a public sign-in sheet. If anyone from the public would like to address us we'1l give you a few minutes at the end of the meeting. We'1l then go through new business. We're going to move item number one up that's on new business appointing our new member to borough council. We're going to make that first. So at this time, just to give the public who entered the room after, council advertised for a position to fill the vacant council seat. We ran a legal. We ran it until August 16th. Anyone from the public of 01d Forge who has lived here for a year, is a registered voter was capable to put an application and resume in. We received seven of them. LOPATKA: Nothing for - well, I guess one question on, Jimmy, that Pagnotti Park, that easement. MR. HOOVER: I spoke to Louis and I went down and met him, explained it to him. He does not want to give us the right-of-way, the utility right-of-way up on top where we decided to move it. He will give us the utility right-of-way on the ingress and egress at the bottom, where it originally is on the plans. The same location. HOOVER: There was some guy from American up there today with Louis. He's doing some private work for him. MR. LOPATKA: The guy that was there last week was their surveyor. There was going to be a little - - the way we have it graded. I will give them a call, tell them to go back and stake it the way we had it staked out with the idea that we're going to - I guess I need to get some kind of change order from him on that slab. MR. BUTLER: Coming out of East Morton Street, somebody on the left is parked within ten feet of Main Street. I don't know whose car it is. I don't know if they're going in Brigid Carey's place. Then on the right : CHIEF DUBERNAS: Somebody told me about a car from Texas. It's there in the evening hours? MR. BUTLER: It's there most of the day. Like I said, I don't have a problem if she parks on the side street. CHIEF DUBERNAS: Where the two garages are. MR. BUTLER: When she parks on the front sidewalk you can't see cars coming down Main Street. MAYOR LEGG: What exactly is the agreement council is voting on tonight as far as Felitto, Italy? What is the issue? We are going to be a sister city? Is that it? MS. AVVISATO: Yes. MAYOR LEGG: What does it entitle us to? What does it entitle them to? I've been on the phone with Jeff Casella. They're supposed to have something at the Felittese and I'm meeting with him on Saturday. It's a royal mess. It's a mess. Now, I know they have a parade scheduled for Saturday or Sunday. It's supposed to take place Saturday at 6 p.m. I 1 think they're the ones who made the choice of it taking place on that day. I think Sunday after the parade, that would be a - better time. MAYOR LEGG: When I spoke with Jeff last night the mayor is not coming. The mayor happens to be his cousin. Supposedly a group of 12 people but no mayor. I'm supposed to issue a proclamation. I don't know who I issue the proclamation to. MR. RUSSELL RINALDI: Bill, is he able to issue it to their members who are coming in? ATTY. So I said we'17 get it on the agenda. I asked Jeff Casella. He didn't know much about it. I did the agreement up the way it is. BARTOLETTI: I received this from Jeff Casella today. It just says "thank you, council, Mayor and borough manager for passing this legislation sO easily tonight. This is a great honor for us, as it is for those in Felitto. We feel this unique partnership will only grow larger in the years to come. One thing I'm going to read, and it's part of what we're going to be passing later on with the CDBG program. But I did receive this from the county, Joe Rovinski, who was here at the last meeting. If you can go ahead and prepare the draft bid" -- which we are working on : "for the project it would be appreciated. I will check them over, and once ERR is done we can go into the bidding process as quickly as possible, as promised." Just sO you know, since it has been taking sO long. That's all I have for tonight except for when we get to the part that we're going to pass the resolution for the CDBG. MR. RUSSELL RINALDI: Anyone have any questions for Marylynn? Thank you, Marylynn. Before we go into new business we're going to go into public comment. First comment is George Kollonige. MR. KOLLONIGE: I'm back for the same problem as a month ago. I can show you pictures of the weeds next door. They are another month bigger, larger, encroaching more into my yard. If you'd like to see pictures I can show you again but this is getting ridiculous. If I let my yard go like this I know somebody would be on my 24 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 butt. Plus, now I've got animals bringing in garbage. Red Solo cups all over the yard. The hard ice tea cans, beer cans coming through the fence, into my yard. I asked my stepson to take a picture of them and I went out to do some work in the back yard. I took the pictures and he cleaned it up. He did me a favor. So I can even show you pictures of that. But it's getting really ridiculous. I'm in the back cleaning out my garden area, I got gopher holes back there now. I guess that's the animal that's bringing all this garbage into my yard. I mean, it's really getting frustrating. MR. RUSSELL RINALDI: I remember you at the last meeting. I remember what your concern was. Mike, did we have any contact with the property owner? MR. SOKOLOWSKI: I sent letters, tried to contact the number on the door. No response back. MR. KOLLONIGE: Why should we not have the borough clean it up and bill : put a lien against it? MR. SOKOLOWSKI: I have the name. I was there last -- maybe last fall. We had a police call