Archuleta County Development Services Department ARCHULETA COUNTY PLANINING COMMISSION MINUTES Archuleta County Planning Commission Minutes, Regular Meeting September 26, 2024 The Archuleta County Planning Commission held a meeting on Thursday, September 26, 2024, at the Archuleta County Commissioners Meeting Room, 398 Lewis Street, Pagosa Springs, Colorado. Chairman Matt Nobles called the meeting to Matt Nobles (Chair), David Pribble (Vice-Chair), Peter Beaudry, and Richard Vihel, were present, and Mont McAllister was order at 6:03 pm. Commissioners in attendance: present via Zoom, establishing a quorum. Staff in Attendance: Pamela Flowers, Development Director; Owen O'Dell, Planning Manager; Justin Griffin, Planner Public in Attendance: Lindy Waldrop Amanda Dillion Terry Edney John Ranson Jennifer Burke Elizabeth Nicholson Katherine and Christopher Solbert Warren Sackman (Zoom) Agenda Review: and it was carried unanimously (5-0). Public Comment: NA Consent Agenda: New Business: US Hwy 160 Commissioner Vihel moved1 to approve the Meeting Agenda, as presented. Commissioner Pribble seconded the motion, Commissioner Beaudry moved to approve the Consent Agenda, as presented. Commissioner Vihel seconded the motion, A. Public Meeting to Review PLN24-126 Keyah Grande, Outdoor Shooting Range, Board Conditional Use Permit, 13211 The Planning Manager reviewed the staff report fort the Outdoor Shooting Range and presented' it with seven (7) conditions. The Applicant was present in person and chose not to give a statement. The property owner was present via The hearing continued with the Planning Commission asking various questions to the Staff and the Applicant. Commissioner Beaudry asked where the shootingi is directed andi ift there were any concerns with ricochets, to witch the staff was not concerned. Commissioner McAllister asked a few clarifying questions that were answered byt the staff. Commissioner Nobles asked about the: second condition stating different weapons omit different levels of noise. Het then asked the applicant what caliper of weaponry they' d allow, to which, the owner (Sackman) responded stating they haven't considered those limitations. Commissioner Vihel asked about the range distances, Staff and the Applicant both Warren. Sackman then gave a large statement explaining thel history of the proposal, sincei it was already in operation. He explained how thel local Sherrif's Office got involved and how he offered his space for their training efforts. andi it was carried unanimously (4-0). zoom andi made a statement for his proposal. gave the same answer ofa a range at 110 yards and a range at! 50 yards. Commissioner Pribble then asked if there were any plans of lead remediation, to which the owner replied theyl have not The Commissioners then heard from numerous members of the public. Thei first to speak was explicitly against the proposal. She claimed this was business as usual because the range was alreadyi in operation. Shet then saidi it should be placed further intoi the Keyah Grande property and that this locationi is thel least intrusive fort them (Keyah Grande) yet the mosti intrusive for everyone else. She saidi it produces al lot ofr noise that she hears constantly. She then saidt that the Planning Staff is making some special permit to allow the use oft the Outdoor Shooting Range. The Planning Manager addressed her concerns by first stating this is receiving an after thei fact permit because the previous County Manger did not allow the Planning Department to properly permit this range, the new County manger has supported Staff's efforts. He then explained that this is not as special permit, rather the appropriate permit as referenced in Table 3 oft the Archuleta County Land Use Regulations. Hei then addressedi the noise concern and pointed to condition number 2. Finally, the Planning Manger explained that Staff cannot require applicant to place their uses int the center of their property eveni if they own thousands of acres. Thel bottom line being they have the right tot this use andt to use their land as they wish. Other members of thep public made their statements reflecting what was said above witha additional concerns being hours of operation, caliper of weapons, and a request for supervision. Commissioner Beaudry then made a motion for recommended conditions whichi included: Onsite supervisor of the range, lead capturing technology, no rocks or other materials that could ricochet bullets, proposed hours, and noise buffering. His motion died for al lack ofas second. The Commissioners then heard more outburst from the public, owner, and the Staff. Theyl had a minor discussion regarding the concerns at hand. Commissioner Pribble then moved to tablet the proposal with requests tol be addressed, which included: Lead Remediation Plan, Hours of Operation, and an Engineered Noise! Study to ensure compliance with eh Archuleta County Noise Ordinance. Commissioner Beaudry seconded the motion andi it carried considered that at this time. unanimously (5-0). B. Public Meeting to Review PLN24-144, Snowball Five Minor Subdivision, X County Road 200 The Planning Manager reviewed the staff report for the Minor Subdivision and presented it with three (3) conditions. The Questions were asked from the Commissioners regarding the Rezone for the! 5 acre parcel, to which the Planning Manger explained thati is their plan, butt the Rezone shall not be discussed untili iti is heardi in as separate public meeting. Ift the Rezone were toi fail, the 5-acre parcel would be rezoned appropriately. Commissioner Beaudry explained his dissatisfaction of the subdivision in such a rural area, to which the Staffe explained it's allowed in the Regulations and does not create inconsistencies int the area. Staff then explained what would create inconsistencies and what they would not Commissioner Vihel moved to recommend approval of the Snowball Five Minor Subdivision, Final Plat, as presented with three (3) conditions. The motion was seconded by Commissioner Pribble, and it passed unanimously (5-0). Applicant was not present. recommend. C. Public Meeting to Review PLN24-106, Our Community Eats, Warehouse and Food Distribution, CUP,197 Navajo Trail The Planning Manager reviewed the staff report for the Conditional Use Permit and presented it withi four (4) conditions. The applicant then spoke about the proposal and the concerns withi the conditions pertaining to engineering. Stafft then Dr. explained they'd be facilitating a Variancet fort the applicant. Page 2of3 Commissioner Pribble moved to recommend approve oft the Our Community Eats, Warehouse and Food Distribution, CUP, 197 Navajo Trail Dr. as presented with four (4) conditions.
