NEWVILLE BOROUGH COUNCIL REGULAR MONTHLY MEETING September 28, 2021 at 7:00 PM The regular monthly meeting of the Newville Borough Council was held on Tuesday, September 28, 2021 at 7:00 PM in the Newville Borough Office, 4 West Street Newville, Pennsylvania and via Zoom. The meeting was called to order by Council Vice-President Ed Sinkovitz. The invocation was offered by Solicitor Marcus McKnight, followed by the pledge of allegiance. On roll call, the following members of council were present: Jack Ericksen via Zoom, Michael Croutch, Robert Darius, Joey Diehl and Ed Sinkovitz. Scott Penner was absent. Also present, Borough Solicitor Marcus McKnight, Mayor Randy Finkey and Borough Manager Fred Potzer. Consent Agenda: A motion was made by Mr. Croutch, seconded by Mrs. Diehl to amend the Administration report to request the appointment of Ms. Martina White to the Zoning Board. All were in favor. His monthly police report was Mayor: Mayor Randy Finkey gave the fine and revenue collection for the Newville Borough Police Department for the month of August 2021: Traffic fines $2,690.48; Non-traffic fines $150.00; Clerk of Court fines $520.16; Accident reports $15.00; Meter revenue for the Borough lot $28.65. The total for fines and revenues for the month totaled $3,404.29. The bank account balances were listed as the following: Police Department checking account at Belco $9,087.37; Police Department K-9 account at BELCO $3,537.20; Police Department debit card at F&M Trust $1,212.48 and the. Auxiliary Police account $110.00. attached to the agenda packet. Borough Solicitor: Mr. McKnight presented Ordinance 2021-04 "An Ordinance of the Borough of Newville, Cumberland County, Pennsylvania prohibiting the drinking of liquor or malt or brewed beverages upon any public street, public or municipal park, or in any vehicles being operated or parked thereon, and fixing penalties for the violation thereof. A motion was made by Mr. Croutch, seconded by Mr. Darius to approve Ordinance 2021-04 as presented. All were in favor. The motion was passed with four (4) affirmative and Mr. McKnight presented Ordinance 2021-3, "An Ordinance of the Borough of Newville, Cumberland County, Pennsylvania establishing penalties and restitution of damages caused by commercial vehicles for safety of the residents of the Borough ofl Newville, as recommended by at traffic and engineering study ofl Martin & Marin Incorporated, completed June 2021. zero (0): negative votes. The motion was passed with four (4) affirmative and Ar motion was made by Mr. Croutch, seconded by Mrs. Diehl to approve the adoption of Ordinance 2021-06, "An Ordinance of the Borough of Newville, Cumberland County, Pennsylvania adopting a zoning ordinance for the Borough of Newville, Cumberland County, Pennsylvania and an official zoning map. All were in favor. The motion was passed with four Mr. McKnight presented Resolution 2021-09, "A Resolution of the Newville Borough Council, Cumberland County, Pennsylvania adopting a program revision for the appropriation A motion was made by Mr. Croutch, seconded by Mrs. Diehl to approve the allocation of ARPA funds of $10,000 towards the summer recreation program and $5,000 towards the ballfield scoreboard. All were in favor. The motion was passed with four (4) affirmative votes Mr. Crouch made a motion, seconded by Mrs. Diehl to approve a proposed contract between the Newville Borough Police Department and Hold the Line Defense Solutions for training, pending proof of a certificate of insurance. All were in favor. The motion was passed Mr. McKnight discussed the Greenway Walking Trail Easement, the shared parking agreement and the radio tower easement for the new municipal building at 103 South Hight Street. He advised that an appraisal of the lot be made to place a value on the gift. A motion was made by Mrs. Diehl, seconded by Mr. Croutch to authorize the President of Council and the Borough Secretary to sign all appropriate documents, and to proceed with the appraisal. All were in favor. The motion was passed with four (4) affirmative and zero (0) negative votes. Mr. Potzer reported that according to the Notice of Violation served upon Gretchen McCarren, the deadline is approaching for the removal of the tree and stump in front ofl her home at3 32W. Big Spring Avenue. No action was taken byt the property owner to resolve the violation. A motion was made by Mrs. Diehl, seconded by Mr. Croutch to authorize Kuhn's' Tree Service to remove the tree and stump and tol bill Ms. McCarren for the work. All were in favor. Borough Manager: The Borough Manager reported that he plans to submit an application for a $500,000 PennDOT multimodal grant for streetscape improvements at the intersection of Main Street and