there. It's the end of Sussex, the corner house. MR. KOLLONIGE: The stink house. MR. SOKOLOWSKI: We were there on : something happened to the lady. CHIEF DUBERNAS: I remember being there with the ambulance. They used to be on the left side but it got condemned, then they went to the right side or vice-versa. MR. SOKOLOWSKI: We had trouble with the lady next door. She was supposed to get the roof fixed, supposed to do this, this and this and all the sudden nothing happened again. I went back, they moved out. There's nobody there. MR. RINALDI: We just dug up what's going on with Winter Street. The sheriff's sale was continued from June. Let me do research with Mike to see if it's a foreclosure, the person's deceased. Before I ask my question I would like to publicly thank Joe and the chief for showing up the past few rain storms, because it makes a difference when you block the street off on how much water comes into my basement. I appreciate that. At the last meeting in June you had mentioned you were going to research the last studies, the engineering studies that you did. Did you have a chance to do that? MR. RUSSELL RINALDI: David? MS. BARTOLETTI: So here's what I found out. I went through minutes and kept going further and further back, and a feasibility study was brought up during one of the engineering reports that was done by Pasonic Engineering. The feasibility study was from 2005, and at that time Drake's Lane was listed and they were trying to come up 28 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 with a plan. They had an idea of a possibility of a plan, and the design alone was over $900,000, approximately, but they weren't sure at that time if that plan would even work. From there, that's the only that If found going back to 2005. MS. O'NEIL: That was the first time that -- in that time frame that I purchased the house, in 2002. So in that time frame. My neighbors told me there was another one done maybe ten years later. MS. BARTOLETTI: I couldn't find anything else. At that time approximately $900,000. Again, they weren't sure that that plan would work because of : Dave can help me with that. Because of elevations and : MR. LOPATKA: Yeah. It's in a low spot, sO detinitely storm water you have to get out of the there with gravity. You don't want to pump storm water. That was probably one of the reason. We are again looking at it ourselves. The dip is really low. We're putting a plan together. I hope to have something for you guys by next 29 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 meeting. At least a rough sketch of what could possibly be done. But it's a little bit of a challenge because of the way the topography is there. There's a low spot, then you have houses on both side. MS. O'NEIL: We're getting runoff coming four ways. Down around the corner, around the corner. Four ways. MR. LOPATKA: To get it out of there is a challenge. There's no storm drains. There's drains, but it all ties into the combined system anyway. There's no separated storm system there. It's a combination system that goes into both. MS. O'NEIL: In this little six inch pipe? MR. LOPATKA: Well, I'm not sure what the size of the line is. It runs : the main line runs down there. Coming out of those two inlets there are six inch pipes going into whatever. MS. O'NEIL: And there's no way you can catch the water before Drake's Lane? MR. LOPATKA: It's still tying into a combined system. It's probably getting 30 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 overtaxed. The best idea is to typically separate storm water from sanitary. There's not supposed to be combined anyway. That's what they did years ago. At this point EPA is trying to get smaller municipalities like this to start :- MS. O'NEIL: Isn't there a time frame we had to come up with a storm water plan? So many years to present your plan to separate the storm water from the sewer? MR. HOOVER: Myself and Joe went to a meeting last week up at city hall in Scranton. They're trying to get : nine towns that are trying to get involved in a storm water and sewer project where we can all throw some money in and everybody can do some work here and there. So we're at the beginning stages with that. MR. LOPATKA: That's an overall group. Even Scranton's having this problem because Scranton and Dunmore has : both of those municipalities are a combined system. So they're trying to separate but from a cost perspective to separate is a pretty significant amount of money. 31 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 MS. O'NEIL: So what is your plan? You said you're coming up with a plan. MR. LOPATKA: Well, I don't have a plan yet. We're looking at grades, see if there's any way we can get it out of there. That's the hard part. To chase it out of where the low spot is to get it to the next spot to turn and go downhill. Some of that starts to get really deep. We brought in the topo that shows us some of those grades. Now we're trying to see how we can get it out of there. MR. HOOVER: We also have someone here tonight that's going to help us get some grants. We're not forgetting you. This is one of my pet peeves. That's one of the worst areas in town. MS. O'NEIL: In the meantime, when I first bought the house : we can't even park in our driveway now because the tractor-trailers that come through, the tidal waves. It was up to the rocker panels on our car. If you get storms at 3:00 in the morning you're trying to get in your car. We used to be able to come around and 32 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 down the back alley and pull in the back yard. Well, now -- IC call it an