A Regular meeting of the Commissioners Court of Garza County, Texas was held on Monday, November 25, 2024 beginning at 9:00 a.m. at the Commissioners Courtroom, 300 W. Main St., Post, Texas with the following members present: Lee Norman, Judge; Pct. 1-Jeff Williams; Pct. 2-Kim Wilks; Pct. 4-Giles W. Dalby and Pct. 3-Ted Brannon was not present. County officials present: Terri Laurence, District & County Clerk; Ted Weems, County Attorney; Nancy Wallace, Tax Assessor-Collector and Also present Carol Williams, Administrative Assistant; Annhya Velez, Assistant County Attorney; Kylene Wheeler, Elections Administrator; Xane Reiter, Family Health Community Agent; Adam Walker, Perdue & Brandon; David Graves, Constable Pct. 1; Lane Jones, Mark Wheeler and Anna Gibson, LuAnne Terry, Treasurer. Post Dispatch. Judge Norman called the Regular Meeting to order at 9:00 a.m. Order 1: Prayer Order 2: Pledge to Flags Order 3: Public Comment None presented. Order 4: Minutes from the November 15, 2024 regular meeting were approved as presented with a motion by Commissioner Williams and seconded by Commissioner Dalby. With a majority of the court members voting aye, the motion carried and SO ordered. Order 5: Came on for consideration was accounts payable from November 15, 2024 through November 25, 2024. Motion was made by Commissioner Dalby and seconded by Commissioner Wilks that all accounts presented in the fund requirement print-out is ordered paid and presented to the Treasurer for payment. With a majority of the court members voting aye, the motion carried and SO ordered. See attachment. See attachment. Post-Garza County EMS: Tax Return for EMS Service. Tax Assessor/COlector: Monthly Report for October 2024. District & County Clerk: Appointed Attorneys & Fees Report for October 2024. Monthly Distribution Report for October 2024. Monthly OCA Reports for County & District for October 2024. PaK H toved a, f Order 7: Take action to approve Contingent Fee Contract with Perdue, Brandon, Fielder, Collins & Mott, LLP for the collection of Delinquent ad valorem property taxes owed to Garza County and notice of said contract is posted with the agenda in accordance with Section 2254 of the Government Gode. A motion was made by Commissioner Williams and seconded by. Commissioner Dalby to approve the contract. With a majority of the court members voting aye, the motion carried and SO ordered. Order 8: Take action to adopt the written findings as the Collections Contract with Perdue, Brandon, Fielder, Collins & Mott, LLP pursuant to Section 2254.1036 of the Government Code. A motion was made by Commissioner Wilks and seconded by Commissioner Williams to adopt the written findings. With a majority of the court members voting aye, the motion carried and SO ordered. See attachment. Order 9: Consider to approve Interlocal Agreement with West Texas Food Service. A motion was made by Commissioner Dalby and seconded by Commissioner Wilks to approve Region 17 Education Service Center 2025-2026 West Texas Food Service Cooperative Interlocal Agreement. With a majority of the court members voting aye, the motion carried and SO ordered. See attachment. Order 10: Consider to approve Resolution of Support for County Motor Fuel Tax Exemption. A motion was made by Commissioner Wilks and seconded by Commissioner Dalby to approve resolution that exempts counties from certain motor fuel taxes. Order 11: Consider to approve Resolution for Post-Garza Municipal Airport Construction and Repair. A motion was made by Commissioner Williams and seconded by Commissioner Wilks to approve resolution. Total project costs are estimated to be $5,192,417.00 and Garza County will be responsible for 5% of total. project costs currently estimated to be $259,620.85. Order 12: Consider to approve the 2025 Implementation of the County Assistance Program offered by TXDOT. Transportation Code 201.706 requires TXDOT to assist counties with materials to Repair and maintain county roads damaged by the impact of 2060 Weight Tolerance Permits. A motion was made by Commissioner Dalby and seconded by Commissioner Wilks to approve the County Assistance Program offered by TXDOT. With a majority of court members voting aye, the motion carried and SO ordered. See attachment. Order 13: Commissioners name two appointees to the Garza County Historical Commission. A motion was made by Commissioner Dalby and seconded by Commissioner Wilks to appoint Margie Maestas and Delores Redman to the Garza County Historical Commission for the 2025-2026 term.
