Archuleta County Development Services Department ARCHULETA COUNTY PLANNING COMMISSION MINUTES Archuleta County Planning Commission Minutes, Regular Meeting August 22, 2024 The Archuleta County Planning Commission held a meeting on Thursday, August 22, 2024, at the Archuleta County Commissioners Meeting Room, 398 Lewis Street, Pagosa Springs, Colorado. Chairman Matt Nobles called the meeting to order at 6:02 pm. Commissioners in attendance: Staffi in Attendance: Matt Nobles (Chair), Peter Beaudry, and Richard Vihel, were present, estabishingaquorum. Pamela Flowers, Development Director; Owen O'Dell, Planning Manager; Melissa Ryan, Planner Public in Attendance: Michael Osborn Joetta Osborn Allen Ray Agenda Review: andi it was carried unanimously (3-0). Public Comment: NA Consent Agenda: New Business: Commissioner Beaudry moved to approve the Meeting Agenda, as presented. The Planning Manager reviewed the staff report fort the Final Plat review and presented it with two (2) conditions. The Applicant was not present. Commission Beaudry requested we adjust condition #1 for clarity, that the structures be Commissioner Beaudry moved to recommend approval of the Pagosa int the Pines, MLLA, Amendment 2024-01, as amended withi two (2) conditions. The motion was seconded by Commissioner Vihel, and it passed unanimously (3-0). Thel Planning Manager reviewed the staffr report for the Minor Subdivision and presented it with thirteen (13) conditions. Ar note was made about the number of conditions presented, the applicant's surveyor had passed away between the Commissioner Vihel moved to recommend approval of the Gonzales Minor Subdivision, Final Plat, as presented with thirteen (13) conditions. Public Meeting to Review PLN24-112, Gonzales Minor Subdivision, 335 Rob Snow Road Sketch Plan and Final Plat. The Applicant was notp present. C. Public Meeting to Review PLN24-122, Searle, Pagosa Meadows Unit 3 Amendment 2024-01, Final Plat, 841 Hersch The Planning Manager reviewed thes staff report for thel Minor Subdivision and presentedi it with two (2) conditions. Commissioner Beaudry brought upi the driveway encroachment on the parcel with the existing home, with concerns. The Development Director explained that it has been in existence, andi iti is beyond our purview. She noted if there were Commissioner Vihel moved to recommend approval of the Searle, Pagosa Meadows Unit 3 Amendment 2024-01, Final Plat, as presented with two (2) conditions. The motion was seconded by Commissioner Beaudry, andi it passed D. Public Hearing tol Review PLN24-120, Inter-Mountain Propane, Outdoor Storage, Board Conditional Use Permit, 1061 Thel Planning Manager reviewed the staff report for the Board Conditional Use Permit and presented it with seventeen There was a major discussion had between the staff, commissioners, and the applicant. The first question that arose was from Commissioner Nobles, asking why this use was considered Outdoor Storage, rather than Heavy Industrial. The Planning Manager explained that previous propane companies have been classified as such. Thes stafft then read the definitions of each, concluding they could be classified as either one, but they kept Outdoor Storage. This discussion continued. The Commission expressed concern with the proximity to the airport, thes staff explained their conversation with the FAA, and that there were no concerns. Some additional questions were asked oft the staffr regarding the numerous conditions, all of which were answered. The Commission ensure all public notice was met. The Commission then started a discussion about the Industrial Park, and this proposal's exclusion. The staffe explained the difference in permitting based on: zoning. The Commission then discussed the possibilities of rezoning thep parcel to be industrial. Commissioner Beaudry express concern with our outdated MUTCD, Director Flowers said we can suggest Commissioner Beaudry moved to recommend. approval of the Inter-Mountain Propane, Outdoor Storage, Board Conditional Use Permit as presented with seventeen (17) conditions. The motion was seconded by Commissioner Vihel, E.Public Hearing to Review PLN24-105, Pereyra, Mastercraft Redi Mix, Concrete Batch Plant, Board Conditional Use The Planning Manager reviewed the staff report for the Board Conditional Use Permit and presented it with nineteen (19) conditions. He explained the lengths thes staff tookt to ensure state and environmental compliance and noted that the conditions reflected their research. He explained thel lack of communication with CDOT, and why that condition (#16) was The commission discussed the conditions presented and asked for clarity on af few. Commissioner Beaudry recommended amending condition 2t to allow the applicant the abilityt toi tapi into PAWS. He also asked for clarity on condition 15, the Planning Manger noted it's address in condition 12. Finally, Commission Beaudry recommended al language change on condition 18 for clarity. The Staff explained the remaining conditions in length, and explained there are numerous Commissioner Beaudry moved to recommend approval of the Mastercraft Redi Mix, Concrete Batch Plant, Board Conditional Use Permit as amended with nineteen (19) conditions. Page2of3 Member Comments: Commission Vihel asked about thep procedure of recommending approval, specifically about Findings A and B, and what those are. Thel Development Director explained they reference the Archuleta County Land Use Regulations, andt that their recommendation is based on meeting those sections. The Development Director then explained Commissioner McAllister's questions that were emailed tot the Planning Manager prior to the meeting. She explained thei importance of those questions being answered int the Public Meeting rather than over ane email. Everyone weighed in and the discussion closed.