alley. It's just two adjoining properties. The homeowners mow past our property lines. So now there's this one section that's really overgrown behind the Methodist church. There's all ruts in it, all these bamboo things. It's encroaching on my property. I complained in the past, sO they have been out and they cleaned it up. But if you're not constantly on them they're not doing anything. So now we can't even come in back and park in back of the house. You can't get through there, it's sO overgrown. So my question is is it an alley? Is that the borough's responsiDIl1ty? MR. RUSSELL RINALDI: My question to you is where these weeds and bamboo is overgrown, you said we went down in the past and cut it? MS. O'NEIL: No, you went to the property owner. MR. RUSSELL RINALDI: The property owner is the church? MS. O'NEIL: Yes. They came out and 33 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 did it twice. MR. I understand there's a cost issue. MS. O'NEIL: But who is responsible? Is it the property owners for letting their weeds grow over? MR. RUSSELL RINALDI: Yes. If it's starting and growing on their property, the property owner's responsiDility: Bill, since them as property owners can go and clean it out can we send our crew down there? That would help us during flood situations. Right now we're parking a block away. MR. It flows like a lake down the driveway. MR. RUSSELL RINALDI: Over the curb, over the grass and into your house. It's not coming out of the pipe inside your house? MS. O'NEIL: No. It's definitely off the road. The minute my neighbor's driveway starts running like a river I know I'm in trouble. It seeps through the 36 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 foundation and then it comes and fills my sun potion. Then the sun porch is full and it comes under my basement door. MR. RUSSELL RINALDI: Brian Rinaldi? MR. BRIAN RINALDI: Brian Rinaldi, 510 Josephine Street. I'm here to speak for my friend Angelo Fumanti, who also lives on Drake's Lane. He deals with a problem that's slightly different from the other residents on Drake's Lane. He's at 163 Drake's Lane. He does get water in the foundation from runoff, but he also, more importantly, gets sewage backing up into his basement after heavy rains. Dave, as you know I've been involved in these projects before and I know the scope and what's involved in trying to get these done. Usually easements are involved and it takes time to straighten them out. But I'm wondering if maybe there's another option for folks like Angelo and the other houses. He lives on the other side of the street from her, sO his problem is a little different. also understand from a couple 37 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 other residents down there that this problem has been compounded by the development of Shawnee Hills behind them, which then leads to storm water management there and how it's not being contained properly. Maybe there's a problem there you can look at. MR. LOPATKA: I wasn't involved with that. They do have a basin but it tends to go in the other direction. We're looking at that, too. I drove up through there to figure out where the break lines are. Their pipes do get collected and go to that basin. Ih have to figure out where the outfall of that goes, but it's kind of on the other side. MR. BRIAN RINALDI: Now, the Corey Slope area, up on Drake's Lane it's affecting these people's lives. Ih have a question for you, Dave, because at Angelo's house he gets sewage backing up. Can we put a check valve on that sewer line? MR. LOPATKA: Well, yeah, likely you could. What's probably happening is the pipe that it's going into is probably 38 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 getting overtaxed because of the amount of storm water. So naturally it's going to find the path of least resistance, and that's back probably in the basement. That pipe is probably completely full and it's surcharging, and that's why the water isn't getting into it along Drake's Lane. But, yes, can you put a backflow or something on it? MR. BRIAN RINALDI: In Angelo's house you'd have to dig up his basement. MR. LOPATKA: You can't do it out in the street. The sewer authority and PennDOT's not going to let you do that in the street. It's a PennDOT right-of-way. You want it closer to the house. MR. BRIAN RINALDI: He'd take it anywhere. MR. LOPATKA: We've have to talk about that. It's definitely something you would want to look into doing. MR. BRIAN RINALDI: A big expense to the homeowner for a borough problem. It's a combined sewer system that the borough is responsible for. You can't obviously put 39 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that burden on a homeowner to resolve a problem the borough should be taking care of you. I understand the expense of it. One more question. Maybe Marylynn can help answer this one. We've been collecting sewage fees in the borough of 01d Forge for how many years? At least billing. There's 8,500 properties in the borough. Let's say 300 of them are unimproved real estate that don't have a sewer system. Assuming we have sewer systems, some have multiple, we're looking at $130,000, $140,000 a year in sewer fees? When was the last time we did a sewer project in the borough of 01d Forge? MR. HOOVER: Two years ago on Hickory Street. It cost $300,000. MR. BRIAN RINALDI: So that's two years' worth of sewer fees you did three years ago. You should have another $300,00 or $400,000 in sewer fees somewhere. And let's go back before that. You're collecting this $40 since I sat here. The money has to be someplace. I just want you to consider that. Consider the lives