High Street to include a new traffic signal, period lighting, ADA crosswalk ramps, sidewalks and curb repair along with pedestrian crossing signals for Main Street and Corporation Street, S. High Street and Big Spring Avenue, North High Street and Cove Avenue. The application is due in November. Mr. Barrick and the Borough Manager plan to meet with the staff of Senator Judy Ward on October 5, 2021 to discuss the W. Main Street bridge replacement and measures to slow the flow of stormwater from Mill Race into the Cloverdale Run. The 2022 budgets have been prepared and will be discussed at a Special Meeting on October 12, 2021 at 7PM. CDBG funding for the North Corporation Street project is due to be received by the Redevelopment Authority at any time. Once the funds have been received New Enterprise may proceed with the project. The contractor hired to construct the salt bin appears to have encountered problems with manpower and concrete deliveries. Solicitor Page 2of5 McKnight suggested the contractor should be requested to state in writing that the job cannot be completed, and the borough will release the contractor from the bid award. It was reported that other vendors have warned of delays in providing products and services to a shortage of materials and delivery drivers. WCCOG: Mr. Croutch reported that Chris Rafferty and Mary Kuna of the Cumberland County Redevelopment Authority were on hand to discuss funding opportunities, specifically HUD block grants. The county will be accepting applications for 2022 projects in November. Lower Frankford is the latest municipality to join the joint trash and recycling collection program. The: new COG website is under construction. Public Safety: Mr. Darius stressed the importance of maintaining a well-staffed police department. He commented there has been a rise in violent crime and drug related crime throughout South Central Pennsylvania. He provided examples of traffic calming devices used by other municipalities to control speed and asked the Police Department to look into the traffic calming measures. Recreation: Mr. Sinkovitz reported that during 2022 the borough will use. ARPA funds to staff a summer program four days per week, and to purchase a new scoreboard for the softball field. Other improvements planned include renovation oft the press box/maintenance building and new steel roofs for the pavilions. The Recreation Commission would like to establish its own checking account, and possibly incorporate as a non-profit organization in order to do more fundraising. Quality of Life Committee: Mrs. Diehl reported that the Wheels for Warriors Car Show was a great success. The committee hopes to make a substantial donation to the PA Wounded Warriors Foundation as a result. The Newville Area Events Committee hopes to return the show once again in 2022. Other organizations such as the Hamilton-Myers VFW Post 6070, the PA Gold Star Mothers, Wreaths Across America and the District 18 Ladies Auxiliary of] PA and Boy Scout Troop 174 also benefited from the event. Finance Committee: A motion was made by Mr. Croutch, seconded by Mr. Darius to pay Myers Auto Body $1,900 to repair the cab of the 2004 Ford Dump Truck and to repaint the cab safety yellow. All were in favor. The motion was passed with four (4) affirmative and zero (0) negative votes. Council electronically. Economic Development Authority: Mr. Ericksen submitted his report to the Borough Administration Committee: A motion was made by Mr. Croutch, seconded by Mrs. Diehl to approve the full-time permanent status for Borough Secretary/Ireasurer Jody Hoffman and to set her salary at $46,000, effective immediately. Citizen Comments: There were no citizen comments. Correspondence: A letter dated September 21, 2021 was received from Heidi Badda to advise that due to additional employment commitments, she must resign as the citizen representative to the Big Spring Senior Center Board of Directors. A motion was made by Mrs. Diehl, seconded by Mr. Croutch to accept Mrs. Badda's resignation with regret, and to advertise for letters ofi interest from borough residents interested in filling the vacancy. An email dated September 23, 2021 from Allison Wilson of the Green Spring First Church of God was received to advise that the committee will not hold the annual fall festival on A notice was received from PennDOT dated September 22, 2021 to advise that the 2022 Motor Fuels Grant for Newville Borough will total $33,765.68. The Turnback Funds for Big A letter dated August 18, 2021 from Thomas J.. Anderson and Associates reports that the 2022 pension MMO's (Minimum Municipal Obligation) will be $50,722 for the police pension The motion passed with four (4) affirmative and zero (0) negative votes.