on 40 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 Drake's Lane. So I suppose I will be back, hopefully, next month to hear a report, maybe get some additional information. I appreciate your time. I know how this feels. Back on August 12, 2019 the fire department dispatched to 435 Sussex Street by request of the Humane Society for a strong odor of ammonia from the cats. So we went there, we did our whole deal. At that time Steve Bieryla, between the two of us we condemned that side of the building. So that's how far back we're going with that. MR. RUSSELL RINALDI: On that address? MR. STULL: On that address. CHIEF DUBERNAS: I want to say it was either '22 or '23 I was on the opposite 41 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 side for an EMS call. I'11 try to find out exactly when it was. They were living on the other side. MR. STULL: The left side was definitely condemned, and then the right side probably should have been condemned, too. But at the time we didn't have the authority to condemn that side. MR. RUSSELL RINALDI: Are you saying we have the authority now to? MR. STULL: Yes, you can do it now. I don't know how bad it is. On the left side, we had cockroaches and everything on that side. There was dead animals in there and there was somebody living there at the time. So we had them removed from there, and that's when Steve condemned that side. But the right side wasn't. They were supposed to move over to that side. That's been an ongoing issue since 2019. MR. RUSSELL RINALDI: Bill, the process of condemning a property? ATTY. RINALDI: There was somebody living there. Right? MR. We're happy to be here this evening. I'm representing Community Consult. I made a presentation back in June to council on this. So we provide services to the borough, any municipality within our region. As I said, we serve two roles. Our very first role we serve is we break the municipality down into five separate departments. The very first thing is I heard during the interviews this evening a lot of similar stuff we do on a daily basis. A very positive interaction for my daughter and I to hear is police, fire, ambulance, economic development and DPW. So those are the things that we do on a - daily basis trying to save money, funds from a federal or state, local, public and private or charitable organizations. So there's five separate streams of money that 46 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 we seek out, and what we do is we have aims and targets that the municipality needs. So what we're going to do is if we are grateful enough to have approval by this council tonight what we're going to do is end up putting a needs assessment out for quite a few needs this evening. Then what we do is we will send out, once a month, all the available grants to the municipality. We'17 break it down into five separate departments. I will be asking Marylynn what do we not apply for. Otherwise, all the rest of them are applied for. But then we will take out the needs assessment, which is the top three needs which will be determined by council, the members of the administration. Then we will begin to go after the infrastructure. Some of the things I've been looking up in doing research on, one of the flood projects, is the planning and preparation. That's a big deal with the engineers working with Dave. Planning and preparation is very expensive with architectural, engineering and any topographical issues and then 47 planning that needs to happen. I've already begun to have that stuff prepared in the event that this borough has steered us in 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 that direction. Then in addition to that, concurrently we will go after the funds. I looked yesterday just to be prepared. Anything beyond the $3 million scope of work would be free money. Anything beneath that would be a low interest loan for the municipality. But I'm assuming based on a $900,000 price tag in 2005 we're going to exceed the $3 million project. So besides that, the second half of our business what we do is we have five municipalities within each county. We actively spread the cost of your tax dollars to a lobby firm in both Harrisburg and Washington, DC to make sure that any application that this council and this administration sends to either the state or the federal level is saw through with some muscling power, that you get what you deserve. So for us, we not only fund the grant writers that are doing this, we seek a 48 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 governmental liaison with every project that you are seeking. So you're going to see two sets of operations going on, that grant writing and the following through on both state and federal levels from a lobbying standpoint. That's our firm. That's what we do. You will receive a bi-weekly report with several statistics on it. What's in process, what has been received, and your return of investment. So for us, if approved this evening, $2,000 a month, $24,000 a year. We've never had anything up to this point, or two and one-quarter years of service, anybody less than four figures of return. Twenty-two hundred percent, things of that nature per year. So I would be happy to come back and serve this community with a report myself or send it to Marylynn or members of this council. Whatever you choose. I will be back here monthly, if that's the case. So that you just maybe transfer the information as to what may be needed. I noticed for our meetings from time to time we have a lot of people, and I love when we get busy meetings. I want as many people to come as possible as well.
